Thank
you
all
right.
Welcome
everyone,
my
apologies
for
being
off
camera.
I've
got
some
health
issues
that
are
going
to
cause
me
to
be
on
and
off
camera,
but
we'll
try
to
be
on
as
much
as
I
can
we'll
begin.
The
the
meeting
now
for
december
15th
begin
with
a
pledge
of
allegiance.
If
you're
able
to
stand,
please
join
us.

Today's
invocation

reverend

In

I
was
honored
that
he
helped
join
work
with
us
and
our
transition
team.
B
When
I
came
into
office,
he
was
an

an
active

of
the
santa
clara
county
alliance

have
been
honored
to
know
reverend
pinkston
for
several
decades.
B
I
won't
say
how
many
because
it
will
display
my
age,
because
he
was
actually
my
originally
my
geometry
teacher
and
I
blame
him
for
my
having
gone
to
law
school.
Apparently,
I
didn't
do
well
enough
in
geometry.
In
any
event,
I
wanted
to
ask
if
henry
would
please
play
the
video
of
reverend
kingston.
D
D
Loving
lord
teach
us
to
be
generous,
teach
us
to
serve
you
as
you
deserve,
to
give,
and
not
to
count
the
cost
to
fight
and
not
to
heed
the
wounds,
to
toil
and
not
to
seek
for
rest
to
labor
and
not
to
ask
for
a
reward
accept
that
in
knowing
that
we
do.
Your
will,
amen
blessings
to
you
and
to
all
of
yours
during
this
holiday
season
have
a
great
day.
B
B
E
Thank
you
oops.
Thank
you!
So
much.
Yes,
I'd
like
to
honor
mr
melchor
for
those
of
us
who
who
pay
our
respects
to
our
elder
I'll
I'll,
be
referring
to
him
as
don
melchor
and
don
melchor
landing
ramirez
started
his
bakery
trade
at
the
age
of
14
years
old
in
his
early
20s.
E
E
He
ventured
to
expand
his
menu.
I'll
tell
you
that
that
I
would
bet
just
about
anything
that
he,
he
probably
started
the
juicing
phenomena,
at
least
on
the
east
side.
My
favorite
is
the
beet
juice
and
I
highly
recommend
it,
but
but
really
he
he
grew
his
menu.
The
tortas
are
phenomenal.
E
The
juices
are
unbelievable,
but
the
bread
really
is
what
what
rose
his
fame
on
the
east
side
and-
and
many
of
us
have
had
the
great
benefit
of
having
the
generosity
of
this
family.
E
Whenever
we've
had
events,
whenever
we've
had
moments
where
we've
needed
his
family
to
come
and
support
they've
they've
given
very
very
generously
I
I
want
to
recognize
matured
for
not
only
having
achieved
his
dream,
but
really
for
making
sure
that
that
we
continue
to
be
connected
to
a
tradition,
that's
very
near
and
dear
to
our
hearts,
and
that
the
east
side
of
san
jose
and
our
families
continue
to
understand,
appreciate
and
love.
Those
traditions
was
definitely
part
of
the
character
of
the
east
side
of
san
jose.
E
E
He
believed
in
the
american
dream.
He
gave
it
his
all.
He
was
most
proud
of
that
and
he
instilled
in
his
family,
the
same
values.
He
leaves
behind
his
wife,
claudia
his
brothers,
angeles
guadalupe,
his
his
family,
melchor,
jr,
juan
jose
and
jorge,
and
and
again
I
want
to
give
my
gratitude.
His
family
is
watching.
Now
and
again.
E
I
want
to
give
my
gratitude
to
the
entire
family
for
helping
build
the
east
side
of
san
jose,
but
I
want
to
make
very
clear
when
you
build
the
east
side
of
san
jose
you're,
building
the
entire
city
of
san
jose.
Thank
you
so
much
for
the
legacy
that
your
father
has
left
behind
and
for
everything
that
your
family
has
contributed
to
this
city.
Thank
you.
B
Thank
you,
councilmember
councilmember,
esparza,.
B
Oh
okay,
I'm
sorry.
I
thought
it
was.
Let's
speak
specifically
on
that.
Okay,
thank
you.
Councilmember
carrasco,
on
back
to
orders
of
the
day
staff
is
recommending
deferral
of
item
8.1,
which
are
actions
related
to
the
agreement
with
the
valley
water
district
for
the
south
san
francisco
bay
shoreline
project.
