calabash,
which,
as
matthew
correctly
mentioned,
is
on
chapel
town
road
at
231-235,
and
it's
a
cafe
which
has
been
trading
under
sharon's
stewardship
since
2015,
and
I'm
told
it's
been
trading
since
then
without
trouble
and
we've
applied
for
alcohol
sales,
both
on
and
off.
The
premise
is
between
noon
and
11
p.m,
and
that
certainly
isn't
to
say
that
the
premises
is
going
to
be
trading
from
noon
until
11
p.m.

Seven
days
a
week,
but
the
applicant
wanted
to
ensure
that
she
has
the
flexibility
should
need
the
need
arise
to
do
so
at
you
know,
at
any
day
of
the
week
following
customer
requests
prior
to
the
lockdown,
sharon
instructed
me
to
make
an
application
for
the
premises
license,
because
people
have
been
asking
her
if
they
can
consume
alcohol
on
the
premises.

It's
a
community
driven
independent
business
and
what
they
want
to
do
is
simply
sell
alcohol
under
the
guise
of
the
the
current
setup,
which
is
a
small
cafe
premises
which,
when
the
weather
dictates,
which
rare
as
it
may
be
and
they'll
put
out
with
with
barriers
and
some
seats
in
front
of
the
premises
so
that
people
can
eat
and
drink
outdoors.

And
the
reason
we're
at
the
hearing
today,
of
course,
is
that
a
representation
has
been
made.
So
my
intention
in
my
submissions
is
to
focus
on
the
representation
and
allay
the
concerns
of
the
committee
and
such
as
they
may
be.
Arising
from
from
that
letter,
and
the
two
license.
Licensing
objectives
which
are
focused
on
seems
to
me
in
the
letter,
friendship,
public
nuisance
and
the
prevention
of
crime
and
disorder,
and
I
think
it's
best
if
I
deal
with
those
two
separately
in
terms
of
crime
and
disorder.

And
I
say
this
with
the
with
the
greatest
of
respect
to,
and
the
councils
who
submitted
the
objection
and
and
and
to
the
the
objectors
who
have
prompted
them
to
do
so.
And
but
there's
no
evidence
at
all
in
the
representation
that
any
crime
or
disorder
would
take
place
and
were
this
application
to
be
granted
as
sort
in
my
submission,
it's
purely
speculative
and
on
the
part
of
those
who've
made
the
objection
that
this
may
be
the
case.

the

If
I

and
the
the
crucial
line
is
at
the
end
of
the
the
third
and
the
end

the
fourth
paragraph

the
the
residents
believe
that

sale

alcohol

evening
will
encourage
noise,
anti-social,
behavior
and
a
disturbance
to
a
residential
area
and
then
in
respect
of
crime
and
disorder.

is
that

list

premises
licenses
in
the
area
which
state
that
the
terminal
hours
for
alcohol
sales
at
any
one
time
now.
The
the
ones
I'm
very,

keen
on
are
tracks
which,
if
you
look
on
page
31,
is
almost
directly
opposite.

My
client's
premises
has
the
ability
to
sell
alcohol
on
a
friday
and
saturday
until
4
30
in
the
morning
sundays

in
the
morning
monday
to
wednesday,
11
p.m,
which
is
the
same
hours
that
my
clients
seeking
and
then
on
a
thursday
until
2am
and
I'll
leave
the
the
committee
to
look
at
the
other
hours
on
there.
But
it's
quite
clear
that
what
my
client's
asking
for
is
it's
not
even
as
shall
we
say
extreme,
is
what
other
premises
are.

Clearly
operating
within
the
area-
and
I
run
home
from
the
office
when
I
do
come
into
the
office,
pass
this
premises
every
day
and
it's
a
very,
very
busy
road,
as
the
councillors
have
submitted
the
objection,
we'll
know,
and
I
drove
past
it
on
the
way
into
the
office
this
morning.
It's
there's
a
bus
lane
outside
there's
traffic
there.

The
the
letter
which
has
been
submitted
by
the
councillors
expresses
some
concerns
about
potential
disorder
and
potential
respectively
car
doors
closing
late
into
the
evening
on
residential
streets
surrounding
the
premises,
and
without
going
into
the
detail
that
there
are
no
parking
restrictions
in
the
area
and
my
clients
actually
informed
me
yesterday
when
I
spoke
to
them
that
there
is
a
dedicated
car
park
at
the
rear
of
the
premises,
I'm
not
told
which
will
fit
up
to
six
cars
at
four
customers
there,
and
so
that
should
allow
the
concerns
of
residents
that
there
will
be
car
doors
slamming
outside
front
doors
late
into
the
evening
and
in
terms
of
the
clientele
and
the
customers
themselves.

premises
is
associated
with
the
greatest
respected
clientele
of
the
of
the
outlet
they're,
middle-aged
and
elderly.

all

the
other
various
licensed
premises
in
the
immediate
vicinity
and
the
point
I
was
making-
and
forgive
me
if
I'm
repeating
myself
or
if
you've
already
heard
me
say
this
this
morning,
but
chapel
town,
road
and
zero
dino
very
well.

