Description
Regular City Council Meeting 3-15-2023
A
A
Good
morning
I'd
like
to
call
to
order
the
March,
15
2023
city
council
meeting,
let
the
record
reflect
that
all
city,
council,
members
and
City
officials
are
present
or
in
the
building.
If
you
would
please
stand
and
join
me
on
a
moment
of
silence,
as
we
do
not
have
a
formal
invocation
this
morning
and
then
we'll
do
the
Pledge
of
Allegiance.
A
A
So
this
morning's
meeting
is
a
little
bit
different
than
our
normal
meetings.
We
have
to
adjourn
this
meeting
at
9
30,
no
matter
where
we
are
on
the
agenda,
because
we
have
another
commitment
that
we
all
must
leave
for
at
9
30..
So
at
the
at
this
time,
we're
going
to
open
up
the
floor
for
public
comments
on
agenda
items.
Only
anything
that's
on
today's
agenda
only
and
then,
if
there
is
time
we
will
allow
comments
for
all
other
subjects.
Let
me
read
some
housekeeping
notes
before
we
begin.
A
If
you
have
a
cell
phone
with
you
or
any
kind
of
a
device
that
has
noise
on
it,
please
silence
it,
as
this
meeting
is
recorded,
there's
a
Code
of
Conduct
in
the
council
chambers,
and
we
would
like
you
to
make
sure
that
you
respect
the
rules
of
the
of
the
council
chamber.
Members
of
the
public
who
wish
to
address
the
council
should
use
the
guest
Podium
at
the
center
of
the
room.
A
The
podium
to
the
right
of
the
stage
is
for
staff
and
applicant
presentations
only
speak
directly
into
the
microphone
and
begin
by
stating
your
name
for
the
record.
If
it
is
a
quasi-judicial
hearing,
please
also
state
that
you've
been
sworn
in.
Each
person
has
three
minutes
to
speak.
Sharing
minutes
is
not
permitted.
A
Speakers
are
to
direct
all
comments
to
the
city
council,
not
the
audience
or
any
one.
Individual
council
member
discussion
between
speakers
and
members
of
the
audience
is
not
permitted
when
there
are
many
individuals
who
wish
to
speak.
Speakers
should
try
not
to
reiterate
lengthy
comments
made
by
others
to
ensure
an
effective
and
efficient
meeting.
This
ensures
everyone
has
an
opportunity
to
speak
audience
and
speakers
will
be
courteous
in
their
language
and
presentation,
no
applause,
sidebar
conversations
or
booing
before
during
or
after
each
speaker.
Please
refrain
from
talking
in
the
audience
during
the
meeting.
A
If
you
have
supporting
documents
you
wish
to
have
displayed
during
the
meeting,
you
must
provide
them
to
the
city
clerk
and
they
become
part
of
the
permanent
record
citizens.
Comments
portion
of
the
meeting
is
not
intended
to
be
a
question
and
answer
session.
This
is
for
citizen
comments.
Only
council
members
should
refrain
from
answering
impromptu
questions
or
debating
issues
with
members
of
the
public.
Now
I
I,
as
I
stated
at
the
moment,
we
are
only
going
to
take
public
comments
on
agenda
items
that
are
on
today's
agenda.
A
Only
and
I
I
know
there
are
people
here
who
wish
to
speak
about
a
specific
project.
Please
understand
that
comments
that
are
received
may
not
be
considered,
as
this
is
not
the
quasi-judicial
hearing
for
that
agenda
item,
which
is
on
April
19th
with
that
said,
and
we
do
not
allow
signage
in
the
room
by
the
way.
Thank
you,
okay,
sir.
Please
go
ahead.
You
have
three
minutes.
A
D
D
A
E
A
G
G
We
need
tax
revenue
and
I
think
that's
been
the
driver
all
along
with
us,
but
along
with
that,
I
think
you
kind
of
have
your
heads
in
the
sand
on
this
or
two
because
there
there
are
costs
dissociated
with
that
tax
tax
revenue,
it's
called
services
and
I.
Think
the
example
today
I
want
to
bring
out
is
in
consented
agenda
item
5D,
which
is
the
allocation
of
a
revolving
fund
for
81
million
dollars.
G
G
Okay,
thank
you
again.
81
million
dollars,
one
of
the
biggest
biggest
projects
who
pays
for
it.
Well,
it's
kind
of
Hidden
Away
too,
because
it's
not
in
not
in
our
budget.
This
is
funded
by
a
by
the
utility
funded
meaning
and
along
with
impact
fees.
Obviously
impact
fees
have
now
covered
the
the
needs.
So
what
does
it
come
out
of?
Look
at
your
text.
Look
at
your
water
bill
and
look
at
the
increases
in
water
bill
for
how
many
years
well
the
citizens
here
be
paying
for
that,
and
why
is
it
it's?