We
expect
the
outcome
back
to
us
in
january
and
then
councilmember
esparza.
You
had
another
change.
F
That
was
my
question.
Thank
you.
B
B
B
7376
ma'am
or
sir,
you
need
to
unmute
your
phone,
probably
by
pushing
star
six
hello,
hello,.
G
Oh
well,
I
was
just
it's
unclear
on
whether
how
a
person
tries
to
bring
an
item
off
the
consent
calendar
to
the.
B
Sir,
we'll
be
coming
to
the
consent
calendar
in
just
a
moment
after
the
closed
session
report,
so
we'll
take
that
all
right,
so
just
raise
your
hand
on
when
we
get
to
the
consent
calendar
so
we'll
just
be
considering
items
on
orders
of
the
day.
Mr
beekman
is
this
specifically
on
orders
of
the
day.
Yes,.
H
It
is
thank
you.
You
know,
orders
of
the
day
has
been
an
item.
That's
been
slowly
developing
this
past
year.
Actually
in
this
time
of
covid,
so
it's
been
a
bit
difficult
to
navigate.
I
think
you've
been
doing
a
great
job
and
thank
you.
You
try
to
be
accessible
to
the
community
on
this
item,
and
that
is
very
nice
of
you.
Thank
you.
So
I'm
learning
you
know
to
specifically
talk
about
orders
of
the
day
issues
and
my
question
to
yourselves.
H
H
The
public
has
to
have
a
have
a
chance
to
speak
on
an
item
if
it's
being
deferred-
and
I
think
that's
an
important
point
to
be
considering
for
your
many
items
on
on
local
committee
agendas
that
are
often
deferred
say
in
rules
in
open
government
that
we
need
to
be
more
clear
about
the
rules
that
if
the
public
can
then
speak
on
those
items
or
not
I've.
Given
you
some
early
brown
act.
H
Ideas
at
this
time
that
I
you
know
can
help
direct
and
I
hope
you
can
learn
to
make
that
clear
to
the
public
and
we
can
have
a
real
good
policy
procedure
in
the
future,
because
I
know
as
as
a
mayor,
the
mayor
himself
seems
to
have
a
really
good
heart
about
wanting
to
allow
open
public
comment
when
items
are
deferred,
and
I
think
that
should
be
the
goal,
and
I
hope
you
can
work
towards
that
goal
and
work
toward
the
brown
act,
ideas
and
and
to
this
process
of
orders
of
the
day
and
how
to
talk
about
these
items.
H
F
B
Okay,
well
on
to
the
closed
session
report,
nora.
A
B
Okay,
I'd
like
to
take
chairs
privilege,
after
we're
done
with
consent,
actually
perhaps
when
we
come
back
enough
for
afternoon
agenda
to
recognize
our
outgoing
council
members.
So
why
don't
we
do
that
right
as
we
return
for
now,
let's
identify
the
items
we'd
like
to
pull
from
consent.
B
So
far,
councilmember
esparza,
as
indicates
you'd
like
to
pull
2.13
actions
related
to
the
agreement
with
randall
reedy
successor,
trustee
of
the
luis
scalioni
ella
credit,
shelter,
trust
for
the
property
at
100,
west
alma
councilmember
esparza
would
like
to
pull
item
2.21,
which
is
a
railroad
maintenance
agreement.
B
Councilman
prowls
would
like
to
pull
I'm
sorry,
we'd
like
to
recuse
himself
from
item
2.28
agreement
with
health
trust
for
housing
opportunities
for
persons
with
aids,
violence
against
women's
act,
presumably
that
it
has
to
do
with
the
employment
of
a
family
member
and
then
councilman
canvas
would
like
to
pull
2.30
approval
accommodation
presented
to
patio
o'malley
sponsored
by
council
district
10..
B
F
Thank
you
mayor.
No,
actually,
I
do
not
want
to
pull
2.21.
I
would
like
to
pull
two
point.
Two
four.
B
B
B
B
I
I
actually
only
wanted
to
pull
it
because
I
wanted
the
public
to
to
chime
in
on
this.
This
is
the
proposed
the
amendment
to
the
legal
services,
so
I
I
would
prefer
just
the
public.
B
H
Oh,
I
didn't
know
my
hand
was
up.
I
thank
you
for
for
offering
public
comment.
Is
there?
Is
there
federated
retirement
city,
employee
issues?
