San Bruno City Council Meeting November 9, 2010 10e. Increase Parking Fines

Good
evening
honorable
mayor
members
of
the
City
Council
Senate
bill
857,
the
courts
funding
trailer
bill
was
signed
by
the
governor
in
October
of
this
year.
The
bill
amends
the
current
government
code,
section
7602
0.3,
and
requires
an
additional
penalty
of
three
dollars
from
each
parking
violation
to
fund
the
new
trial
court
trust
fund.
The
city
was
recently
notified
by
the
county
that
the
additional
three
dollar
fee
per
citation
would
be
remitted
to
the
state
when
SB
857
becomes
effective,
December
7
2010
the
Department
issues
approximately
1,000
citations
a
month.

The
increased
monthly
expenditure
paid
to
the
fund
as
a
result
of
SB
857
is
estimated
at
3,000
dollars.
In
order
to
offset
the
increase
in
costs,
staff
is
recommending
that
the
City
Council
increased
the
fines
set
for
the
parking
violations
by
three
dollars
for
each
violation.
The
Vehicle
Code
provides
the
council
with
the
authority
to
do
so
and
to
set
the
parking
violation.

We
are
not
alone
in
this
request,
as
several
cities
within
San
Mateo
County
and
around
the
state
are
taking
similar
actions
and
asking
their
local
governing
boards
to
raise
finds.

The
last
increase
to
the
San
bernal
parking
violation
schedule
was
in
March
of
2009.
As
you
may
recall,
the
increase
was
to
recover
costs
associated
with
the
court
construction
fund
surcharge,
which
was
also
imposed
by
the
legislature.
The
department
recognizes
these
two
increases
are
within
a
two-year
period.

However,
they
come
to
us
mandated
and
surcharges
that
are
put
to
us
by
the
state
legislature.
Adopting
a
three
dollar
increase
for
parking
violations
to
take
effect.
December
7
2010
will
allow
the
city
to
recover
costs.
She
ate
it
with
the
trial
court
trust
fund
set
forth
in
the
Senate
bill
staff
estimates
that,
by
adopting
the
proposed
fine
increase,
estimated
revenues
would
increase
by
thirty
six
thousand
dollars.
The
impact
of
the
Senate
bill
will
result
in
an
additional
expenditure
of
the
same
amount,
resulting
in
no
net
impact
to
the
general
fund.

To
the
chair,
the
only
thing
from
my
understanding
is
the
city
is
being
charged
an
additional
three
dollars
and
we
either
passed
that
on
to
those
who
are
being
cited
or
we
pay
for
that
out
of
the
general
fund.
That's
as
clear
as
it
is
my
understanding,
which
could
average
about
thirty
six
thousand
dollars
a
year
which
would
go
against
the
general
fund
manager
if
I'm
not
in
tractor.

though
I
don't
think
this
is
the
you
know
raising
something
again,
as
we
just
did
the
citations.
I
just
can't
see
having
the
city
absorb
the
costs,
which
obviously,
we
have
not
budgeted,
which
means
reserves
which
I'm
not
prepared
to
use.
So
I
think,
in
order
to
recoup
these
costs,
we
need
to
unfortunately
pass
these
on,
but
these
are
to
those
persons
who
are
cited
for
offenses.
So
there's
just
my
opinion.
There's
no
comment

go
ahead
and
introduce
the
resolution
for.
