it's
a
pleasure
to
speak
with
you
tonight.
I
will
be
presenting
on
the
proposed
ordinance
amending
the
city's
trespass
adjustment
and
exclusion
procedures
from
city
property.
H
So
in
1985
it
appears
that
the
city
council
first
adopted
the
trespass
and
park
ejectment
municipal
code
sections,
and
it
appears
that
they
haven't
been
revised
since
that
time,
based
on
the
legislative
history
obtained
from
the
municipal
code.
H
However,
recent
case
law
across
the
nation
has
called
into
question
the
enforceability
of
similar
municipal
ordinances
and
policies,
particularly
presenting
due
process
challenges
by
claimants,
who
have
been
subjected
to
exclusions
from
parks
and
libraries,
particularly
so
for
a
variety
of
different
issues.
Safety
concerns
legal
violations,
rule
violations
based
on
that
case
law.
We,
the
city
attorney's
office,
identified
a
need
for
revision
of
inglewood's
trespass
and
park.
Ejectment
municipal
code
sections,
7-6-2
and
11-4-3.
H
In
order
to
ensure
that
what
was
drafted
is
both
a
legally
sound,
enforceable
method
based
on
taking
into
consideration
the
concerns
identified
by
courts
in
those
decisions
that
have
been
issued,
as
well
as
balancing
in
order
to
balance
the
the
court's
concerns
for
the
need
for
due
process
protection
of
people
subjected
to
exclusions.
At
the
same
time,
balancing
the
the
need
for
protection
of
the
inglewood
citizens
and
the
city
staff.
H
So
the
proposed
amendment
of
section
7-6-f-2
that
would
expressly
indicate
that
violation
of
section
11-4-3
can
form
the
basis
for
a
trespass
prosecution
under
section
7-6-f-2,
which
is
the
current
trespass
ordinance
and
indicates
that
criminal
conduct
of
unlawfully
trespassing
onto
another
person's
property
onto
another's
property.
H
So
the
the
big,
the
big
changes
that
are
being
proposed
are
to
section
11-4-3.
H
Which
applies
to
violations
of
rules
and
regulations
and
currently
does
authorize
removal
of
a
person
from
city
property
under
certain
circumstances,
and
the
proposed
amendments
to
that
section
would
provide
that.
A
person
who
commits
a
rule
violation
may
be
subject
to
a
variety
of
different
potential
responses,
which
would
include
potentially
a
verbal
warning
and
an
opportunity
to
seize
or
correct
the
rule
violation
that
is
being
engaged
in
possibly
ejectment
from
the
city
property,
where
the
rule
violation
is
occurring
for
24
hours.
H
So,
for
example,
littering
it's.
It's
envisioned
that
there
would
be
two
different
tiers.
One
tier
would
be
for
lesser
rule
violations
and
the
second
tier
for
more
significant
rule
violations,
so,
for
example,
littering
would
fall
under
tier
one,
and
based
on
that,
you
may
again
all
the
responses
are
potentially
available,
such
as
a
verbal
warning
calling
law
enforcement,
ejectment
and
exclusion,
but
the
but
the
key
difference
would
be
that
the
exclusion
that
may
occur
for
littering
would
be
less
than
it
would
be,
for
example,
threatening
an
assault
on
on
a
city
sac
member.
H
So
the
proposed
amended
municipal
code,
section
11-4-3,
would
provide
for
a
very
robust
appeals
procedure.
That's
protective
of
due
process
rights
for
those
who
are
subjected
to
it,
including
providing
for
an
exclusion
from
city
property
to
go
into
effect.
Four
days
after
issuance,
unless
timely
and
properly
appealed,
providing
for
an
exclusion
from
city
property
to
be
stayed
if
timely
and
properly
appealed
until
resolution
of
that
appeal
and
also
providing
an
alternative
avenue
of
permitting
a
person
issued
an
exclusion
to
file
a
written
request
to
modify
the
exclusion.
H
If
no
appeal
is
pending
and
facts
or
circumstances
change.
So
that's
a
that's
a
more
that's
another
option
available
to
people
who
may
be
subjected
to
a
notice
of
exclusion,
and
these
these
provisions
again
were
based
directly
upon
in
reaction
to
concerns
raised
by
due
process
challenges
to
other
ordinances
in
the
nation,
such
as
providing
for
an
exclusion
that
doesn't
immediately
go
into
effect,
but
rather
there's
a
window
of
opportunity
to
appeal
before
that
exclusion
goes
into
effect
and
also
the
the
stay
if
it
is
appealed.
H
So,
just
a
couple
of
other
things
that
I
wanted
to
point
out
is
the
part
of
the
proposed
amendment.
To
section
11-4-3
is
that
it
would
be
expressly
applicable
to
to
city
property,
including
parks,
and
that
was
something
that
is
a
little
bit
different
from
the
current
version,
where
it
is
only
expressly
applicable
to
parks.

