Applicants
seeks
approval
to
allow
for
the
sale
of
alcoholic
beverages.
Let
me
turn
on
the
the
overhead
view
here.
First,
okay
applicant
seeks
approval
to
allow
for
the
sale
of
alcoholic
beverages
in
a
convenience
store
located
in
the
I
1
light
industrial
district
pursuant
to
2130
203
contingent
upon
compliance
with
location,
21,
o
102
purpose
of
the
I
1
zone,
21,
3,
201
and
specific
rules
governing
individual
conditional
uses,
including,
but
not
limited
to
2100
202
to
b6
a
through
H.
B
A
little
history
of
the
Casey's
property
in
1997
is
when
there
was
board
approval
for
variances
for
a
future
convenience
store
in
1998
underground
fuel
tanks
were
approved
by
City
Council
again
in
1998
a
2720
square
foot
convenience
store
was
built
in
1998.
Again
there
was
a
fence
and
a
canopy
constructed
and
in
2015
just
last
year,
two
building
additions
received
variances
for
construction
in
the
staff
findings.
B
Bar
Tavern
is
not
a
listed
conditional
use
in
the
I
1
light
industrial
district,
however
per
21
3
203
conditional
uses
for
the
I
Wanda
direct,
the
Board
of
Adjustment
may
permit
other
uses
which,
in
its
opinion,
are
not
detrimental
to
other
uses
and
are
in
the
general
character
of
other
uses
in
the
Iowan
district.
If
they
meet
the
purpose
of
the
I
1
district
4
21,
3
201,
the
following
rules,
requirements
and
standards
of
the
ordinance
are
to
be
considered
for
approval.
B
The
applicant
submitted
the
attached
site
plan,
which
reflects
or
does
not
reflect
these
regulations.
21
o
2o
2
2,
B
6
a
through
H
again
the
specific
rules
governing
individual
conditional
uses.
They
pertain
to
ingress
and
egress
off
street
parking
and
loading
refuse
and
service
areas,
utilities,
screening,
buffering,
signage,
exterior
lighting
required
yards
and
open
space
and
general
compatibility
in
a
location.
The
property
complies
with
location
which
is
under
Section
2.0
102
in
the
ordinance.
B
This
property
is
not
located
within
100
yards,
measured
by
the
regular
and
usual
path
of
travel,
travel
from
any
door
or
exit
of
any
church,
school
boys
or
girls,
clubs
or
community
sponsored
recreation
center.
So
it
meets
that
other
chapters
that
the
board
must
deal
with
in
considering
condition
conditional
uses
our
chapter
21,
63
off-street
parking
and
loading
requirements,
chapter
20,
165,
outside
storage
and
display
requirements
for
specific
uses,
chapter
20,
173,
landscape
and
lighting
standards
in
chapter
21,
80
signs
and
outdoor
advertising
signage
was
not
addressed
in
this
application.
B
Any
signage
would
be
required
to
be
issued
by
a
compliant
signage.
Permit
variances
were
granted
as
I
mentioned
in
2015
for
expansion
of
this
store.
Those
improvements
are
not
yet
completed,
I,
don't
believe,
they're
even
started,
and
in
that
southerly
addition,
which
will
go
right
here.
That's
where
they
want
to
put
this
liquor
store
section.
B
If
approved,
the
applicant
will
apply
to
the
City
Council
for
alcoholic
beverage,
license
the
specifics
on
that.
So
this
board
must
determine
if
satisfactory
provision
and
arrangement
has
been
made
concerning
2102
o2
to
b6
a
through
H
and
the
chapters
that
I
specified
previously
and
if,
if
endorsed
this
board,
has
the
authority
to
compel
fulfilment
of
any
and
all
boulevard
infrastructure
requirements
in
conjunction
with
any
structural
improvements
authorized
by
build
a
building?
C
B
B
That
is
not
part
of
this
application
if
they
cannot
revise
their
plan.
Let's,
let's
say
you
approve
this
conditional
use,
that's
what
we're
here
for
and
if
they
cannot
revise
their
plan
to
fit
last
year's
variants
approval
then
they'll
have
to
come
back
to
you
for
a
new
variance
because
it
was
not
public
noticed.
Okay,.
