thank
you
and
good
evening.
As
the
City
Council
knows,
the
code
enforcement
program
is
a
complaint
driven
program
that
primarily
responds
to
building
code
as
well
as
nuisance
violations
within
the
city.
One
such
violation
that
we
started
to
get
complaints
about
several
years
ago
was
at
50
to
San
Felipe,
which
is
the
subject
of
this
report.
It
was
a
case
that
involved
overgrown
vegetation
neighbor
worst
neighbors
were
complaining
that
the
vegetation
was
beyond
the
legal
limits
and
also
trash
and
debris
was
starting
to
accumulate
in
the
front
yard.

We
started
as
we
normally
did
a
sending
a
notice
to
the
property
owner
who
actually
does
not
live
at
the
home,
but
owns
a
second
home
in
San
Bruno
on
Cypress.
Unfortunately,
the
property
owner
did
not
respond
to
that
notice,
nor
second
and
third,
by
notices
that
included
citations
in
all
the
property
owners,
receive
six
notices
and
has
not
respond
to
any
of
them.

It
is
very
rare
that
someone
doesn't
respond
to
these
or
the
citations,
but
it
did
when
it
does
get
to
a
point.
The
city
does
have
the
option
to
abate
the
nuisance
with
city
crews
or
with
city
contractors.
We've
only
done
this
three
times
in
the
past
three
years.
The
first
time
was
a
home
on
acacia
that
we
spent
several
thousand
dollars
on
including
two
abatements,
as
well
as
a
number
of
fines
and
code
enforcement
time.

Fortunately,
in
that
case,
a
court
had
appointed
a
receiver,
because
the
property
owner
was
not
found
fit
to
handle
all
everything
associated
with
the
property,
and
the
city
eventually
got
their
money
when
the
home
was
sold
in
an
escrow.
We
received
those
funds.
In
this
case,
the
property
owner
did
not
respond
to
our
notice
to
abate.
So
we
did
hire
a
landscape
contractor
who
went
out
they're
about
a
year
ago
and
abated
the
nuisance,
remove
the
vegetation,
as
well
as
the
trash
and
debris
from
the
front
yard.

The
next
step
is
to
basically
send
something
called.
It
is
basically
a
invoice.
A
statement
of
claim
is
that
is
the
legal
name
that
outlines
everything
that's
owed
to
the
city.
In
this
case,
there
refines
that
were
owed
to
the
city,
the
actual
abatement
costs,
as
well
as
code
enforcement
oversight
related
to
that
abatement.
Cost
came
out
to
about
three
thousand
dollars.
Once
again,
the
property
owner
did
not
receive
in
this
case.
We
also
in
a
number
two
times.
In
fact,
we've
stopped
by
the
home
on
Cyprus,
and
they
were
not
home.
They
were
not.

They
did
not
answer
the
door
there
as
well
the
property
owner.
So
the
next
step,
when
someone
does
not
pay
the
abatement
costs
not
respond
to
notices
city
has
the
right
to
place
a
special
assessment
on
the
property
and
what
the
special
assessment
is
is
instructing
the
county
to
record
the
amount
ohs
and
that
would
the
city
would
get
paid
through
the
property
tax
bills
that
would
actually
see
it
on
the
property
tax
bills.
In
order
to
do
this,
you
need
to
adopt
two
resolutions.

In
this
case,
it's
about
a
dollar
30
per
parcel
and
it's
waived
if
it's
under
ten
dollars
total,
so
the
fee
would
be
waived
in
this
circumstance,
and
the
second
part
of
the
resolution
is
actually
for
placing
it
on
50
to
San
Felipe
that
the
total
amount
you'll
notice,
that
the
total
amount
is
not
the
three
thousand
dollars
that
was
billed
and
that's
because
we
cannot
recover
finds
through
the
special
assessment
process.
It's
not
allowed
by
state
law,
but
we
can
recover
the
actual
abatement
cost,
as
well
as
the
code
enforcement
oversight.
