staff
recommend
approval
of
a
text
amendment
to
the
zoning
ordinance
to
create
a
definition
for
cannabis.
Dispensary
business
establishment

applicable
general
provisions
for
cannabis
dispensaries,
including
a
1500
foot
separation
requirement
between
dispensaries
and
a
750
foot
separation
requirement
from
schools
and
amend
the
special
use
in
the
business,
commercial,
downtown,
research,
part
and
special
purpose
and
overlay
zoning
districts.

mentioned

issue

opposition
of
any
change
in
the
city,
ordinance
that
protects
our
neighborhood
from
irreparable
harm
by
allowing
additional
uses
of
Ryan
field
and
welsh
ryan
arena.
My
opposition
reflects
my
own
opinions
based
on
living
in
and
loving
Evanston
for
over
45
years.

be
weighing
on
your
mind
what
you
think,
I'm
exaggerating
when
I
tell
you
that
this
ordinance
will
cause
irreparable
harm
if
it's
changed
to
our
neighborhood.
But
the
fact
is,
you
don't
have
to
believe
me,
because
this
issue
has
been
carefully
and
repeatedly
studied
by
virtually
every
Zoning
Board
Planning,
Commission,
City,
Council
and
mayor,
including
mayor
Morton,
for
over
50
years
and
I've
been
involved
in
many
of
those
myself
each
and
every
time
this
issue
is
comp
has
been
reviewed.
The
conclusion
has
been
the
same.

countless
privately
funded

volunteer,
organizers

coaches
for
youth
sports

countless
Evanston

turning
your
back
on
our
neighborhood
in
its
time
of
need
will
undoubtedly
have
unintended
consequences
that
will
adversely
affect
the
entire
city.
The
ordinance
in
question
has
stood
like
the
American
flag
in
Baltimore
Harbor
during
the
War
of
1812.
So
I
asked
you.
What
will
be
your
legacy?
Will
at
dawn's
early
light?

Well,
the
ordinance
still
be
there
or
will
you
succumb
to
your
own
fears,
prejudices
and
wishful
thinking
and
turn
the
city
of
Evanston
into
a
corporate
town
run
by
a
multi-billion
dollar,
mercenary
institution?
If
you
choose
that
alternative
I
predict
that
northwestern
will
come
after
your
neighborhood
next
and
when
they
do,
there
will
be
one
left
to
fight
for
you.

as
my
husband
said
before
me,
we've
lived
in
Evanston
in
the
same
house
two
blocks
from
Ryan
field.

For
over
40
years
we
raised
our
three
sons
here
and
two
of
them
live
in
Evanston
with
their
families.
I've
been
PGA
president
of
Warrington
haven
and
et
HS
at
various
times,
and
volunteered
with
Haven
help
us
helped
found
and
run
Bravo
Arts
at
et
HS
and
currently
volunteer
with
the
Women's
Club
of
Evanston.
I
worked
at
et
HS
as
a
librarian
for
a
dozen
years,
sponsored
with
my
family,
a
scholarship
for
deserving
athletes,
a
TT
HS
and
my
husband
now
volunteers,
over
a
dozen
hours
a
week,
tutoring
at
et
HS.

In
short,
we've
given
a
lot
to
this
community,
a
lot
more
in
time
and
energy
and,
in
my
mind,
more
valuable
than
any
financial
contribution
made
by
northwestern,
and
while
we
knew
when
we
purchased
our
home
that
we
live
near
the
stadium,
we
were
willing
to
put
up
with
the
occasional
football
game
and
basketball
game
to
enjoy
our
beautiful
neighborhood.
We
have
fought
this
kind
of
change
in
the
ordinance
that
would
adversely
affect
our
neighborhood
for
the
past
40
years.

this
change
would
have
happened,
then
this
would
not
have
been
a
place
where
I
would
have
wanted
to
raise
my
children.
This
year
there
were
several
rock
concerts
down
the
street
from
our
home
run
by
space.
Again,
we
put
up
with
the
noise
garbage
traffic
illegally
parked
cars,
disrespect
and
vulgarity
from
patients
from
patrons
I
took
a
picture
of
a
pile
of
garbage
left
near
my
home
that
remained
days
after
the
last
concert
and
sent
it
to
my
altar
person,
miss
Ravel
who
passed
it
on
to
the
space
people.

talk
about
the
proposed
zoning
amendment,
the
two
amendment
which
will
be
on
your
agenda
at
the
next
meeting
on
October,
the
28th
like
most
cities,
Evanston
zoning
code
specifies
standards
for
evaluating
proposed
zoning
changes.
These
standards
provide
a
common
framework,
an
objectives,
objective
basis
to
support
and
justify
decisions.
Cities
have
learned
that
decisions
which
are
consistent
with
their
standards
are
less
likely
to
become
embroiled
in
public
controversy
and
court
challenges.

