Description
City of Palm Springs Planning Commission meeting, held April 27th, 2022
A
A
May
I
have
a
report
on
the
posting
of
the
agenda.
Please.
C
A
Thank
you.
Can
I
have
a
motion
to
accept
the
agenda.
A
A
Okay-
oh
actually,
we
haven't
gotten
to
that
yet
so
we
she
just
accepted
the
agenda,
so
we
have
one
recusal
for
commissioner
hirschbein
on
the
consent,
calendar
item,
your
motion
and
your
motions
included
that
correct.
D
A
A
A
C
B
Thank
you,
chair
wermick
and
fellow
planet.
Commissioners.
My
name
is
erica
gucci
and
I
am
the
owner
applicant
for
agenda
item
four
point:
a
just
wanted
to
say:
I'm
very
appreciative
to
be
here
tonight.
I
wanted
to
thank
staff
for
their
very
hard
work.
Getting
us
helping
us
process
our
application.
B
I
will
be
available
to
address
any
questions
you
may
have
related
to
the
agenda
item.
In
addition,
our
architects,
shah
bakiwi
and
amelia
mon
anon,
as
well
as
civil
engineers,
brad
eichenhauer
and
nicole
van,
are
available
tonight
as
well,
and
again
just
thank
you
for
your
time
and
for
your
service
to
the
city.
Thank
you.
A
A
Thank
you.
Is
there
a
second
commissioner
miller?
Second,
second,
second,
did
this:
can
you
call
the
roll
please.
F
G
A
The
next
item.
Sorry,
thank
you.
The
next
item
is
the
business.
It
is
item
4a.
It
is
eric
gucci
for
a
major
development
permit
to
construct
a
65.
A
C
C
The
site
of
the
project
in
question
that
is
surrounded
on
three
streets
by
feral,
drive,
computer
way
and
research
drive
to
the
north
of
the
site
is
the
dmv
and
to
the
south
is
the
hop
purple
energy,
solar,
installer
to
the
west?
We
do
have
single-family
homes
and
vacant
land
and
to
the
east.
We
have
light
industrial
uses.
C
C
C
C
C
I
do
have
the
25-foot
landscape
buffer
required
by
the
code,
and
there
is
a
100-foot
setback
requirement
along
farrell
drive
due
to
its
proximity
to
residential
to
the
west.
So
the
project
meets
this.
The
development
standards
in
the
m1
fee
zone
and
the
afternoon
has
provided
additional
renderings
of
the
proposed
project.
C
C
Those
are
included
in
our
conditions
in
the
staff
report.
In
addition,
staff
believe
that
the
project
could
be
improved
based
on
the
findings
required
for
approving
this
development.
First,
that
the
applicant
installed
additional
planting
material
in
the
perimeter.
Planting
planting
bed
along
feral
drive
to
provide
additional
screening
of
any
rv
that
might
be
located
on
that
side
of
the
property
and
that
these
the
additional
planting
is
in
compliance.
C
It
must
be
in
compliance
with
the
airport
land
use
commission's
requirements,
they
do
have
specific
requirements
on
their
website
and
they
do
impose
specific
limitations
on
tree
lines
due
to
concerns
about
birds
near
the
airport.
C
So,
in
terms
of
the
application
before
you
tonight,
as
I
mentioned,
this
is
a
major
development
permit
application
that
the
commission
will
be
considering
under
the
revised
entitlement
review
process
that
was
adopted
last
year.
This
is
the
first
step
of
review
that
is
required
and
then
the
second
step
would
be
a
rc
review
and
at
which
time
the
committee
could
provide
additional
or
the
arc
could
approve
the
project
based
on
any
direction
that
the
commission
may
have
relative
to
the
architecture
of
the
project.
C
Landscaping,
solar
control,
landscaping
and,
as
I
mentioned
so,
those
are
items
that
arc
would
look
at,
but
in
terms
of
the
planning
commission's
purview
staff
has
provided
recommended
findings
for
approving
the
project.
As
shown
on
pages
six,
starting
on
pages.
Six
in
your
staff
report
relative
to
the
criteria
for
a
development
permit,
and
we
have
provided
a
draft
resolution
should
the
commission
wish
to
adopt
and
approve
the
project
this
evening.
So
with
that
I'll
conclude,
my
presentation
and
I'm
happy
to
answer
any
questions
the
commission
may
have.
Thank
you.