G
A
A
I
I
H
And
good
morning
my
name
is
Kathleen
nantona
and
I'm.
John
Carlo's
wife
I
also
submitted
an
application
and
would
like
to
be
considered
as
an
alternate
for
a
member
of
your
Planning
Commission.
You
also
have
my
resume
on
on
your
file.
I
believe
I
have
extensive
background
working
with
the
federal
and
local
government
and
would
enjoy
serving
on
the
Planning
Commission.
Thank
you.
Thank
you.
A
A
I'm
going
to
come
down
to
the
the
main
Podium,
we
have
a
couple
of
proclamations,
we're
going
to
first
do
one
for
the
government
Finance
professionals
week
and
then
one
for
the
procurement
professionals
month,
foreign.
A
For
the
finance
Officers
Association
to
where
the
city's
finance
department,
whereas
the
Florida
government
Finance
Officers
Association,
is
a
professional
association
founded
in
1937
and
serves
more
than
3
300
professionals
from
state
county
and
City
governments,
school
districts,
colleges
and
universities,
Special
Districts
and
private
firms,
and
whereas
the
fgfoa
is
dedicated
to
being
a
professional
resource
by
providing
opportunities
through
education,
networking
leadership
and
information.
A
And
whereas
this
government
Finance
professionals
week
sponsored
by
the
fgfoa
and
all
of
its
member
or
governmental
organizations,
is
a
week-long
series
of
activities
aimed
at
recognizing
government,
Finance
professionals
and
the
vital
services
that
they
provide
to
our
state
and
community.
And
whereas,
during
this
week,
government
Finance
professionals
throughout
the
State
of
Florida
will
be
acknowledged
for
their
hard
work,
dedication
and
Leadership.
A
Now,
therefore,
the
city
council
of
the
city
of
Punta,
Gorda
Florida,
does
hereby
Proclaim
March
20-24
2023
as
Government
Finance
professionals
week,
and
extend
our
appreciation
to
all
government
Finance
professionals
throughout
the
state
and
here
in
Punta
Gorda
for
their
service.
Pastor
Julie,
adopted
in
regular
session
this
15th
day
of
March
2023
and
accepting
is
our
finance
director,
Kristen
Simeon.

A
Employees
are
members
of
the
Florida

of
public

Inc
Fafa

an
organization
established
in
1968,
which
is
focused
on
and
driven
towards,
education,
professional
development
and
agency
collaboration
and
cooperation
for

fappo
strives
to
provide
its

with
opportunities
to
advance
their
public
procurement
experience
in
order
to
convey
current
best
practices.
Industry
standards
and
Professional
Services
to
their
agencies
and
whereas
the
city
of
Punta
Gorda
desires
to
acknowledge
these
hard-working
dedicated
employees.
A
K
L
L
Government
Finance
officers
award
the
government
Finance
Officers
Association,
presents
a
certificate
of
achievement
for
excellence
in
financial
reporting
each
year
to
ones
that
earn
that
designation.
What
that
really
means
is
that
we
have
a
team
that
provides
accurate
and
complete
information
to
the
public,
it's
transparent
and
it's
presented
in
a
format.
That's
understandable
and
complete.
So
we're
very
proud
that
we
have
a
finance
department
that,
once
again
for
the
presentation
has
earned
the
certificate
of
achievement
for
excellence
and
financial
reporting
presented
to
the
city
of
Punta.
L
Gorda
Florida
for
its
annual
comprehensive
financial
report
for
the
fiscal
year
ended
September,
30
2021,
if
you've
ever
taken
time
to
look
at
the
annual
comprehensive
financial
report
other
than
make
your
head
spin
and
your
eyes
roll
back.
It's
got
a
lot
of
good
information
in
there
about
the
city.
It's
well
put
together
and
very
complete.
L
Almost
anything
you
want
to
know
about
City
finances
and
government
is
in
that
report,
so
we're
very
pleased
that
we're
able
to
again
earn
that
designation
through
the
efforts
of
our
finance
department
and
the
support
of
the
council
for
the
information
that's
put
in
there
and
would
like
to
recognize
them
for
that
award.
Today.
Again,
our
finance
director,
Kristen
Simeon
I,
don't
have
the
physical
word
here,
but
if
again,
you
would
like
to
say
anything.
L
I
can
give
you
the
piece
of
paper
that
that
represents
that
award
between
our
finance
department
and
our
procurement
that
we're
recognized.
Today.
We
not
only
account
for
all
the
money,
that's
allocated
through
the
various
City
departments
and
operations,
but
then
also
spend
it
through
the
procurement
department,
so
two
very
important
departments
to
recognize,
and
we
appreciate
all
the
hard
work
that
goes
into
both
of
those
operations.
