A
A
A
A
B
B
We
have
a
physical
quorum
present.
This
is
our
last
case
of
the
day,
since
the
other
two
were
continued.
We
already
had
a
motion
to
open,
so
they
are
open
and
we
have
any
general
introductory
remarks
anything
else.
Mr
sheldon
yeah.
D
I'd
like
to
just
just
make
a
comment
council
with
regard
to
the
any
hearing
frankly,
and
particularly
the
last
one,
in
that
it's
been
continued
to
to
march
4th
just
a
reminder
council
again,
because
this
is
quasi-judicial
and
it
is
a
in
the
process,
and
certainly
it's
not
finished.
D
I
would
just
caution
you
against
commenting
if
being
asked
on
this
subject
and
certainly
to
avoid
ex
parte
communications
other
than
that
comes
in
through
emails
and
the
like
and
which
are,
in
fact
uploaded
and
made
available
to
the
public,
so
just
to
caution,
please,
as
we
move
forward
with
these
types
of
hearings.
To
be
mindful
of
that.
Thank
you.
E
E
E
So
the
city
in
this
case
will
present
evidence
and
testimony
that
seventh
and
grove
received
information
and
education
on
mass
requirements
and
then,
after
receiving
that
information,
the
employees
were
observed
on
december
19,
2020
not
wearing
face
coverings
when
not
social,
distancing
and
patrons
were
also
without
face
coverings,
while
congregating
around
the
bar
and
other
open
areas,
then
again
on
january,
10,
2021
patrons
were
again
without
face
coverings,
while
congregating
at
the
bar
and
other
open
areas.
I
would
now
ask
kamaria
pettis
mackel
to
come
forward
for
presentation
of
testimony.
F
Good
morning,
camaria
pettis
mackel
from
the
city
attorney's
office,
I'd
like
to
first
call
officer
wayne,
rasmus
rasmussen,
actually
before
I
do
that
they
all
the
witnesses
need
to
be
sworn
in.
F
F
G
G
F
Can
you
please
introduce
yourself
to
members
of
city
council
crystal
ramos
city
of
tampa
code
enforcement
inspector
ramos,
were
you
employed
or
were
you
working
on
december
19th
of
2020
yeah
I'd
like
to
draw
your
attention?
Can
you
explain
to
city
council
if
you've
had
a
chance
to,
did
you
have
a
chance
to
respond
to
seventh
and
grove
which
is
located
at
1930
east
7th
avenue.
H
F
H
Yes,
this
is
a
photo
when
you
walk
into
the
business
and
there
were
several
people
standing
around
without
a
face
mask
at
the
time
they
were
not
drinking
or
eating.
F
Did
you
see
any
employees
walking
around
handing
out
masks
to
the
individuals
who
did
not
have
any?
No,
I
did
not.
Did
you
see
any
of
the
staff
members
remove
or
ask
the
patrons
to
leave
the
premises
if
they
were
not
wearing
face
masks?
F
H
We
did
ask
the
manager
to
come
outside
with
us
and
we
did
explain
why
we
were
issuing
a
citation.
I
also
even
showed
them
the
photos
that
I
had
taken,
showing
the
patrons
without
a
face
mask
and
then
at
that
time
we
did
go
ahead
and
issue
the
citations.
F
Next,
I'd
like
to
call
inspector
barbara
riley
who's
already
been,
who
was
previously
sworn.
C
I
believe
it
was
inspector
ruth
newton.
F
H
The
the
club.
F
And
were
you
able
to
take
a
photograph
depicting
your
observation
yeah
and
I'm
showing
you
the
photograph,
that's
on
the
screen
that
was
also
previously
provided
to
city
council.
Can
you
describe
to
city
council
what
we're
seeing
in
this
photograph.
C
F
At
the
time
that
you
were
at
this
establishment,
did
you
hear
any
announcement
from
the
establishment
regarding
requirements
for
face
mask
and
social
distancing.
F
At
the
time
that
you
were
at
the
establishment,
did
you
see
any
staff
member
handing
out
mass
to
those
individuals
who
did
not
have
one?
No
idea?
Where
did
you
hear
music
at
the
time
of
at
the
during
while
you
were
there
at
the
establishment
yeah?
