Code Enforcement Board 3-22-2023
B
C
D
They
have
tried
part
of
the
problem
with
Florida
Still
Remains
in
Tallahassee,
and
it's
called
home
rule
yeah.
It's
like
every
time
the
city
tries
to
do
something,
Tallahassee
comes
and
says:
no,
you
can't
do
that
and
we're
doing
it
right
now
or
who
even
there's
a
state
right
now:
Senate
bills,
102.
F
Mics
are
on
the
meeting,
is
recording.

Members
presents
so
we
do
have
a
quorum
since
it's
just
us
I,
don't
think
I'm
gonna
have
to
request
everybody
to
adhere
to
code
of
conduct
and
proper
decorum.
So
we
will
move
on
I
believe
the
new
requirements
are
that
we
take
stand
for
a
pledge
of
allegiance.
Is
that
correct.
A
A
A
A
Receipt
of
the
minutes
will
be
held
in
advance
until
the
technical
problems
are
completed.
The
next
meeting
is
April
26
2023
and
it
will
be
held
in
the
military,
Heritage
Museum,
starting
at
nine
o'clock.
Standard
Time,
the
with
that
anybody
who
will
be
giving
testimony.
Will
you
please
stand
and
be

The

are
a

accurate

of
the

of
the

At
the

the
pictures
were
taken
on
January
10
2023.
A
noticeable
violation
and
Order
of
corrective
action
was
sent
to
the
respondents
ordering
correct
that
shouldn't
be
taken
and
the
large
downed
trees
be
properly
removed.
The

be
below

any

All
they
do
is
trim
and
maintain
the
property,
the
grass
they
that's
all
they
do.
I
A
H
A
H
It's
considered
outside
storage
when
it
it's
on
the
property,
the
dead
tree
branches
that
are
laying
on
the
property.
H
E
C
Just
a
question
again
on
my
side,
but
if
we
start
finding
them
it's
sort
of,
let's
say
the
250
a
day
over
time.
Does
that
go
under
their
tax
bill
or
does
that
have
to
be
something
there's
a
lien
on
the
property?
Or
how
do
you
go
after
people
that
you
can't
get
a
hold
of
there's
a
lien
on
the
property?
So
if
they
sell
it.
A
D
A
Has
been
made
that
the
city
has
established
a
prima
facial
case
and
it
has
been
second
all
those
in
favor
of
the
motion,
please
signify
by
saying
aye,
aye
and
they're
a
vegan,
no
objection,
emotions
carried
and
since
we
don't
have
a
respondent
to
make
any
inquiry
of,
and
that
will
entertain
a
motion
to
resolve
this
matter.
D
Just
kind
of
figure
out
the
okay
I'll
make
a
motion
to
find
that
the
respondents
violated
chapter