J
Kristen
Simeone
again
I
want
to
thank
our
and
recognize
our
finance
team.
Again,
it's
a
all
year.
Effort
I
also
do
want
to
recognize
dick
Branch,
who
is
the
lead
on
preparing
the
annual
comprehensive
financial
report
as
well
as
George,
Sparks
and
Linda
fan
still,
who
do
a
lot
of
analysis
and
put
a
lot
of
effort
into
the
discussion
that
is
in
the
the
book.
So
thank
you.
Thank
you
Christian.
Thank
you
all
for.
M
This
is
a
legislative
public
hearing
by
resolution
which
I'll
read
by
title.
Only
a
resolution
of
the
city
council
of
the
city
of
Punta
Gorda
Florida
vacating,
a
15-foot
wide
easement,
as
described
in
official
record
book
774
Pages
649-650
Charlotte,
County
public
records
and
lying
in
section
21,

East,
Charlotte,

Florida
and
further
bounded
and

in

Incorporated
herein

N
Hand
and
Zoning
official
so
we'd
like
to
enter
our
staff
report
into
the
record
by
reference
in
its
entirety.
This
is
an
easement
vacation.
It's
a
15-foot
utility
easement,
it's
approximately
6,
900
square
feet
give
or
take.
It
is
required
for
the
proposed
seagrass
subdivision
development.
All
the
existing
lots
and
plants
were
previously
vacated
in
2021,
so
all
of
the
appropriate
utilities
have
been
notified.
We've
received
no
comments.
This
is
the
area
you
can
see
on
the
screen.
The
little
highlighted
blue
area
of
the
easement
location,
the
brown
area
around.
N
L
And
if
I
can
just
comment,
both
of
these
public
hearings
have
previously
come
to
council
for
an
intent
to
vacate,
so
obviously,
you've
seen
them
before
went
back
to
Planning
Commission
and
came
back
now
for
final
approval.
Their
old
easements
that
have
previously
been
planted
now
that
whole
subdivision
is
being
replatted
and
they're,
not
necessary.
A
A
P
A
M
Yes,
this
too
is
a
legislative
matter,
public
hearing
resolution
which
I'll
read
by

Only
a

of
the
city

A
A
Q
O
A
Have
a
motion
in
a
second
to
approve
sv-04-2022,
all
those
in
favor,
please
signify
by
saying
aye.
Aye
opposed
motion
carries
unanimously.
Okay.
Next,
we
have
the
consent
agenda.
This
includes
the
approval
of
minutes
from
the
March
1
meeting
invoice
for
icard
Merrell.
The
resolution
authorizing
The
Joint
meeting
with
the
board
of
County
Commissioners
next
week,
a
resolution
amending
the
resolution
3686-2022
for
the
wastewater
treatment
plant,
The
Joint
habitat
support
letter
and
the
2024
cops
hiring
Grant.
Any
one
would
pull
anything
from
that
agenda,
move
to
approve
consent,
agenda.
F
A
A
L
Need
to
be
raised
so
that
we
can
continue
with
the
process
of
committee
and
determining
what
the
future
use
of
that
site
will
be.
Along
with
that.
We
had
the
lease
for
the
bay
front
center
that
not
only
had
the
YMCA
and
all
the
subsequent
events
that
were
put
on
there,
but
also
a
requirement
in
that
lease.
The
city
required
that
the
lecee
provide
storage
space
for
learn
to
sail
so
with,
of
course,
the
demolition
of
that
building,
that
storage
space
is
going.
L
The
city
has
a
vested
interest
in,
of
course,
providing
some
level
of
storage
for
that
operation,
given
that
Not
only
was
it
in
the
lease.
The
YMCA,
of
course,
has
moved
to
Cooper
Street,
but
there's
nowhere
for
learn
to
sell
storage,
to
move
not
only
in
the
lease,
but
also
because
they've
been
given
permission
to
expand
operations
put
in
the
ramp
and
there's
a
lot
of
interest,
especially
from
their
presence
at
the
farmers
market,
to
continue
that
operation
and
enhance
the
level
of
service
as
they
provide.
L
Given
that
and
given
several
options
that
were
evaluated,
including
on-site
trailers
and
everything
else
that
were
less
palatable
and
actually
not
allowed,
the
dumpster
enclosure
became
the
primary
focus.
It
is
given
some
upgrades
to
the
enclosure
itself.
It
already
has
the
three
sides:
the
hurricane
ripped,
the
whole
front
off
of
it,
so
that
being
replaced
and
covered
would
provide
a
level
of
storage
that
was
acceptable.
L
When
looking
at
all
the
options
and
running
it
through,
of
course,
Urban
Design
to
review
and
evaluate
this
was
the
least
obtrusive
the
quickest
and
the
least
expensive.
To
make
this
happen
on
a
temporary
basis.