F
And
the
photograph
that
I
just
displayed
to
you
there's
no
date
and
time
stamp,
but
does
that
this
photograph
fairly
and
actually
represent
the
observations
that
you
made
on
january
10th
of
2021
yeah?
And
you
said
that
I
I
don't
have
any
other
questions
for
officer
inspector
riley.
I'd
like
to
call
inspector
rasmussen.
F
G
F
Did
you
see
any
of
the
personnel
from
the
establishment
handing
out
face
mask
or
making
announcements
regarding
the
requirement
for
face
mask
no.
I
We
come
on
scene,
who's,
who's,
the
lead,
the
lead
officer
on
scene
or
who's.
G
I
go
ahead.
I
see
my
name
yeah,
mr
expected
rasmussen.
I
believe
that
night
inspector
jack
cuccio
was
our
lead.
G
I
So
we're
open
at
100
what
kind
of
counter
measure
or
counter
that
we're
doing
to
make
sure
that
the
bar
is
in
compliance
to
the
number
of
people
in
the
bar.
If
we're
saying
no
standing,
because
to
me
the
bar
looks
pretty
crowded,
so
I
mean
I'm
trying
to
figure
out.
How
could
you
have
seating
your
seating
on
a
dance
floor
anywhere
with
that
number
of
people
so
is,
is?
I
I
I
think
in
the
future
we
should
have
all
these
facts
in
the
place
these
new
things
come
into
play
now.
I
know
we,
we
see
this
activity
going
on,
do
do
we
just
automate
just
because
we
see
it
go
inside
or
do
we
go
in
and
talk
to
the
management
say:
hey,
I'm
gonna
come
back
in
an
hour
or
two.
G
I
That
was
what
I
asked
you.
What
I'm
asking
is,
if,
if
I
did
an
education
on
this
particular
bar
a
week
ago
or
two
weeks
ago-
and
I
come
back
this
saturday
night
and
I
see
this
crowd,
do
I
go
in
and
say:
let
me
speak
to
manager.
Jojo
joe
and
say:
hey
you've
got
a
problem
and
we
need
to
correct
this
or
you'll
probably
decide
this
this
evening,
or
we
just
say,
I
see
a
violation.
We
cite
you.
G
J
Thank
you,
mr
chairman
inspector
rasmussen,
and
excuse
me:
if
I'm
wrong,
were
you
the
one
who
testified
earlier
about
the
june
28th
education?
J
Yes,
there
was
okay
a
long
time
ago
and
and
this
year
it's
this
year.
Of
course
it
seems
like
centuries
ago,
but
how
is
it
that
you
recall
that
you
were
there
june
28th
I
mean.
Is
that
a
totally?
Is
that
a
totally
independent
recollection
or
is
that
a
function
of
documents.
G
To
me:
well,
that's
independent!
That's
when
the
original
order
was
done
from
the
governor,
so
we
started
going
out
and
flyers
to
inform
the
clubs
and
restaurants
and
we've
done
so
periodically
throughout
the
summer
in
december.
Until
now,
even
though
we're
still
doing
it.
J
Okay,
so
let
me
restate
my
question,
then,
in
regard
to
the
specificity
that
you
testified
to
about
june
28th,
you
you
work
five
days
a
week,
I'm
sure
you
got
hundreds
of
clubs
to
go
talk
to
back
in
june.
J
J
So
so
do
you
recall
going
to
this
particular
club
between
june
and
december
19th
with
updates?
Do
you
recall
specific
dates
who
you
talked
to
or
anything
like
that
in
terms
of
you
know,
warnings,
education
or
any
anything
like
that,
because,
obviously,
between
june
and
december,
things
were
changing,
orders
were
changing,
etc,
etc.
G
J
So
you're
just
saying
generically
you
went
you
covered
ybor
city
with
with
updates
and
and
flyers
and
in
education
between
june
and
december.
G
B
Thank
you
very
much
any
other
questions
or
comments
all
right.
We
now
go
to
the
respondents
cross-examination
of
cities,
witnesses
and
that
would
be
any
representative
or
owners
of
seventh
and
grove
restaurant,
which
were
if,
if
it's
the
same
group,
they
were
already
sworn
in.
