energy
storage
facility
within

existing
industrial
building
on
an
approximately
25
point,
33
gross
acre
site,
as
described
in
more
detail
within
the
staff
report.

transmission
line
would
connect
the
substation
to
the
PG&E
Metcalf
substation,
no
power
would
be
generated
on
site
and
there
would
be
no
employees
on
site
as
operations
are
conducted
remotely
in
general.
The
energy
storage
system
absorbs
energy
from
the
electric
grid,
and
then
it
would
release
energy
back
to
the
grid
which
would
occur
based
on
market
demand
determined
by
PG&E.

project
would
be
located
within
an
existing
industrial
complex,

would
thereby
retain
the
existing
aesthetics

operations
of
the
adjacent
uses.

project
involves
a
battery
energy
storage
system
that
would
address
an

caused
by
the
potential
retirement

Metcalfe
national
natural
gas
generating
station
apologies,
not
the
Train
everybody.

behalf
of
San
Jose
citizens
for
sensible
industry
was
received
during
the
I,
am
indeed
public
comment
period.

comment
letter
emphasized
environmental
concerns
such
as
energy
efficiency,
greenhouse
gas
and
construction
emissions,
hazards
related
to
fire
biological
impacts
to
turtles
and
birds
and
noise,
resulting
from
transmission
line
construction
staff,
reviewed
the
comments
added
clarifying
information
and
concluded
that
these
comments
did
not
raise
any
new
impacts
or
result
in
new
mitigation
measures.
The

formal
responses
to
comments
document

made

our
website
staff
received
another
letter
from
the
same
entity
with
rebuttal
to
our
responses
shortly
before
4:00
p.m.

common
rule
letter
also
claims
that
there
could
be
both
construction
and
operational
health
and
hazard
impacts.
These
claims
are
alluded
to
feature
accidents
of
project
components
such
as
the
battery
fires
or
accidents
during
the
operational
lifetime,

well
as
construction
impacts
to
biological
species
such
as
pond
turtles.
Now
that
the
staff
has
responded
to
these
comments
in
the
original
responses
with
information
regarding
emergency
protocols
of
how
battery
failure
or
accidents
would
be
taken
care
of
if
such
an
event
is
to
occur.

the

MND
did
disclose
that
potentially
impacted
species
such
as
the
Western
pond
turtle,
occur
in
low
numbers
in
the
creek
with
the
site
vicinity,
and
have
noted
that
the
project,
like
all
projects

city

San
Jose,
would
be
required
to
comply
with
the
habita
agency
measures
prior
to
any
grading
permits.
Overall
staff
have
reviewed
the
new
letter
and
found
that
the
new
comments
reiterate
similar
concerns
as
the
original
letter.

letter

not
result
in
new

new

effects

additional
mitigation
visitors
and
those
analyzed

this

Edenvale
area

Ignacio.
This
is
a
critical
facility
for
the
city
of
San
Jose
and
the
state
of
California
to
advance
its
climate,
smart
policies
and
renewable
energy
goals,
and
the
reason
that
is
is
that,
in
order
to
maximize
the
use
of
solar
and
wind
power,
you
have
to
have
storage
capacity
since
the
wind
doesn't
always
blow
and
the
Sun
doesn't
always
shine.

need
to
store
surplus
power
from
those
renewable
resources
and
use
it
when
those
natural
resources
are
not
available
in
California
and
in
San
Jose.
We
do
not
yet
have
enough
storage
capacity
to
have
our
electrical
power
system
rely
completely
on
renewable
resources
and,
as
a
result,
the
state
and
therefore
the
city
of
San
Jose,
must
rely
on
natural
gas
burning
power
plants
to
meet
energy.

Electrical
energy
needs
at
certain
times
of
the
day
and
the
year,
so
allowing
these
kinds
of
facilities
that
we're
proposing-
and
we
need
many
more
in
the
city
and
throughout
the
state-
will
allow
San
Jose
to
meet
its
climate.
Smart
objectives
of
100%
renewable
in
electrical
energy
and
allow
California
to
also
meet
its
objectives
so.

we
that
we
are
in

also
note
that
San
Jose,
specifically
San
Jose,
clean
energy,
does
benefit
specifically
by
having
this
facility
within
San
Jose's
jurisdiction,
because
the
way
it
works
is
the
see

California
Public
Utility
Commission,
mandates
that
local
jurisdictions,
like
San
Jose,
clean
energy,
that
they
meet
renewable
percentages
like
other
entities
in
the
state,
and
so
not
only
is
this
facility
beneficial
to
the
state
as
a
whole.
San
Jose
gets
specific
credit
for
having
this
facility.

