requests
for
retroactive
approval

contracts,
and
this
is
just
the
second
time
in
my
27
months
on
this
committee
that
we've
had
this
situation.

this
is
a
very
sizeable
contract
in
you

there's
any
objection
to
it,

explanation
as
to
how
it
evolved,
because
this
looks
like
it's
on
an
emergency
order.
So
can
you
give
us
some
background
of
this
particular
agreement
and
how
they
evolved
and
get
some
safely?
Why
it's
it's
part
of
a
Master
Agreement?

it's
a
Master
Agreement,
so
it
can
be
used
by
multiple
agencies
and
there
was
a
need
expressed
from
CH
FS
and
from
Kentucky
Veterans
Affairs
for
medical
services.
They
were
concerned
about
having
enough
staffing
for
the
event
and
for
the
hospital
it's
being
set
up
at
fairgrounds,
so
that's
primarily
how
they'll
be
used
to
fill
any
gaps
and
for
fairgrounds
well.

were
not
being.
We
had
reached
out
to
all
the
resources
that
we
had
available
and
many
had
contacted
us
and
we
just
went
through
a
vetting
to
to
verify
their
credibility
to
make
sure
they
were
a
viable
vendor
and
then
we're
awarding
contracts
as
needed
to
whoever
we
reached
out
to
all
of
them
and
we're
basically
going
to
award
contracts
that
they
have
availability.

Finance
cabinet
will
issue
master
agreements
and
a
master
agreement
is
used
for
all
state
agencies
or
or
it
could
be
awarded
just
for
one
state
agency.
But
the
finance
cabinet
has
the
authority
to
issue
those,
so
the
office
of
procurement,
services
and
Department
of
engineering
and
contracting
for
the
facilities
they
can
issue
master
agreements
and
transportation
has
a
delegated
authority
specific
to
them.
They
can
order
or
they
can
award
master
agreements
for
transportation
needed
items,
transportation
related
items,
authority.

The
statute
gives
procurement
authority
to
the
secretary
of
the
finance
cabinet
and
then
the
cabinet
secretary
can
delegate
authority
to
other
agencies
and
in
order
to
satisfy
agencies
that
cannot
exceed
their
small
purchase
authority.
Each
agency
by
statute
has
$1,000
purchase
authority
and
they
can
request
a
higher
delegated
authority
through
the
finance
cabinet
secretary,
but
anything
that
exceeds
their
authority.

the
finance
cabinet
has
to
award
the
contracts
on
their
behalf,
so
we
use
master
agreements
usually
for
an
ongoing
need,
and
then
we
go
through
the
bidding
process
and
award
the
master
agreement
and
then,
as
agencies
have

need
they
can
utilize
those
master
agreements
and
that
satisfies
their
need
to
seek
competition.
So,
for
example,
office
supplies.
We
award
a
master
agreement
for
all
state
agencies
to
use
this
master
agreement
and
as
they
have
a
need,
they
would
issue
a
delivery
order
for
their
specific
need,
based
on
the
prices
that
were
established.

get
that
one,
but
never
give
me
another
example
that
I'm,
even
personally
aware
of-
and
this
goes
back
to
2012
whenever
the
Medicaid
program
with
the
manias
care
organizations
and
those
contracts
were
issued
under
master
agreement,
and
that
took
a
scenario.
Why
did
that
fall
under
that
particular
category?

exemption.

think
that
they
in
2012
they
decided
that
a
Master
Agreement
can
have
a
longer
term
than
a
personal
service
contract,
and
so
it
was
determined
at
that
point
that
the
finance
cabinet
would
issue
those
contracts,
an
award
I.
Think
another
factor
was
that
the
finance
cabinet
procurement
office.
That's
what
we
do
on
a
general
basis.
We
issue
contracts
and
award
contracts,
so
there
was
more
expertise
available
rather
than
in
an
individual
agency.
So
that
was
another
reason
why
they
determined
to
issue
the
contracts
as
a
Master
Agreement.