So.
B
K
My
question
was
for
the
I
wasn't
getting
everybody's
names,
I'm
sorry,
we
don't
have
any
legal
representation.
We
are
all
the
owners
here,
but
the
gentleman
that
was
present
on
december
19th.
B
K
Okay,
there
was
actually
another
individual,
I
want
to
say,
maybe
a
higher
up.
I
was
present
that
day,
but
what
was
told
to
us
at
the
time
that
we
were
given
code
enforcement
and
they
come
regularly
sometimes
four
times
a
night-
was
that
they
will
return
every
45
minutes
and
will
cite
us
again
and
again
and
again
if
we
are
not
in
compliance.
I
just
want
to
make
sure
that
that
is
a
a
policy
up
there.
D
I
L
Keith
o'connor
city
of
tampa
manager,
neighborhood
enhancement.
There
was
no
policy
that
we
would
go
back
every
45
minutes,
but
we
did
in
the
beginning.
We
said
if
you're
going
to
return
as
clubs
get
busier
and
busier
in
ebore,
for
instance,
you
could
be
there
and
an
hour
later
it
could
double
in
in
size.
As
far
as
the
patrons
that
we
would,
we
would
try
to
come
back
not
sooner
than
45
minutes,
so
the
earliest
they
should
be
make
their
rounds
and
come
back
would
be
about
45
minutes.
I
So,
mr
o'connor,
does
that
mean
that,
like
I
stated
earlier,
I
come
and
I
see
the
bars
is
in
a
certain
situation.
I
say:
okay,
I'm
going
to
come
back
in
45
minutes
or
a
couple
hours,
and
if
it's
not
in
compliance,
I'm
giving
you
a
citation,
we're
saying
it
I'm
there
and
I
see
it,
I'm
going
to
cite
you
now
and
I'm
going
to
come
back
when
I
make
more
rounds
inside
you
again.
L
The
the
instructions
from
the
beginning,
once
we
decided
in
december,
that
we
were
going
to
start
writing
citations
since
we
had
been
out
every
thursday,
friday
and
saturday
night.
Since
actually
may
we've
been
out
there
every
night,
educating
and
encouraging
everyone
for
compliance
with
the
rules.
Our
goal
from
the
start
was
compliance
once
we
started
the
citations.
If
we
went.
L
We
had
one
violation
or
minor
violations
that
would
be
another
education
and
encouragement
time
for
the
bar
management
to
get
them
in
compliance.
But
if
we
walk
in
and
it's
flavored
violations,
multiple,
they
cite
right
when
they
go
in,
they
don't
have
time
to
get
through
all
the
bars
and
see
everything
and
have
a
30
minute
conversation
with
every
manager.
L
We've
been
doing
it
for
months
now.
So
that's
that
was
the
instructions.
When
we
started
in
december.
L
I
L
I
With
compliance
now
so
now
we
go
by.
Let
me
make
sure
right
now,
so
now
we're
tpd
we're
code.
We
go
by.
We
see
somebody
in
violation.
We
don't
talk
to
again
to
educate
the
talk,
saying
we're
going
to
be
back,
make
sure
you
make
sure
you
take
care,
take
care
of
your
house
or
we're
going
to
come
back
inside
you
we'll
just
say
now
we
go.
We
see
we
cite
correct.
L
If
it's
multiple
citations,
no,
if
we
go
in
there
and
just
see
you
know
a
couple
of
people
without
math
or
people
starting
to
congregate,
a
small
three
or
four
people
at
a
bar
will
remind
them
of
the
rules
and
they
come
back.
But
if
we
walk
in
there
and
there's
20
people
at
the
bar
for
30
or
40
on
the
dance
floor,
they're
going
to
get
sighted.
I
That's
my
question
again
now
the
dance
floor
because
again,
I'm
not
at
the
executive
orders,
because
I
I,
when
I
look
at
the
photos
of
several
grovers,
some
others,
I
see
a
bunch
of
people
standing
so
is
the
requirement
not
to
be
standing
on
the
dance
floor,
dancing
with
a
mask
or
without
a
mask
or
what
is
the
policy
on
that?