D
Just
one
question
or
concern
I
had,
and
I
just
want
to
make
sure
this
is
looked
at
carefully
if
it
hadn't
already
the
monument
sign
that's
being
proposed
at
the
corner
of
feral
in
computer
way.
D
Farrell
has
a
you
know
the
s-curve
through
there
and
it's
a
little
treacherous
getting
out
onto
ferrell
from
computer
way
at
certain
times
of
the
day,
and
I
want
to
make
sure
that
that
monument
sign
isn't
creating
any
visibility
issues
with
traffic
exiting
onto
pharaoh.
So
I
just
want
to
make
sure
that's
looked
at
carefully
and
specifically
because
my
fear
is
that
it
could
possibly
be
blocking
traffic
coming
southbound
on
feral.
D
You
know
it's
hard
to
say
from
the
looking
at
the
plan,
but
I
was
out
there
today
and
even
without
blockage.
It's
the
traffic
is
roaring
down
feral
at
at
least
45
miles
an
hour,
and
I
just
want
to
make
sure
we're
not
creating
a
a
traffic
nightmare
by
having
that
sign
too
close
to
the
right-of-way
line
on
feral.
So
just
a
a
request
to
take
a
careful
look
at
that.
C
Correct
so
we
can
take
note
of
that
commissioner
miller
and
certainly
address
that
as
a
part
of
the
sign
permit
application
that
the
app
can
submit.
But
since
the
opt-in
is
here,
I
think
we'll
be
aware
that
that's
something
we'll
look
for
when
they
do
bring
that
forward.
H
Some
questions
specific
to
the
findings
that
are
carrying
the
resolution
and
in
the
staff
report,
and
I
want
to
make
sure
that
our
findings
are
going
to
be
responsive
to
what
we
are
required
by
code
to
fund
in
order
to
approval
the
project
and
I'm
missing
some
of
the
information
that
I'm
looking
for
we'll
start
with
number
four.
We're
required
to
find
that
the
proposed
hyphen
massino
project
is
consistent
with
local
standards
and
compatible
with
the
adjacent
development.
H
C
Correct
commissioner
land,
the
the
project
does
meet
the
height
limitations
of
40
foot
maximum
at
the
proposed
21
feet.
So
we
can
certainly
add
another
sentence
or
two
to
address
that.
H
Okay,
great,
I
just
want
to
make
sure
that
on
number
five
we're
talking
about
we're
asked
to
find
that
the
proposed
setbacks
and
placement
are
consistent
with
applicable
standards
and
consistent
with
the
setback
of
adjacent
buildings.
H
I'm
not
finding
anything
discussing
the
setbacks
of
adjacent
buildings
in
the
findings
that
are
offered.
Can
you
tell
us
for
certain
whether
or
not
the
proposed
project
is
consistent
with
the
setbacks
of
the
adjacent
buildings.
C
Yeah,
I
did
take
a
look
at
that
this
evening,
just
to
confirm
for
myself
I
looked
at
the
hot
purple
energy
building
and
it
does
have
a
100
foot
set
back
from
feral
drive.
They
do
have
a
roughly
20
25
foot
landscape
buffer,
a
long
ferrule
as
well,
so
they
are
consistent.
B
H
It
fair
to,
could
we
alert
it
or
could
we
say
then
that
the
proposed
project
is
consistent
with
or
has
greater
setbacks
than
the
adjacent
buildings?
Yes,.
H
Okay,
all
right
and
then
on
number
eight,
and
this
is
really
got
what
kind
of
got
me
thinking
about.
It
was
looking
at
the
suggestions
that
have
been
made
to
improve
the
landscaping
for
screening
and
one
thing
or
another
and
number
eight.
The
finding
we're
asked
to
make
is
that
the
landscape
areas
and
open
space
are
in
conformance
with
applicable
standards,
and
the
design
of
the
stormwater
management
features
are
appropriately
integrated
with
other
elements
of
site
design.
H
Here,
I'm
presuming
that
the
applicable
standards
are
dealing
with
things
like
the
wastewater
efficiency
ordinance,
the
standards
by
desert
water
agency
and
by
the
county
ag.
Commissioner,
are
there
other
standards
that
that
we
would
have
to
comport
with,
and
does
this
project
comply
with
those
standards.
C
Yes,
so
the
you
are
correct,
the
applicable
criteria
that
we
would
evaluate
under
is,
we
would
evaluate
under
the
county
agricultural
commissioner,
or
they
would
evaluate
it
to
meet
their
standards
and
that's
a
condition
we
have
in
our
our
conditions.
