property
located

677,
West
Crescent
Drive
here
in
Palm
Springs.
Now
some
background
on
this
property
is
this:
Market
did
hold
a
vacation
route
certificate
which
expired
July,
31st
2012..
It
was
managed
by
an
agency
titled
365
vacation
rentals
in
that
vocational
certificate
was
closed.
July
15
2020.

on
December
28
2022
staff
did
find
that
this
property
was
operating
as
a
vacation
rental.
As
elements
listed,
English
staff
reports
there's
an
advertisement
found
on
Airbnb
listed
via
in
Palm
Springs
and
had
five
reviews.
Additionally,
a
code
compliance
officer
did
submit
a
booking
inquiry
to
state
for
the
dates
between
March
6
2023
through
March
10th
2023,
a
total
of
four
nights
and
a
response
was
received
by
the
code
officer
confirming
their
availability
and
that's
an
attachment.

in

staff
reported
to
do
based
off
of
the
elements
that
led
that
road
officers
investigate
the
property
citation,
was
issued,
830446
and
amount
of
five
thousand
dollars
to
the
property
owner
on
title
and
was
mailed
to

property
address

listed

title
as
well,

not
sure
if
that
code
officers
on
the

Airbnb.Com
code
officer,
Jacob
Gonzalez
came
across
an
advertisement
in
the
Las
Palmas
neighborhood
titled
Villa
in
Palm
Springs,
which
can
be
found
in
attachment
number
five
in
the
staff
report.

So
he
reviewed
the
photos
contained
within
the
ad
and
was
able
to
identify
the
property
address
as
677
West
Crescent
Drive
positively
and
drafted
a
citation
for
failing
to
post
the
city
ID
on
Wednesday
December
28
2022,
while
reviewing
the
issued
citation
by
Officer
Gonzalez
I
found
that
the
property
located
at
677,
West,
Crescent
Drive
no
longer
held
an
active
vacation
rental
registration
certificate
showing
as
having
expired
in
July
of
2020.
I,
confirmed
this
with
the
office
of
special
program
admin
staff.
The
certificate
had
been
closed
with
the
owner's
authorized
agency.

Having
submitted
closure
paperwork
on
July
15
2020..
At
that
point,
I
opened
an
investigation
for
what
appeared
to
be
an
operating
unregistered
rental.
I
sent
a
message
via
the
airbnb.com
contact
host
feature
inquiring
about
a
four
nights
day:
arriving
Monday,
March
6th
and
departing
Friday
March
10th.
The
message
was:
hi
Stephen.
The
pictures
of
the
house
look
great.
My
family
and
I
are
planning
a
trip
to
come
out
to
the
tennis
tournament
in
March.

looking
for
a
place
to
stay
for
the
first
week,
Monday
through
Friday,
our
flight
into
Palm
Springs
arrives
at
10,
A.M
and
I,
see
that
you
have
your
check-in
time
listed
as
3
P.M.
But
would
you
be
able
to
accommodate
a
check-in
time
listed
accommodate

earlier
check-in

inquiry

the
property
owner
on

and
again,
to
reiterate
the
specific
Elements
which
resulted
in
us
finding
that
the
property
was
in
violation
number
one.

property
was
advertised
on
airbnb.com
as
being
able
to
book
the
entire
home
for
a
minimum
of
four
nights
which
can
be
found
on

Believe
it's
page.

stock
report
is
attachment
number

without
a
vacation
rental
registration

and
number

The
host
Stephen
interacted
with
me
via
con
via
the
contact
host
feature
and
displayed
clear
intent
to
accept
and
facilitate
my
request
to
book
a
four
night
stay
by
sending
the
invitation
to
book.

of
these
facts
fit
within
the
established
within
what
was
established
as
part
of
the
administrative
regulation
dated
July
2017,
which
defined
the
operation
of
a
vacation
rental,
as
used
in
Palm
Street's
Municipal
Code,
section
5.25,

is
not
limited
to
any
one
or
more
of
the
following
one
advertisement
of
the
property,
means
on
any
web-based:
advertising
hosting
platform,
print
media
bulletin,
signage,
radio
and
television,
or
on
any
other
medium
for
the
purposes
of
promoting
interest
in
testing
the
market
for
or
soliciting
the
occupancy
of,
a
property
for
a
period
of
28
consecutive
days
or
less
and
then
also
number
three
under
that
regulation.

agency
prior

is
that?

does
that
look
like?

agency
would

signature
from
the
property
owner
stating
that
they

no
longer
going
to
Vacation
grants
so
that
the
agency
will
work
with
the
property
owner

sure

both
in
agreement

submit

the
city
with
an
effective
closure
date,
and
then
that
vocational
certificate
then
is
no
longer
valid
after
that
affected
dates.

