actually

come
in
here
and
I
get
a
Deja
Vu.
Many
of
you
who
are
here
probably
don't
even
know
this.
So
you
this
used
to
be
Santa,
Fe,
High,
high
school
speech
class,
and
so
when
I
come
in
here,
I'm
remembering
my
first
speech
when
I
arranged
flowers
for
Miss,
Marjorie
Carr,
who
was
forever
the
speech
teacher
at
Santa
Fe-
and
this
was
a
long
time
ago.
So,
but
the
room
looks
pretty
much
the
same.

just
have
a
minor
updates
for
you
all
the
first
one
being
that
many
of
you
know
that
Homeless
Court
no
longer
exists.
The
pandemic
sort
of
took
that
aside,
what
we've
done
and
and
before
I
go
any
further
I
want
to
introduce
Mr,
Chad
chittam,
who
is
really
implemented
a
lot
of
the
things
Mr
chittam.
If
you
wouldn't
mind
standing,
he
is
the
staff
attorney
and
also
administrator,
and
it
is
really
because
he's
he's
a
miracle
workers.

What
I
call
him
he's
been
able
to
implement
the
Outreach
court,
and
many
of
you
may
have
seen
the
press
release
on
that.
The
Outreach
court
is
the
court
that
is
trying
to
capture
those
defendants
who
need
an
incredible
amount
of
assistance
through
services
that
are
available
through
the
city,
and
we've
worked
with
many
of
City
staff.

In
order
to
make
that
happen,
and
so
it's
just
beginning
now,
we've
we've
only
had
three
or
four
participants,
but
it's
a
diversionary
program
so
that
if
they
participate
in
Outreach
and
they
are
connected
with
the
services
they're
needed
for
them,
then
they
do
not
get
prosecuted,
which
is
a
huge
incentive
for
them
and
also
creates
a
larger
benefit
for
the
community.
The
other
new
thing
that
I
wanted
to
mention
and
everything
is
actually
on
the
memo
that
you've
received
is
we
now
have
a
database,
that's
open
to
the
public.

It's
the
public
database
prior
to
that
we
would
just
post,
whatever
cases
would
appear,
would
be
on
a
court
on
that
date.
On
the
docket.
Please
excuse

I've
been
fighting
a
cold
and
if
you
have
questions
I
may
ask
you
to
repeat
it,
because
I'm
highly
congested,
but
anyway,
the
database
that
we've
implemented
is
accessible.
Attorneys
are
very
happy
with
it.
Everyone
else
who
accesses
it
is
happy
with
it
too.
You
can
now.

received
a
citation
and
you're
scheduled
to
come
for
an
arraignment
or
for
whatever
other
hearing
you
can
access
our
database
and
see
when
your
court
date
is
that's
huge.
Not
very
many
municipal
courts
in
the
state
have
that
option,
but
other
than
that
everything
else
pretty
much
remains
administrative,
we're
moving
forward
in
our
Landscaping,
which
is
huge
for
me,
and
we
also
adopted
a
language
access
specialist
program.
I
almost
cannot
hire
anyone
unless
they
are
truly
bilingual.

We
just
get
inquiries
on
a
daily
basis
and
never
know
you
know
if
it's
going
to
be
someone
who's
required
to
speak
Spanish.
So
when
we
interview
it's
a
real
plus
to
have
folks
who
can
speak,
Spanish
and
I
would
tell
you.
We
have
some
excellent
language
access,
Specialists
and
within
the
court
system,
they're
required
by
state
law
to
take
very
intensive
training
and
repeated
continuing
training.

we've
adopted
a
policy
for
that
and
are
hoping
to
incentivize
those
folks
to
stay
with
Santa
Fe
Municipal
Court,
because
my
history
has
been
that
they
leave
and
now
hopefully
we
can
keep
them
and
that's
part
of
the
goal,
but
other
than
that.

really
stand
for

on
any
questions
you
may

violations

forth

variety

we

by

police
officer

charged

a

dollar
fine
and
fee.

that's

common

it
really
does
get
cited
to
teachers,
not
for
non-professional
it.
Just
cell
phone
violation
happens
without
their
identifying
a
demographic.

adhere

well
to

hands-off
ordinance

explained

to
people
that
come
to
court,
that
that
is
a
very
strict
ordinance
and
it's
intended
for
the
safety
of
the
driver
and

people

bio
ordinance
violator
explain
to
them
that,
even
if
you're,
looking
at
your
GPS,
it's
a
No-No,
so
a
police
officer
may
ask
a
defendant,
were
you
texting?
Were
you
talking
whether
they
respond
appropriately
or

never
know.

chronic

big
things

have
going
on
the
munis
upgrade
continues

move
forward.

hrit

finance
departments
in
particular,

continued

work
very
aggressively
to
make
sure
that
we're
ready
for

still

to
be
a
transition
in
the
end
of
January,
and
so
we
actually,
the
I.T
staff,
led
a
really
productive.

lunch

learn

building

some
understanding
about
safe
spaces
and
how
they
work
and
lessons
learned
from
other
places

just
have
a
chance

talk

do
want
to
maybe
make
some
clarifications.
There's
been
some
newspaper
articles
this
week
about
our
public
process
and
they
are
there's
some
misunderstanding.