But
in
terms
of
what
we
look
at
here
for
projects,
it's
chapter
8.60,
which
is
the
water
efficient
landscape
ordinance.
C
H
Okay,
so
we
can.
It
is
fair
to
say
that
prior
to
issue
of
permit
or
of
the
construction
permit,
conformance
with
all
standards
will
be
required.
C
H
Okay
and
and
how
about
the
integration
of
the
stormwater
management,
which
I
presume
is
retention
and
basins,
is
appropriately
integrated
with
the
elements
of
the
site,
design.
I
Tell
us
good
afternoon,
everybody
yeah
the
site
plan
that
we
have.
They
are
indicating
some
retention
basins,
whether
or
not
those
retention
basins
are
sized
appropriately
for
the
amount
of
water
they're
going
to
be
generating.
I
That
will
come
out
later
during
the
plan
check
of
the
precise
grading
and
they
are
required
to
also
implement
water
quality
management
plan
and
to
treat
the
first
flush
off
of
everything
that
they're
generating.
I
don't
see
that
on
the
site
plan,
but
it
is
our
one
of
our
conditions
and
they
would
be
required
to
comply
with
that
prior
to
the
issuance
of
even
a
grading
plan.
I
H
Okay,
so
on
this
one,
perhaps
we
could
say
that
components
with
the
standards
established
in
water,
efficient,
ornaments
and
by
the
emergency
and
the
county
agricultural
commissioner's
office
will
be
verified
prior
to
issuance
of
building
permit,
and
it
sounds
like
we've
you've
already
verified
generally,
that
it
will
meet
that
green
lantern.
Stormwater
retention
will
need,
will
integrate
with
the
site
design.
A
So
we're
going
to
need
some
of
these
rewritten
jim.
If
you
can
be
working
on
that
right
now,
commissioner,
commissioner
ryan,
you
still
are
going
forward
right.
No
that.
H
That
concludes
my
question.
I
guess
I
guess
the
other
thing
that
I'm,
maybe
I'm
just
looking
for
science
on
this-
is
how
I
I
agree
absolutely
with
with
the
staff
assessment
that
the
monotony
in
the
wall
facing
feral
needs
to
be
addressed,
whether
it
be
with
some
undulation
in
the
wall,
some
pilots
or
some
decorative
elements,
and
same
thing
that
the
landscape
there
in
particular
the
trees
which
would
give
height
to
to
screen
the
rvs
that
that
needs
to
be
addressed.
And
but
I'm
not
sure,
is
this.
H
A
Oh,
you
have
a
mechanical
ring
all
right,
a
mechanical
hand
raised
if
there
aren't
other
questions.
I
have
several.
This
says
that
we
don't
require
rooftop
solar.
Can
we
or
can
we
do
the
same
requirement?
We
did
with
cannabis
to
require
either
solar
or
that
they
purchase
energy
generated
from
green
sources,
and
is
there
any
reason
we
can't
do
that.
C
We
can
ask
the
applicant
if
that
is
something
that
they
do
propose
in
terms
of
requirement
at
this
time
we
don't
have
a
ordinance
that
mandates
such
standards.
So
I
would
defer
to
mr
priest
if
there's
any
other
thoughts
on
how
that
might
be
achieved.
A
Mr
priest,
we
didn't
have,
we
did
require,
I
know
with
cannabis
and
city
council
approved
requirements
for
the
minimally
purchase
of
green
energy,
green
sourced
energy.
G
Yes
and
I'm
trying
to
recall
if
the
council
was
making
a
policy
when
they
made
that
decision
with
respect
to
cannabis
facilities
or
whether
that
was
a
broader
policy
with
respect
to
rooftop
solar
on
commercial
overall,
do
you
recall
when
the
council
made
that
decision,
I'm
I'm
asking
that
of
staff
as
well.
G
My
recommendation
to
the
commission
would
be
if
you
believe
that
there's
particularized
concerns
about
this
project
that
would
require
solar
or
green
energy.
You
could
condition
it
that
way.
However,
if
it
is
to
further
the
policy
goal
that
is
best
left
to
the
council
to
set
that
policy,
and
then
the
commission
can
implement
that
on
a
project
specific
basis.
A
Okay,
I'm
going
to
go
through
some
other
questions.
I'm
I
have
a
concern
about
the
rvs
being
parked
on
the
other
side
of
the
fence.
