bill

update
krs
151,
particularly
the
high

emergency
action
plans
for
certain
dams,
for
a
facility
to
meet
the
definition

dam

kentucky.

has
to
be
25
feet
in
height
and
impound
50
acre
feet
of
water.

what
this?
What
this
ultimately
does
is
require
dam
owners
to
develop
an
emergency
action
plan
in
the
event
that
there
could
be
a
catastrophic
release
or
failure
of
the
dam
as
much
as
anything.
It's
a
public
protection
piece.
You
know
in
our
department
we
have
an
emergency
response
team
and
we
understand
and
appreciate
the
necessity
for
having
a
plan
and
being
prepared,
which
is
primarily
what
this,
what
this
bill
would
do.

It's
important
to
understand
that
a
a
high
hazard
dam
or
what
may
be
defined
as
a
hyzer
dam,
doesn't
necessarily
mean
that
it's
a
dam
that
has
structural
problems,
but
it
could
be
a
high
hazard
dam
as
a
result
of
inhabitants
living
below
it.
Dam
could
be
in
fine
shape
people
move
in
below
it
or
build
below
it.
It
may
go
up
to
be
defined
as
a
high
hazard
dam,
one
of
the
things
that
we
are
particularly
interested
in
as
as
the
agency
is
making
sure
this
is
a
compliance
assistance
effort.

There
are
certain
things
that
would
be
required
by
dam
owners
that
could
be
a
cost
to
them
or
a
requirement
for
them
to
hire
specific
expertise.
We
are.
We
are
going
to
address
that
issue
from
the
agency's
standpoint.
We
have.
We
have
digital
mapping,
we've
done
inundation
mapping
for
all
these
facilities,
so
that
will
not
be
something
that
a
dam
owner
would
have
to
pay
to
have
done.

have
developed
emergency
action
plan
templates
and
we've
already
planned
to
have
emergency
action
workshops,
because
it's
we're
very
interested
in
this
being
a
compliance
assistance
approach
moving
forward.
Lastly,
I
would
just
say
it's
important,
because
what
this
would
do
is
be
a
tie
into
local
responders.
Who
can
be
there
if
a
problem
occurs
before
state
responders
can
so
in
essence,
its
emergency
action
plan
would
be
in
the
queue
at
a
county
level,
so
everyone
would
be
aware
if
an
event
did
unfortunately
happen
so
from
the
50
000
foot
view.

in
and

of

and

a
couple

incidents
toward
red
fox
where
we
had
a
guy
that
had
to
take
out
several
of
them
that
were
really
beautiful

still

bad

make
sure
that
we
don't
put
it
to

through
some
action

that
we
wind
up
taking

wildlife
areas

house
bill
600.
The
kentucky
guarantee
reclamation
fund
provides
financial
resources
when
there
aren't
sufficient
bonds
to
cover
the
cost
of
the
reclamation
of
a
mine
site.

With
the
downturn
in
the
coal
industry,
we
just
haven't
got
any
operators
in
the
highest
tier
and
we
only
have
a
few
in
the
mid-sized
tiers.
So
what
this
bill
would
do
is
allow
us
to
have
commissioners
be
chosen
from
the
lower
tiers
all
the
way
down
to
the
smallest
tier,
if
necessary,
if
there
aren't
any
operators
in
the
mid-size
or
upper
tier,
so
this
will
allow
the
kentucky
reclamation
guarantee
fund
commission
to
have
a
quorum
and
continue
to
to
its
business.