You
got
the
same
30
days,
exclusion
or
the
same
60
days,
exclusion
here,
there's
a
variety
of
potential
responses
and
so
and
that
those
responses
also
will
have
guidance
through
that
code
of
conduct
which
will
be
posted
throughout
the
city,
and
there
will
be
also
addendums
that
will
be
provided,
which
will
be
specific
to
certain
facilities.
Such
as
the
library,
so
the
library
might
have
certain
unique
aspects
that
wouldn't
necessarily
be
applicable
throughout
the
city,
and
so
in
recognition
of
that
we
will
also
post
an
addendum
where
relevant
in
certain
facilities.

And
oh
one
other
thing
I
wanted
to
point
out
is
that
the
notice
of
it
in
the
proposal
for
section
11-4-3
there's
also
it
addresses
the
information
that
needs
to
be
included
in
the
notice
of
exclusion,
and
so
that
is
again
to
to
be
protective
of
due
process
rights,
providing
a
variety
of
information
to
the
person
who
is
being
subjected
to
the
notice
of
exclusion
so
that
they
are
fully
aware
of
the
of
the
rule
violation.

That
is
at
issue
and
the
the
appeals
process
that
is
available
and
the
consequences
of
of
failing
to
comply
with
the
exclusion
once
it
goes
into
effect.

couple

questions.
One
is
in
the
appeals
process
that
you
laid
out
for
us
to
protect
you
process
and
the
first
bullet
there
is
that
it
wouldn't
go
into
effect
until
four
days
after
issuance.
Is
that
going
to
be
standard
for
every
ejection
or
exclusion,
because
or
would
it
go
into
effect
immediately
in
any
cases,
can
you
help
clarify
that.

So,
yes,
I
can't
clarify
that
so
that
would
that
four
days
before
it
goes
into
effect,
that
provision
is
specific
to
notices
of
exclusion.
So
if
a
person
is
subjected
to
it
receives
a
notice
of
exclusion,
then
that
exclusion
wouldn't
go
into
effect
for
four
days
and
that's
to
allow
them
time
to
file
an
appeal.
An
ejectment
is
different,
so
an
ejectment
would
go
immediately
into
effect
and
that
would
be
subjected.
They
would
be
subjected
to
the
ejectment
from
that
city
property,
where
the
rural
violation
occurred
and
that's
important.

It
is
not
all
city
properties,
it
is
specific
to
where
the
rural
violation
is
occurring
for
24
hours,
so
that
would
go
immediately
into
effect,
but
even
in
those
situations
it
is
intended
that
a
verbal
warning
would
be
issued
to
give
an
opportunity
to
seize
or
correct
the
rule
violation.
That's
occurring
with
a
few
certain
exceptions
such
as,
if
it's,
if
a
dangerous
behavior
is
occurring.
For
example,
a
verbal
warning
may
not
be
required
in
that
situation,
and
it
would
still
be
if
an
ejection
was
issued.

think
you

the

the
code

conduct

facility

this
goes
into
effect,

that
all
citizens
have
clarity
on
what's
being
expected
in
city
facilities,

parks.

areas

everyone

be
aware.
Everyone
who

entering
city
property
has
an
opportunity
to
review
and
be
aware
of
what
their

expected

of
standards
of
behavior
on
city
property
and
then,
like,
I
said,
for
there
there's
envision,
that
there
may
be
addendums
and
certain
facilities
where
there's
unique
aspects
such
as
the
library
great.

line

police
officer
could
be
changed
to
law
enforcement
officers

officers

pick

enforcement,
although
we
have
one
park
ranger,

the
park
ranger
isn't
available
is
not
on.
Duty
is
sick,
whatever
code
is
probably
the
ones
that
are
going
to
be
taking
care
of
that,
and
I
think
the
police
officer.

that

concern

we

law

jurisdiction
here.

absolutely
I
think
that
it
would
be
permissible
to
change
it
from
englewood
police
officer
to
englewood
law
enforcement
to
in
order
to
address
that
concern.

teeth
that
this
piece
of
legislation
bears.
This
looks
like
a
civil
process
to
me
when
someone
is
becomes
a
party
to
this
process
and
they
do
not
comply.

so,
if
someone
violates
a
an
exclusion
that
has
gone
into
effect,
then
they
would
be
subject
to.
They
may
be
subject
to
a
trespass
prosecution
as
well
as
subject
to
the
general
penalty
under
inglewood
municipal
code,
1,
section
1-4-1,
which
provides
for
a
fine
and
or
imprisonment.