On
behalf
of
many
nearby
residents,
I
would
like
to
comment
on
whether
the
proposed
you
to
amendment
meets
Evanston
zone
approval
standards.
First
is
the
amendment
consistent
with
the
goals,
objectives
and
policies
of
the
comprehensive
general
plan?
No,
the
amendment
doesn't
preserve
the
quality
and
integrity
of
residential
areas
or
guard
against
spillover
nuisances
into
these
areas.
It
doesn't
provide
parking
that
considers
the
impact
on
the
neighborhood
nor
minimize
the
impact
of
spillover
parking.
It
harms
the
pedestrian
oriented
Central
Street
businesses
that
contribute
to
neighborhood
strength.

Many
of
them
have
stated
that
their
shops
are
virtually
deserted
on
days
with
large.
You
two
events.
The
proposed
amendment
is
actually
inconsistent
with
the
goals
and
purpose
of
the
central
street
corridor
overlay
district,
which
was
created
to
encourage
and
sustain
unique,
diverse
neighborhood
businesses.
To
is
the
amendment
compatible
with
the
overall
character
of
existing
development
in
the
immediate
vicinity?
No,
the
u-2
district
is
a
virtual
island
in
the
middle
of
an
overwhelmingly
residential
neighborhood.

Pro
sports
and
entertainment
events
have
no
place
in
the
heart
of
a
neighborhood
with
over
500
adjacent
families
and
many
children

Will
the
amendment
have
an
adverse
impact
on
the
value
of
adjacent
property?
Yes,
multiple
studies
show
negative
impacts
on
property
values
near
professional
sports
arenas,
professional
sports
and
commercial
entertainment
would
be
a
radical
departure
from
existing
uses
of
the
You
Tube
district
and
property
values
will
likely
be
negatively
affected
for
are
there
adequate
public
facilities
and
services?
No
access
roads
and
parking
facilities
are
woefully
in
adequate
for
large
you
to
events.

Existing
events
already
create
gridlock
on
the
primary
thoroughfare
used
by
the
hospital
and
two
fire
stations.
There
is
enough
off
street
parking
for
roughly
3,500
spectators,
not
7,000.
The
proposed
amendment
will
increase
the
number
and
intensity
of
these
events
by
45%
five
loaning
amendments
are
supposed
to
be
based
on
a
legitimate
need.
Is
there
a
need
for
this
proposed
amendment?
No,
there
is
no
need
to
revitalize
the
area.
There
have
been
no
changes
in
conditions,
circumstances.

The
reason
we're
all
speaking
is
because
it's
been
hard
to
find
time
to
meet
with
you,
and
we
have
about
eight
inches

information
for
you

we

like
to
summarize
I
would
go
back
with
law
and
standards
and
impact
studies
and
everything
that
you
did
not
see
in
the
new
zoning
application,
which
consisted
of
five
pages
with
basically,
nothing
filled
out
on
it.

following
up
with
that,

to
the
you
know,
why
does
one
have
a
text
amendment
and
in
our
zoning
it
says
we
only
do
the
purpose
of
an
amendment.

is
for
a
general
significance
that
this
amendment
process
is
not
intended
to
relieve
a
particular
hardship.
We
know
northwestern
needs
money
in
spite
of
the
fact
they
made
ninety-three
million
last
year
and
they
have
a
thirteen
billion
dollar
endowment.
So
but
it's
not
our
job
to
make
their
particular
hardship
to
confer
special
privileges
or
right
well.