Is
there
another
consent?
Calendar
item.
H
B
I'll
go
then,
thank
you,
okay,
thank
you.
Brady
mamura,.
J
Thank
you,
mr
mayor,
and
thank
you
council
member
candice
for
your
many
many
years
of
service
on
the
city
council.
My
name
is
brady
mamura,
I'm
the
city
of
san
jose
retiree,
and
I
was
on
the
representative
to
the
federated
retirement
board
for
12
years
as
an
active
employee
representative.
J
I
was
disappointed
that
I
saw
this
item
on
the
agenda
because
mainly
I
was
disappointed
that
a
group
of
already
highly
compensated
retirees
within
the
san
jose
retiree
retired
employees
association
has
taken
this
course
of
action.
I
saw
in
the
beginning
back
in
december
of
2017.
This
amount
to
would
defend
this
lawsuit
was
amount
not
to
exceed
175
000.
Now
it's
ballooned
to
1.9
million
dollars
as
a
taxpayer,
as
well
as
a
retiree.
I'm
really
appalled
by
this.
J
This
is
truly
biting
the
hands
that
feeds
it.
I
think
this
is
disrespectful
to
the
taxpayers
and
in
my
service,
as
a
public
employee,
I
always
felt
that
it
was
a
privilege
and
not
a
right,
and
our
retirement
system
is
very
generous
and
to
have
some
highly
compensated.
Employees
try
and
go
back
and
enrich
themselves.
To
me
is
in
is
is
deplorable.
J
It
was
also
brought
to
my
attention
that
the
san
jose
retirees
association
is
also
is
helping
in
assisting
to
fund
this
lawsuit
in
the
amount,
and
I
I
understand,
there's
a
vote
among
their
members
of
funding
in
the
amount
of
200
000.
J
B
B
Yeah,
rather
than
voting
on
each
of
these
items,
we're
going
to
try
to
see
if
we
can
get
a
colossal
consolidated
item.
If
there
are
areas
where
people
want,
a
dissent
will
break
those
items
off.
So
why
don't
we?
If,
if
see
here,
I'm
trying
to
figure
out
how
we
can
manage
this
without
consuming
undue
amount
of
time?
Why
don't
we
move
on
to
the
next
item?
B
B
Great
okay,
councilmember
sparza
unicated
pulling
2.13
actions
related
to
the
agreement
relating
to
100,
west
alma
avenue
and
1413
sanborn
avenue.
F
Yes,
mayor
and
I'll
be
quick.
I
just
this
is
such
a
special
thing
for
our
city
and
for
the
community.
It's
an
unusual
thing,
and
so
I
wanted
to
pull
it
to
highlight
it,
and
I
particularly
would
like
to
thank
staff.
F
The
alma
community
center
is
frankly
a
center
that
is
really
sorely
in
need
of
revitalization,
and
I
think
this
project
presents
an
amazing
opportunity
for
the
community
and
again
I'd
like
to
thank
staff
in
particular
this
year,
who
worked
really
hard
throughout
2020.
To
make
this
happen.
Thank
you.
B
No,
I
was
muted
sorry.
I
was
as
many
screens
away
sorry,
so
I
I
want
to
ask
now,
if
there's
any
members
of
the
public
who
would
like
to
speak
on
2.13
relating
to
this
generous
gift
from
the
trusts
of
the
elias
to
the
city
for
alma
avenue
and
sanborn
avenue,
I
see
no
hands
so
we'll
come
back
to
the
council
I'll
move
on
now
to
item
2.0,
which
is
the
charter
review
commission.
Now
I
expect
that
maybe
extended
discussion
on
this.
It
is
now
about
almost
12
o'clock.
B
F
I'm
okay
with
deferring
it
or
unless
you
would
suggest
taking
this
separately
up
to
you.
B
Okay,
I
suspect
we're
going
to
want
to
take
it
separately
anyway.
I
understand
there's
a
fair
amount
of
discussion
to
be
had
so
with
your
consent.
We
could
go
on
to
2.25
and
quickly
get
to
that
one
okay
and
come
back.
Okay,
I'm
happy.
B
All
right
on
2.25
is
counseling
our
canvases
item
to
pull.
This
is
the
retired
representative
appointment
to
the
federated
board.
Councillor
chemist
yeah.
I
Again,
I
I
wanted
the
public
to
speak
on
this
issue.