So
I'm
clear
on
that.
L
K
L
Waiting
to
be
seated
and
you're
waiting
to
go
in
once
the
bars
and
restaurants
need
to
have
seating
for
everybody
that
they
want
to
serve.
You
cannot
go
in
and
hang
around
drinking
or
standing
on
a
dance.
I
Okay,
so
basically
saying
that
this
should
be
well
look
at
the
position
there
should
be
no
standing
at
all
and
the
laws
of
restaurants
should
know
that
you,
regardless
of
your
occupancy,
you
need
to
have
chairs
and
tables
for
seating
versus
standing
for
the
occupancy,
and
all
bar
residents
should
have
that
policy
from
our
code.
Enforced
division,
correct.
K
L
K
Okay
and
when
they
do
change,
how
is
that
communicated
to
the
business.
L
Like
I
said,
we've
been,
we've
been
out
there
every
thursday,
friday
and
saturday
night
for
night
time.
I
think
your
location
a
lot
of
time
we
visit
at
night,
but
you
are
open
early.
We're
also
we're
also
there
monday
through
friday,
as
they
change
coming
out
with
the
new
flyers.
Suppliers
have
changed
the
information
on
the
flyers.
So
every
time
you
got
a
new
flyer
that
was
indicative
of
a
new
update.
L
Yeah
we
have,
we
have
multiple
spreadsheets
of
the
bars
we
checked.
Some.
Some
of
them
have
more
information
than
others.
Sometimes
the
bars
are
closed,
but
we
we
have
the
list
of
who
went
out
to
each
location
and
it's
usually
a
yes
or
no,
whether
they
just
they
gave
posters.
K
G
K
Okay
on
january
10th,
during
the
incident
that
you
described
to
where
there
were
patrons
again,
we
were
not
cited
for
masks.
We
were
cited
for
social
distancing,
not
practicing
social
distancing.
So
I
wanted
to
ask
you:
did
you
return
that
night
after
you
cited
us
the
first
time?
C
K
So
I
wasn't
present
that
night,
but
my
partner,
khalid
mcduffie,
was
when
we
were
told
that
there
would
be
to
be
no
people
on
the
dance
floor,
and
so
once
we
were
sighted,
we
remedied
that
situation
by
putting
chairs
and
tables
at
the
dance
floor
for
people
to
sit.
We
had
an
employee
that
day
that
had
a
medical
emergency
as
to
what
need
he
needed.
K
Ambulatory
care,
they
came
to
the
they
came
to
the
establishment
and
code
enforcement
was
there
and
they
could
not
get
through
because
the
gurney
could
not
fit
to
get
that
person
medical
attention.
I'm.
K
D
I
believe
the
city
might
have
some
redirect.
F
F
Please,
mr
o'connor,
as
a
as
a
part
as
the
manager
of
code
enforcement
in
order
to
keep
organized
the
number
of
inspectors
that
have
gone
to
the
different
establishments
to
educate
and
warn
the
establishments
regarding
the
orders
of
the
hillsborough
county
and
the
city
of
tampa.
Did
you
document?
L
Yes,
there's
a
spreadsheet
that
lists
all
the
boards
and
when
they
go
to
that
location,
it's
like
a
check
off
a
yes
or
no,
that
they've
been
there.
F
So
inspectors
can
have
also
independent
recollections
of
going
to
an
establishment,
but
also
you
have
documentation
as
the
manager
that
an
inspector
did
go
out
to
give
education
and
warning
to
a
particular
establishment.
L
F
C
B
K
However,
you
should
proceed
yes
and
again,
like
I
said
we
don't
have
a
legal
representation.
We
are
here
solely
on
our
business
and
I
just
wanted
to
give
you
a
little
feedback
about
our
business.
Not
many
have
expressed
what
we
actually
do.
K
My
name
is
dr
jamarus
glenn
all
right-
and
I
am
here
with
my
partners,
kalia
mcduffie
and
dr
vondelin
wright.
Again
we
are
the
owners
of
7th
and
grove
in
ybor
city.
The
three
of
us
are
tampa
natives
and
products
of
hillsborough
county
school
district.