A
H
The
record
the
board
here-
price,
Junior,
co-compliance
officer
for
the
city
of
Punta,
Gorda
and
I,
have
been
sworn
according
to
the
Charlotte
County
Property
Appraisers
record.
The
property
located
at
56
tropical
Ocean
Drive
is
within
the
city
limits
of
this
city
of
Punta,
Gorda
Florida
and
the
property
is
owned
by
the
responders.
This
matters
before
the
board
November
17
2020
at
Western.
The
board
heard
testimony
receive
evidence
and
enter
this
compliance
order,
which
was
posted
on
the
property
and
at
City
Hall
by
a
code
officer,
Adam
co-compliance
officer,
Alan
McDaniel
on
November
17
2020.
H
The
compliance
order
required
the
respondents
to
clean
and
maintain
the
roof
on
the
house
structure
within
30
days
of
receipt
of
the
order
and
to
cease
and
desist
for
many
future
violations
of
Punta
Gorda
code.
Chapter
26,
section
8.11
A,
a
re-inspection
of
the
property
at
56
Ocean
Drive
by
Cold
compliance
officer,
Alan
McDaniel
on
December
17
2020
found
that
more
than
20
percent
of
the
roof
on
the
house
structure
on
the
property
was
not
cleaned
and
maintained
as
to
be
free
from
dirt
or
mold,
and
the
property
remained
in
non-compliance.
H
H
2021
reinspected
the
property
on
March
9th
2023
and
found
that
more
than
20
percent
of
the
roof
on
the
house
structure
on
the
property,
continued,
not
to
be
cleaned
or
maintained,
has
to
be
free
from
dirt
or
mold,
and
the
property
continue
to
be
in
non-compliance.
I'm
submitting
seven
photos
for
the
record.
The
pictures
submitted
for
evidence
are
a
true
and
accurate
representation
of
the
conditions
of
the
site.
H
A
A
G
A
That
would
that's
fifteen
thousand
680
plus
82
on
there
already
so
now
we're
up
to
23
000.
I.
E
Have
a
question:
what
was
the
status
of
the
property
between
the
time
that
we
impose
the
fine
in
January
2021
until
today,
in
terms
of
the
compliance
it's.
E
F
E
C
I
Well,
I
do
not
practice
probate
law
and
have
really
no
experience
with
respect
to
how
long
it
takes
remember.
During
that
period
of
time,
we
also
had
covid
that
was
delaying
Court
proceedings
a
week
by
Statute
were
required
to
notify
the
owner
of
record
as
provide
for
in
the
property
appraisers
and
tax
collectors
records.
I
I
We
could
go
and
and
take
a
look
in
at
the
court
records
and
see
if
there
is
an
attorney
of
record
representing
the
estate
or
whomever
I.
Think
the
personal
representative
that's
identified
in
the
pleadings
of
this
case
is
the
party
who
has
responsibility
for
the
estate
and
we
have
been
contacting
that
person
or
that
person
has
elected
to
retrieve.
The
documents
that
are
sent
to
them
is
really.
I
So
we've
done
everything
that
we
need
to
do
to
make
sure
that
we
have
the
ability
to
to
rectify
the
situation
are.
A
H
A
Yes,
and
you
called-
and
what
happened,
nobody
answered
it,
nobody
answered
and
it
wasn't
a
voicemail
set
up.
What
about
mail
Communications?
Have
you
mailed
to
that
address?
Yes,
it
all
comes
back
in
return,
so
you
don't
even
know
if
it's
a
valid
address
anymore
I
mean
ordinary
mail
is
delivered
unless
there's
nobody
there
to
receive
it
and.
B
For
the
record
day,
McCarty
coach,
my
supervisor
has
been
sworn
we
mail
to
the
address
listed
with
the
property
appraiser
Thomas
R
McCollum,
the
personal
representative,
is
listed
with
property
appraiser.
So
for
our
purposes
he's
the
representative,
so
I'm
just
asking,
but
no
we
we
don't
know
if
he's
received
it.
If
everything's
left
I
mean
you.
D
Okay,
only
this
this
is
the
only
violation
listed,
so
there
hasn't
been
any
violation
listed
for
like
lawn
or
things
like
that.
So
is
it
an
assumption,
then,
that
the
lawn
is
being
maintained
by
someone
that
there's
some
active
management
process
in
place
that
that
otherwise
there
would
be
other
violations,
for
you
know
grass
or
trees,
or
something
like
that.
So
somebody
somebody
is
taking
care
of
the
property.
H
Yes
and
no
so
there
are
other
cases
on
the
property.
This
is
separate
from
that.
It
is
under
the
distressed
mode
through
the
city,
but.
H
The
property,
when
it's
needed
to
be
mowed,
occasionally
it
is
mowed
by
somebody
else
before
the
city
gets
there,
but.
H
C
A
E
G
E
I
And
if
the
address
that
is
provided
to
the
Property