We
in
its
jurisdiction
area
with
three
I'll,
come
back
and
speak
after
public
comment,
but
with
regard
to
the
the
letter
on
the
sequa
that
you've
heard
about
from
staff,
this
is
the
same
old
routine
that
you
see
periodically
each
year
the
so
called
citizens
for
Responsible
industry.
It
is
an
agent
of
the
IBEW
construction
unions.

Their
motivation
has
nothing
to
do
with
environmental
protection.
They
have
other
motives.

we
want
to

city
policy

city's
environmental
document

the
requirements

sequa,

are
confident

planning
department

project

San
Jose
citizens

sensible
industry,
a
coalition
of
individuals
and
labor
organizations
in
San
Jose,
who
may
be
adversely
affected
by
impacts
to
public
health
and
the
environment.
The
city's
responses
to
our
initial
comments
failed
to
resolve
major
issues
we
raised,
including
the
possibility
for
battery
accidents,
greenhouse
gas
emissions
impacts,
air
quality
impacts,
biological
impacts
and
noise
impacts.

Given
my
limited
time,
I
will
focus
my
royal
comments
on
two
issues:
first,
hazards
of
a
battery
accident
and
second
greenhouse
gas
emissions.
First
secret
requires
analysis
of
foreseeable
accidents
that
could
impact
the
environment
if
the
city
has
failed
to
analyze
the
potential
for
battery
fires,
explosions
and
release
of
toxic
gases,
despite
evidence
that
such
accidents
have
occurred
in
other
places,
with
battery
storage
facilities
with
disastrous
public
health
consequences.

Second,
while
we
agree
that
energy
storage
can
be
a
useful,
clean
energy
tool,
this
is
only
true
if
measures
are
in
place
regulating
how
batteries
are
used.
The
city's
response
has
failed
to
provide
key
information
about
the
efficiency
of
the
batteries
and
the
sources
of
energy
that
will
be
used
to
charge
the
batteries.
The
city
discusses
the
goals
of
the
project
to
support
renewable
energy,
but
does
not
include
binding
measures
to
ensure
that
that
will
be
true
in
practice.
Our
expert.

Expert
David
Marcus
explains
that,
without
finding
measures
to
guarantee
that
batteries
are
only
charged
with
curtailed
renewable
energy,
the
operation
of
this
facility
will
likely
result
in
an
increase
in
greenhouse
gas
emissions
from
fossil
fuel
generators
in
the
area.
We
urge
the
Commission
to
postpone
their
approval
of
this
project.
To
allow
for
preparation
of
an
e
I
are
analyzing
these
issues
and
other
significant
environmental
impacts.

replace
the
entire
Metcalf
Energy
Center.
They
deport
the
power
generation
site
of

center
waste
battery
storage
because

amount

getting
from
this
site,
which
is
essentially
the
reason
they
took
it
there,
because
it
was
the
intersection
of
a
major
power
trunk
line
and
a
major
gas
line
does
the
only
reason
why
that
side.
Today
we
fold

we
lost
it
and
they're
refusing
to
put
you
know,
air
quality
monitoring
equipment
over
they.

the
last
20
years

the
Commission
or
the
City
Council,

Director

ever
found

claims
made

these
letters
justified
a
finding
of
inadequacy
of
the
city's
secret
documents

trying
to
delay
jobs
and
delay
environmental
benefits

our
city

commissioners

the
staff

The
rezoning
supports
major
strategy,
three
focus
growth
of
the
general
plan
and
conforms
to
other
general
plan
policies
related
to
affordable
housing.

core
companies
and
Republic
urban
properties
one
several
years
ago
and
it

put
out

the
VTA
after
they

Planning
Commission
and
City
Council
zoning
approval
in
2016.

project
consists

units,

we
had
mentioned.

