addresses
something
that
we
saw
in
the
budget
and
funded

the
budget,
but
what
this
committee
substitute
actually.
First
of
all,
I

like
to

what
this
deals
with
is
there's
beginning
to
be
a
a
situation.

That's
arising
with
accumulated
sick
leave
and
the
state
police
are
kind
of
a
unique
in
in
constrained
environment
with
their
troopers,
as
it
relates
to
basically
doing
anything.
And
so
what
we
wanted
to
do
is
explore
a
sick
leave,
buyback
program
and
the
language
that
you
see
on
pages,
10
and
11
allows
for
that
sick
leave
buyback
program.

So,
basically,
you
would
accumulate
a
balance
at
the
end
of
the
year
after
five
years
and
the
employer
would
buy
it
back
from
you
annually
as
to
your
sick
leave,
and
what
that
does
is
it's
bought
into
the
hybrid
cash
balance
plan.
At
that
point,
and,
as
you
can
imagine,
begins
to
accumulate
value
pretty
dramatically
and
increases
by
over
a
thousand
dollars
a
month,
the
end
of
service
annuity
that
a
given
member
would
accumulate,
assuming
that
they
sell
their
leave
back
at
the
end
right
now.
A
As
you
know,
that's
kind
of
rolled
into
a
retirement
calculation,
but
with
the
hybrid
cash
balance,
that's
no
longer
an
option.
That's
available.
This
has
been
run
through
retirement
to
ensure
that
we
don't
have
any
federal
issues
with
this
and
we
will
have
an
actuarial
analysis
on
it
shortly,
but
I
expect
it
to
not
necessarily
have
any
impact.

request

the
kentucky
state,
police
and
they've
been
involved
in
helping
us
work.
Through
this
issue

I

it
is
funded
in
the
biennium
to

this
program,

it

give

look
at

state
government

they

will
provide
funds
to

help
them
as
they
need
to

half
million
dollars
in

first
year
of
the
biennium
to
the
cpe
to
help
them
administer
and
oversee
this
program.

the
board
in
the
council
in
accordance
with
accreditation
requirements.

faculty

want

serve
the
kids
that
go
there

we
owe
them

said
that
many
a

said

short
months

president
kentucky
state,
the
president
kentucky
state's
assistant
and
the
lobbyists
on
behalf
of
kentucky
state
sat
in
my
office
and
told
me
everything
was
perfect
at
kentucky
state.
They
were
on
the
right
track,
the
right
trajectory
and
four
months
after
they
walked
out
of
my
office.

Telling
me
everything
was
perfect.
We
found
there's
a
23
million
dollar
hole
in
the
budget
and
by
the
end
of
this
session
we
realized
it's
a
38
million
dollar
hole.
Hence
the
reason
for
lines
11
and
12
on
page
six,
because
I
don't
like
to
look
in
the
rear
view
mirror.
But
sometimes
accountability
demands
as
much
which
states
that,
based
on
the
review
from
the
council
in
approval,
they
can
make
recommendations
for
further
investigations.
If
any
conduct
has
risen
to
the
level
of
a
crime.

Struggle
to
think
that,
somewhere
in
the
past,
there's
not
something
that
may
touch
to
that
level.
I
don't
know,
but
we
as
a
general
assembly,
owe
the
taxpayers
of
the
commonwealth
accountability
for
the
folks
that

placed
in
positions
of
responsibility,
and
this
is
not
like
something
we
had
any
warning
on.

surprised
as
I

that
newspaper

out
and
that
the

representations
were

university

body

disingenuous

taxpayers

bill

about
serving
those
kids
right.

administrations
responsible
for

holes

they
blew

think
this
bill
addresses
two
critical
items.
First,
there's
a
shortage
of
ready
to
go
sites
and
buildings
across
the
commonwealth,
so
this
bill
allows
the
mechanism
by
which
the
general
assembly
can
make
job-creating
investments
into
kentucky
communities
across
the
commonwealth.
Secondly,
this
bill
elevates
kentucky's
economic
development,
competitiveness
relative
to
competitor
states.
We
think
this
is.

We
are
very
appreciative
of
your
leadership,
and
your
consideration
of
this
with
this
bill
makes
a
few
minor
needed
tweaks.
It
will
allow
for
property
acquisition.
It
will
allow
for
due
diligence
studies,

we're

appreciative

good
work
on
that.

administrator
of
this
program,
we
seek
no
administrative
fee

seek

seek
and
will
not
seek

capture

the
commonwealth's

program
allows

interaction
in
the
interfacing,
with
the
site,
selection,
consultant

anytime,
that
we
can
facilitate
good
conversations
with
our
economic
developers
with
site
selection
consultants.
We
feel
really
good
about
that
now.
With
respect
to
to
rural.

