This
owner
applicant
is
Michelle
Kelly.
The
property
address
is

43rd,
Street
Northwest.
She
has
a
conditional
use
request
to
operate
a
service
business
beauty
salon
from
her
home
located
in
the
r1
single-family
residential
district.
This

contingent
upon
compliance
with
21.7,
double

home
occupations
and

double
O,

home
occupations,
standards
and
specific
rules
governing
individual
conditional
uses,
including,
but
not
limited
to
section

staff
findings
are
all
public
notice.
Requirements
were
met.
B
The
home
occupations
is
a
listed
conditional
use
for
the
r1
single-family
residential
district
for
21
1403
v,
which
is
home
occupations
in
accordance
with
chapter
20
170.
By
definition,
a
home
occupation
is
any
occupation
which
is
clearly
secondary
to
the
main
use
of
the
premises
as
a
dwelling
and
does
not
change
the
character
thereof
or
have
any
exterior
evidence
of
such
secondary
use
other
than
a
non
illuminated
sign,
not
exceeding
400
square
inches
in
area.
B
B
Okay,
chapter
21,
63,
off-street
parking
and
loading
requirements
and
engineering
design
standards.
Sufficient
area
exists
for
three
legal
off
street
parking
spaces
to
be
counted
as
a
legal
off
street
parking
space.
They
must
meet
minimum
size
and
location
standards
and
allow
the
exit
of
a
vehicle
without
moving
another
vehicle.
A
minimum
of
two
off
street
parking
spaces
are
required
just
for
the
single-family
dwelling
alone,
and
this
board
may
require
more
as
a
condition
of
secondary
uses
such
as
home
occupations,
chapter
21,
65
is
outside
storage
and
display
requirements
for
specific
uses.
B
Section
21,
7,
double
O
2
supersedes
the
secondary
four
for
secondary
uses.
Just
the
normal
residential
standards,
7
double
O,
2
2
says
no.
Outdoor
storage
of
equipment
or
materials
used
in
the
home
occupation
shall
be
permitted
and
number
6
says.
No
public
display
of
goods
shall
be
allowed
on
the
premises
except
inside
the
principal
building:
chapter
21,
73,
landscape
and
lighting
scant
standards.
There
is
no
sidewalk
or
trail
in
the
area.
Several
trees
exist
in
the
front
yard.
B
B
Overhanging
limbs
are
dangerous
to
the
public
health
and
safety
of
the
citizens
and
are
hereby
declared
a
public
nuisance.
So
this
board
must
determine
if
this
request
shows
satisfactory
provision
and
arrangement
concerning
chapter
20,
170,
home
occupations
and
standards,
section
21,
o
202
to
b6
a
through
H
specific
rules
governing
individual
conditional
uses
in
chapters
21,
63,
65
and
73,
as
just
as
I
just
went
over.
If
generally
endorsed.
This
board
may
consider
conditions
of
approval
such
as
fulfillment
of
any
are
all
lacking.
B
A
B
This
has
interpretation
of
that
has
changed
over
the
years
I've
been
here.
It
does
not
specify
the
Boulevard,
even
though
it
has
been
interpreted
that
way
in
the
past.
So
right
now
as
long
as
a
tree
and
we're
talking
deciduous
trees,
because
evergreens
are
prohibited
in
in
the
boulevard
blocking
view.
As
long
as
it
is
in
the
front
yard
and
near
the
sidewalk
or
Boulevard
area,
we
can
called
that
okay.
A
B
D
D
A
D
Her
current
work
schedule
is,
as
a
preschool
teacher
Clara
stone
church
should
be
full-time
Tuesday
through
Thursday,
so
there
would
be
Monday
and
Friday
available
for
her
appointments
and
obviously
there
would
be
some
evenings,
but
I
would
say
she
indicated
around
ten
hours
a
week
of
appointments,
but
majority
would
take
place
either
Monday's
or
Friday's
during
the
daytime.
With.
D
C
It
doesn't
look
like
we
have
sidewalk
on
any
of
the
neighboring
properties
in
that
area.
So
I,
don't
think
it'd
be.
You
know
pertinent
to
require
sidewalk
to
be
put
in
at
this
time,
but
what
I
would
like
to
see
is
a
way
of
a
right
to
protest.
If
such
time
in
the
future
that
we
do
have
sidewalk
go
through
there,
that
we
install
it
absolutely.
D
Encroached
within
the
right-of-way-
and
you
know,
I'm
not
familiar
without
sidewalks.
That
needs
to
be
with
the
ordinance
with
the
7-foot
overhanging
limbs.
If
it
is
not
a
problem,
if
we
need
to
trim
that
up,
but
apparently
on
43rd
Street
from
Golf
Course
Road,
there
is
no
established
sidewalks
within
that
entire
cul-de-sac,
but,
like
I,
agree
Blake,
if
it
ever
becomes
that
absolutely.
