D
Thank
you,
madam
chair
Mr,
chair
and
members
of
the
committee
I
appreciate
the
opportunity
to
present
to
you
today.
Senate
Bill
282
increases
the
award
caps
for
awards
given
to
Crime
Victims
through
the
Crime
Victims
Compensation
Board,
specifically
Senate
Bill
282
would
increase
the
lost
wages
and
loss
of
financial
support
caps
from
150
a
week
to
300
a
week,
and
this
is
a
first
increase
since
1976.
D
the
funeral
and
burial
expenses
from
the
cap
of
5
000
to
7500,
which
has
not
been
increased
since
1988,
and
the
overall
cap,
including
medical
and
mental
health.
Counseling
expenses
increases
from
twenty
five
thousand
to
thirty
thousand,
which
has
not
been
increased
since
1986..
There's
no
new
money
needed
for
this.
All
we
needed
to
do
was
give
the
board
approval
to
use
their
current
funds.
Finally,
we
added
an
emergency
Clause
so
that
this
allows
victims
to
file
claims
for
compensation
under
the
new
caps
in
the
last
part
of
this
quarter.
D
C
Thank
you,
madam
chair,
and
thank
you
for
bringing
this
language
I
agree
that
there
are
probably
reasons
to
increase
These
funds,
but
I
have
a
couple
of
questions.
How
is
this
fund
currently
funded?
It's.
C
Okay,
so
so
these
are
fees,
court
fees
that
fund
this
okay,
it's
not
I
I
thought
I
was
reading
that
this
is
funded
through
the
executive
branch,
biennial
budget,
no.
C
Okay
and
then,
if
I
may,
ask
one
one
follow-up:
is
this
payment
out
of
this
Fund
in
addition
to
insurance
coverage,
if
an
individual
has
insurance
coverage
or
is
it
offset
in
any
way.
D
C
That's
that's
what
I
was
wondering,
because
it's
not
clear
in
the
language
that
it's
that
is
an
it,
that
it
is
an
offset
okay,
so
that's
that
makes
more
sense.
Thank
you.
My.
D
F
Thank
you.
It's
been
a
few
years
dealing
with
this
as
the
as
a
hearing
officer
and
for
a
period
of
time
as
the
Director
of
then
the
Claims
Commission
on
page
one.
It
has
some
new
language
involving
the
operator
of
a
vehicle
in
an
accident
who
did
not
stop
and
disclose
I
guess
my
question
would
be
why
that's
needed.

D
A
C
A
F
Always
appreciate
a
quick
motion:
do
you
care
to
explain.
E
The
bill
yeah
absolutely
I'd,
be
happy
to
last
time.
We
came
up
just
for
discussion
and
so
I
appreciate
very
much
you
taking
the
time
to
bring
you
back
here
today.
E
What
this
does
is
in
the
event
that
someone
is
convicted
of
a
DUI
and
they
take
the
life
of
a
parent
or
guardian
and
there's
a
surviving
minor
child.
Those
their
judge
at
this
point
May
issue
restitution
in
a
way
to
support
that
minor
child,
not
child
support
in
a
way
to
support
that
minor
child.
E
As
part
of
that
sentencing-
and
this
is
done
in
other
places-
we
do
here
today
and
the
reason
we
pass
this
or
we
would
ask
to
pass.
This
is
ultimately
in
civil
cases.
There's
there
they
can
bankrupt
that
there's
no
way
of
be
able
to
enforce
those
judgments,
but
you
still
have
a
minor
child
that
is
surviving
once
they
do
the
short
sentence,
whatever
that
is
they're
able,
they're
out
of
incarceration,
they
go
on
with
their
life.
This
child
has
lost
their
parent,
the
guardian,
the
basic
ability
to
fund
things.
E
It's
a
right
just
bill,
and
while
it
may
not
be
big
money,
it
is
a
check
that
they
will
have
to
write
continuously
I,
remember
what
they
had
done,
but
also
offset
some
of
the
costs
that
child
will
have
by
not
having
their
parent.
This
was
named
after
Melanie.
This
is
my
cousin
Melanie
who
is
currently
and
and
so
named
after
Melanie.
She
has
a
surviving
child
and
she's
she's
struggling
right
now
and
I.
E
Think
that
me
being
brought
to
this
to
the
attention
and
my
family
and
my
years
of
practicing
we've
seen
this
over
and
over
and
over
again
and
so
I
would
love
to
have
something
in
her
honor.
That
could
make
a
difference
for
so
many
other
children
who
have
lost
a
parent
or
Guardian
in
that
support,
and
so
I'll
have
to
ask
for
your
support.