You
know,
I
know
the
proposed
retiree
representative,
that's
being
appointed
here
is
is
is
alleged
to
be
a
member
of
the
retirees
association
that
is
suing
the
city
of
san
jose,
so
I
just
wanted
to
see
if,
if
that
is
the
case
from
staff,
and
if
anybody
wants
to
speak
on
this
from
the
public,
I
know
brad
memoria
wanted
to
speak
on
it.
I
don't
know
why
his
hand
is
not
up.
Okay
there.
It.
B
Is
yeah?
I
know
he
indicated
he
did
yeah
mr
beekman.
H
Hi
I
thought
yeah
hi.
This
is
about
federated.
H
I
thought
it
was
about
the
the
the
appointment
of
a
person,
and
I
wanted
to
speak
on
overall,
federated
retirement
issues,
city
retirement
issues
of
you
know
just
to
thank
yourselves
that
I've
attended
meetings
recently
and
I've
been
impressed
with
how
you
can
work
with
how
they
work-
and
I
just
I
learn
things-
and
it's
been
nice
to
learn
things,
and
I've
learned,
for
instance,
that
that
that
the
ideas
of
inflation
may
not
be
considered
as
much
of
a
factor
in
the
next
year
and
to
respect
the
many
factors
of
the
pension
negotiation
process
there
can
be.
H
There
can
be
a
simple
logic
that
cola
funding
can
be
put
on
hold
for
at
least
into
the
next
year,
and
I
wanted
to
take
this
time
at
public
comment
just
to
just
to
simply
thank
city
manager.
David
sykes,
who
has
since
june,
he's
always
tried
to
look
for
ways
that
the
sjpoa
negotiation
process
can
be
a
somewhat
open
process
for
both
the
public
and
local
government.
This
openness
can
be
of
help
not
only
for
everyday
community,
but
how
local
government
itself
can
more
openly
understand
things
as
well.
H
The
most
recent
ssf
poa
negotiation
process
for
the
next
three
years
just
conclude
in
san
francisco.
They
were,
they
were
the
the
elected
officials.
There
were
now
regular
complaints
from
its
elected
officials
of
the
secretive,
confused
and
unclear
negotiation
process.
As
usual
again,
a
thank
you
to
city
manager,
david
sykes
and
his
attempts
to
offer
the
concepts
of
openness
and
transparency
in
the
latest
round
of
the
sj
poa
negotiations.
H
J
Thank
you,
mr
mayor
I'll,
try
and
rush
through
this,
as
my
two
minutes
will
allow.
I
wanted
to
get
some
items
on
the
agenda
apparently
did
not.
I
went
through
the
city
clerk
but
apparently
didn't
get
on
there,
but
anyway
I
had
some
questions
regarding
the
item
on
this
agenda
about
the
appointment.
Why
did
the
selection
panel
for
the
retiree
representative
to
the
federated
board
consist
of
three
active
employees
and
two
retiree
representatives
who
are
members
of
an
association
that
the
majority
of
retirees
are
not
members
of
the
active
employees
already
vote?
J
Slash,
select
two
representatives
among
the
ranks
and
the
two
retirees
are
members
of
an
association
that
does
not
represent
the
majority
of
retirees.
This
panel
is
fundamentally
flawed,
the
most
recent
election
for
the
retiree
representative,
the
ones
that
we
actually
got
to
vote.
The
retirees
are
no
longer
allowed
to
vote
anymore,
but
the
most
recent
one
overwhelmingly
favored
a
candidate
who
was
not
selected
by
the
panel.
Why
was
that?
J
This
time
the
selection
panel
concluded
that
the
candidate
who
received
the
most
votes
in
the
previous
election
was
quote.
Very
impressive,
however,
was
edged
out.
For
quote
a
couple
things:
what
were
those
things?
The
current
federated
board
consists
of
six
members
with
less
than
two
and
a
half
years
experience
two
have
just
over
one
year
experience
and
one
with
less
than
one
year.
J
Why
would
the
panel
disregard
a
candidate
myself
with
12
years
previous
experience,
the
candidates
selected
by
the
panel
appears
to
have
a
conflict
of
interest
and
is
apparently
party
to
a
lawsuit
against
the
city
of
san
jose,
known
as
the
taxpayers
brought
forth
by
a
subgroup
of
members
of
the
san
jose
retired
employees,
association
and
supported
by
the
sjrea
board.
Is
this
a
reason
for
disqualification
this
a
question
for
the
city
attorney?