would
strike
me
that,
if
you're
going
to
consider
this,
please
deeply
consider
is:
are
you
giving
preferential
zoning
treatment
because
what
they
are
asking
for?
Is
a
patron
performance,
entertainment
area
and
the
only
districts
that
that
is
allowed
in
is
d2,
d3,
d4
and
RP.
It
is
not
even
a
special
use
in
it
and
they're
asking
for
that
to
become
a
permitted
use
so
based
on
that
and
no
other
district
in
the
whole
city
has
that
and
for
you
to
go
to
a
commercial
use,
it
is
not
a
light
change.

a
huge
change
again
because
of
the
dramatic
implement
implications.
The
last
thing
I'm
going
to
say
is:
please
please,
please
look
at
the
purpose
and
intent
of
the
zoning
and
your
responsibility.
I'm
sure
you
know
it
and
I
hate
to
you,
know
lecture
but
promote
that
public
health,
safety,
comfort,
morals,
convenience
and
objections,
and
to
conserve
and
enhance
the
taxable
value
of
land
and
buildings
throughout
the
house
we
took
throughout
the
city
and
minimize
and
lessening
the
congestion
in
public
streets.
This
does
nothing
to
do
that
and
my
final
comment
is
right.

Now
we're
building
on
trust
people
come
to
this
city.
They
build
they
invest,
they
improve.
Their
house
is
based
on
trusting
of
the
zoning
ordinance.
They
are
not
going
to
come
and
spend
a
hundred
thousand
or
two
hundred
thousand
in
a
neighborhood
that
they're
doing
now
in
all
the
surrounding
neighborhoods,
because
they
have
confident
that
this
zoning
has
been
upheld
for
50
years.
But
if
you
break
this,
you
are
breaking
it,
not
even
just
in
our
area
but
says
to
every
district
in
town.
Our
zoning
means
nothing.

comprehensive
plan,
which
says
a
value
neighborhoods
means
nothing.
This
vote
is
huge
and
that's
why
you're
hearing
people
come
out
now
because
we
need
you
guys
to
look
at
the
information.
I
must
be
sending
you
a
lot
of
real
estate
information
on
taxable
values
that
have
happened.
How
this
neighborhood
surrounding
the
neighborhood
has
gone
from
13%
lower,
then
average
properties
to
probably
about
5%
higher
because
of
people
investing
in
the
properties
and
if
you
think
you
miss.

But
it
was
40
minutes
of
presentation
by
our
residents
versus
zero
minutes,
a
presentation
by
northwestern
review,
the
800
signatures
by
residents,
or
at
least
talk
to
one
of
those
residents
who
signed
petition
that
believe
that
this
change
is
going
to
be
adversely
affect
the
quality
of
their
life,
that
this
change
on
the
50
business
owners
that
sign
those
petitions
in
the
area
believe
that
this
will
hurt
their
business
and
at
least
all
of
those
people
believe
that
this
will
hurt
the
value
of
their
hard-earned
property.

order

do
that,
they
have
to
be
in
compliance
with
local
codes
and
laws,
and
since
we
this
we're
creating
a
special
used
process
in
order
for
them
to
be
in
compliance,
they
would
need
to
have

if
you
sort
out
the
intro
tonight,
action
on
October
28th,
that's
the
first
point
at
which
that
they
would
be
able
to
apply
for
their
special
use.
We
have
a
noticing
requirement

publication,
so
that
puts

meeting

basically

December,
which
isn't

line

the
schedule
of
the
CBA,
has
so

Looking

special
meeting

9th
City
Council
meeting,
which
would
be
when
the
applicant
would
put
forth
their
special
use
for
consideration
and
we
would
anticipate
in
order
to
meet
the
January
1st
deadline,
that
that
would
be
an
introduction
in
action.

is
not

which

has
never
been
on
the
tax
rolls
and
the
sixty
units,
senior
housing
building,
will
be
on
the
tax
rolls,

hallelujah
it'll
be
in
a
TIF
district
and
it'll
all
be
on
the
tax
rolls.

that's
a
pretty
special
project
and
hopefully
we'll
all
support
it
and
construction
will
begin
in
the
very
very
late
winter,
probably
around
end
of
January
and
February,
and
all
the
documents
miss
Leonard
have
come
in
to
the
to
the
plan.

yeah.
So
that's
the
explanation
of
why
we
want
to
change
the
zoning,
because

will
allow
for
housing
on
the
second
story.