So
we
have
a
state
criminal,
trespass
code
as
well
that
we
can
enact
to
sort
of
am.
I
am
I
correct
in
that.
If
someone
violates
this,
they
could
be
subject
to
prosecution
under
municipal
code
or
potentially
under
state
criminal
code
as
well.

Prosecution,
okay-
and
that
is
part
partly
what
is
being
amended
in
section
7-6-2,.

Which
makes
it
clear
that
that
this
provides
an
express
basis
for
prosecution
under
that
trespass
code.

then
in
a
similar
vein
under
the
possibility
that
someone
might
threaten
a
city
staffer,
for
instance,
there's
a
another
civil
process
where
potentially
a
restraining
order
could
be
filed
and
the
person
would
be
ordered
not
to
come
near
that
person
or
the
place
where
they
work.

So
I'm
not
specifically
aware
of
any
such
instance
where
a
restraining
order
was
involved.
This
is
envisioned
more
as
a
more
as
an
instance
where
people
are
engaging
in
misconduct
and
and
violating
different
rules
of
the
city
that
this.
These
are
different
options
that
can
be
used
to
respond
to
that
behavior
in
order
to
ensure
the
public
safety
and
the
safety
of
staff
members.
But
in
an
instance
where
there's
where
there's
dangerous,
behavior
occurring
or
violence
being
threatened
against
a
city
staff
member,
we
have
it's
my
recommendation
that
law
enforcement
be
utilized.

If
there's,
if
there's
a
danger
to
someone,
that's
criminal
conduct
that
may
be
occurring
and
it
is
important
to
involve
law
enforcement,
and
that
is
also
one
of
the
one
of
the
responses
that
is
available
always
is
to
utilize
law
enforcement
to
call
them
an
and
a
citation
or
fine
may
be
issued
or
an
arrest
may
occur.
For
example,
if
someone
is
threatening
someone,
if
it
rises
to
the
level
of
criminal
conduct.

Okay,
that
that
helps
me
so
this
process,
I
would
describe
as
something
similar
to
having
your
name
written
on
the
board
when
you
were
in
you
know
elementary
school
or
what
have
you?
You
know,
you're
on
the
naughty
list,
sit
in
timeout
for
a
while
and
come
back
when
you're
when
you're
finished,
with
your
punishment.

Well,
there
I
think,
there's
more
teeth
to
it
than
that
in
the
sense
of
you
can.
The
potential
exclusion
can
be
relatively
lengthy
if
you
engage
in
one
of
the
more
serious
rule
violations
and
like
I
said,
if
you
violate
that
exclusion
that
can
result
in
a
trespass
prosecution
which
is
not
insignificant.
So
we
do
believe
that
this
has
been
carefully
balanced
to
protect
due
process
rights,
but
at
the
same
time,
have
some
teeth
so
that
there
is
protection
of
city
staff.

If
member
woodward's
concern
is
that
we
are
not
capturing
code
enforcement
or
giving
code
enforcement
the
authority
to
act
in
these
cases,
my
suggestion
would
be
that
we
alter
and
add
code
enforcement
rather
than
changing
inglewood
police
officer
or
park
ranger
to
law
enforcement
officer.
That
is
an
amendment
that
I
could
support.

the
most
part,
the
ordinance
gives
the
city
manager
also
discretion
to
designate
who
can
issue
these
things
and
who
can
enforce
them.
So
I
think
that
would
respond
to
council
member
woodward's
concerns,
because
the
city
manager
could
designate
a
code
enforcement
officer
to
do
these
things
as
well.

facilities
in
the
south
engwood
basin.

stormwater
program
manager,
with
the
public
works
department
to
provide
a
short
presentation.

agreement

the

district
and

is

project

identified
because

are
waiting
on
the
city-wide
master
or
major
drainage

plan.

additional

surveying

once
we

information
on
potential
priorities
and
projects
in
the
south
englewood
basin

project

on

outcome

effort

additional
stormwater
funding
from
some
other
sources.

supported
consumption
in
the
city
paseos.
They
are
a
public
area,
but
they
are
a
defined
area
with
structures
on
two
of
their
four
sides,

allow
us
to
post
signage
regarding
the
public
consumption
and
the
only
licensee
that
is
currently
licensed
to
sell
takeout
cocktail
cocktails
is
located
near
those
paseos.

did
receive
58
additional
survey,
responses
that
were
people
both
within
the
district
and
outside
of
it.

responses
were
received
from
businesses
within
3,
200
and
3
400
blocks
of
south
broadway.
These
are
areas
where
public
consumption

previously

of
the
ten
responses
were
from
businesses
that
were
previously
reported
to
council

ask
the
inkwood
downtown
development
authority
to
analyze
the
survey
results
and
to
weigh
in
on
the
city
council
action,
and
they
were
supportive
of
it.
They
noted
that
the
survey
respondents
generally
like
the
idea
of
outdoor
public
consumption
because
it
does
support
local
restaurants
and
bars
and
it
enlivens
our
downtown
south
broadway
district.