Can
the
applicant
can
someone
tell
me
how
high
an
rv
usually
is
I'm
thinking
11
to
14
feet
tall,
but
I
could
be
wrong
in
that.
B
Your
maximum
rv
height
could
be
14
feet.
You
know
your
bigger
rvs,
you
know,
will
be
12
feet.
The
rv
we
expect
to
have
the
most
here
will
be
air.
You
know
those
air
streams,
those
trailers
and
with
the
addition
of
the
air
conditioning
unit
on
top
of
the
air
spring
trailer,
it
will
be
10
feet.
High
other
potential
uses
here
are
going
to
be
smaller
trailers,
cars,
maybe
boats
as
well,
which
will
be
below
the
tennessee
limit
below
12
feet.
A
Okay,
thank
you.
So
this
is
a
question
for
rick.
Can
we
require
that
they
grade
down
below
the
wall
so
that
that
isn't
visible
from
the
street
and
some
of
the
concern
is
people
turn
on
that
curve?
A
I
I
wouldn't
I
wouldn't
want
to
comment
about
the
traffic
or
the
or
the
glare
off
the
rvs,
but
as
far
as
the
grading
is
concerned,
there
isn't
any
reason
why
they
couldn't
grade
that
lower
to
try
to
to
try
to
drop
that
visual
impact
of
the
rvs,
but
from
an
operational
standpoint
and
hydraulic
standpoint.
I
That
might
be
a
bit
of
a
challenge
for
them
right
now,
as
a
basic
site
plan
they're,
giving
us
a
general
schematic
of
how
where
the
water
is
going
draining
through
surface
drain
or
through
some
subterranean
pipes
and
going
to
the
retention
basins.
But
if
you
lower
that
a
significant
amount
of
feet
to
lower
the
height
of
the
rvs
that
might
end
up
being
a
problem
for
them
operational
wise.
Because
you
know
some
of
these
rvs
can
be.
I
You
know,
40
feet
long.
You
know-
and
I
know
that,
because
mine
is
40
feet
long
and
if
you
lower
this
a
significant
amount
you
trying
to
back
such
a
vehicle
in
that
big
of
a
great
difference,
might
be
a
problem
operational
wise,
but
that's
something
that
they
would
have
to
figure
out.
But
you
end
up
creating
an
internal
moat
for
water
by
doing
that,
and
then
they'll
end
up
having
to
either
probably
put
in
some
underground
pumps
or
something
to
get
that
water
from
that
location
to
their
wqmp
or
to
their
retention
injuries.
I
It
could
be
done,
but
it
it
makes
it
makes
maintenance
and
operations
kind
of
tricky.
A
So
if
it
makes
maintenance
and
operations
kind
of
tricky
and
that
that
isn't
something
I
was
looking
at
doing,
the
other
thing
is
plant
material.
That
would
create
screening
and
we've
heard,
and
this
is
for
jim,
do
we
have
to
respect
the
airport
request
to
not
put
in
a
15
foot
trees
on
15
foot
of
center.
G
G
If
we
were
to
deviate
from
those,
I
think
we'd
have
to
have
some
cause.
Be
able
to.
You
know,
work
that
out
in
advance,
but
right
now
I
mean
if
the
commission
wants
to
move
forward
with
seeing
if
we
can
get
higher
trees.
We
would
want
to
look
into
that
further
and
see
whether
in
fact,.
A
I
don't
think
so:
I'm
not
looking
at
higher
trees,
I'm
looking
at
a
tree
canopy.
If
we
can't
do
a
tree
canopy.
This
is
for
david.
A
C
Yeah
I
mean
that
is
certainly
another
option
that
the
commission
could
consider.
I
just
pulled
up
the
the
brochure
that
is
online
for
airport
land
use
commission
and
they
do
have
a
specific
design
guidance
criteria
that
says
avoid
and
prevent.
Oh
contiguous
canopy
prevent
overlapping
of
crown
structures
tree
crowns
that
is
contiguous.
Crowns
can
be,
can
provide
safe
passage
for
wildlife,
provide
sufficient
distance
between
plants
to
ensure
at
least
15
feet
of
open
space
will
remain
between
mature
grounds,
so
they
do
want
to
avoid
the
continual
tree
canopy
along
projects
near
airports,.
A
Okay,
those
are
my
questions.
Does
anybody
have
questions
for
the
applicant
and
then
we'll
go
to
comments
and
motions?