What's
before,
you
today
is
to
approve
the
concept
so
that
it
can
move
forward
and
we'll
have
to
then
further
solidify
that
with
an
agreement
that
specifies
the
understanding
that
it's
a
temporary
solution.
C
I
have
a
few
comments
on
this.
I
have
some
issues
in
looking
at
this
and
just
kind
of
getting
ramped
up
on
it.
I
was
made
aware
that
this
dumpster
that's
actually
in
there
was
not
Bay
fronts.
It's
the
boat
clubs
and
there's
no
need
for
that
dumpster
to
be
on
that
property.
That
dumpster
needs
to
be
moved
to
the
boat
club,
it's
their
dumpster,
so
they
can
access
their
dumpster
there.
C
That
enclosure
needs
to
be
used
specifically,
for
you
know
if
we
decide
to
move
forward,
to
use
it
for
storage
space,
I
have
no
problem
with
that,
but
that
dumpster
needs
to
be
moved.
That
is
not
a
bay
front.
Dumpster!
It's
a
boat
club
dumpster
needs
to
go
back
to
boat
club
and
they
need
to
take
care
of
it
on
their
property.
C
A
couple
issues
with
that
is
number
one.
If
we
do
move
forward
with
the
storage
and
it's
going
to
be
locked
is
my
impression
now
you're
going
to
have
an
issue
where
you
have
different
things
stored
there
and
if
you
have
a
dumpster
in
there
now
it's
a
liability.
If
two
people
have
keys
and
if
somebody
gets
in
there
and
things
go
missing,
I
just
believe
it
muddles.
Everything
I
think
that
now
that
we're
looking
at
this
and
Bayfront
is
no
more.
We
need
to
have
that.
F
So
I
have
two
comments:
I
was
approached
by
the
bay
front
center
or
excuse
me
by
the
boat
club
as
well,
because
they
were
concerned
about
what
was
going
to
happen
to
their
dumpster.
My
understanding
is
that
it's
now
going
to
be
relocated
adjacent
to
that
facility,
and
that
was
agreeable
to
everyone
that
was
agreeable
to
City
staff.
That's
agreeable
with
the
The
Boat
Club,
so
I
personally,
don't
see
an
issue
with
that,
especially
if
everyone
else
is
in
agreement.
I
do
think,
though,
that
we
ought
to
consider
some
kind
of
trash
collection.
F
You
know
City
trash
collection,
because
if,
if
people
are
coming
off
of
those
the
dinghy
docks
and
wherever
else
and
using
a
dumpster
that
really
shouldn't
be
used
for
that
purpose,
maybe
the
city
should
consider
providing
a
some
kind
of
a
can
or
something
that
we
collect
on
a
regular
basis.
That's
not
the
boat
clubs.
F
L
A
I
would
like
to
see
some
kind
of
a
written
agreement
that
allows
the
boat
club
to
use
that
space,
because
that
is,
city,
property
and
the
bay
front
center
is
owned
by
the
city.
Even
if
there's
not
going
to
be
a
structure
there,
that
is
city,
property
and
I,
think
we
need
to
have
something
in
writing
that
confirms
that.
C
I
I
respectfully
disagree
I
believe
that
now
that
we're
going
through
different,
obviously
the
city
is
changing
and
the
whole
Speck
of
Bayfront
has
changed.
The
dumpster
is
boat
club
and
the
enclosure
is
not
and
I
believe
that
that
dumpster
needs
to
be
moved
back
on
their
property
and
we
need
to
start
looking
at
things
and
revamping
I
I've
been
hurt.
I've
been
told
that
that's
the
way
it
was
always
done.
I,
don't
think
that's
a
viable
solution.
I
think
that
it'd
be
the
same.
C
If
you
have
any
other
property
that
all
of
a
sudden,
a
dumpster
has
been
put
on,
I
think
it
needs
to
be
back
to
where
that
I
think
everybody
needs
to
start
looking
at
different
things
and
and
the
way
it's
done
needs
to
be
done
properly
and
I
think
the
dumpster
needs
to
be
moved
back
to
the
Oakland.
Q
Donna
I
tend
to
agree
with
Melissa
as
I
understand
at
the
boat
club.
Just
put
the
dumpster
there
I
don't
think
it
was
a
An
approved
dumpster.
They
are,
you
know
they
are
all
Swan
city
property.
I
would
think
they
would
want
a
dumpster
that
aligns
with
their
facility
and
I.
Think
that's
where
it
should
be.
C
What
well
I
will
go
forward
as
make
a
motion
that
I
would
like
to
see.
I
don't
know
if
it's
if
it's
appropriate,
because
it's
is
an
agenda
item
or
not
Mr
Levin.