I
want
to
be
very
clear
that
when
the
governing
body
adopted
our
new
procedural
rules
in
January
of
this
year,
we
very
much
were
looking
to
increase
public
participation.

In
fact,
in
our
legislative
process
we
now
added
a
hearing,
so
a
bill
is
introduced
and
then,
at
the
next
meeting
very
next
meeting,
there's
a
public
hearing
to
hear
from
the
public
about
their
thoughts
about
the
legislation,
so
that
as
it
moves
through
our
standing
committees,
we
have
opportunities
to
address
if
there
are
problems
or
issues
or
need
for
information
and
do
that
on
the
front
end
and
get
the
work
done
in
committee
so
that
when
it
comes
to
this
night
to
this
governing
body
on
Final
passage,
the
legislation
has
been
given
a
lot
of
thought
and
Community
input
and
we
used
to
only
do
the
public
hearing
on
Final
passage
and
what
we
discovered
is
that's
kind
of
too
late
right,
because
we
do
the
public
hearing
and
then,
if
there
was
a
problem
with
the
bill,
it
was
pretty
much
a
done
deal.

Obviously
we
could
send
it
back
if
it
was
really
problematic,
but
I.
Just
I
want
to
make
that
comment
that
I
think
we
have
really
worked
to
make
the
public
process
better
and
there's
also
been
some
comments
that
the
that
there
are
a
couple
of
things
that
are
in
our
rules
that
they
are
just
not
so,
for
instance,
the
cross-examination
of
witnesses
which
we
may
hear
about
later
tonight.

Our
rules
do
not
address
that.
We
did
not
put
that
in
the
rules.
That
is
something
that
comes
as
a
result
of
particular
situations
when
you
are
a
party
to
a
case,
that's
in
front
of
this
body,
and
you
it's
part
of
that
post
posture,
part
of
that
legal,
proceeding
that
you
might
get
to
cross-examine,
but
only
if
you're
a
party
to
the
case
we
did
put
in
the
rules,
one
thing
which
has
been
a
long-standing
custom,
which
is
at
the
governing
body
level.

rules
say
that
you
can't
seed
time
to
somebody
else
to
give
them
a
longer
speaking
time
during
public
comment.
That
is
in
the
rules
that,
but
all
we
did
was
State
what
has
been
a
long-standing
practice.
It's
not
necessarily
new
in
the
way
this
body
does
its
work.
It
also
is
not
discouraging
or
limiting
people
from
participating.

Anybody
can
come
in
front
of
this
body
and
speak
for
two
minutes,
either
from
petitions
to
the
floor
about
anything
they
want
or
in
a
particular
public
hearing
on
a
particular
matter,
and
they
are
given
two
minutes.
You
can,
if
you're
part
of
a
group
line
up-
and
you
know,
designate
an
order
for
your
group
to
speak-
that
you
feel
makes
sense
in
presenting
whatever
it
is.
You
need
to
present
and
we
allow
anybody.

encourage

feel

strongly
that
we
need
to
correct
the
record
because
there

people
can
be
trained
to
get
jobs
in

industry.

saw

Lindell
there

seem
to
remember
her,
and
the
meow
wolf
folks
were

excited
to
host
us

officers
were
sworn
in
at

nice

she
did

great

officers
onto

recruits
and
find
people

want

decades

mismatch
that
exists
today
between
the
R1
zoning
and
the
three
to
seven
dwelling
unit
per
acre,
General
plan
land
use
designation.
You
know
when
I
started
on
this
case
about
a
year
ago.
That's
the
first
thing.
I
looked
at
I
said:
wow,
there's
a
mismatch,
or
why
is
there
a
mismatch?
Nobody
likes
a
mismatch
in
planning
situations,
but
it
exists
and
I'm
going
to
elaborate
a
little
bit
of
what
on
what
Dan
talked
about
and
expand
on
his
discussion
and
focus
on
some
critic.