A
Oh,
I
have.
I
have
another
couple
of
put
actually
a
couple
of
comments.
Some
of
the
trees
that
they
suggested
using
are
trees
that
die
in
the
valley
right
now
we're
having
a
huge
problem
with
the
hella
verdi
trees,
especially
the
variety
that
they
proposed
and
the
the
pepper
trees
are
also
dying
out,
and
I
know
I
live
in
a
community
with
a
lot
of
them
and
we
re
remove
about
10
of
them
a
year
because
of
death.
A
So
I
think
the
tree.
The
tree
palette
is
something
that
would
need
to
be
revised.
But
commissioner,
hirschbein
you're,
following
on
my
comments,
yeah.
E
Rather
than
getting
into
the
proverbial
weeds
over
this
issue,
I
believe
it's
the
commission's
responsibility
to
identify
issues
to
the
arc
and
let
them
resolve
it
as
far
as
specific
plant
types
go
and
the
same
with
the
notion
of
judging
up
that
long
wall,
I
mean
we
could
say,
that's
an
issue
for
us,
but
I
don't
propose
that
we
solve
the
problem.
That's
why
we
have
the
arc
working
with
us.
A
But
are
we
at
a
point
where
I
mean
I'm
perfectly
happy
to
make
a
motion
on
this?
That
we
include
in
the
language?
A
I
I'd
move
approval
I
would
move,
I
would
add
the
staff's
conditions
and
I
would
require
something
of
a
hedge
that
would
be
up
to
15
that
could
go
to
15
feet
of
height
that
so
that
it
could
screen
the
rvs
from
the
street,
and
that
specifically
for
me,
is
not
just
aesthetic,
but
I
drive
down
that
street
all
the
time
and
I'm
concerned
about
the
glare
of
the
rvs
on
the
the
traffic
that's
going
in
both
directions
on
the
street.
A
I
would.
I
would
specifically
say
that
the
pallet
of
plants
needs
to
be
changed
so
that
they
exclude
the
two
trees
that
are
dying
out
in
the
valley,
but
the
rest
of
them,
I
think,
are
their
choices,
and
I
don't
know
if
there's
and
that
we
and
that
they
work
on
the
wall
and
that
they
do
any
work
that
they
think
is
appropriate
on
the
buildings.
A
A
I
No,
the
current
sidewalks
that
are
out
there
all
meet
the
current
zoning
sidewalk
widths
are
based
on
the
adjacent
zone
and
they
all
meet
that
currently
and
we,
our
conditions
are
for
them
to.
You,
know,
leave
them
in
place
and
then
they're
to
repair
or
replace
anything.
That's
broken
or
off-grid.
D
D
There
are
a
number
of
palm
trees
out
in
the
area.
I
was
concerned
that
that
was
an
airport
requirement,
but
it
doesn't
appear
to
be
because
there
are
many
tall
palm
trees
even
to
the
east
toward
the
airport
from
this
site,
and
I
think
if,
if
this
gets
planted
out
with
zero
palm
trees,
it's
gonna
look
a
little
strange
because,
as
we
know,
there
is
a
a
skyline
of
palm
trees
throughout
the
city,
and
I
think
this
site
should
at
least
include
some.
I
would
recommend
the
california
fan
palm
then
the
native
washingtonian
philipphera.
A
A
I
I
just
wouldn't
allow
the
removal
of
a
tree
that
provides
a
canopy
for
a
it
would
be
an
addition
of
palm
trees.
The
other
thing
david
is
there:
no,
there
is
no.
There
are
no
trees
in
the
rv
parking
lot.
C
A
F
I
wouldn't
want
that
requirement
to
impact,
though
the
ability
of
the
rvs
to
be
able
to
maneuver
in
their
specific
spaces,
because
it
looks
like
they're
going
to
be
pretty
tight,
so
we've
got
to
be
after
the
at
least
get
some
feedback
from
the
applicant
as
to
whether
or
not
that
is
the
right
area
to
be
putting
trees.
A
E
I
have
another
concern
about
the
proposal
having
the
hedge
inboard.
E
First
of
all,
hedges
are
lovely
and
I
wouldn't
mind
seeing
a
hedge
in
front
of
a
block
wall
from
pharaoh.
So
I'm
not
sure
why
you're
asking
for
that.