those
are
affordable

a
building

north

the

and
the
overall
density
for
the
project
is
a

station

Caltrain

close

downtown
area

where

project

changed

Our
design
brief
come
in
with
working
with
the
VTA
was
to
increase
housing
on
the
project
as
well
as
affordable
housing.
So,
yes,
you'll
see

the

we
have

range
of
unit
types
from
studios
up
to
three
bedrooms,
and
then
we
also
have
a
deeper
affordability,
whereas
previously
the
project
was
contemplated
for
50%
ami,
we
are
offering
30,
40
and
60%
so
deeper
portability
for
families
in
San
Jose
and
in
working
with
the
community
on
this
project
as
well.
In
some
of
our
community
meetings,
overwhelmingly
people
were
asking:
when
is
the
affordable
housing
coming?

was
one
of
the
very
strong
needs
that
we
got
from
the
community
and
we
wanted
to
move
this
project
forward
as
fast
and
also
providing
a
touch
on
the
architectural
styles
for
the
project.
Another
we
got
from
the
community
was
to
make
it
reflect
the
historical
nature
of
San
Jose,
the
the
styles
of
San
Jose,
the
vernacular
San
Jose,
as
well
as
the
teaming
community,
so
you'll
see
from
the
architectural
styles
we're
pulling
from
a
vernacular
San
Jose
style
such
as
edition
style,
Spanish,
colonial
Mediterranean.

These
are
ones
that
found
in
team
Ian's
community,
as
well
as
around
San
Jose,
just
to
walk
you
to
the
site
plan
as
well.
The
projects
when
we
award,
where
we
rewarded
them
the
project.
We
took
a
pause
and
ask
ourselves
what's
really
important
this
project,
where
we
really
want
to
make
sure
we
get
right
and
what
kept
on
coming
up
in
our
design
iterations
was
an
importance
trying
to
have
a
strong
pedestrian
civic
minded
closet
connecting
to
the
VTA
station.

wanted
to
step
down
the
architecture
soften
it
as
well
as
providing
for
amenities
on
the
pedestrian
level
to
provide
both
activation
of
the
street,
as
well
as
a
compliment
to
the
rest
of
the
surrounding
site.

sense
for
some
of
the
other
master
planning
components.
These
are
as
small
as
painting
the
crosswalks
in
a
decorative
pattern
that
complements
the
design
pulling
in
the
architectural
or
started
the
landscape,
planting
elements
in
a
similar
design
motif
and
then
also
at
a
larger
scale.

pulling
out
architectural
feature
architectural
features

design
the
project
such

it
creates
prominence
for
the
site
and
it
creates
a
true
master
plan.

space

connection

transit

connected

dire

need

affordable

community

neighborhood

more
affordable
housing
in
our
neighborhood,
because
it's
a
high
need
and
worked
at
Washington,
Elementary,
School,
so
I
know
a
lot
of
the
families.
This
is
something
that
that
we
are
in
need
of,
and
it's
been
on
the
planning
for
for
many
years,
and
you
know
I'm
already
in
my
mid-40s,
and
this
was
over
20
years
ago,
that
we've
been
asking
for
for
this
to
happen.
So
now
that
I
live,
have
my
own
house
I?

Yeah,
so
I
am
a
resident
at
Street,
which
is
near
the
taemin
station
and
I
am
definitely
in
favor
of
this
project.
For
many
reasons,
one
every
time
I
take
my
daughter
on
a
bike
ride
on
lick
Avenue
in
an
entertainment
part,
the
lot
looks
very
abandoned
and
vacated,
and
the
project
definitely
needs
an
uplift,
and
the
project
will
definitely
beautify
the
neighborhood
and
I
also
believe
that
we
definitely
need
verbal
housing
in
their
neighborhood,
especially
during
this
these
hard
times.
I

mean
I
really
support,
you
know:
affordable
housing
and
I.
You
know
friends
and
even
in
the
Washington
area
and
I
really
feel
for
them.
But
you
got
to
understand
that
what
you're
looking
at
here,
a
system,
a
greedy,
a
transposition
panel,
failure
what's
going
away,
it's
not
a
VTA,
possibly
parking
lot.
Is
the
entire
Cal
train
parking
lot
and
it's
just
not
any
cafe
parking
lot.
It's
a
southernmost
couch
with
pain,
baby
bullets
station.
The
parking
demand
is
in
excess
or
was
rather
prior
to
coming
in
excess
of
a
thousand
cars
a
day.