D
D
A
A
E
E
F
E
So
I
will
do
whatever
we
have
to
to
make
this
work
I'm
willing
to
do
that
because
you
guys
are
working
with
us
great.
So
if
that's
a
concern,
I'm
sure
that
we
could
take
out
the
windows
and
the
door,
but
that's
kind
of
our
view
is
that
way
we
can
help
each
other
and
see
what's
going
on
in
both
both
areas
and
plus,
for
me,
it'd
be
a
safety
concern
that
there's
only
one
tenant
in
that
liquor
store
we're
with
Casey's
policy.
E
E
G
E
G
E
H
H
A
H
Butcher
shop
opened
up,
we
had
kind
of
the
same
concerns,
I
believe
I
called.
We
talked
with
the
city
attorney
and
at
that
time
he
informed
us
that
it
stipulated
that
there
had
to
be
a
wall,
physical
barrier
and
a
separate
entrance
from
another
establishment
accepted
altogether
and
that
it
had
to
have
a
separate
tale
and
a
separate
staff
running
that
portion
itself.
J
Luke
Molly
first
district,
just
two
points
that
you're,
probably
aware
of
one
of
which
is
you,
do
as
a
Board
of
Adjustment,
absolutely
have
the
ability
to
add
conditions
on
to
a
request
if
you
feel
it's
in
the
nature
of
the
requester
pertinent
to
it.
So
you've
got
the
ability
to
attach
a
condition,
as
has
been
mentioned,
about
requiring
a
door
there
and
not
in
between
that's
something,
that's
typically
allowed
within
conditional
use
requests.
The
other
one
is
one
that
I
I
try
not
to
ask
questions.
J
I,
don't
have
any
idea
on
in
this
case,
I'm,
not
sure
if
you
have
any
other,
if
you've
issued
any
other
would
be
bar
tavern
in
the
industrial
district
and
so
at
a
minimum
I.
Don't
think
we
paid
enough
attention
to
the
fact
that
there
should
be
a
requirement
that,
at
a
minimum,
that
property
be
rezone
DIF
not
at
all,
if
not
to.
A
J
A
A
K
J
L
Wait:
Pengilly
finance
officer
I
handle
the
alcohol
licenses
for
the
city,
just
to
clarify
something.
I
was
never
approached
that
this
was
going
to
be
a
bar.
This
will
be
a
package
liquor
package.
Malt
beverage
license
beer,
only
no
video
lottery
and
no
serving
in
the
building
at
all,
strictly
off
sale.
Just
you
know
no.
M
John
May
I
guess
my
biggest
concern
too,
is
just
the
door
and
the
windows
facing
into
the
convenience
store
itself
and
in
the
liquor
industry
long
enough
to
know
that
it
is
a
high
risk
industry
for
theft
as
well.
That's
why
you
have
to
have
a
clerk
in
that
in
the
position
to
stop
that
from
happening
all
the
time
and
I
don't
think
with
their
business
plan.
M
D
D
A
E
Don't
need
my
Casey's
again,
just
one
thing:
I'd
like
to
say
too
is
I
oversee
South,
Dakota,
Minnesota
and
Iowa
and
I
have
51
stores
all
together.
Watertown
in
Milbank
are
my
only
two
cities
that
I
do
not
have
beer
in
my
stores
and
I
understand
the
concern
for
theft
and
and
other
things
out
there.
But
one
thing:
I
like
to
pride
myself
on
and
working
for
a
company
like
Casey's
that
we
do
take
age
restricted
products
very
seriously,
and
we
do
have
many
security
systems
in
place
for
theft
reasons.
E
We
will
do
everything
we
can
to
minimize
that-
and
that's
my
word
and
Casey's
word,
and
we
do
a
lot
of
quarterly
training
on
age-restricted
products
and
what
to
look
for
and
stuff
like
that,
so
that
part
of
it
doesn't
concern
me
as
much
as
the
safety
of
that
individual
in
there
and
that's
my
biggest
concern,
because
Casey's
is
very
strict
on
having
two
people
at
night
to
deter
theft
and
robberies
and
stuff
and
I.
Just
don't
feel
comfortable,
not
seeing
being
able
to
see
into
that
liquor
store,
I'm
perfectly
okay
and
I'm.
