plants

they

garden

Well,
the
education
pavilion
is
part
of
our
management
plan
through
the
Department
of
Environmental
Protection.
They
oversee
this
project
and
because
of
the
prompt,
the
way
that
the
area
has
been
maintained,
we
are
now
on
a
five-year
review
process
rather
than
an
annual
inspection
of
the
area,
so
we
will
be
seeing
them
in
five
years.
We've
just
had
our
last
approval
rating
and
they
expanded
that
inspection.

of
the
paths
will
be
a
DA
compliant,
which
is
something
we
have
a
little
bit
of
trouble
with
in
the
phase
one
area
we
are
currently
fixing
that,
with
the
implementation
of
the
furniture,
we
will
now
have
a
DA
compatible
areas
for
people
to
use.
So
it's
big
improvement
in
that
phase,
one
section
and
we'll
carry
that
from
the
very
beginning
and
faced
ok.
This
is
area
two
phase,
one
but
area.

phase,

on
phase
two
of
the
project
will
involve
additional
gardens,
as
additional
paths
get
put
in
we're.

looking
as
part
of
that
education
component
and

educational
shelter

drop-off
point

the

They'll
come

Center
crosswalk
connections
are
going
to
be

section

key

heavily
traveled
by

walkers
on
a

ability

them
to
cross
safely
at

Marino

area.

will
be
a
big
improvement
and
again.
Safety
issue
is
a
concern,
we'll
go
ahead
and
do
some
breaking
or
some
brick-like
feature
in
the
roadway
with
that
slow
down
a
traffic,
so
they
are
aware
of
the
pedestrian
crossing
and
again,
all
of
this
will
be
a
DA
compatible.

improve

upland
gardens
as

the
sidewalk
completion
along

on
Monday
of
this
week,
and
that
lasts
about
almost
little
bit
more
than
five
hours
after
that
deposition.

conclusion
was
that
it
hears
that
the
methodology
that
our
expert
utilized
in
order
to
ascertain
whether
the
proposed
amendments
at
the
potential
of
adversely
impacting
the
water
quality
and
water
quantity

shale
Creek
were
agreed
to
be
acceptable
and
appropriate
by
the
witnesses.
The
witness
for
the

disagree

impact

an

speaking,
are
intended
to
prevent
adverse
impacts
to
water
quality
and
quantity

shale

I
think
we're
on
were
on
the
right
track.

the
hearing,

I've
mentioned
in
the
past,
the
attorneys
get
the
transcript
and
pick
out
from
the
transcript

evidence

supports
its

it
makes

legal
argument

judge

case
is
that
these
permits
will
have
been
in
existence
for
approximately
ten
years
when
the
request
for
extension
is
made,
and
we
should
have
an
opportunity

question

permits
and
the
extension
of
the
permits
at
that
time
to
determine
whether
or
not
the
permit
in
in
its
original
form
what
met
the
requirements
of
the
law
so
that
there
wouldn't
be
an
impact
to
shale
Creek
and
certainly
under
today's
regulations.

difficult

county
is
saying
is

DEP

Swift
mud
oversees
this

good
enough
for
them,

saying

a
very
stringent
process
to
go
through
Swift
mud
and
dep,
but

What
I'm
gathering
from
you
is
that

in
our
expert.

case

this
is
a
unique
case
in
that
we
are
attacking
the
amendment
to
the
comprehensive
plan.
Utilizing
the
statute
that
dictates
how
comprehensive
plan
amendments
can

challenged
and
it's
very
narrow
in
what
scope
of
challenge
we
can
launch
and
one
of
them
and
the
one
that's.
The
primary
argument
in
our
case
is
that
the-
and
this
is
requirement,
the
statute,
that
the
proposed
amendment
must
not
be
inconsistent
with
other
provisions
of
the
county's
comprehensive
pant
and
at
kylies.

Comprehensive
plan
has
quite
a
number
of
provisions
that
are
intended
to
protect
the
city's
drinking
water
are
intended
to
protect
the
natural
environment
in
general
and
the
quantity
and
quality
of
water
in
shelf
in

shale

watershed

it's

of
the
work
that

Kincaid
has
done
and
is
his

other

amendments

before
they
adopted
the
comprehensive
plan
amendment
that
was
supposed
to
be
supporting
those
regulations
and
I
think
that
it's
not
beyond
the
realm
of
legal
argument
that
administrative
law
judge
in
our
case
would
not
find
at
least
somewhat
persuasive
a
decision
of
another
administrative
law
judge
same
agency
from
years
ago.

share

done
a
very
cursory
internet
during
the
break
and
found
out
that
this
is
not
an
unusual
problem
for
other
communities

relative
to
the

shale

and
the
protection
of

rights
of
the
city
towards
that
I
just
want
to
tell
David
that
I'm
behind
you
I
realized
that
these
are
not
gold
mines
and
iron
mines.
We
have
cyanide
and
arsenic
issues
that
we
have
to
deal
with,
and
the
impact
is
a
mathematical
issue
that
could
always
be
up
for
debate,
but
I
think
that
there's
a
principle
that
is
being
pursued
here
that
is
certainly
worthwhile.

just

share
that
comment
with
me,
so
that
you

where
I
stand