But
if
we
need
emotion,
I'd
like
to
make
a
motion
that
the
boat
club
moves
that
dumpster
back
onto
their
property
and
then
we
can
move
forward
to
talking
about
the
enclosure.
Part
of
it.
A
We
have
a
motion
and
a
second
to
relocate
the
boat
club
dumpster
to
boat
club
property
and
that
will
open
up
the
space
for
the
learn
to
sail,
to
use
that
garbage
hide
area
for
storage,
correct,
correct.
Okay,
all
those
in
favor,
please
signify
by
saying
aye,
aye
aye
opposed
opposed
motion
carries
three
to
two
okay.
C
A
R
Karen
Smith
City
Clerk,
first
for
the
boards
and
committees,
we
still
have
some
vacancies
code
enforcement
board.
We
have
two
regular
seats
and
two
alternates
historic
preservation:
Advisory
Board.
We
have
two
alternates,
the
Planning
Commission.
We
have
one
alternate
and
Punta
Gorda
Housing
Authority.
We
have
two
seats
and
the
next
item
is
nominations.
R
R
Okay,
that's
all
I.
Have
then
oh
actually
one
other
thing
we
need
to
I.
Think
we
did
not
resolve
was
the
representative
for
the
regional
planning,
Council
I
had
researched
that
and
it
is,
it
does
have
to
be
an
elected
official,
so
we
will
need
to
have
someone
serve
on
that
on
that
board.
I,
don't
know
if
council
member
dreyberg
is
able
to
continue.
O
R
L
I
just
want
to
do
you
say
thank
you
again
for
supporting
the
efforts
we
have
and
clean
up
with
the
city,
we're
still
trying
to
move
forward
with
several
things
and
coordinate
with,
for
example,
FPL
for
street
lights,
we're
moving
forward
on
our
permitting
system.
Of
course,
we've
brought
on
additional
Personnel,
so
we're
staffed
more
than
with
temporary
Personnel.
More
than
normally
we
are,
we've
still
had
over
4
000
permits
right
now
that
we're
working
through
so
we're
trying
to
get
those
processed.
L
Those
are
for
processed
family,
including
the
screen
includes
screen,
enclosure,
grooves
and
other
building
permits.
So
we
are
getting
there,
we're
starting
to
we're
down
we're
starting
to
put
in
some
of
the
electronic
processes
so
that
we
can
have
online
permitting
and
moving
forward,
say
that
overall
it'll
be
a
more
efficient
process
at
the
end
of
the
day.
O
I
just
noticed
that
when
we
went
to
all
those
events,
especially
to
Senator
Pasadena,
we're
the
only
ones
there
that
didn't
have
some
sort
of
a
pen
recognizing
the
fact
that
we
were
elected
city
council,
so
I
got
with
Greg
I
got
with
our
city
clerk
and
they
kind
of
agreed
us
something
to
do
and
think
to
Melissa.
She
just
did
an
outstanding
job,
and
so
they
are
there
I'd
kind
of
like
to
have
Greg,
pin
yours,
and
then
you
could
pin
the
rest
of
us
all
right.
A
J
A
M
You
want
to
now
open
it
up
for
public
comment,
but
it
may
be
necessary
to
cut
that
public
comment
short
and
I'm
just
again
expressing
for
the
record
that
the
law
section
286.0114,
Florida
Statutes,
does
only
give
a
right
to
be
heard
on
public
hearings
and
the
matters
that
are
on
an
agenda.
Thank
you.
A
Okay,
thank
you
city
clerk.
Anything
additional,
okay,
I
do
have
a
couple
of
things.
Next
week
we
do
have
a
special
city
council
meeting,
which
will
be
on
Tuesday
morning
at
11
A.M
in
this
room,
and
the
reason
for
that
is
because
we
do
not
have
a
meeting
the
first
week
of
April
due
to
all
the
council
members
that
are
going
to
be
in
Tallahassee
for
legislative
days,
so
we
have
a
council
meeting
at
11
and
then
the
board
of
County
Commissioners
joint
meeting
at
2
pm
in
the
Murdoch
Administration
Center.
A
So
anyone
who
wishes
to
attend
those
they're
both
open
to
the
public,
yes
and
the
agenda
is
online
for
for
the
meeting
with
the
County
Commissioners.
There
are
several
items
of
interest
that
will
work
cooperatively
with
the
County
Commissioners
on
various
projects
that
will
be
discussed
that
day.
Okay,
council
member
comments,
Mr
kaharski.
H
A
Mr
driver
nothing,
Ms,
Lockhart,
nothing,
Ms,
Peterman,
nothing,
okay.
We
will
then
open
up
the
floor
for
public
comments.
You
will
have
three
minutes.
Please
state
your
name
for
the
record.
Please
come
and
please
line
up.
So
we
can
keep
this
moving
because
we
do
have
20
minutes
left
and
we'll
take
comments
up
through
and
including
9
30,
and
then
we
will
adjourn
go
ahead.