E
A
A
E
A
H
C
H
H
B
B
I
I
City
Council
is
going
to
decide
on
the
kind
of
alcohol
or
whatever
is
inside
there,
so
it
will
be
a
beer
ask,
but
we're
really
only
concerned
about
the
building
itself
and
for
what
the
prescribed,
what
he's
saying,
is
going
to
be
in
there.
So
if
we
want
a
window
in
there,
okay,
but
not
a
door
and
not
a
sliding
glass
window,
obviously
then
or
then
you've
got
a
door
really.
You.
G
A
B
Okay,
applicant
seeks
approval
of
modification
of
site
plan
for
the
expansion
of
a
medical
facility,
previously
approved
by
a
conditional
use,
formerly
known,
as
special
exception
contingent,
upon
compliance
with
specific
rules
governing
individual
conditional
uses,
including,
but
not
limited
to
21:02,
to
be
six
A
through
H
and
concur
concurrently.
The
applicant
appeals
the
following
ordinance
regulation
to
allow
for
that
construction,
which
is
section
21,
o
302,
which
prohibits
the
alteration
modification
and/or
enlargement
of
non-conforming
structures.
B
Prairie
lakes.
Health
care
system
submitted
application
for
conditional
use
approval
for
modification
of
site
plan,
including
parcel
expansion
to
facilitate
the
construction
of
a
compliant
medical
offices,
addition
onto
a
legal
non-conforming
building
and
allow
for
new
parking
lots
in
the
proposed
expansion
of
the
existing
medical
facility,
a
little
bit
of
insight
into
what
they
are
proposing
and
the
proposed
building
addition
will
be
a
two-story,
brick
and
glass
medical
office
building
with
a
relocated
helipad
mounted
on
the
roof
of
the
building.
There
is
an
existing
helipad
located
on
grade
that
is
being
proposed
to
be
removed.
B
Chapter
20,
163
off
street
parking
and
loading
requirements
and
21-7
304
parking
lot
requirements
also
proposed
the
closure
of
to
site
driveways,
a
new
main
driveway
off
3rd
Street
Southwest
on
the
east
side
of
the
property
and
a
relocated
driveway
off
of
20th
Avenue
Northwest
additional
right-of-way
vacation
requests
will
be
forthcoming.
Certain
property
purchases
within
this
application
have
not
been
finalized
by
but
are
expected
to
be
completed
within
the
near
future.
B
A
N
N
When
that
was
originally
approved
and
built,
the
houses
on
7th
Avenue
Northwest
that
Prairie
lace
owns
was
left
there
to
be
a
buffer
zone
for
the
traffic
and
parking
and
to
cut
down
on
the
noise
of
the
helicopter.
Okay
and
now
they
are
saying
they
want
to
eliminate
all
that
and
then
they
on
on
the
corner.
They
want
to
put
up
a
a
pond
water,
overflow
or
whatever,
and
right
next
to
the
school
I.
Think
that's
a
hazard.
N
Okay,
back
when
that
clinic
was
built,
it
was
suggested
that
they
take
the
whole
thing
out
north
of
the
city
and
buy
a
piece
of
property
and
rebuild
the
clinic
and
the
hospital
and
use
the
whole,
the
old
hospital
for
a
elderly
nursing
home
okay,
but
that
never
materialized
and
they
got
their
way,
but
right
now,
I'm
objecting
to
them.
Taking
that
buffer
zone
houses,
it
was
three
houses
and
moving
them
out
or
destroying
them
or
whatever
they're
gonna
do
as
a
buffer
zone.
N
N
A
A
N
Cut
down
the
noise
on
the
helicopter
coming
in
and
they're
suggesting
or
recommending
that
they
be
taken
out
and
I
object
to
that
it
will
Lord
lower
my
property
value
and
everybody
else's
on
7th
Avenue.
So
right
now,
I
think
on
classified
as
an
r1
or
r2.
If
you
lower
my
thing
to
r3,
so
I
can
put
in
a
physical
therapists
office
or
something
then
fine,
looking
out
my
front
window
and
seeing
all
those
cars
parked
there
in
front
of
my
house,
that's
not
acceptable.
N
A
I
N
N
D
O
Hi,
my
name
is
Scott
Davidson
architect,
working
with
Jill
in
the
hospital,
so
one
thing
that
I'd
like
to
address.
