this

is
the
bill
that
we
started
to
file
last
year
and
it
kind
of
goes
in
conjunction
with
senate
bill
2
that
passed
last
year,

so

chair

administrative
regs,
we
keep
a
composite
list
of
all
the
regs
that
were
found
efficient
throughout
the
year
and
as
we
go
into
session,
I
file
a
bill
that
finds
those
regulations
null
and
void,
and
the
purpose
of
this
is
more
or
less
to
keep
keep
the
executive
branch
honest
and,
and
so
they
will
work
with
us
and
what
we
saw
happening
was
you
know,
regs
would
come
through
administrative
regs.

find
them
deficient,
the
cabinet
would,

go
on
and

those
regs
will
be
implemented
anyway,

there
really
wasn't

lot
of
teeth
to
the
administrative
rig
review
committee,
and
so
this

just
another
way

put
some
teeth
into
the
committee
to
let
the
administration
know
that
we
are
when
we
bring
up
a
deficiency
motion
where
we're
serious
there's

valid
reason
for
that.

ranks
committee
has
found
regs
deficient
from
republican
administrations
and
democrat
administrations,
and
look
it's
just
the
nature
of
the
executive
branch
who's
ever
in
charge
that
from
time
to
time,
they
try
to
do
things.
That's
outside
the
scope
of
legislative
intent,
and
it
is
completely
within
the
statutory
authority
of
the
general
assembly
to
go
ahead
and
take
administrative
regulations
that
were
found
efficient
and
get
them
off
the
books
and
that's
what
this
does,
and
I
appreciate
your
efforts
and

a
practitioner

this

something

it's

it
should
have

done

understanding.
There
was
an
agreement
to
consult
with
the
legislative
branch
on
that,
a
an
agreement
which
was
not
abide
by
between
the
administration
and
the
legislative
branch,
and
so
thank

bringing
this
bill

meredith
representing
the
fifth
district
was
in
me,
breckenridge,
grayson,
emerson
and
hart
larue
counties,
and
I'm
certainly
pleasure
to
be
here
today.
I
think
in
my
six
years
here
this
is
only
the
second
time
I've
been
before
this
committee,
and
I
didn't
know,
is
this
entertaining
so
maybe
maybe
I
can
be
here
more
frequently,
but
the
bill
I'm
presenting
to
you
today.
You
heard
last
session
matter
of
fact.
It
made
it
out
of
this
committee,
made
it
through
the
senate
and
made
it
to
the
to
the
house
committee.

As
we
looked
into
it
further
found
out
that
the
company
they
were
gonna
award
it
to
was
about
a
million
dollars
higher
than
the
next
bidder.
This
just
doesn't
look
right
and,
as
we
looked
a
little
bit
further,
we
found
out
that
there
was
a
company
that
had
had
the
contract
for
several
years
and
their
in
previous
years
at
the
attempt
to
renew
their
contract.

So
we
have
a
company,
that's
been
awarded
the
contract,
that's
not.
The
low
bidder
has
a
lobbyist
and
two
other
gentlemen
who
have
are
serving
prison
time
for
their
involvement
in
this
they've
been
cited
for
executive
ethics,
commission
violations,
but
yet
we're
going
to
consider
we're
we're
gonna
award
the
bid
to
them
and
the
response
to
the
the
staff
at
that
time
was
well
there's
nothing.
We
can
do
about
that.
There's
nothing
statute
that
really
excludes
them
from
the
rfp
process.

You
know
really
there
should
be,
and
you
know
this
is
about
as
egregious
as
any
situation.
You'd
ever
find
people
don't
like
to
come
before
our
committees,
I
think
senator
southworth
will
attest
to,
but
I
tell
them
they
should
because
we're
kind
of
like
the
good,
householding
seal
of
approval
that
passes
our
muster.
Then
it's
a
good
contract
and
gives
confidence
to
people
commonwealth
that
it's
a
good
contract
and
if
you
can't
get
that
from
us,
then
there's
something
problems
with
it.

in
2010.
Longmire
said
he
worked
to
keep
the
contract
with
his
firm,
because
sullivan
had
paid
him
again,
certainly
not
in
the
best
interest
for
commonwealth-
and
I
know,
there's
a
lot
of
litigation
about
this.
But
all
these
issues
aside,
I
can't
see
where
it
makes
sense
in
terms
of
transparency
for
our
state
to
award
a
contract
to
a
country.
That's
involved
in
this
kind
of
activity.

So
I
think
that's
a
fair
standard
to
have
to
to
adhere
to
the
other.
Part
of
this
has
to
do
with
the
folks
who
are
involved
in
the
scoring
of
these
contracts
and,
if
you're
not
familiar
with
that,
just
because
you
have
the
low
bid
doesn't
mean
you
have
the
best
bid
that
there's
a
scoring
mechanism-
that's
supposedly
tied
to
hrfp.
That
tells
you
that
you
know
the
bid
is
just
part
of
the
scoring
process.
There's
other
factors
are
involved,
and
I
think
it's
a
little
bit
too
ambiguous
another
issue
we
need
to
address.

But
again
these
contracts
are
scored
and
then
the
best
contract
gets
awarded
and
I
think
there's
opportunity
to
manipulate
the
scoring
process
and
if
people
are
involved
in
that
they
theoretically
could
go
to
work
for
a
firm
that
was
awarded
the
contract,
knowing
that
that
they
had
influenced
the
outcome
and
then
go
back
to
work
for
that
firm
in
theory.

So
the
additional
thing
that
this
bill
does
is
says
that,
excuse
me
no
officer,
employee
or
appointee
of
an
agency,
including
persons
who
serve
without
salary
or
other
payments
may
participate
in
the
procurement
of
a
contract
under
this
chapter,
as
it
relates
their
prior
employment
until
at
least
one
year
has
passed
since
his
or
her
termination
with
that
employer.
You
know
we
have
the
same
standard
for
lobbyists,
so
I
don't
know
why
I
shouldn't
be
extended
to
these
people
as
well.

They
kind
of
don't
get
a
lot
of
attention,
they're,
just
sleepy
little
committees,
but
they
do
a
lot
of
really
important
work
and
your
attention
to
contract
review
has
been
one
of
them.
I've
been
really
happy.
One
of
my
most
disappointing
defeats
in
the
general
assembly
was
when
I
was
first
on
contract
review.
We
couldn't
get
a
contract,
disapproved
for
twenty
seven
hundred
dollars
to
euthanize
a
descented
skunk
with
a
broken
leg.

So
you
know
there's
a
lot
of
weird
stuff
that
comes
in
front
of
that
committee,
but
you
know
congratulations
on
this.

have
a
simple
but
important
bill
here.
We
passed
it
out
of
the
senate
last
year
and
because
it
ran
into
time-
and
we
were
very
time
got-
we
were
focusing
on
four-wheelers
and
constables
at
the
late
session.
So
we
couldn't
quite
get
this
bill
through,
but
it's
very
important
it's
hard
to
find
teachers
and
instructors
and
people
to
work.
So
we
have
part-time
accident
instructor
instructors
that
don't
want
to
work
because
of
the
effects
of
retirement.
