The
subject
property
is
currently
occupied
by
illegal
non-conforming
use
of
a
multi-family
structure.
The
structure
was
built
as
a
multi-family
building
in
1969.
because
of
its
age.
The
property
was
never
granted
conditional
use
approval
as
the
structure
creates
the
current
land
development
code
as
a
leak
and
non-performing
structure,
the
building
can
remain
and
can
be
renovated
to
an
extent.
But
if
the
structure
were
to
be
destroyed,
it
would
need
conditional
use
approval
to
be
reconstructed.

has
a
request
requested
to
have
initial
use
granted,
so
the
structure
would
then
be
conforming
and
should
the
unforeseen
happen,
the
applicant
would
then
be
able
to
rebuild.
The
applicant
has
also
submitted
for
variance
for
this
location

address
the
existing
non-conformities
and
setbacks
and
parking
current
property
owner.

over

allowable

in
the
comprehensive
plan
and
the

are

some

related
issues
they
may

deal
with
on
the
western
side,
but
the
developers
agreement
concept
for
the
trails
was
discussed
at
tonight's
council
briefing.

information

type