So
when
it
comes
to
noise
barriers,
there
are
actually
a
number
of
different
avenues.
I
understand
the
houses
is
a
buffer,
but
I
actually
think
from
a
sound
fences
properly
designed
might
actually
be
a
better
solution.
O
So
when
we
designed
the
chiller
building,
that
was
put
there
a
number
of
years
ago,
there
were
also
noise
concerns
with
that
and
what
we
ultimately
wound
up
doing
was
looking
at
fences
that
knock
the
noise
down
and
we
were
able
to
prove
that
through
the
math
associated
with
the
fence.
So
if
noise
is
a
concern,
there
are
avenues
like
that
and
also
I
think
from
there's
also
buffers
such
as
foliage
trees,
bushes
hills.
O
That
I
think
would
actually
serve
this
gentleman's
purposes
better
than
the
houses
themselves
and
I
think
that
we
could
show
that
through
the
use
of
3d,
3d
visualization,
sound
studies,
or
what
have
you
so
I
don't
want
to
suggest
that
we
have
to
go
there
because
I
think
there
are
I
think
that
the
solutions
that
we
have
up
there
are
good
as
well.
But
if
you
want
to
entertain
some
of
those
types
of
things,
there
are
certainly
ways
that
there's
designers,
we
do
it
for
clients
all
over
the
country.
I
Scott
you're
not
opposed
to
using
trees
of
some,
because
you
kind
of
understand
what
they're
saying
you
all
of
a
sudden.
You
open
up
a
residential
area
to
a
parking
lot,
but
some
nice,
really
nice
trees
would
to
me
and
I
appreciate
what
you're
saying
about
the
noise
from
the
fences
being
a
killer
to
stop
it.
But
it's
also
the
look
of
it
that
trees.
J
O
O
So
along
third,
we
had
already
been
planning
on
a
series
of
berms
along
there,
which
would
and
berms
being
basically
small
hills
running
along
there,
along
with
bushes
and
trees.
Already
thinking
about
the
houses
over
here,
it's
my
honest
opinion.
It's
less
about
sound
and
probably
more
about
headlights,
that
sort
of
thing
at
night
and
and
I
think
that
would
vary,
and
the
berms
would
be
size
such
that
that
gets
knocked
down.
I
think
he
could
very
easily
extend
that.
O
O
Going
to
be
stormwater
management
is
something
that's
required
by
code.
We're
gonna
have
to
address
it
in
some
form
or
another.
The
calculations
on
that
are
still
being
done.
It
has
to
do
with
the
amount
of
impervious
asphalt,
that's
being
put
into
place
here.
So
currently,
a
large
portion
of
this
site
is
being
fed
into
the
downhill
portion.
Doubt
runs
down
to
the
railroad
tracks
that
was
put
in
back
when
we
did
the
covered
canopy
I
think
in
2012.
O
O
That's
why
mosquito
catcher
doesn't
really
concern
me
a
little
bit
water
hazard
during
rain.
They
are
designed
to
fill
up
because
that's
the
way
it
works.
The
water
runs
from
the
back
blacktop
into
that,
and
then
it
slowly
seeps
away
into
the
groundwater
and
so
they're
designed
to
basically
catch
that,
so
it
doesn't
overflow
the
the
drainage
system.
O
So,
after
a
heavy
rain,
there
would
be
water
standing
in
there
and
then
it
would
drain
away
in
a
day
or
two
most
the
time
that
it's
dry,
but
that's
only
if
it's
actually
going
to
wind
up
being
necessary
today,
we're
being
conservative
and
showing
it
there.
Our
hope
would
be
that
it
goes
away
and
if
the
group
so
felt
it,
it
could
be
done
via
a
buried
structure.
There's
an
added
cost
of
the
owner
for
that.
But
it's
a
possibility
as
well.
Okay,.
K
And
I
do
want
to
confirm
that
those
type
of
facilities
are
not
only
built
in
this
type
of
construction,
but
every
residential
neighborhood
that
reaches
a
certain
size
has
these
same
facilities
built
right
into
the
neighborhoods.
So
this
is
not
an
uncommon
request.
In
fact,
it's
become
the
normal
operation
of
development
in
this
community
I.
D
C
If
I
could
make
a
comment
on
the
helipad
and
Scott,
if
I've
got
my
details
wrong,
you
can
back
me
up
but
currently
are
on
grade
on
the
ground.