But
then
the
southern
sort
of
third
of
the
rv
parking
would
be
required
to
be
readjusted
by
a
few
feet
because
it
looks
like
they
actually
go
right
up
to
the
to
the
wall,
which
would
impact
the
the
ability
to
use
those.
E
D
D
You
know
again
with
our
condition
and
the
staff
condition
regarding
judging
up
that
wall
with
undulations
or
cutouts,
or
something
I
would
prefer
not
to
see
the
hedge
on
the
outside
of
the
wall.
To
tell
you
the
truth,
because
I
think
the
parkway
that's
being
proposed
with
the
addition
of
palm
trees
as
well,
is
going
to
be
much
more
attractive
than
a
hedge
along
a
wall.
C
What
they
might
consider
is
working
with
the
applicant
to
do
an
alternating
undulation,
where
you
might
have
a
hedge
on
the
outside
for
a
portion,
hedge
on
the
inside
floor
portion.
So
there's
some
variation
in
design
along
the
street.
C
So
from
what
I
have
written
down
here,
the
motion
is
to
approve
the
staff
recommendation,
including
the
two
additional
conditions
related
to
the
to
the
landscape
and
wall
design
along
feral
additional
revisions,
including
adding
a
14
foot
high
hedge
along
the
street,
on
partially
the
inside
and
outside
of
that
wall,
as
it
undulates
along
feral
and
then.
The
other
condition
I
have
was
that
the
palo
verde
species
be
substituted
for
an
alternate
tree
and.
A
They're
listed
or
I'm
sorry,
it's
the
it's,
the
african
sumac
didn't
mean
the
pepper
trees
and
that's
the
one
that
has
been
dying
out.
G
And
then
also
madame
cher
staff
will
reflect
the
amended
findings
for
findings.
G
Four
five
and
eight
are
what
I
have
on
my
notes:
just
making
making
a
more
detailed
finding
of
conformance
with
applicable
standards,
based
on
the
record
that
between
mr
newell
and
mr
menaris,
we
can
you
know
distill,
that
from
the
verbal
record
and
we
can
amend
those
findings.
E
I'd
like
to
clarify
something
as
far
as
the
conditions
we're
imposing
specifically
on
the
hedge
staff,
said
that
the
hedge
has
to
be
14
feet
high.
Are
you
proposing
that
they
plant
plants
that
are
14
feet
high
to
create
this
or
the
plants
are
genetically
predisposed
to
grow
to
14
feet?.
C
What
we
might
do
is
have
a
healthy
size
plant
be
installed
so
typically
that
might
be
like
a
15
gallon
hedge
and
that
that
it
be
maintained
at
a
14
foot,
height
level.
A
I
I
did
have
one
question
before
we
vote
and
it's
for
jim
priest.
Often
applicants
who
don't
have
entrances
on
the
on
the
main
thoroughfare:
don't
maintain
their
landscape
it.
It
certainly
is
the
case
on
gene
autry
and
is
there
any?
A
I
know
that
this
requires
they
maintain
it,
but
is
there
any
anything
that's
stronger
than
the
language
we
have
about
maintaining
it
to
make
sure
that
the
applicant
maintains
the
landscape.
G
Yes,
madam
chair,
I
don't
know
if
there's
much
more,
we
can
add.
We
already
have
condition
adm
six,
which
requires
the
property
owner
to
maintain
repair
the
improvements,
including
without
limitation
and
then
there's
a
non-exclusive
list.
G
Landscaping
is
not
listed
in
there.
I
suppose
we
could
just
include
that.
You
know
landscaping
shall
be
maintained
as
well.
We
have
existing
codes
and
code
enforcement.
Oftentimes
is
sent
out
to
deal
with
these
property
maintenance,
landscape
maintenance
issues,
and
that
would
typically
be
where
we
would
direct
those
efforts
if
we
found
out
that
they
weren't
maintaining
the
property,
there's
really
not
a
clear
process
in
the
code,
for
you
know,
revoking
a
major
development
permit
and
I'm
not
familiar
with
that
being
an
option
with
a
use,
that's
permitted
as
of
right.
A
I
I
But
there
is
a
california
streets
and
highways
code
that
public
works
and
engineering
we
use
quite
often
and
that's
for
any
kind
of
landscaping
or
hedges
that
actually
lies
within
the
public
right-of-way
and
that
is
very
enforceable
by
us,
and
we
actually
recite
that
quite
often
and
it's
quite
effective
when
the
hedges
are
actually
hitting
the
public
right
away.
So
we
do
have
that
in
place
as
well.
