emergency
clause

pause

billboard
construction

the
cabinet
re-establishes
proper
and
reasonable
regulations,
and
finally,
it
takes
the
first
critical
step
in
meeting
federal
requirements
for

providing
regulations

highway
bills
without
state
regulations
of
the
billboards
were
at
least
of
losing
as
much
as
70
million
dollars
in
transportation
funding,
and
I
will
say
that
the
reason
this
bill
is
necessary
is
that
recently
federal
court
ruled
that
our
language
and
our
current
regulations
is
unconstitutional
during
due
to
first
amendment
concerns.

do
this
bill
to
re-establish

regulatory
authority
over
billboards.

the
outdoor
advertising
association
here
in
kentucky.
Currently,
there
are
no
permitting
fees
in
the
state
of
kentucky
for
billboards,
and
that
is
something
that
we,
the
industry,
have
talked
to
the
kentucky
transportation
cabinet
about
and
have
committed
along
with
representative
johnson
to
sit
down
with
them
in
the
interim
and
talk
about
not
only
permitting
fees
but
several
other
things
that
need
to
be
done
to
further
the
industry,
both
from
the
industry's
perspective
and
from
transportation.

But
we,
as
collectively
as
a
group
in
scenic
kentucky,
is
on
there
on
zoom
as
well
felt
like
that.
This
was
critically
important
to
pass
the
bill
without
any
of
those
other
things
that
the
industry
wanted,
or
that
the
cabinet
wanted
to
to
present
a
clean
piece
of
legislation
to
the
general
assembly.
So
we
could
fix
this
constitutional
problem
in
very
short
order.

we'll
have
to
wait
another
year
and,
as
you
know,
as
all
of
you
have
seen
these
boards
going
up
across
the
commonwealth
at
rapid
pace,
so
we
felt
like
we
collectively
got
together
and
decided
that
we

push

one
clean,
build
just
to
fix
the
constitutional
problem
that
the
sixth
circuit
said.

constitutional
issue
that

trying
to
achieve.

I
represented
scenic
kentucky
in
the
sixth
circuit
review
of
the
district
court
decision
that
had
determined
it
was
a
in
the
lions
and
superstore
billboard
on
I-65
determined
that
the
on-site
off-site
distinction,
that
was
in
kentucky's
law
and
wasn't
a
number
of
other
laws,
required
an
intrusion
into
the
first
amendment
in
order
to
determine
if
the
board
was
regulated
or
not.
So
the
law
was
determined
unconstitutional.

But
what
had
happened
with
and-
and
I
do
senator
wilson-
I
I
feel
for
the
landowners
who
may
be
affected
by
this
and-
and
you
know-
would
would
welcome
the
way
you
know
the
ability
to
protect
the
the
least
interest
that
they
had,
but
the
couple
of
companies
who
came
into
the
state
and
erected
billboards
during
the
time
when
there
was
a
great
uncertainty.

lower
court
decision
appeared
to
be
broader
than
the
sixth
serpent
interpreted.
Is
they
took
a
gamble
and
they
lost
that
gamble.
They
put
up
boards
that
don't
meet
the
spacing
requirements
that
don't
meet
the
distance
requirements
that
don't
otherwise
conform
to
kentucky's
statutory
requirements
for
billboards,
and
they
did
so
take
it
a
gamble
that
they
would
be
able
to
keep
to
that.

The
the
upper
the
sixth
circuit
would
would
affirm
the
decision
that
they
would
be
able
to
leave
the
boards
in
place
and
they
lost
that
gamble
and
there
are
a
number
of
landowners,
and
I
appreciate
the
fact
that
there
are
landowners
who
who
may
have
have
signed
with
these
folks
to
put
these
boards
up
during
the
interim.

The
cabinet
is
not
indicated
whether
it
intends
to
to
prosecute
or
not
prosecute
to
not
prosecute
but
to
get
the
boards
removed.
But
there
are,
you
know,
serious
concerns
that
that
when
you
take
that
kind
of
a
gamble
and
you
lose-
you
don't
get
to
come
into
the
general
assembly
and
say
I
want
you
to
to
to
change
the
outcome
on
my
behalf,
because
I
took
a
risk
and
that's
the
concern
that
that
I
have.
There
are
folks
out
there
who
have
been.

know
this
is
one
of
those
rare
situations,
senator
wilson,
as
you
know,
the
the
word
billboard
has
not
historically
produced
consensus
between
groups
like
scenic
kentucky,
the
kentucky
resources
council,
which
occasionally
represents
them
and
the
billboard
industry.
But
we
all
agree
that
we
need
to
clarify
the
onsite
offside
issue
and
get
that
out
of
the
law
and
change
it.
Instead,
just
saying
it's
regulated,
it's
commercial
in
terms
of
being
somebody's
making
money
off
the
board
being
erected,
and
it's
and
it's
not
regulated
if
it
is
non-commercial.

of
them
may
be
conforming
in
terms
of
their
spacing
their
distance
and
things.
Some
of
them
are
pretty
egregiously
not,
but
I
think
that's
something
that's
best
left
to
there
to
a
conversation
between
those
companies
and
those
boards

cabinet

testified

house
committee
said
that
they
weren't
exactly
sure
of
the
number,
but
the
industry
has
estimated
well
over
a
hundred
faces
just
in
this
short
time
period

the
summer.
Until
now-
and
I
know
in
tennessee
when
this
happened
there-
there
were
over
250
boards
that
were
erected
during
the
time
that
they
were
unregulated.
So
it's
it's
very
prolific.

I
think,
brings
up

valid
point

I
guess
one
concern.

would
think
as
an
attorney
that
you
know
if,
if
the
cabinet
were
to
take
action,

this
could
put
you

somebody

his
son,
into
a
breach
of
contract
with
his

his
organization
that
he
signed
an
agreement.

amenable
to
some
type

floor

vacuum

the
law

erect

structures
to
make
sure

nobody

from
day
one,
but
we
also
recognize

bill
needs

accidentally
kill

bill

the

the
process.
In
the
days
we

I
am
advocating
for
a
clean
build

about

issue

billboards

coming
up

central
kentucky
regional
airport,
which
is
located
in
madison
county,
is
the
third
busiest
general
aviation
airport
in
kentucky.
Thanks
to
the
support
of
the
general
assembly
in
last
fiscal
year,
eku
aviation
plans
to
construct
a
state-of-the-art
flight
training
center
at
the
airport.

Eku
is
kentucky's
only
four-year
pilot
training
degree
program
and
currently
has
over
300
aviation
majors.
They
have
also
experienced
a
hundred
percent
enrollment
growth
over
the
past
three
years.
The
current
airport
board
consists
of
two
members,
each
from
the
city
of
richmond,
the
city
of
berea
and
the
county
government.

seats

the
current
six
board
makeup
and
add
eku
as
a
member,

equal
member

that
board,
the
legislation

expand

to