We
started
our
business
in
june
of
2019
because
we
wanted
to
create
a
space
for
people
who
looked
like
us.
K
In
just
a
year
and
a
half,
we
have
dedicated
our
business
to
uplifting
black
voices
and
supporting
our
community.
We
employ
indirectly
over
100
people
of
color,
from
single
mothers
to
ex-cons
to
lgbtqia
persons,
and
during
the
pandemic
we
had
to
furlough
over
85
percent
of
our
workers,
knowing
that
we
had
to
let
go
of
people
we
considered
family
was
absolutely
and
utterly
heartbreaking.
K
With
the
help
of
local
and
federal
funding,
we
were
able
to
hire
a
majority
of
them
back,
but
over
the
past
year
we've
and
over
the
past
year,
we've
decided
to
partner
with
other
organizations
like
the
tampa
bay,
lightning
grow
financial
fueling,
the
front
lines
and
the
james
winston
foundation
to
donate
over
1500
free
meals
to
families
and
over
500
turkeys.
During
thanksgiving
last
year,
we
recently
honored
over
75
black
healthcare
workers
during
covet
19,
with
the
help
of
and
with
the
help
of
pepsi.
K
Recently,
we
fed
over
a
thousand
advent
and
tampa
general
hospital
employees.
The
this
friday
before
the
super
bowl
with
incredible
community
partners,
comes
incredible
growth
and
we
truly
would
not
have
been
able
to
make
it
through
without
the
support.
It
has
also
presented
unique
challenges
to
ensure
as
we
grow,
our
safety
measures
grow
with
the
demand.
K
During
the
time,
I'm
sorry
the
these
are
the
precautions
that
we
have
taken
since
then,
on
the
day
of
december
19th
after
we
were
fined,
we've
had
consistent
meetings
with
our
staff
to
ensure
that
all
employees
are
masked.
As
you
can
see
on
the
incident
of
january
10th,
there
was
no
citation
for
unmet
patrons
being
unmasked.
It
was
about
social
distancing,
which
we
also
you
know
teached
and
trained
our
staff,
but
unfortunately
we
failed
in
that,
but
we've
also
organized
and
attended
one-on-one
meetings
with
eboard
chamber
of
commerce.
K
President
lee
bell
and
courtney
orr
of
ycdc
for
best
practices
on
how
to
proactively
partner
with
the
city
and
code
enforcement.
We
have
mandatory
temperature
checks
at
the
door
gloves
and
masks
are
required
upon
entry
for
all
staff.
We
post
fast
face
masks,
are
required
and
lift
up
local
ordinances
on
our
windows.
K
We,
the
mask
and
face
shield,
is
required
upon
entry
and
must
be
worn
until
guests
are
seated
at
a
private
table.
Our
space
is
fogged
and
disinfected
at
least
twice
a
week.
We
provide
consistent
staff
meetings
for
front
of
the
house
and
back
of
the
house
where
we
could
inform
and
stress
new
covert,
19
mandates
and
sanitation
policies.
K
Guests
are
asked
to
wear
masks
when
walking
around
the
facility
if
a
guest
is
not
wearing
one,
an
employee
kindly
request
them
to
put
the
mask
back
on
if
the
guest
is
not
compliant
the
employee
escalates
the
security
detail.
Guests
are
prohibited
from
walk-up
bar
services
and
it
must
be
seated
to
receive
service.
We
have
touchless
sanitation
machines
that
are
stationed
throughout
the
facility.
Our
dj
announces
consistently
on
the
pa
system.
K
That
guests
are
to
wear
their
mask
and
will
not
receive
service
from
the
bar
if
they
are
not
seated
in
many
instances,
we
have
stopped
the
music
and
stopped
serving
the
bar
until
guests
comply.
We
have
also
had
security
escort
patrons
out.
We
finance
over
three
thousand
dollars
in
additional
seating
for
guests
throughout
our
space.
K
We've
increased
staffing
to
include
a
doorman,
to
explain
a
restaurant
policy,
we've
hired
police
to
help
facilitate
with
patients
who
are
non-compliant
and
may
be
resistant.
We've
bumped
up
our
security
to
a
dismal
twenty
thousand
dollar.