I

Stephen

son

the
owner
of
the
property
at
677,
West
question
Drive,
Palm,
Springs
and
I'm,
representing
my
dad
on
this
hearing,
I'm
here
to
address
our
first
violation
issue
regarding
to
the
rental
premise:
we
posted
that
out
Airbnb
late
last
year,
and
we
were
not
aware
that
our
rental
license
has
expired
years
ago.
I
We
thought
the
license
was
still
active,
but
as
it
turns
out,
it
expired
in
July
of
2020..
Therefore,
we
were
marked
on
the
violation
of
advertising
a
house
on
Airbnb
without
having
a
valid
permit
in
Palm
Springs
via
officer
Mitch.
The
violation
consisted
of
a
five
thousand
dollar
fine
and
a
permanent
ban
on
the
rental
license.
The
page
has
now
been
shut
down
when
the
violation
was
issued
and
we
were
awaiting
this
year.

addition,
given
the
approval
of
the
board,
we
would
like
to
request
to
renew
our
previous
rental
permit
that
expired
in
2020
and
potentially
start
again,
given
that
everything
is
valid,
this
time
and
checked
by
the
student
again,
we
were
not
aware
of
the
expiration
of
the
rental
license
and
would
like
to
sincerely
apologize
again
on
this
issue.

hope
that
the
board
understands
our
situation

will
take
consideration
into
a
fair
solution.

was

citation

for

violation

January

2023
at
approximately

PM.
The
complaint
was
received
referencing
loud
occupants
and
music
coming
from
the
backyard
area
that
could
be
heard
beyond
the
property
line
via
the
City
app
for
the
the
report.

Well,
our
response
to
the
property
did
not
result
in
the
issuance
of
a
citation
for
the
reported
noise
or
music.
We
did
contact
the
occupants
at
the
front
door
and
found
that
the
property
was
in
fact
operating
as
a
vacation
rental.
The
responsible
renter
stated
that
they
had
booked
the
property
for
a
short-term
stay,
arriving
on
Thursday,
January
5th
and
departing
on
Sunday
January,
8th
via
the
booking
website
airbnb.com.

After
returning
to
my
workstation
after
our
response,
I
conducted
a
second,
more
detailed
check
for
a
submitted
contract.
Summary
I,
confirmed
no
contract.
Summary
was
on
file
for
the
current
guest
stay.
As
a
result
of
my
findings,
the
property
owner
was
found
to
be
in
violation
of
psmc
525070h
and
I
worked
with
officer
Gonzalez
to
draft
an
issue
Citation
ab0448
for
failing
to
submit
a
contract
summary
prior
to
guest
occupancy
to
the
owner
on
title.

couple
of
things
to
note
on
August
13th
2022,
while
conducting
follow-up
related
to
the
citation
that
was
issued
to
the
property
owner's
guest
for
music
I
spoke
with
the
owner
armeen
on
the
topic
of
contract.
Summaries
and
I
provided
specific
education
on
what
they
are,
how
to
submit
them
and
the
enforcement
action
that
could
result
in
failing
to
submit
them
and
it
kind
of
walked
her
through
the
process
of
of
of
how
to
get
that
link
on
the
city's
website.
Also
worth
noting.

Since
the
suspension
began
on
February
20th
2023,
we've
continued
to
receive
complaints
and
our
investigations
have
found
that
the
property
owner
has
continued
to
operate
as
a
vacation
rental
in
violation
of
her
suspension.
As
recently
as
two
weeks
ago,
the
Airbnb
advertisement
was
still
available
and
it
request
to
book
a
short-term
stay
was
met
with
an
invitation,
a
book
from
the
host
by
by
one
of
our
one
of
our
officers.

estimation

the
attachments
that
are
provided
in
the
staff
report

attachment

you'll

that
we
attached
quite
a
few
vacational
newsletters,
where
we
email
these
out
to
any
subscriber

the
requirement

submitting

occupants
at
the
front
door
and
found
that
the
property

fact
operating

vacation

renter
stated
that
they
had
booked
the
property
for
short-term
stay,
arriving
on
Thursday,
January
5th
and
departing
on
Sunday
January,
8th
via
the
booking
website
airbnb.com.

the

The

vacation
rental

as

suspension

receive
complaints

address

our
investigations
have
found
that
the
property
owner
has
continued

operate

vacation
rental
in
violation

her

weeks
ago,
the
Airbnb
advertisement
was
still
available
and
request
to
book.

by

our
Enforcement
Officers
was
met
with
an
invitation
to
book
from
the
host,
which
all
indications

property
owner

calls

conversation

felt
that

and

received
that

my
officers
are
acting
inappropriately,

with

get

ring
cameras
and

conversating
with
our

person
on

ring
came
over
and
said,
there's
nobody
here,
the
property
is
unoccupied,
and
it

point

conversation
with
the
guests,
and
so
it's
it's
quite
a
distraction
on
multiple
occasions
where
we've
gone
out
to
do
these,

to
to
our
investigations
and
have
our
discussions

the
guests

we've

kind
of
the
destruction
of
the
owner
or
whoever
has
access
to
their
ring.

evidence
to
support

true
and

there
was
like

mentioned