If
not,
why
not?
J
Trustees
on
the
federated
board
are
fiduciaries
and
their
duties
are
to
manage
the
fund
professionally
responsibly
and
without
any
conflict
of
interest?
It's
currently
costing
the
taxpayers
money
now,
in
attorney
fees
alone.
To
defend
this
lawsuit,
please
do
not
vote
for
the
candidate
on
your
agenda.
You
have
a
candidate
myself,
who
is
a
an
experienced
alternative?
Thank
you.
So
much.
B
Hello
can.
G
We
can
yeah
that's
a
terrible
system
to
use.
I
mean
it's
just
unbelievably
cumbersome
anyway,
the
the
issue
about
the
seat
on
the
retirement
board
for
retirees,
the
active
employees,
get
two
seats
and
they
get
to
vote,
they
get
to
vote
and
then,
when
they're
done
voting,
the
results
are
given
to
the
city
council
for
approval.
G
G
If
there
ever
is
a
vote,
then
there's
no?
Actually
there
there
there's
a
a
an
impediment
during
the
process
where
there's
a
filtration
interview
board
that
reviews
the
selection
and
then
and
three
of
those
people
are
also
active
employees
again
and
the
other
two
are
not
chosen
by
a
vote.
G
So
are
us.
The
retirees
have
absolutely
no
say-so
in
the
choice
of
our
representative
on
that
retirement
board,
and
that
was
the
intent
of
the
city
council
years
ago
and
we
used
to
have
elections
and
it's
been
stolen,
taken
away
from
us
and
that's
wrong.
It's
un
unequal
treatment,
it's
unfair,
get
back.
Have
the
city
clerk
run
an
election
run
the
winning
candidate
to
the
city
council
and
and
approval
real,
simple
solution
to
this
year
problem,
as
it
is
right
now
in
this
year
time
right
now
this
moment
it's
wrong.
G
It
needs
to
be
stopped.
An
election
held
so
put
it
into
january
whatever,
and
and
have
an
election
for
the
retirees
seat,
as
the
original
selection
process
by
the
city
council
created.
A
B
Thank
you,
sir
councilmember
campus.
Did
you
want
to
be
heard
any
further
on
this
item.
I
Yeah
yeah,
I
I
and
I
can
I
I
sympathize
with
the
folks
on
the
phone
here.
I
I
did
have
a
question
for
staff
about
the
the
person
that's
being
appointed
on
on
this
item.
If
they're
associated
with
a
lawsuit
against
the
city,
I
also
don't
necessarily
agree
with
the
process.
Currently
I
remember
I
may
have
voted
against
the
process
in
what
could
have
been
four
years
ago.
It's
been
a
little
a
little
long.
Now
is
the
person
that's
being
appointed
part
of
the
lawsuit.
A
I
don't
know
if
may
or
this
is
nor
I
don't
know
if
staff
knows
the
answer
off
the
top
of
their
head,
but
mr
costello
is
in
fact
a
named
plaintiff
in
the
preservation,
lawsuit.
I
So
I
don't
know
how
unbiased
that
person
would
be,
and
I
I
may
not
be
supporting
this
item
at
a
minimum.
I
think
we
should
defer
this
item
until
next
year
until
we
could,
I
I
don't
know.
I
just
think
we
should
think
about
this,
a
little
more
okay.
So
if,
if
you're
going
to
take
these
all
in
one
vote,
I
would
either.
B
B
All
right,
councilmember
davis,.
K
Thank
you
mayor.
I
just
want
to
point
out
that
jay
castellano
has
been
a
member
of
the
federated
board
for
at
least
a
couple
of
years
already,
and
he
is
currently
the
chair
of
the
federated
board.
I
I've
been
the
liaison
to
to
federated
all
of
my
entire
first
term,
and
I
have
found
in
the
time
that
he
has
been
on
the
board
jay
to
be
a
very
thoughtful
member
of
that
board.
So
I
I
am
not
going
to
be
supporting
the
motion.
That's
on
the
floor.
B
G
Yeah,
I
was
actually
going
to
make
a
motion
that
we
approve
all
the
consent
items
except
for
2.24,
which
I
think
we
will
hear
after
the
break
and
then
2.28.
I
need
to
recuse
myself
on.
B
G
B
G
K
B
Is
there
any
comment?