Appraiser's
office
is
not
correct
or
if
they're
paying
I
mean,
we
don't
know
if
they're,
if,
if
their
taxes
are
current,
but
we're
also
not
aware
of
any
indication
that
the
property
is
delinquent,
I
mean
taxes
are
still
not
I.
Don't
you
know,
they're
still
payable.
I
So
ultimately,
if,
if
someone
ignores
the
their
responsibilities
with
respect
to
the
property,
irrespective
of
the
note
of
of
our
situation,.
I
The
the
liens
that
are
on
the
property
are
going
to
need
to
be
addressed
at
some
point
in
time
and
ultimately,
it
may
be
possible,
just
like
in
the
rat
house
situation,
where
some,
where
the
owner
ignores
their
responsibilities
with
respect
to
the
property,
then
the
property
could
be
sold
for
the
for
foreclosure
of
the
liens
and
then
a
responsible
party
will
take
over
the
property
and
make
sure
that
it's
it's
conforms
to
standards
for
the
community.
I.
E
Understand
that,
but
he,
but
our
goal
here
is
to
try
to
get
people
to
be
in
compliance.
If
there
is
a
party
who
is
responsible
for
this
property,
not
maybe
legally
but
practically
responsible
for
this
property,
I
guess,
if
it's
the
probate,
it
would
be
legally
I
think
it
would
behoove
the
board
and
the
city
to
notify
that
person
and
if
the
person
still
does
not
respond,
then
I
think
it's
appropriate
to
put
in
a
lien.
Putting
in
a
lien.
E
E
C
Our
job
is
that
we
get
people
in
compliance
and
I,
don't
have
a
problem
with
the
lien
on
the
property
and
if,
at
the
end
of
it
the
city
collects
money
out
of
it,
it
does
give
you
a
strong
arm.
Maybe
to
get
this
accomplished.
I
think
it's
also
important
to
go
after
anybody.
We
can
to
try
to
get
in
compliance
for
the
Neighbors.
C
This
is
a
beautiful
Street
and
there's
no
reason
for
Neighbors
to
have
to
live
with
that,
so
I
think
it
whatever
we
have
to
do
to
get
a
hold
of
them
to
try
to
get
them
to
wake
up
to.
What's
going
on
here
and
I,
I
mean
I
still
think
I
I
think
having
a
fine
against
it's
fine,
but
we
need
to
chase
these
people
down.
D
We
continue
the
fine
currently
in
place
for
30
days
to
give
the
city
time
to
check
tax
records
representative
of
record
exhaust,
whatever
other
sources
of
information
possible,
to
attempt
to
rec
to
find
a
responsible
person
and
at
the
end
of
that
30
days,
if
there's
no
responsible
person
available
or
we
find
somebody
and
they
blow
us
off,
we
then
take
further
action,
but
it's
sort
of
a
I,
don't
know
a
continuance
of
short
but
leave
the
leave
the
fine
in
effect
continuing
until
we
can
try
to
resolve.
A
A
A
D
G
A
I,
don't
think
that
as
far
as
I'm
concerned,
somebody's
being
irresponsible,
if
they
are
the
property
is
not
violent,
is
not
in
compliance
with
the
code.
And
there
are
penalties
for
that
situation
and
I.
Think
it'd
be
really
responsibility
in
the
sport
to
actually
impose
the
penalty
and
to
reach
a
point,
possibly
where
the
city
actually
takes
possession
of
the
property
and
executes
on
it,
but
and
then
does
what
it
has
to
do
like.
E
I
moved
this
matter.
We
continued
for
30
days
to
allow
the
city
the
records
are
in
terms
of
who
paid
taxes
on
this
property
and
who
is
representing
the
estate
in
the
probate
court
of
the
county
and
at
the
end
of
that
time,
for
the
city
to
make
contact
with
these
parties
and
report
back
to
the
board.
A
Motion's
been
made
to
place
in
advance
for
30
days
any
action
on
this
case
that
is
presently
before
the
board
and
direct
the
city
to
Endeavor,
to
find
a
response
party
who
might
might
be
responsible
for
the
management
of
this
property
and
to
return
at
the
next
hearing
and
provide
whatever
information
they
have
found.
Yes,
David.
B
E
A
C
A
Motion
has
been
made
in
second:
is
there
any
discussion
on
it?
Take
a
vote.
I'm,
sorry
yeah.
All
those
in
favor
of
the
motion
is
presented.
Please
wait
by
saying
aye
aye,
any
opposition.
None
motion
is
carried.
Do
you
understand
what
the
motion
is?
Sarah,
okay
kind
of
convoluted
I
know,
but
it's
appropriate.
D
For
those
who
might
have
missed
it,
this
board
was
complimented
at
yesterday's
city
council
meeting
for
having
a
kind
heart
and
working
with
people
in
the
community
by
a
member
of
the
community.
So
who.
A
Yes,
any
other
business.
Any
member
comments,
no.