A
month
expense
to
escort
patients
out
patrons
out
who
are
non-compliant.
K
Our
experience
with
covet
19
has
been
incredibly
unique
in
that
myself
and
my
partner,
dr
wright,
are
both
practicing
health
care
providers.
We
have
assisted
in
covenanting
testing
sites
and
we
have
administered
the
vaccine.
We
have
seen
the
ramification
of
this
virus
firsthand
in
our
practices
and
understand
that
this
is
something
that
not
to
be
taken
lightly.
Suspending
our
liquor
license
would
absolutely
devastate
our
business
and
impact
our
employees
and
vendors.
K
Not
only
is
our
alcohol
license
at
risk,
we
are
now
in
jeopardy
of
losing
our
business
all
together,
because
our
landlord
feels
fears
his
wet
zoning
license
is
at
risk
risk.
We
are
asking
for
grace
today
and
a
continuing
partnership
with
the
city
to
provide
the
safest
environment
for
our
staff
and
patrons
during
this
trying
time.
J
Sir,
you,
mr
chairman,
oh
thank
you
dr.
I
just
wanted
to
get
some
clarification
on
the
the
mitigation
and
the
remedies
that
you
that
you've
identified
in
terms
of
off-duty
police,
disinfectant
announcements,
music,
etc.
Can
you
hear
me
okay?
I
can
okay.
So
in
your
case
the
allegations
are
that
the
officers
came
in
on
the
19th
of
december
and
and
gave
you
the
first
citation
with
warnings,
etc
and
then
came
back
on
january
10th,
approximately
two
three
weeks
later
and
issued
the
second
citation.
J
The
second
citation
was
basically
about
social
distancing
on
especially
the
dance
floor,
and
then
you
said
you
subsequently
remedied
that
with
chairs
and
tables
after
you
got
the
second
citation
on
the
tent.
The.
J
K
K
The
security
is
happened
after
december
as
well.
We've
had
incidents
to
when
we
asked
when
employees
ask
it
is
a
risk
to
their
safety,
as
you
can
youtube
it,
and
you
can
see
from
early
announcements.
There
are
people
who
are
very
vocal
about
not
wearing
masks
and
we
did
not
employ
our
employees
to
be
police.
We
tell
them
to
ask
nicely
and
if
security
sometimes
security
is
available.
Sometimes
security
is
not
I'm
sorry.
You
were
asking
about
the
police,
we
hired.
K
D
To
inquire
councilman
dink
felder,
I
just
want
to
be
clear
that
the
the
gentleman
is
is
complete
with
his
presentation
and
the
other
people
with
him.
Do
they
wish
to
speak
or
if
that's
not
the
case,
that's
fine
too,
but
I
just
want
to
be
clear
that
we
hold
the
questions
till
the
end
of
the
presentation
rather
than
interrupt.
If
we
can.
M
My
name
is
dr
rondalyn
wright,
I'd
like
to
speak
on
the
fact
that
sometimes,
when
we
ask
our
patrons
to
put
on
masks,
they
can
get
combative
and
we've
been
told
by
some
some
patriots
that
we're
violating
their
hipaa
rights
as
far
as
I'm
asking
them
to
put
on
masks,
and
they
have
reasons
that
they
won't.
So
I
just
wanted
to
make
that
statement.
N
Hi,
I'm
kalia
mcduffie,
I'm
also
one
of
the
partners
at
7th
and
grove,
and
I
also
want
to
add
to
we
have
a
good
relationship
with
code
enforcement.
Whatever
they
ask
of
us,
we
try
to
correct
it
right,
then
right
right
away
when
they
come
back,
we
let
them
back
in.
We
ask
them,
is
this
done
correctly?
They
normally
say:
yes,
they
normally
say
no,
and
if
they
say
no,
we
ask
right
then,
and
there,
how
do
we
fix
it?
How
do
we
make
it
right?
N
So
I
mean
we
do
have
a
good
relationship
with
code
enforcement.
I
don't
want
this
to
seem
like
we're
bashing
them
or
we
don't
have
a
good
relationship
with
them.