There
is
an
element
within
the
scoring
system
of
this
program
that
elevates
rural
competitiveness,
by
which-
and
we
do
so
by
evaluating
the
relative
economic
impact
of
an
investment
of
that
projected
return
in
a
rural
community,
and
we
add
additional
weights
to
that.
So
it
elevates
real
competitiveness
in
a
way.
That's
ultimately
good
for
the
commonwealth
and
and
to
the
representative's
point,
with
with
just
a
small
and
restricted
pool
of
funds
that
we've
tapped
into.
We
have
we've
accessed
under
eight
million
dollars
and
that's
turned
into
over
half
a
billion
dollars.
So.

to
follow
up
on
this
particular
bill,
I
think
it's
great
and
that
kind
of
return.

is
tremendous
and
I
had
lobbied
for
an
additional
funding
for
this
program.

could

the

proven

it's
structured

This
is
the
work
product
of
meeting
with
the
house
of
representatives
on
their
tax
plan,
plus
the
tax
plan
that
we
had
originally
presented
here
in
the
senate
and
there.
For
starters,
there
are
no
rebates
anticipated
in
this
whatsoever.
A
You'll
recall
that
the
house
bill
originally
had
revenue
triggers
in
it.
We
have
the
same
up
by
one
percent
down
by
a
half
an
income
tax
kind
of
concept,
but
it's
a
little
more
complex
than
that.
In
essence,
what
we
say
is
income
tax
can
drop
by
a
half
of
a
percentage
point
if
the
at
the
end
of
the
year,
the
actual
revenues
incurred
exceed
the
amount
of
expenses
from
that
year,
plus
the
dollar
value
of
a
one
percent
reduction
in
the
income
tax.
A
So,
for
example,
if
revenues
were
15
million
and
expenses
were
13
million
and
a
1
drop
in
tax
was
1
million.
To
give
you
14.
15
is
obviously
more
than
14
I'd
say
a
million
should
be
billion
necessarily
you
would
have
a
half
of
a
percent
reduction
in
the
income
tax
at
this.

At
that
point,
however,
there's
more,
we
have
to
also
have
a
10
budget
reserve
trust
fund,
so
10
of
the
amount
of
actual
revenues
that
we
receive
would
have
to
be
in
the
budget
reserve
trust
fund,
so
there's
a
two-part
and
then
finally,
we've
added
as
senator
gibbs
likes
to
refer
to
it.
Another
chalk
in
the
wheel
where
the
general
assembly
has
to
have
the
opportunity
to
return
and
affirmatively
vote
on
the
first
of
those
triggers
going
through.

inside
of
here,
there
was
some
concern
about
certain
services
that
had
been
taxed
under
the
original
house
bill
8.
This
removes
travel
agencies,
financial
services
and
boat,
launch
fees
from
those
services
which
are
otherwise
taxed,
and
also
there
is
some
cleanup
related
to
the
taxation
of
the
uber
and
lyft
as
it
relates
to
the
northern
kentucky
triad,
and
that
is
cleaned
up
in
here
as
well.
Also,
one
of
the
things
that
is
coming
very
quickly
to
the
commonwealth
is
electric
vehicles
and
we
have
got
to
be
prepared.

We
cannot
find
our
road
fund
in
the
situation
that
our
911
funds
were
when
the
transition
from
copper
line
to
wireless
began
to
occur,
and
so
what
you
will
see
is
a
three
cent
per
kilowatt
hour
on
charging
station
fee,
and
you
will
also
see
fees
related
to
hybrid
vehicles,
as
well
as
two
purely
electric
vehicles
in
here.
The
implementation
date
for
the
taxation
on
electric
vehicles
is
in
2024..
A
The
reason
for
that
is
this.
We
know
that
taxation
of
electric
vehicles
is
an
ever
evolving
topic
and
we
know
that
we
didn't
get
it
perfect
in
here,
and
there
are
a
lot
of
solid
voices
to
be
heard
in
that
conversation,
but
something
must
be
on
the
books,
and
so
that's
what
this
legislation
does
is
get
something
onto
the
books.

We
look
forward
to
those
with
other
ideas,
positive,
negative
or
otherwise
to
come
forward
through
the
course
of
this
interim
and
help
us
get
to
good
tax
policy,
because
the
fact
is,
the
nature
of
our
travel
will
shift
over
the
next
15
years
and
we've
got
to
get
the
funding
mechanisms
right
so
that
we
can
ensure
solvency
and
stability
inside
of
our
road
fund
and
those
are
the
major
components
of
the
committee
substitutes.
I
think
we
have
someone

to
testify
against
this.

this

not
seen
the
committee
sub,
but
but
there
were
two
points
that
I
wanted
to
raise
regarding
the
original
bill.
I'm
not
sure
if
those
provisions
are
still
in
the
sub.
The
first
was
regarding
the
taxation
of
utility
bills
for
residences
that
are
not
the
primary
domicile.

I
certainly
don't
have
one,
but
the
concern
is
that
the
tax,
the
exemption
from
taxes
that's
currently
in
there
in
order
to
be
maintained
by
a
homeowner
or
by
a
renter,
they
are
required
to
declare
that
it
is
their
primary
domicile
and
I'm
not
sure
the
mechanism
by
which
they're
supposed
to
declare
that
my
concern
is
that
if
folks
don't
understand
that
they
now
have
an
affirmative
obligation
to
declare
that
their
residence
is
their
residence
or
their
rental.
Property
is
where
they're
living
that
they're
going
to
face
taxes
on
their
utility
bills.