G
I
mean
we
could
explicitly
mention
that
streets
and
highways
code
provision.
I
would
note
that
the
condition
already
says
in
accordance
with
all
applicable
law
rules,
ordinances,
regulations
of
all
federal.
D
F
A
Moving
right
along
to
planning,
commission
reports,
requests
and
comments.
Are
there
any
reports
or
comments?
Commissioner
marouzzi.
F
And
since
we
were
bringing
up
the
issue
of
landscaping
on
major
streets,
I
recall
that
there
was
a
frontier
communications
project
that
we
approved
and
we
specifically
mentioned
them
improving
their
landscaping
along
sunrise,
and
I
don't
see
any
real
improvements
since
then.
It
still
looks
rather
shabby
so
I'd
like
to
find
out
what
we
required.
F
F
H
Manager,
I
thought
that
we
got
an
update
on
some
of
the
projects
last
week,
er
at
our
last
meeting,
and
there
were
a
couple
that
were
outstanding.
One
was
I'm
curious.
Every
time
I
go
past
between
gallardo
and.
H
Palm
canyon,
the
residential
development.
There
was
some
question
about
the
pad
elevations
and
staff
was
going
to
look
into
those
and
see
if
those
were
actually
being
constructed,
as
was
approved
by
the
planning
commission
and
then
the
second
one.
There
was
also
going
to
be
an
update
on
the
orchid
tree.
I
noticed
that
there's
been
a
lot
of
demolition
in
the
last
week,
a
lot
of
demolition
and
I'm
not
sure
if
purpose
has
been
the
issue
that
presumably
has
been
for
the
demolition,
but
is
the
project
now
in
permitting?
C
So
to
address
the
first
question,
it
looks
like
we've
lost
mr
minhares,
so
I
was
hoping
he
might
be
able
to
weigh
in
on
that,
but
I
will
check
in
with
him
on
that
and
that's
the
lawn
project
and
see
what's
happening
there
in
terms
of
orchid
tree.
C
Those
were
nuisance,
prop
nuisance
buildings,
where
homeless
were
getting
into
breaking
into
causing
fires
that
did
retain
obviously
the
historic
structures
on
the
church
and
the
bungalows
on
along
barista.
So
those
still
remain,
but
they
have
been
working
and
have
submitted
documents,
as
required
by
the
hotel
team
tot
incentive
program.
C
So
they
have
been
moving
forward
with
that
timeline.
They
have
submitted
an
extension
request,
so
that
will
be
before
the
commission
at
a
future
meeting
and
they
will
show
some
some
changes
that
they're
proposing
per
it
sounds
like
what
the
the
operator
is
requesting.
So
those
items
will
be
shown
to
the
commission
as
well,
but
they
do.
C
Not
yet,
but
they've
submitted
a
letter
from
their
architect
to
state
that
they're
more
than
60
of
the
way
in
construction
documents
and
to
have
completed
more
than
60
as
required
by
the
timeline,
so
they
are
fulfilling
their
time,
their
timeline,
their
milestones,
as
required
by
that
program.
A
F
Can
I
just
ask
for
a
little
more
clarification
on
that
david?
I'm
not
sure
what
you're
referring
to
in
terms
of
the
tot
timeline,
but
there
was
a
lot,
a
timeline
that
had
been
imposed
based
on
the
extension
of
the
the
agreement.
The
development
agreement
is
that
the
same
thing.
C
So
the
yeah,
the
city-ish,
the
city
council,
approves
the
t.o.t
incentive
program,
a
rebate
program
for
that
project.
So
yeah,
it's
essentially
the
same
thing.
It's
a
it's
a
it's
an
agreement
between
the
city
and
the
the
developer
to
carry
out
the
project
and
they
get
incentive
and
tot
rebates.
C
A
A
I
have
a
general
comment,
as
you
may
have
noticed,
in
monday's
planning
session.
The
city
has
a
great
deal
of
money
right
now
and
several
years
ago
we
asked
the
city
there.
May
there
may
not
be
anyone
other
than
me,
that's
still
on
the
commission,
but
we
asked
the
city
to
hire
a
long-term
planner
which
we
don't
have
in
our
department,
and
we
have
many
things
that
would
benefit
from
somebody
doing
long-term
planning
in
the
city,
and
I
have
sort
of
informally
commented
on
that
with
various
city
councilors.
A
A
And
I
would
like
it
makes
it
much
stronger
to
make
that
request
from
the
commission.