S
Pat
Manuel's
concerned
voting
resident
I
had
something
else.
I
was
going
to
talk
about.
It
was
going
to
talk
about
Saturday's
get-together
with
smart
growth
and
what
they
did
in
our
community.
S
S
T
A
Are
rules
in
this
condo
in
this
chamber,
rules
of
conduct-
I
am
listening.
I
am
not
disrespecting.
Anyone
I
am
totally
listening
to
what
you're
saying
I'm,
trying
to
sign
all
the
documents
that
have
to
be
signed
before
I
leave
today,
so
I'm
doing
what
I
have
to
do
and
I'm
listening
to
you
and
please
don't
just
respect
the
council
members
when
you're
in
this
chamber
this.
S
J
A
Am
not
disrespecting
anyone,
yes,
I
am
listening
to
everyone
and
everything
that
you're
saying
I've
listened
to
everything
you
just
said
about
the
the
thing
that
happened
on
Saturday
I've,
listened
to
everything,
you've
said
no
one
is
disrespecting
or
ignoring
you,
and
please
just
keep
your
comments
to
what
you
came
here
to
say.
Well,.
S
S
S
There
are
going
to
be
people
here
that
seriously
are
going
to
be
affected
by
what
you're
doing
here
and
I'm
going
to
make
one
last
thing
and
then
I
will
sit
down.
Maybe
I'm
going
to
be
the
only
one
coming
I
guess,
not
the
only
one
coming
up
here,
but
I
personally,
don't
care
what
other
meetings
you
have
to
cut
our
city
council
meeting
short
today,
I!
Don't
care
if
you're
late
going
to
that
meeting,
I,
don't
care
any
more
I
used
to
care.
S
E
My
name
is
Dr
Deborah
Lutz,
United,
States
Navy.
Let's
just
talk
about
zoning.
The
entire
Fisherman's
Village
proposal
is
based
off
of
it
being
rezoned
from
professional
office
space
to
professional
development
neighborhood
without
even
being
approved.
In
addition,
its
calculations
are
being
based
off
of
having
West
red
up
Pitman
and
Alice
Street
vacated.
Why
would
we
even
give
up
any
of
our
streets
for
argument's
sake?
Fish
still
wants
to
compare
itself
to
posidia,
Dussel.
Sorry,
I'm
saying
that
wrong.
E
The
building
was
built
in
the
80s
and
it's
the
only
building
in
the
city
at
six
stories.
Official
proposes
six
seven
and
eight
stories,
not
two
stories.
Above
this,
this
property
has
around
one
and
a
half
acres
with
one
building
on
it.
Fishville
has
around
three
acres
with
19
buildings
on
it
nine
times
more
buildings.
The
closest
setback
of
this
building
to
Marion
Street
is
approximately
143
feet.
Fish
fill
is
around
18
feet.
The
official
building
is
125
feet
closer
to
the
street.
It's
density
is
3.5.
E
Du
official
inaccurately
states,
it's
15.9
EU
at
at
least
five
times
more
dense.
It's
several
blocks
away
from
the
post
site,
not
within
200
feet,
so
by
no
means
is
visually
incompatible
to
this
building,
nor
any
of
the
other
one
to
four
story.
Buildings
that
are
actually
within
the
200
feet
do
not
Grant
PDN.
Zoning
here
are
a
few
requirement
violations.
6.4
no
power
provided
in
connection
with
any
building
shall
be
included
as
meeting
the
requirements
for
any
other
building.
This
means
fishville
cannot
use
existing
buildings
to
calculate
its
height
and
density
6.7.
E
These
regulations
shall
be
met
for
each
structure
as
we're
on
its
own
individual
separate
lot.
This
means
each
building
on
its
own
must
meet
the
requirement
to
be
built
higher
and
have
more
density.
The
proposed
buildings
do
not
meet
these
requirements.
Besides
the
hotel,
none
of
the
other
18
buildings
meets
the
requirement
of
section
5.3
M,
which
is
a
maximum
of
60
feet.
E
Therefore,
the
height
limit
for
the
proposed
building
is
35
feet.
This
makes
the
building
a
maximum
of
around
55
feet
with
BFE
and
rooftop
editions.
Posse
1.1.14.4
permits,
residential
densities
can
be
increased,
provided
25
percent
of
the
project
is
commercial.
Again
official
cannot
use
existing
commercial
space
to
calculate
this.
We
are
not
a
community
that
uses
bicycles
at
an
alternate
mode
of
transportation.
E
Do
we
bicycle
for
recreation?
Yes,
going
to
work
or
shopping?
No,
even
in
this
cold
did
any
of
you
bike
here.
Could
you
imagine
biking
In,
the
Heat
of
rain?