even
though
council
and
the
public
were
in
favor
of
this,
unless
and
until
state
law
changes,
adding
that
section
to
our
public
consumption
ordinance
does
not
make
public
consumption
legal
in
those
areas
on
public
property
and
just
for
council's
reference
here

map

the
3200
block
of
south
broadway,
and
you
can
see
going
through
the
middle,
maybe
about
two-thirds.
There
is
an
alleyway,
but
otherwise
it's
all
private
property,
so
this
ordinance
doesn't
affect
the
consumption
of
alcohol
on
private
property.

all,
only
public
property
that
is
not
right-of-way.

committee

committee
in
the
coming
cycle.

toured

south
platte
renew
plant.

at

walked

acres
for

work

amazing

worked

two
cities
who

the

manager
and

attorney
sitting

council

two
that
haven't.

only
comment
would
be
I,
as
you
notice,

this
meeting,

I'm
running
back

forth.

to
you
know
talk
to
staff,
I
sometimes
need
to
take.
You
know
someone
in
the
hallway,
even
citizens
that
I'm
talking

so
it
could
be
a
little
distracting

me

particular
to
be
at

diocese,

constantly
communicating
with
staff
and
getting
information
for
council.
So
that
would
be
my
only
way
in
moving
on
to
the
library,
and
I
really
appreciate
the
the
comments
and
the
questions
with
regard
to
hours.

send
that

friday
report,

do
want
to
let
council
know
that

was
a
bit
after

library
board

not

With
regard
to
the
decision
itself,

really
feel

we

probably
call

a
temporary

received
emails
from
library
staff
about

questions
concerns
about
their
security.

had
serious
concerns
with
our
current
security
contract,
which
is
now
expired,
we're
essentially
on
a
month
to
month
and
trying
to
get
a
handle
on
what
our
next
steps
are.
The
city
attorney
has
been
very
involved
with
that
we've
been
very
involved
with
city
staff
and
what
would
be
burp
best
with
the
court
with
the
library
with,
if
in
general,
trying
to
figure
out
what's
best
for
that.

So
I
appreciate
staff's
diligent
work
on
that,
but
one
of
the
problems
is:
we
have
not
been
able
to
have
those
security
personnel
at
the
library
for
the
required
number
of
hours
that
we
have.
We
are
open
55
hours
a
week
in
the
library,
and
so
we
really
had
a
problem
with
staffing,
both
the
security
position
as
well,
as
you
know,
with
all
departments
in
the
city
just
being
short
staffed
in
general.
So
I
think
it
was.

are
actually
a
number
of
issues
that
council
has
raised
that
we're
working
on
some
responses
for
what's
the
training
that
library
staff
is
receiving,
you
know
with
regard
to
security,
how
is
the
police
department,
interacting
with
library
staff
you've,
asked
questions
about
co-responders
being
housed
at
the
library,
so
we're
putting
together
information
for
you
on
that?
That
will
hopefully
be
helpful
and
provide
a
little
bit
better
picture
on
that.

think
they
call
that
the
training
room
and
then
just
starting
with
our
facilitator
nick
kittle,
who
I
think,
you'll
really
enjoy
with
some
team
building
exercises
some
strengthsfinder
work
that
we
want
to
have
everyone
do,
but,

we'll
be
doing
an
overview
of
the
strategic
plan
outcome
and
goals,
just
making
sure
that
we
all
are
in
agreement
on
the
definitions
of
both
what
the
outcome
areas
are,
but
also
the
definition

the
goals,

we
think
that
that's
really
critical
so
that
the
leadership
team
will
be
taking
the
lead
on
that
we'll
have
a
lunch,
break
and
or
working
lunch
as
requested
by
the
mayor
and
then
really
finish
off
with
some
priority
setting
looking
at
the
data
that
we're
collecting
right
now
from
the
public
about
the
strategic
plan,
you
know
you
all
have
given
us
a
number
of
additions
and
clarifications
that
you
asked
for,
and
so
those
have
all
been
included
in
the
draft.

currently
out

review
and
we're
getting
some
good
feedback
from
inglewood
engaged
on
that
so
assistant
city
manager,
dodd,
will
be
going
over
that
with
you
and
then
our
facilitator
will
really
be
leading
you
through

priority
setting.

know
what
the
community
priorities
are
from.
Englewood
engage
but
really
it'll
be
up
to
you
to
really
set
those
priorities
on
on
how
we
rank
all
the
different
things
that
are
in
the
strategic
plan
by
outcome
area.