At
a
time
when
the
utility
bills
are
already
because
of
the
fuel
adjustment,
much
higher
than
they
have
anticipated
or
much
higher
than
they've
historically
been
paying.
The
second
is
regarding
the
fee
on
electric
and
hybrid
vehicles.
The
resources
council
strongly
believes
that
both
evs
and
hybrid
vehicles
should
pay
their
fair
share
of
road
fund
taxes
and,
to
the
extent
that
electric
vehicles
are
not
purchasing
gas
they're,
not
paying
that
component
into
the
road
fund.
The
assessment
that
was
in
the
original
bill
is
punitive.
H
It's
140
dollars
for
for
evs
and
70
a
year
for
hybrid
vehicles,
even
though
traditional
vehicles
are,
in
some
cases,
more
fuel
efficient
than
the
hybri
than
the
hybrids,
and
also
because
hybrids
are
already
paying
a
portion
of
their
fuel
taxes.
My
concern
is
that
the
assessment,
in
addition
to
being
punitive,
is
not
going
to
the
road
fund.
While
it's
called
a
battery
and
reclamation
and
mitigation
fee,
it's
not
going
to
dealing
with
batteries
or
mitigation
or
reclamation.

It's
just
a
fee
that
is
going
to
the
general
fund
rather
than
the
road
fund,
and
so
while
we
believe
that
the,
according
to
consumer
reports
in
2019
the
maximum
amount
that
that
ev
drivers
should
be
paying
is
around
85
rather
than
140,
and
that
should
be
going
to
the
road
fund
and
not
to
the
general
fund.
So

use
different
words,
the
drafter
and

along
with
others,
as
we

felt
that
deleting
the
word
broadband
was
the
best
path
forward.
To
avoid
some
ambiguity,
the
sub
retains
the
definition
of
the
word
unserved.

balance

one

the

important
investments
we

that

mentioned
house
bill
320,
because
one
of

issues
that
senator
gibbons
pointed
that
I
do
want
to
speak
to
very
briefly,
is
that
this
bill
eliminates
the
public
service
commission's
review
of
the
pledging
by
co-ops
of
up
to
25
of
their
regulated
assets
towards
broadband.

That
was
something
that
I
felt
very
seriously
about.
During
the
last
session,
it
was
in
house
bill
320
because
we're
talking
about
co-op
assets
that
have
been
paid
for
by
the
members
we're
talking
about
the
regulated
electricity
assets
that
are
now
going
to
be
pledged
up
to
25
percent
of
them
to
support
an
unregulated
affiliate
transaction
in
broadband.

I
am
a
strong
supporter
of
expanding
broad
co-ops
into
broadband,
but
I
believe
that
the
public
service
commission
has
a
legitimate
and
necessary
role
as
the
gatekeeper
to
make
sure
that
that
pledging
is
under
a
a
plan
that
is
well
thought
out
is
not
going
to
put
the
electric
customers
assets
at
risk,
and
so
I
would
encourage,
if
we're
going,
to
have
further
conversation
on
this,
that
that
be
revisited,
because
there
has
been
no
adjudicated
case.
It
was
only
done
last
year
that
they
were
allowed
to
get
into
this
area
with
psc
approval.

This
bill
would
allow
those
successful
bidders
to
come
back
and
seek
supplemental
funding,
even
though
they
already
have
an
obligation
to
serve,
even
though
they've
already
won,
based
on
that
representation
that
they
could
bring
it
in
under
budget
and
I'm
concerned
that
we're
taking
the
available
state
funds
and
providing
supplemental
funding.
So
I
would
encourage
that
that
be
excluded
if
it's
not
going
to
be
excluded
at
least
make
sure
that
the
the
total
amount
that
they're
getting
from
federal
and
state
funds
combined
does
not
exceed
50.

folks
are
awarding
contracts

committee

interest,

that
everything's
out
in
the
open
and
above

second
issue
we

with
this
bill,
senator
mcdaniel,
is
the
fact
that
it
limits
poll
attachment
fees
for
municipal
recovery
to
0.05
percent
of
the
10
cap,
which
is
10
000
for
poll
replacement.
That's
not
enough,
because
the
average
pole
replacement,
according
to
our
members,
cost
about
five
thousand
dollars.
That's
250
to
send
a
truck
out
to
have
an
engineer.
Look
at
the
poll
and
make
decisions,
then
do
paperwork,
so
250
is
not
enough
to
even
cover
our
cost
as
non-profits.

give

appropriate
time
for
review,
and
especially
with
the
comments
made
today,
it
is
clear
this
still
needs
debate.

that
debate
to
happen
quickly
and
for
us
to
get
this
bill
as
right
as
we
can
to
get
broadband
to
as
many
kentuckians
as
we
can
this
session,
but
just
like
in
the
last
bill
in
house
bill
8,
where
we
had

sub
that
we
did
not
have
time
to
review
going
over
the
state's
tax
policy.
For
the
same
reason,
I
cast
a
pass
vote
on
this
one.

one
priority

been

a
long
time

I

I've

a
lot
of
experience

and
lack

oversight