I
the
further
up
in
chat
ballot
and
so
commutes
along
it
every
day,
sometimes
more
often
than
not
on
foot
and
it's
a
noisy
road
with
buses,
and
indeed
there's
a
bus
lane
right
outside.
And
the
premise
is
in
question,
albeit
on
the
other
side
of
the
road,
and
this
is
a
premises
which
is
sat
in
an
area
which
is
going
to
attract
noise
anyway.

point
I
made
about
car
parking
and
which
wasn't
reflected
in
the
application
but
has
come
to
my
attention
since
is
that
there's
a
six
bay
car
park,
which
is
private
for
the
premises
to
the
rear,
I'm
told
and
the
objection
which
has
come
in
mentions
car
parking
and
there's
concern,
and
the
council
say
on
behalf
of
the
local
residents
of
the
cars
being
parked
in
and
around
the
the
local
streets
and
car
doors
slamming
late
at
night.

Well,
hopefully,
it
will
allow
the
concerns
of
those
residents
and
those
councillors
and
to
be
able
to
confirm
that
we've
got
a
six
paid
parking
area
to
the
rear
of
the
premises
and
moving
on
to
my
other
submissions,

we've

of
the
menu
and
sorry
it
was
late.
But
I
thought
it
would
be
useful
just
so
that
the
the
committee
can
look
and

this
is
a
premises
which
is
food.

aside
from
getting
my
appetite
worked
up
at
this
time
of
the
morning.

it's
very
clear
that
alcohol
is
very
much
going
to
be
ancillary
to
what's
going
on
at
the
premises
and
it's
an
addition
to
the
current
offer,
rather
than
something
that's
going
to
be
taking
over.
I'm
told
by
sharon
that
this
is
the
menu
that
was
used
previously.
It
has
been
for
quite
some
time
and
it's
going
to
be
the
menu
which
is
going
to
be
used
moving
forward.

What
I
want
to
move
on
to
very
briefly
before
I
finish,
is
the
section
182
guidance
and
I'm
not
sure
whether
the
committee
will
have
a
copy
of
that,
but
I'm
sure
either
robert
or
matthew
will
be
able
to
point
to
the
the
areas
that
I'm
about
to
mention,
and
the
paragraphs
that
just
I
wanted
to
submit
today
were
that
paragraph
1.16
states
that
any
conditions
and
provisions
in
a
premises
license
need
to
be
appropriate
for
the
promotion
of
licensing
objectives
and
also
that
they
need
to
be
proportionate,
justifiable
and
capable
of
being
met.

Now
I
will
ask
you
to
turn
to
the
application
form
which
is
at
and
specifically
page
23
of
the
bundles
is
section
m,
which
shows
that
the
the
conditions
which
have
been
offered
by
my
clients
and
are
quite
appropriate,
proportionate,
in
our
view,
the
justifiable
and,
in
my
submission,
they're,
certainly
capable
of
being
met
by
by
sharon
and
her
team
and
you'll
see
that
at
section
a
we
said
that
there'll
be
no
external
sales
of
alcohol.

Crucially,
the
sales
are
only
going
to
take
place
indoors,
there'll
be
no
external
bars
being
set
up
and
people
being
enticed
and
as
passers-by
and
clearly
the
external
area
will
be
used
for
the
consumption
of
alcohol
and,
although,
as
I'm
sure,
the
material
robert
will
attest
to
the
consumption
of
alcohol
in
itself,
isn't
a
licenseable
activity
and
paragraph
1.17
of
the
guidance
will
state
that
each
application
needs
to
be
considered
on
its
own
merits.

Now,
there's
reference
in
the
objection
to
a
premises
down
the
road
which
I
understand
is
an
off
an
off
licence
shop
and
my
client
is
the
firm
view
that
the
provisions
put
forward
in
the
application
are
quite
proportionate,
justifiable
appropriate
and
that
they
should
be
granted
as
as
they've
been
put
forward.

So,
almost
briefly,
to
summarize,
really,
there
are
extensive
crime
and
disorder
provisions
in
the
application
of
page
23
of
the
bundle.
And
there
are
provisions.
There
was
one
provision
with
respect
to
public
nuisance.

Although
my
submission,
the
remainder
of
the
application,
does
what
it
needs
to
do
in
respect
to
public
use
and
certainly
with
the
addition
of
the
car
park
and
the
premises
attracts
an
elderly
clientele
predominantly
who
come
from
the
area
and
will
walk
to
the
premises
and
are
based
locally
and
and
it's
a
premises
which
is
surrounded
by
noise
and
any
potential
destruction
will
likely
come
from
vehicles
rather
than
anything
else.
And
what
my
clients
will
be
prepared
to
do.

Just
very
briefly,
popping
back
to
the
guidance
at
paragraph
2.21
and
where
it
suggested
that,
if
there's
any
potential
for
customers,
certainly
late
at
night,
to
leave
the
premises
and
cause
any
difficulty
that,
whilst
my
client
and
her
premises
can't
be
held
responsible
for
what
customers
do
after
they
leave
and
they'll
certainly
be
prepared
to
put
up
a
sign
which
asks
the
clients
and
the
customers
and
of
the
premises
to
respect
neighbours
and
to
basically
keep
quiet.

they're
making
their
way
home-
and
this
is
a
quiet
premises
on
a
busy
road-
the
application
is,
in
my
submission,
appropriate
and
proportionate
and
the
clients
offered
additional
comforts
hopefully
and
to
those
making
the
decisions
today,
which
will
and
hopefully
leave
you
an
agreement
with
me
and
I'll
pass
back
to
the
chair,
and
both
I
and
sharon
are
here
for
questions.

customers

close
by
the
premises

live

elderly
people
that
just
like
to
come
out
just
for
a
walk
really
if
they
are
living
in
a
walking
distance

they

soup

elderly

just
like
to
sit
and
chat,
and
you
know
just
for
a
bit
of
company.