Helipad
is
grandfathered
actually
by
the
FAA,
and
we
cannot
expand
any
part
of
our
building
even
an
inch
without
violating
the
grandfathering
they
gave
a
sport.
The
space
is
too
small.
The
pilots.
Don't
like
it.
It's
not
a
real,
safe
environments,
much
safer
to
land
on
top
of
a
building.
We
desperately
need
a
canopy
structure
over
our
er
outpatient
entrance.
C
It's
entirely
exposed
to
the
elements
and
every
patient
who
has
outpatient
surgery
goes
out
through
that
entrance
to
get
into
their
car
and
there's
absolutely
no
overhang
or
protection.
We
can't
add
that
now,
with
a
helipad
location
where
it's
at
so
that
would
be
a
significant
improvement
for
the
patient
experience
and
for
patient
and
for
safety
of
our
helicopters
coming
in.
C
C
We
built
we
remodeled
in
place
in
the
existing
hospital
building
to
find
room
for
them
and
they're
out
of
space
and
those
clinics,
because
they've
really
grown
their
practices,
and
we
have
three
new
physicians
coming
in
September,
two
more
surgeons
and
a
dermatologist
which
we've
been
trying
to
recruit
to
this
community,
for
you
know
well
over
15
years,
and
so
that's
phenomenal.
You
know
good
things
in
terms
of
health
care
delivering
this
community,
but
our
dermatologists
will
have
to
be
in
a
temporary
structure
until
this
building
is
completed.
Joe.
D
C
We
have
18
rural
outreach
sites
going
into
western
Minnesota,
a
Sisseton
meal
Bank
and
those
doctors.
Those
specialists
go
out
and
do
outreach
and
they
try
to
do
what
they
can
in
those
communities,
because,
as
we
believe
that
health
care
should
be
local,
but
there
are
procedures
that
those
patients
can't
have
in
their
communities.
So
then
they
come
into
town
to
have
a
surgical
procedure
or
cath
lab
procedure.
So
then
you
have
some
economic
impact.
From
that
you
know
again,
that's
we
have
550
employees
and
we're
continuing
to
grow
our
health
care
system.
So.
H
F
B
F
7
321,
7th,
Avenue,
320
and
320
I'm,
sorry
320,
but
we're
noise
wise
we
can
put
up
with
the
buffer
houses,
are
what
is
important
to
me.
Looking
out
my
kitchen
window,
I'm
gonna
see
parking
lot
and
cars
when
that
clinic
was
proud
and
when
the
clinic
was
built,
they
promised
we
didn't
get
it
in
writing,
but
they
promised
that
those
houses
on
the
north
side
of
7th
Avenue
would
stay
so
that
it
would
look
more
like
a
residential
area
and
not
a
big
parking
lot
outside
our
windows.
I
Would
make
a
motion
scott?
Do
we
need
to
have
something
in
it?
As
far
as
because
I
appreciate
what
the
clocks
are
saying
with
this,
do
we
need
something
in
there
that
says
there
will
be
trees
flying
it
along
because
they
really
don't
want
to
look
at
cars
and
because
they've
got
houses
now,
but
do
we
need
anything
in
there
jail
and
maybe
jail,
or
is
it
an
understood
or.
B
I
Want
a
little
help
in
wording
that
to
make
sure
that
there's
something
so
they
don't
look
in
to
a
fence
and
okay
I
like
that
tree
thing:
I,
don't
this
is
not
going
to
be
a
amiable
deal
really
big,
but
I
think
it's
if
we
can
work
out
something
that
looks
decent
because
I
would
make
that
motion
if
we
could
get
trees
and
I.
Think.
O
The
berms
I
think
are
the
other
I
think
berms,
bushes
and
trees.
I
think
you
could
probably
word
it
something
like
firms,
bushes
and
trees,
to
reduce
nighttime
lights,
headlights
on
cars
and
and
reduce
sound,
and
it
could
actually
be
a
fence
as
part
of
that
as
well
and
I.
Think
that's
something
that
sound.
O
The
sound
and
the
visual
to
be
consistent
with
you
know
other
similar
types
of
situations,
I
guess
the
hospital
and
I've
worked
with
the
hospital
for
well
over
a
decade
and
they've
always
tried
to
be
worked
hard
to
be
a
good
neighbor.