We
are
not
an
urban
city
parking
in
traffic.
I.
Don't
even
have
enough
time
to
go
into
this,
but
I'm
sure
every
one
of
you
know
this
will
be
a
nightmare
one
way
in
and
out
of
a
two-story
parking
lot
on.
A
narrow,
heavily
pedestrian
street
won't
cause
issues.
E
There
isn't
even
enough
parking
proposed
what
happens
if
there's
an
accident
or
emergency
look
at
all
the
accidents
that
already
occur
right
outside
fishville,
the
chapter
26
rules,
LDL
regulations
and
zonings
were
made
for
a
specific
reason
here
in
Punta
Gorda
Don't
Go
Changing,
all
this
just
to
have
development
in
the
lots
for
City,
Center
and
fishville.
This
seems
to
play
favoritism
to
the
Developers
for
these
two
areas.
Let's
keep
Punta
Gorda,
Hometown,
waterfront
property.
Sorry
I
talked
fast
I
know,
I
had
three
minutes.
B
My
name
is
Mike
Polk
and
I'm
here
to
speak
about
the
Fisherman's
Village
rezoning
I
couldn't
understand
why
Fisherman's
Village
was
requesting
a
zoning
change
to
office
for
proposed
development
that
contains
minimal
office
space
and
is
predominantly
multi-family.
Then
I
looked
at
the
floor
area
ratios
for
the
two
zonings
and
quickly
understood
office.
Development
allows
for
a
four-year
ratio
of
2.0,
which
equates
to
a
200
percent
coverage
ratio,
while
General
multi-family
would
allow
only
a
coverage
ratio
of
55
percent
staff
has
given
preliminary
approval
for
a
zoning
change
to
office
for
a
project.
B
That's
predominantly
multi-family,
with
basically
no
office.
That
sounds
arbitrary
to
me.
This
would
allow
a
density
for
two
for
the
two
primary
multi-family
sites.
That
is
more
than
three
times
the
current
density
under
existing
zoning.
You
have
one
chance
to
get
this
right.
Do
you
want
to
be
proactive
or
reactive,
Sun
Seekers
across
the
river,
provides
you
a
preview
of
what
to
expect
on
Marion
Avenue.
If
you
approve
the
fisherman's
Bill
Bill's
Redevelopment
at
its
current
density,
the
Charlotte
County
Commissioners
are
now
asking
son
the
sun
Seeker
developers.
B
How
are
they
going
to
mitigate
the
traffic
increase
from
the
development
now
that
its
first
phase
is
nearing
completion?
That's
a
little
late,
Sun
Seekers
is
also
having
staging
problems
with
the
construction
and
parking
for
workers
and
have
to
and
have
had
to
acquire
over
10
million
dollars
in
additional
properties
across
US
41
from
the
project
for
the
workers
to
park.
Imagine
how
difficult
it
will
be
to
Stage
the
Redevelopment
of
Fisherman's
Village
at
the
proposed
density
in
a
residential
neighborhood.
B
While
they
try
to
continue
to
operate
the
retail
Center
and
the
marina
the
developers
had
the
site
since
2016
and
now,
seven
years
later
he
is
finally
getting
the
property
rezoned
and
a
PD
approved
before
the
new
ldrs
go
into
effect.
If
you,
if
you
do,
allow
the
rezoning
to
office
and
plan
development
and
the
independent
development
is
approved
at
the
requested
density
developers,
property
rights
will
vest
and
he
will
have
standing
for
potential
litigation
in
the
future.
B
In
regards
to
the
real
estate
to
the
Retta
Esplanade
vacation,
you
are
taking
the
only
access
to
the
sunset
breezes
condominium
and
it's
not
a
simple
vacation,
but
is
it
is
taking
up
their
access
and
you
will
be
liable
for
damages.
Please
leave
the
meeting
today
and
Drive
by
Sun
Seekers
and
take
a
long
look,
because
that's
what
we're
going
to
have
on
Marion
Avenue
to
condemn
with
thank
you.
P
Good
morning,
Kathleen
Davis,
Punta,
Gorda
iOS
I
first
would
like
to
commend
you
for
your
extreme
diligence
and
agenda
items.
3A
and
3B.
Where
you
took.
You
are
vacating
easements,
which
are
our
property.
You
know
all
of
our
property
and
you
this
has
been
going
on
for
a
while.
You
listen
to
all
kinds
of
there's
all
kinds
of
requirements.
You
had
to
go
through
the
property
owners,
the
which
is
partially
us
as
well.
P
Everything
had
to
be
properly
done,
and
you
guys
have
done
this
in
an
extremely
diligent
and
really
go
in
the
extra
mile.
So
when
vacating
Rada
and
Pittman
Park
I
just
would
ask
that
you
give
the
owners,
which
are
us,
your
ex
the
same
diligence
and
the
same
care
in
vacating
our
property,
to
give
it
to
a
developer.