Let's
go
to
the
public
here
briefly
before
we
go
to
the
break
blair
beekman,
it's
on
the
remainder
of
the
consent
items.
H
H
It
seems
important
at
this
time
to
begin
to
learn
how
to
focus
the
continued
use
and
growth
of
these
two
renewable
technologies,
along
with
other
renewable
energy
ideas
as
ways
to
prepare
immediately
before
and
after
natural
disaster
events
of
the
next
ten
five
to
ten
years.
As
I
hope,
these
good
efforts
from
all
of
us
can
work
to
reduce
the
need
of
diesel
and
other
brown
energy
dirty
fuels
that
will
be
demanded
in
the
days
weeks,
months
and
years
after
a
large,
catastrophic
event
here
in
san
jose
and
the
sfa
area.
H
Yeah,
I
guess
my
other
items.
I
will
speak
on
2.24
after
break
and
then
I
wanted
to
speak
on
the
hud
items
with
the
remaining
time
I
have.
I
have
10
seconds
left
here,
the
hud
items
yeah.
I
will
speak
on
that
later
in
the
con
and
the
agenda
as
well.
Thank
you.
B
H
A
G
G
A
B
L
Hi,
okay:
I
am
y
and
trung
with
mothers
out
front.
I
asked
the
council
members:
do
you
have
children?
L
L
L
N
M
Okay,
thank
you
for
making
time
for
comments.
I
just
want
to
talk
to
you
off
the
cuff
to
say.
Thank
you
so
much
for
this
ordinance.
It
is
extremely
important
to
get
our
buildings
off
gas
and
we
need
to
stop
building
new
fossil
gas
infrastructure.
So
I
really
appreciate
this
ordinance.
It's
very
important.
I
do
feel
deeply
concerned
and
troubled
that
the
you
voted
to
approve
this
exemption
for
der.
Without
really,
I
believe,
understanding
what
it
includes.
M
This
is
a
really
bad
example
and
a
really
poor
way
to
do
public
policy
when,
after
a
long
time
of
vetting
a
sudden,
last-minute
change
is
made
without
truly
understanding
its
significance.
We
are
asking
you
to
go
ahead
and
pass
the
ordinance
to
even
with
this
terrible
exemption,
but
we
do
ask
you
guys
questions
please
hon.
Thank
you.
Please
have
a
hard
time
hearing.
I
know.
That's
not
me.
M
We
have
spoken
with
architects
who
are
building
resilient
energy
systems
for
large
facilities
that
have
four
or
more
days
of
backup
power.
The
way
it
was
explained
to
me
is:
don't,
if
you
you
can't
say:
oh,
I
can't
charge
my
cell
phone
for
only
until
10
a.m.
That's
because
your
cell
phone
battery
is
inadequate.
M
O
Good
afternoon,
mayor,
licardo
and
and
council
members,
and
thanks
so
much
for
the
opportunity
to
comment
here
I'll,
be
brief.
I
want
to
echo
the
comments
of
my
colleagues
wyan
and
linda
hutchinson-knowles.
I
share
their
concerns
on
behalf
of
menlo
spark
and
the
campaign
for
fossil
free
buildings.
In
silicon
valley.
We
respectfully
ask
you
to
go
ahead
and
approve
this
gas
prohibition
today,
but
we
also
think
that
it's
essential
to
direct
esd
staff
to
conduct
a
thorough
analysis
of
the
implications
of
der
systems
and
provide
a
comprehensive
list
of
alternates.
O
These
could
release
more
pollution
than
we're
saving
from
prohibiting
gas
and
new
construction,
and
we
want
to
make
sure
that's
not
the
case.
I
think
it's
a
smart
idea
to
evaluate
the
emissions
from
these
devices
and
evaluate
the
alternatives,
and
I
hope
that
you'll
direct
staff
to
do
so,
but
I
also
help
that
you'll
pass
this
historic
gas
prohibition
today
thanks
so
much
for
your
time.
C
So
we
do
support
the
passing
of
this
ordinance
today,
but
please
take
the
time
to
study
the
impacts
of
what
these
potential
exemptions
would
have
on
the
future
of
san
jose's
climate,
smart
plants.
Thank
you.
A
Good
morning,
mayor
licardo
and
the
council
and
staff,
I
just
like
to
echo
all
the
other
comments
that
are
concerned
about
this
exemption
to
the
natural
gas,
but
I'm
really
glad
about
the
natural
gas
ban,
as
the
previous
speaker
is
saying
that
this
exemption
could
undermine
it.