That's
something
always
concerns
me,
because
if
you
rituals
effectively
do
that,
then
it's
already
in
place
and
very
difficult
to
turn
back
the
wheels
of
time
and
just
for
that
particular
situation.
I,
don't
know
that
the
emergency
existed,
it
looks
like
there
would
have
been
the
RFPs,
and
you
would
have
brought
that
contract
to
this
committee
before
they
were.

the
previous
administration,
the
renewal
of
the
MCO
contracts
were
made
without
review
this
committee
in
when
enquired
as
to
why
we
hadn't
seen
those
what
I
was
told
was
well.
This
is
a
Master
Agreement,
well
we'll
contract
renewals.
Why
would
that
fall
under
a
Master,
Agreement
category
I?

The
reason
it
the
way
our
procurement
system
is
set
up
the
Emaar
system,
the
personal
service
contracts
are
routed
to
the
committee
electronically
and
the
way
the
master
agreement
is
set
up.
It
doesn't
do
that,
but
we
are
working
on.
We
were
working
on
upgrade
so
that
those
that
should
come
before
the
committee
would.

Generally,
you
know
what
would
come
before
this
committee
was
whatever
is
considered
a
professional
service
and
that's
very
broadly
defined.
But
historically
it's
been
medical
services
and
legal
services
and
consulting
services
and
I
think
it
was
2000.
At
the
beginning
of
the
last
administration,
the
Justice
cabinet
wanted
to
award
a
medical
Master
Agreement,
so
it
could
extend
beyond
biennium
and
have
a
longer
term,
so
we
would
hopefully
get
more
interest
from
benders
and
we
would
get
better
economy
of
scales
and
Kim.

You
probably
remember
we
met
with
the
community
chair
at
that
time
and
they
agreed
that
we
could
do
those
type
of
services
as
a
Master
Agreement,
as
long
as
we
thought
them
with
the
committee,
but
we
would
do
them
at
the
finance
cabinet
level.
So
multiple
agencies
could
use
those
contracts
rather
than
each
agency
doing
their
own
contracts,
so
that
was
kind
of
that
was
meeting
with
the
chair
at
that
time
and.

truly
can't
approve
or
disapprove
a
contract,
because
final
authority
rests
with
the
finance
cabinet,
but
again,
if
we're
not
given
that
an
opportunity
to
review
those
contracts
and
there's
not
at
least
the
appearance
of
the
transparency
and
that's
my
concern
so
I
guess
a
more
fundamental
question
is
shouldn't.
We
define
these
things
by
statute
rather
than
just
here's.
The
way
we
have
stormed
historically
done
things
is
that
a
fair
right.

losing
nurses
to
private
hospitals
and
they
were
in
urgent
need
of
some
resources

concern
for
them.
They
said
they
plan
to
use
internal
resources
as
much
as
possible,
but
they
know
that
they're
gonna
have
to
fill
some
gaps.

I

so,
these
this
temporary
hospital
setup
will
not
be
used
unless
the
coronavirus
gets
extremely
bigger
than
it
is
now
and
if
far
local
hospitals
are
filled
to
capacity.

contracts
won't
be
executed,
so
to
speak,
unless
our
hospitals
are
filled
to
capacity
and
beyond.

appreciate

an
internal

think
there's
some
opportunity

request.
One
is
from
the
Department
of
Agriculture
to
request
exemption
for
committee
policy
statement
in
94,
99
for
which
were
hip
its
contracts
and
agreements
from
extend
beyond
the
biennium
for
the
purpose
of
dispersing
funds
for
spay/neuter
services,
one
of
her
percent
restricted
funds
expire
on
December,
31st
2020,
and
we
have
an
exemption
request
from
the
Transportation
Cabinet.
They
could
request
an
exemption
from
the
committee's
routine
review
process
for
the
KYTC
aviation
economic
development
grant
agreements
and
continue
to
provide
quarterly
reports
to
sparked
June
30th
2022.