That
mismatch
was
not
a
mistake,
but
rather
was
an
intentional
part
of
the
city's
land
use
designation
regulations
dating
back
to
1961.
in
1961.
This
section
excuse
me
in
1961
this
section
1441e4
existed
in
the
city
code
and
it
still
exists
today.
It
says
in
the
event
of
annexation,
of
new
areas
to
Santa
Fe.
The
area
shall
be
zoned
R1
until
otherwise
classified
let's
go
back
to
1961.

that
time,
the
city
council
had
the
opportunity
to
Annex
a
substantial
area
along
the
Old
Pecos
trail
to
the
city,
which
included
the
project
site,
Solly,
Lomas
and
Sev
in
areas
to
the
South
and

east.

was
a
major
annexation
to
the
city.
I
wasn't
around
at
that
time,
but
I'm
aware
that
at
that
time
this
area
was
not
on
the
outskirts
of
the
city
was
beyond
the
outskirts
of
the
city.

that
time
there
was
no
basis
for
the
city
to
carry
out
planning
of
this
area
to
decide
what
the
land
use
should
be
more
specifically
than
the
R1
Zone,
and
that's
why
it
was
in
your
code.
You
start
with
a
base
Zone,
it's
effectively
a
holding
Zone
that
stands
until,
as
the
as
the
section
says,
the
property
is
otherwise
classified.

It
was
a
great
effort,
a
lot
of
people
put
time
and
effort

heart
into
the
1999
General
plan.
Perhaps
some
of
the
folks
in
the
room

tonight

process
took
a
number
of
years
to
complete

result
was
that
the
city
council
at
that
time,
in

plan,

use

spoke
directly
to
this
property
and
other
properties
along
the
Old
Pecos
Trail,
as
Dan

showed
you
and
took
a
step
forward
in
the
planning
process.

They,
the
city
council
in
1999,
adopted
a
policy.
They
didn't
rezone
the
property,
that's
not
for
the
city
to
do
on
private
property.
That's
a
private
property
owner's
obligation,
but
in
based
on
the
development
patterns
and
existence
at
the
time
and
the
public
process
that
took
place
in
the
mid-1990s,
the
city
council
adopted
and
provided
guidance
to
all
of
us.
Since
1999
we
have
all
known.
If
we
look
at
the
general
plan,
land
use
map
the
city
council's
intent
in
adopting
the
1999
General
plan.

They
didn't
want
to
see
less
density
than
three
units
loss
per
acre.
They
didn't
want
to
see
more
than
seven
loss
per
acre
that
that
was
a
fade
to
complete
that's
what
the
council
did,
and
it's
guided
us
ever
since
and
I'm
going
to
go
beyond
what
Dan
talked
about
and
described
three
regulations
that
provide
guidance,
because
the
discrepancy
between
the
R1
zoning
and
the
three
to
seven
unit
breaker
land
use
designation.
That
was
intentional.
It's
built
into
the
plan.
It
was
inherent
in
what
happened
from
the
1960s
to
the
1990s.

first
one
is
the
resolution
that
adopted
the
general
Plan
update,
whereas
pursuant
to
the
state
law
guiding
General
plans
quote
the
zoning
regulations
and
restrictions
of
the
city
are
to
be
in
accordance
with
a
comprehensive
plan.
The
comprehensive
plan
is
your
general
plan.
This
makes
clear
to
you.

This
is
the
answer
to
the
question
of
how
to
resolve
the
discrepancy
either
the
zoning
could
guide
the
general
plan
or
the
general
plan
could
guide

zoning,
and
this
makes
clear
that
it

the
zoning

plan

sense,

to

of
these
two
sections
provides
the
answer
to
the
question
of
which
should
control

the

plan

us
and

the

spoke

Valero
at
the
State
Department
of
Transportation.

concerns

the
traffic
impact

this
proposed
development,
at

end
of
our
conversation,

Valero
stated,

intersection

not
considered
hazardous
until
a
fatality
has
occurred
on
Monday
evening,
December
5th

accident
in
opecost
trail
in
westia
intersection
involving
two
vehicles,
which
required
police
attention
and
an
ambulance.

is
unknown
to
me
the
cause
of
the
accident,
but
one
of
the
vehicles
went
over
the
embankment
and
land
in
one
of
the
proposed
building.
Lots
westia
is
a
poorly
designed
rural
residential
road
with
no
shoulders
and
or
sidewalks.

by
cyclists,
pedestrians

The
degree
of
curve

length
and
stopping
sight
distances

not
conducive
for
the
addition
of
an
Ingress

to

development
traffic

covid,
when
many
people

telecommuting

the

roadway

anecdotal
evidence

picture
presented
is
much
smaller

be
blunt,
it
is
too
dense
the
capital
Flats
at
Penn
and
Cordova
are
good
examples

infill
property

be
developed
at
its
current
designation
of
R1
and
infill
much
better
suited
to
the
environment
at

Corridor

influential

friend

my

Trail

designated

a
project

hope