I
mean
anything
they
have
ever
asked
about
the
seventh
grove
and
when
we
do
get
citations
when
they
have
written
us
up,
we
have
corrected
them
right
then,
and
right
there.
So
I
mean
we
would
like
to
keep
the
relationship
wrong.
I
mean
we're
not
trying
to
get
any
more
citations.
N
M
B
M
Sorry
with
khalia,
I
wanted
to
add
that
we
are
being
seen
by
code
enforcement
at
least
a
couple
times
on
the
nights
that
they're
working,
and
so
we
do
question
on
the
rest
of
the
city.
Are
they
getting
the
same
force
that
we
are
because
we
know
of
places
that
probably
are
not
social
distancing
or
are
not
putting
as
much
effort
as
we
are
intimate
into
complying?
Are
they
getting
those
same
visits
that
we
get
every
single
time
that
code
enforcement
is
out.
K
Thank
you.
I'm
sorry,
one
more
comment
I
just
want
to
let
the
board
know
that
we've
only
received
two
citations
in
this
entire
time
again,
code
enforcement
has
been
very
cooperative
and
we've
been
very
cooperative
with
them
as
well
again,
it
is
not
a
bashing
thing,
but
we
wanted
to
also
indicate
that
that
we
we've
only
received
two.
I
Mr
chairman,
I
guess
that's
the
code.
Let
me
let
me
try
to
get
the
violations
clear.
We
have
one
violation
on
the
19.
is
that
for
no
mass
miss?
Where
is
that
for
no
mass
or
is
because
I
need
to
understand
if
we're
getting
a
citation
for
the
covet,
19
executive
order
or
we're
saying
we
get
a
citation
that
we
can
issue
one
for
a
new
mass
and
one
for
no
standing.
How
does
that?
How
does
that
work?
What
how
does
that
come
apply?
I
E
Susan
johnsonville
is
senior
assistant
city
attorney,
councilman
goods,
so
the
citations
that
were
issued
did.
It
did
in
fact
indicate
that
employees
were
not
wearing
a
face
covering
when
not
maintaining
social
distancing
and
that
patrons
were
unseated
on
the
dance
floor,
which
also
is
something
that's
prohibited
by
the
order.
So
it's
not
that
where
you
as
council
are
enforcing
those
particular
orders.
It's
that
a
violation
of
the
order
constitutes
a
violation
of
27-318
of
the
land
development
code,
because
it
is
a
failure
to
comply
with
health
and
sanitation
regulations.
E
I
E
What
the
order,
what
the
order
addresses
is
wearing
a
face
covering
so
if
you're
standing
without
wearing
a
face
covering
if
you're
congregating
without
wearing
a
face
covering
that
is
the
crux
of
the
violation.
That's
the
basis
for
these
proceedings,
which
again
is
a
failure
to
comply
with
health
laws
which
causes
which
gives
you
cause
to
consider
suspension
of
the
a
b
license
under
27-318.
I
Yeah,
I
I
I
get
that
I
just
when
I
look
at
some
photos
and
look
at
the
other
person's
photos,
and
I
see
and
when
I
in
my
mind
when
I
picture
driving
on
eboard
and
I
see
a
bunch
of
people
standing
inside
the
bars,
I'm
trying
to
figure
out.
Well,
that's
why
I
asked.
Is
there
a
counter
measure?
Are
we
counting
to
say
how
many
people
are
going
to
bar
because
it
only
can
be
so
many
seats
inside
of
a
bar
so
where
these
people,
where
they're
sitting
at
I'm
just.
E
Well
there,
the
the
orders,
if
persons
who
are
not,
who
are
not
seated
or
businesses,
are
precluded
from
serving
anyone
who
is
not
seated
at
the
bar
or
at
a
table.
So
people
have
to
be
seated
they're
not
to
be
congregating
around
the
bars
they're
not
supposed
to
be
served.
If
they're
standing
at
you,
they.
I
E
That's
that's
maybe
a
possibility,
but
that's
what
the
order
provides.
Is
that.
I
I
F
Kamaria
pettis
mackel
from
the
city
attorney's
office,
for
the
record.
Excuse
me
and
I
apologize
I
couldn't
is
dr-
is
it
dr
glenn?