Thank
you.
So
much.
T
Good
morning
City
Council,
my
name
is
Janine
Polk,
say
hi
to
Ron.
For
me,
if
you
see
him
later,
I'm
a
resident
of
downtown
Punta
Gorda,
my
children
are
sixth
generation
Punta
gordians,
my
grandchildren,
God
willing,
will
be
the
seventh
generation
point
of
gordians,
and
with
that
in
mind,
I
would
like
for
you
to
focus
on
the
recent
and
soon
to
be
submitted.
Developments
that
these
high-powered
attorneys
and
land
use
experts
insist
must
include
80
to
100
foot
buildings
in
order
for
their
development
to
be
feasible.
T
Furthermore,
buildings
within
three
miles
of
salt
water
must
perform
a
milestone:
inspection
by
December
31st
of
the
year
they
reach
25
years
of
age
and
every
10
years
after
that,
the
bill
goes
on
the
state.
The
legislature
finds
that
maintaining
the
structural
Integrity
of
a
building
throughout
its
service
life
is
of
Paramount
importance
in
order
to
ensure
that
buildings
are
structurally
sound
so
as
to
not
pose
a
threat
to
the
public
health
safety
or
welfare.
T
The
questions
you
need
to
ask
yourselves
before
approving
these
building
Heights
is.
Why
would
this
bill
require
such
in-depth
Milestone
inspections
of
buildings
over
three
stories?
Could
it
be
that
these
80
to
100
foot
buildings
might
be
a
detriment
to
the
people
who
live
in
the
city
of
Punta,
Gorda,
say
30
40
50
years
from
now,
because
that's
a
question:
I?
Am
any
citizens
like
me
with
their
children
and
grandchildren
growing
up
in
the
city,
Upon
A,
Gorda
Ponder,
these
buildings
are
simply
not
sustainable.
T
These
projects
will
not
have
a
net
positive
impact
on
our
community
in
the
future.
Most
likely
the
developers
will
be
long
gone
before
the
first
Milestone
inspections
occur,
but
chances
are
my
children
and
their
children
will
still
be
here.
Please
consider
SB
154
when
voting
on
future
projects.
Thank
you
thank.
U
Hi,
my
name
is
Debbie
Wilson
I
live
on
West,
Marion
and
I.
Don't
have
any
written
comments
to
make
to
you
today,
but
this
I
bought
that
home
in
February
of
1996
and
I
have
lived
in
it
all
these
years.
I
bought
on
a
main
street,
but
there
has
never
been
as
much
traffic,
including
construction
equipment,
huge
trucks
barreling
down
what
is
a
30
mile,
an
hour
road.
U
It
is
so
loud
that
I
can't
keep
my
windows
open,
because
I
can't
hear
myself
think
in
the
house
with
all
the
traffic
yesterday.
Not
only
did
I
see
one
car
go
the
wrong
way
on
Marion
I
saw
someone
turn
left
from
the
right
hand,
lane
and
smash
into
someone.
Of
course,
I
heard
it
I
came
out.
No
one
was
hurt,
it
happens
all
the
time.
It's
already
out
of
control.
Add
these
structures
to
the
only
road
that
goes
to
them
and
you
are
causing
immense
damage
to
our
city.
Thank
you.
Thank.
A
V
Hi
Jeff
lustig
I
wanted
to
commend
a
police
officer
of
the
Punta
Gorda.
His
name
is
Officer.
Veteran
I
witnessed
him
yesterday
at
the
court.
He
was
incredibly
professional.
It
was
a
DWI
case.
V
I've
witnessed
50
to
100
of
trials
that
any
member
of
the
public
can
go
to
his
professionalism
and
how
he
handled
the
traffic
stop
was
exempl,
exemplary
and
I.
Think
it's
great
that
the
City
staff
has
found
a
way
to
hire
three
more
police
officers
with
a
five
hundred
thousand
dollar
Grant.
V
We
ask
our
police
officers
to
do
a
lot
of
things,
especially
dealing
with
the
homeless
population.
Anyone
can
be
homeless,
I'm
an
example
of
that
as
a
battered
spouse,
I
was
had
to
go
to
a
homeless
shelter
to
seek
protection
from
drug
dealers
that
my
wife
was
seeing
and
spending
money
on.
V
I
think
if
the
city
staff
could
also
look
for
grants
for
in
a
social
service
workers
to
help
the
police,
a
large
number
of
police
calls
are
generated
from
a
very
few
individuals
who
are
permanently
homeless
and
it
may
be
cost
effective
to
have
social
service
workers
Target
these
chronically
homeless
people,
so
that
the
police
officers
are
able
to
use
the
resources
elsewhere.
Thank
you
very
much.