They've,
always
directed
me
to
try
to
be
a
good
neighbor.
We've
put
up
fences
in
the
past
in
different
locations.
Put
up
bushes
trees.
That
sort
of
thing
so
I
don't
see
any
reason
why
we
wouldn't
be
able
to
accommodate
that
in
this
sort
of
a
project
all.
I
J
B
A
A
D
K
Okay,
first
I
want
to
take
the
pleasure
and
welcome
to
new
staff
members
to
our
proceedings
here,
one
being
justin
gets,
who
is
our
new
city
attorney?
This
is
his
first
meeting
with
the
this
board,
so
wouldn't
want
to
welcome
him
and
all
of
his
knowledge
and
background
that
we
can
utilize
his
skills
well
for
our
boards.
So
the
other
one
I
want
to
introduce
is
brandy,
Hanten,
she's,
sitting
two
people
to
my
left
and
she
is
our
new
urban
planner.
K
J
A
K
K
The
hospital
did
come
to
an
agreement
to
purchase
that
property
and
through
this
process,
then
we
required
them
to
come
forward
with
another
petition.
The
first
petition
documents
just
for
clarification
that
appeared
in
the
packet
did
not
have
all
the
signatures
required
to
fulfill
the
petition,
because
the
hospital
has
not
obtained
the
actual
deed
to
the
property.
They
have
entered
a
agreement
to
purchase
and
I
understand
the
in
August.
That
purchase
will
be
complete.
K
So
what
we
did
is
we
requested
that
they
perfect
their
petition
and
they've
done
so,
and
you
just
got
handed
out
to
you
at
your
desk
the
perfect,
the
perfect
petition
that
has
all
the
signatures,
then
of
the
joining
property
owners.
With
that
said,
I
don't
have
anything
additional
to
add,
except
that
now
there's
no
need
to
maintain
a
utility
easement
for
this
vacation.
We
can
grant
the
vacation
completely
and
remove
all
utilities
great.
A
Like
again
Jason,
thank
you
any
discussion,
all
in
favor,
say
aye
aye
motion
passes,
I
have
a
question
now
that
we
have
an
urban
planner
and/or
with
a
cook
working
closely
hand-in-hand.
Are
we
going
to
get
a
hospital
campus
district
and
a
school
campus
district,
and
so
we
don't
have
to
go
through
some
of
these
hoops.
J
It's
not
the
first
item
on
the
agenda,
but
yes
in
the
end,
where
we're
at
right
now
and
I'll,
just
kind
of
give
you
the
project
list
as
to
what
we've
got
working
through
first
district.
In
that
first
item,
that's
on
on
the
task
list
is
the
update
to
the
sign
code,
which
there's
a
small
subcommittee
working
on
at
this
time,
we're
trying
to
get
together
on
that.
The
other
thing
is
the
formal
update
to
the
land
use
plan.
That's
pretty
well
stalled
out
here
for
a
while
here.
J
That'll
also
be
picked
up
here
to
be
done
by
the
by
the
end
of
this
calendar
year
would
be
at
that
point.
That
would
be
pertinent
to
do
that,
because
to
have
that
campus
district,
it
should
be
referenced
in
the
land
use
plan.
So
the
answer
is
it's
coming,
but
it's
land-use
plan
should
be
first
I.
Think
it's
kind
of
your
way
to
remind
we
need
to
do
that.
I'm
betting.
More
than
anything.
A
J
K
Well,
I
guess
I
can
give
you
a
little
old
business.
We
city
staff
has
received
a
new
concept
plan
regarding
stony
point
and
right
now.
Staff
is
we're.
Gonna
convene
our
design
review
team,
we're
gonna,
evaluate
where
that
new
plat
request
and
plan
fits
with
what
we've
approved
to
date
and
what
we,
what
has
changed
to
date.
K
I
will
be
simple
and
say
that
at
this
point
it
does
not
include
a
channel
so
we're
evaluating
that
we'll
come
back
with
more
formal
information
at
the
appropriate
time,
but
I
just
wanted
in
case
that
had
hit
out
there
that
we
have
received
some
information
and
all
we're
doing
is
evaluating
over
at
with
iterate
it.
At
this
point.
So
thank.