Yes,
you
stated
the
the
safety
measures
or
the
safety
precautions
you
took
regarding
the
hand
sanitizer
you
did
that
after
you
received
your
citation,
correct.
K
This
is
also
this
is
all
out
after
cove
after
we
opened
up
for
covet,
but
we
did
order
extra
hand,
sanitizer
dispensers,
that
were
touchless
instead
of
just
keeping
a
hand,
sanitizer
pump,
we
ordered
touchless
hand
sanitizers,
and
we
ordered
about
two
or
three
extra,
but.
F
The
additional
avenues
to
address
the
in
order
to
come
to
compliance
for
the
ordinances
from
the
county
and
from
the
city.
You
took
those
measures
after
you
received
this.
B
B
K
K
We
know
that
the
alcohol
licensing
is,
you
know
up
to
your
your
decision,
but
again
again,
as
I
said
before,
this
is
not
just
about
days
that
we're
out
of
business.
This
is
about
affecting
a
lot
of
families
as
well
as
possibly
the
detriment
of
our
business.
E
E
I
think
the
testimony
that
the
city
provided
again
showed
clearly
that
7th
and
grove
was
in
violation
of
section
27-318
c1f
for
failing
to
comply
with
the
two
executive
orders
that
we
described
here
this
afternoon
and
there's
no
contradicting
testimony
or
evidence
in
the
record.
I
I
appreciate
dr
glenn's
comments,
but
none
of
none
of
them
or
his
or
his
business
partners
contradicted
any
of
the
evidence
or
testimony
that
was
presented
by
the
city,
which
again,
we
believe,
shows
clearly
the
violations.
E
But
we
would
ask
at
this
time
that,
based
on
the
evidence
and
the
testimony
that
the
city
has
provided,
which
we
clearly
believe
shows
a
violation
of
section,
27,
318
c1,
f-
that
the
council
does
make
a
finding
that
there
has
been
a
violation
and
then
in
considering
their
penalty,
that
council
consider
penalty
of
up
to
three
days
suspension
or
I'm
sorry
over
three
days,
suspension
for
this
establishment.
Thank
you.
Miss.
I
I
E
D
Yes,
I'm
going
to
I'm
going
to
cite
and
read
from
27
318.
city
council
may
suspend
the
ability
to
sell
alcoholic
beverages
for
up
to
30
days
for
the
first
violation
60
days
for
the
second
violation
and
90
days
for
the
third
violation
upon
the
fourth
or
subsequent
violation.
City
council
may
consider,
revocation
of
the
approval
to
sell
alcoholic
beverages
in
determining
whether
to
suspend
or
revoke
an
approval
to
sell
alcoholic
beverages.
D
D
So,
yes,
a
finding
of
a
violation,
does
subject
them
to
greater
penalties
for
subsequent
violations,
but
as
to
the
penalty
phase,
you
certainly
can
take
into
account
either
mitigating
or
aggregating
aggravating
factors
before
you
determine
whether
up
to
30
days
for
the
first
violence,
michelle.
D
It
says
in
determining
whether
to
suspend
or
revoking
the
approval
to
sell
alcoholic
beverages,
shitty
city
count.
Sorry,
forgive
me,
city
council
shall
consider
a
the
gravity
of
the
violation
b,
any
actions
taken
by
the
violator
to
correct
the
violation
and
see
any
previous
violations
committed
by
the
violator.
I
I
I
B
J
D
Sir,
and
I'm
going
to
be,
thank
you
very
much
councilman
dingfelder
and
I'm
going
to
ask
councilman
goodz
to
be
more
specific
that
when
you
actually
do
make
a
determination
of
a
violation
that
you
do
actually
make
it
as
a
finding
of
fact
and
refer
to
the
facts,
so
that
if
a
case
should
ever
end
up

You
know
something
I
think
I
would
prefer
that
we
talk
about
it
offline
and
again
remind
your
counsel
that,
just
as
with
any
quasi-judicial
matter,
your
decision
has
an
appeal
period
subject
to
appeal,
so
I
would
caution
you
to
be
mindful
of
the
30
days
and
to
not
comment
on
any
cases
related
to
to
your
decision.
Thank
you.