All
the
people
spoke
know
that
they
got
cars
all
over
the
day.
Then
the
Hebert
Hood,
the
v-j
army,
took
at
the
two
and
seventy-five
base
parking
spaces.
They
completely
ignore
the
fact
that
the
child
care
facility
at
seventy-five
dedicated
parking
spaces
the
way
through
every
day
by
people
and
even
their
children
there
before
they
go
not
helping
they've,
also
ignored
that
this
abandoned
piece
of
land
that
the
neighbors
referred
to
that's
way
the
overflow
attest.
There
is
another
200
cars
part
day
hunters.

Initially,
the
developer
was
supposed
to
be
medicating
for
this
by
building
a
parking
garage
with
450
spaces
from
memory
on
Alma.
On
the
other
side,
the
other
thing
I
think
that's
a
concern
is
a
child
care
facility
and
by
the
way,
I
do
thank
the
Planning
Commission
for
keeping
this
child
care
facility
used
to
be
9,000
square
feet
22nd.

delved
into
this
project,
where
our
members
have
had
a
chance
to
advocate
for
it.

however,
want

the
core
companies
and
Republic

their

analysis

about

community
parking
permits

prevent
people
who

currently

the
station

Caltrain

community

last
and
most
importantly,
there
needs
to
be
crosswalks
on
Lake
Avenue.
So
this
is
gonna
significantly
increase
traffic
and
we
need
crosswalks
on
lick
Avenue
with
bulges,
particularly
around
tini
and
park,
as
as
activity
will
increase
on
that
Street.

There's
an
unsafe
exit
from
tinea
Park
on
to
lick
Avenue,
which
currently
no
no
crosswalks
and
traffic
really
fast,
because
it's
a
wide
open
street,
so
I
want

make
sure
that
there's
bulges
with
crosswalks
at
tinea
Park
and
then
another
crosswalk
with
the
Bulge
act
at
the
entrance
to
the
to
the
station.

think
it's
important

get
those
modifications
and

heed

stipulations

Department

Transportation

working

update

bike
plan,

better
bike

2025
and

recommendations
and
suggestions

to
improve
access
in
and
around
that
area.
Improving
the
bike,
lanes
and
I
believe
some
of
the
other
recommendations
are
are
to
improve
that
trail.
That,
however,
is
not
going
to
council.

council
until
the
fall
and
additionally
VTA
undergoing
a
transit,
oriented
development
station
access
study
for
teh
nyan

is
focused
on

connections

VTA
is
on

call

they
want

board

policy
provides
guidance

tools

how
our
agency

address
transit
parking

these
tools
include
alternative
mode
support
to
make
sure
our
stations
are
more
accessible
to
bike
and
ped
access.
Car
bike
and
scooter
share
implementation.
Shared
youth
parking
agreements
with
private
neighborhood
parking
lots,
the
surrounding
area,
time
limits
to
promote
parking
turnover
and
met
of
shifting
parking
demand
from
one
station.

is,

it
is
heavily
utilized
to
a
station
area.
That's
not
adjacent
station
areas
at
VTA
or
nearby
VTA
parking.
Lots
are
highly
underutilized.
I
just
wanted
to
note
that
after
this
project

constructed,

be
the
same
number
of
parking
stalls
that
exist
today.
So
those
are
striped
parking
stalls
that
I'm
referencing
and
we
are
looking
into
shared
youth
parking
arrangements
with
some
of
our
neighbors
in
the
area
so
that
we
can
provide
parking
solutions
during
the
construction
phase.
So
I
just

to
share
that
detail.

this
is
kind
of
outside
of
the
scope

this

Willow
it
speaks
to
the
connectivity
that
connecting
to
this
site

off

trail
can
be

little
bit
sketchy
cars
speed

so

much
as
this
project
can
help
solve

kinds

exempt

excessive

able

craft
the
standards

this
one
there
is
no
minimum
motorcycle
parking
required.

applicant
will
provide
some
but
again

they
have

would
be

one
per
four
units
which
would
be
many
more
than
they
believe
they
require

their
developments.

were
able