They
have
been
looking
at
addition,
you
know
many
additional
positions
in
different
departments
and
we
have.
A
H
Yeah
well,
I
agree
that
long-term
planning
is
a
good
and
necessary
thing
and
that
I
don't
necessarily
believe
that
there
is
staffing
to
be
able
to
currently
to
address
that
appropriately.
I
really
don't
think
that
it
is
the
planning
commission's
purview
to
be
trying
to
guide
the
management
of
the
department
and
staff
and
personnel
issues.
I'm
I'm
not
comfortable
weighing
in
and
asking
the
city
council
for
something
like
that
myself.
E
C
Just
mentioned,
we
did
sorry,
commissioner:
miller,
go
ahead.
D
I
was
gonna,
I'm
gonna
say
I.
I
agree
with
commissioner
elaine
that
it's
very
strange
for
the
planning
commission
to
be
trying
to
dictate
the
professional
management
of
any
department.
I
saying
that
I
mean
I
agree
that
there's
a
lot
of
things
that
we
need
to
look
at
as
a
city,
but
I
wouldn't
want
to
be
included
in
any
formal
recommendation
from
the
commission
to
suggest
staffing
levels.
I
assume
and
maybe
david's
going
to
address
this.
D
I
assume
that
our
development
services
director
is
dealing
with
staffing
issues
all
the
time
and
maybe
they
can
tell
us.
Are
they
looking
at
new
positions
being
added
in
the
next
year
or
two,
but
I
don't
think
it
needs
to
come
from
the
planning
commission
or
should
come
from
the
planning
commission.
C
The
only
thing
I
was
going
to
say,
chair
and
commissioners
is
that
when
we
did
provide
comments
before
the
council
started
their
strategic
planning
session,
we
did
send
them
your
requests,
which
did
include
the
request
for
an
additional
planner
to
handle
long-range
plan.
So
they
do
have
a
copy
of
that.
C
A
I,
with
the
commission
not
being
unanimous
on
this.
It's
certainly
something
I
wouldn't
raise
coming
from
s
coming
from
the
commission.
C
Yes,
madam
chair
and
commissioners,
so
at
the
last
thursday
council
meeting
the
city
council
took
up
the
appeal
for
the
fuego
nightclub.
C
There
is
additional
discussion
on
it.
There's
additional
requests
from
the
council
on
whether
or
not
police
department
is
able
to
accommodate
another
venue
that
closes
at
the
same
time
as
author
bars
downtown,
so
that
item
was
continued
to
their
next
meeting.
So
no
decision
has
been
made
on
that.
I
just
wanted
to
give
you
all
an
update
on
that.
C
My
recollection
was,
they
asked
those
questions
about
whether
hours
occurred
and
the
applicant
responded
that
they
did
reach
out
to
the
neighborhood
organizations,
but
they
didn't
reach
directly
out
to
the
adjacent
owners
and
hoteliers,
but
I'm
not
sure
if
that
was
additional
direction
from
council
on
that
we're
still
preparing
the
report.
So
I
don't
have
the
specifics
on
it.
Yet.
I
Did
you
say
that
the
fuego
was
pulled
up
by
the
city
council.
C
It
was
appealed
so
the
afghan
filed,
the
appeal
and
the
appeal
was-
was
reviewed
at
their
last
meeting
on
thursday.
So
but
it's
been
continued
to
the
next
meeting,
so
they
haven't
made
a
decision
on
it.
Quite
yet.
C
Let's
see
the
only
other
thing
that
I
wanted
to
mention
is
in
late
august.
I
believe
it's
august
26th,
it's
a
friday,
there's
a
free
training
that
we
would
like
to
send
commissioners
to
through
the
institute
of
local
government.
So
it's
it's
really
a
training
on.
You
know,
understanding
the
role
of
planning
commissioners
working
effectively
together
as
a
board
and
with
staff,
effective
community
engagement,
sql
basics,
typical
planning
documents.
C
So
there's
several
things
that
I
think
would
be
good
for
commissioners,
if
you're
able
to
attend
I'll
forward
you
the
email
that
we
got
today
about
it,
but
the
deputy
city
manager-
and
I
believe
it
would
be
helpful
for
commissioners
if
you're
able
to
attend.
So
that's
the
only
other
thing
you
have
to
report.
A
Thank
you
so
much
with
that.
We
will
adjourn
until
5
30
wednesday
may
11th.