I
believe
there
are
a
lot
of
other
municipalities
that
have
not
permitted
this
carve
out,
and
the
city
needs
to
do
a
full
analysis
before
permitting
it.
Thank
you.
P
Hello,
can
you
hear
me.
P
Thank
you.
Thank
you,
mary
lou
cardo
and
city
council
members,
I'm
olivia
walker
with
nrdc
the
natural
resources
defense
council,
like
the
speakers
before
me,
I'm
here
to
express
nrdc's,
strong
support
of
the
proposal
to
expand
the
natural
gas
infrastructure
prohibition
ordinance
to
make
nearly
all
new
buildings
in
san
jose
all-electric.
P
Your
action
today
will
demonstrate
san
jose's
reputation
as
a
climate
leader.
However,
nrdc
still
has
urgent
concerns
about
the
distributed
energy
resources
exemption.
This
exemption
opens
the
door
for
unfettered
use
of
gas-powered
energy
systems,
including
fuel
cells
and
co
or
trigen
systems,
and
not
just
during
grid
outages,
as
the
language
of
the
exemption
implies,
but
24
7
365
days
a
year.
P
Staff
weren't
provided
adequate
time
to
analyze
the
full
extent
of
the
consequences
of
this
exemption
because
it
arose
mere
days
before
the
ordinance
went
to
council.
If
you
must
explain
the
ordinance
with
this
exemption,
the
least
you
can
do
is
ensure
that
you
fully
understand
the
consequences
of
that
decision.
P
Please
drive
staff
to
first
conduct
a
thorough
analysis
of
the
climate
impacts
of
these
so-called
distributed
energy
resources,
including
fuel
cells,
co-generation
and
tri-generation
systems,
and
second
survey
and
analyze
alternative
backup
power
options
that
do
not
rely
on
fossil
gas.
Again,
please
do
pass
the
all-electric
ordinance
today
and
direct
staff
to
analyze
the
impacts
of
an
exemption
for
these
gas
powered
systems.
Thank
you
for
your
time.
N
They
also
had
to
restate
earnings
in
their
public
sec
filings
and
that
again,
like
I
said,
was
in
a
recent
article.
So
I
would
just
like
to
strongly
encourage
you
to
look
deeper
into
this
exemption
and
see
that
these
dirty
fossil
fuel
boxes
are
not
what
we
need
right
now.
We
really
need
a
clean
energy
sector,
that's
going
to
support
our
city
and
it's
possible.
B
Thank
you
christine
prillage.
P
A
A
Super,
I
guess
I
don't
fully
know
how
this
works,
because
I've
not
participated
in
these
many
times
before,
but
I
I
guess
I
wanted
to
pose
a
question
as
to
why
this
exemption
would
be
considered
with
the
fuel
cells
specifically
because
they're
not
considered
a
good
backup.
A
Reason
because
their
longevity
is
very
short
and
yeah.
I
just
I
don't
understand.
Q
Q
Since
then,
we've
realized
that
the
gas
gun
would
not
only
allow
the
exemption
would
not
only
allow
gas-powered
fuel
cells,
but
it
would
also
allow
other
types
of
der
that
are
several
times
dirtier
than
the
energy
supply
supplied
by
by
san
jose
clean
energy
and
even
worse
than
than
than
fuel
cells.
Q
So
we're
asking
that
please,
if
you
would
at
least
direct
the
city's
environmental
services
department,
to
provide
the
city
council
sometime
before
march
31st,
with
a
detailed
analysis
of
how
all
the
various
types
of
der
could
impact
san
jose's
greenhouse
gas
reduction
goals,
so
that
the
council
can
fully
consider
the
possible
consequences
of
continuing
to
allow
der.
The
analysis
should
only
take
a
couple
of
weeks
and
environmental
services
staff
would
have
the
support
of
of
advocates
and
experts
on
der.
Q
B
Thank
you
all
right
back
to
council.
Remember
the
motion
from
council
member
perales
as
to
all
the
consent
items.
I
think
we
had
begun
the
voting
should
we
take
it
over
from
the
top
here.
F
B
A
B
No
we'll
we'll
take
it
up
separately.
Why
don't
we
come
back
at
one
o'clock
and
take
those
three
consent
items
up
and
then
we'll
proceed
to
the
rest
of
the
agenda.
Thanks
everybody
we'll
return
at
one.
