The
proposal
is
for
a
retrospective
application.
It's
a
retrospective
application
for
the
installation
of
one
awning
and
two
paracels
and
alterations
to
the
rear
extension,
including
new
downpipe
parapets
to
the
roof
and
modifications
to
the
fenestration
application
is
recommended
for
approval,
subject
to
the
conditions
listed
within
the
report.
The
application
has
been
brought
to
plans
panel
as
officers
feel
that
the
approval
of
the
application
would
reverse
a
decision
previously
taken
by
panel
members
under
the
terms
of
the
office
of
delegation
scheme.

the
previous
two
applications

the
site
were
reported
to
plants
panels
the
first
one
related
to
the
change
of
use
of
the
the
site
from
a1
shop
with
flats
above
to
a
100-seater
restaurant,
and
this
included
the
rear-end
side.

Is
it's
just
off
hardcore
road?
The
application
lies
within
the
chapalation
conservation
area
and
within
the
s2
center.

can
see
regent
street
along
the
side
and
there's
a
public
or
a
footpath,
leading
up
to
the
garden
area
for
customers
to
use.
Baccalatin
terrace
runs
along
the
rear
of
the
site
where
you
can
access
the
garden
as
well
and
off
the
baccala
containers.
There's
a
number
of
residential
dwellings
and,
historically
all
the
objections
have
come.
Most
of
the
objectives
have
come
from
that
the
residents
on
market
and
terrace
when
the
previous
applications
were
under
consideration.

you
can
see
the
property
here,
it's
the
actually
one
of
the
oldest
buildings
in
the
town
center.
It
used
to
be
one
of
the
used
to
be
the
farmhouse
and
it's
it's
designated
designated
as
a
positive
building
within
the
conservation
area
appraisal.

a

garden
area
is
just
beyond

in
terms
of
publicity,
the
application
was
publicized
by
means
of
site
notice
and
was
advertised
in
the
yorkshire
evening
post
the
application,
the
application
hasn't
generated
any
representations
from
members
of
the
public,
sometimes
in
terms
of
consultations.
The
highways
have
not
objected
to
this.

The
scheme,
the
conservation
officers,
have
also
looked
at
the
scheme
and,
as
there
is
no
significant
concerns
in
terms
of
the
design
of
the
awnings,
we
feel
that
I
said
the
traditional
method
of
providing
cover
from
weather,
such
as
rain
and
intense
sunlight,
and
it
is
considered
that
the
proposal
does
not
appear
controversial
on
this
traditional
building.
Nor
does
it
have
a
significant
detrimental
impact
on
the
character
of
the
conservation
area.

For
majority
of
the
time
the
owning
is
likely
to
be
closed,
and
in
that
position
it
does
not
appear
particularly
prominent
from
public
view
and
thus
has
a
minimal
impact
on
the
appearance
of
the
building.
When
extended,
the
owning
will
appear
as
a
lightweight
structure,
although
fixed
to
the
building.
This
will
translate
as
a
secondary
element
that
does
not
overwhelm
the
design
of
the
building,
nor
would
it
significantly
harm
the
character
in
the
conservation
area.
The
paracels
are
structures
that
are
found
commonly
within
restaurants
and
pubs
within
the
garden
areas
of
the
restaurants.

Therefore,
we
don't
feel
the
proposal
appear,
appears
controversial
and
out
of
place
or
in
in
the
garden
of
this
restaurant.

The
conservation
officers,
as
I
mentioned,
has
I've,
looked
at
this
these
structures
and
have
not
raised
any
significant
concerns
in
terms
of
their
impact
on
the
conservation
area
or
the
the
visual
impact
on
the
positive
building,
the
alterations
to
the
side
extension
that
have
been
made,
which
include
the
parapets
the
window
and
down
piper,
we
feel,
are
minor
additions
that
do
not
significantly
alter
the
overall
design
of
the
side.

So
the
the
outdoor
areas
and
the
terrace
area
can't
be
used
more
longer
than
9
pm
on
this
basis
and
balanced
against
the
fact
that
the
application
property
is
located
within
the
designated
and
busy
town
center,
it
is
considered
the
levels
of
noise
associated
with
the
development
will
not
be
significantly
detrimental
to
the
amenity
of
nearby
residents,
or
at
least
not.
The
noise
would
not
be
to
a
level
that
is
uncommon
for
this
town
center
location.

It
is
considered
that
the
the
condition
relating
to
the
hours
of
use
of
the
outdoor
seating
area
should
be
restricted
to
should
be
reattached.
To
this
permission,
for
the
avoidance
of
doubt
in
terms
of
the
highways
highways
officers,
haven't,
have
evaluated
the
the
parking
and
traffic
implications
of
the
scheme
and
has
raised
no
significant
concerns.
The
proposal
only
seeks
to
provide
cover
for
existing
seating
areas
such
that
it
would
not
encourage
or
allow
for
extra
capacity
other
than
that
already
provided
within
the
facility.

So
in
conclusion,
it
is
going
to
consider
that
the
owning
and
parcels
and
the
alterations
to
the
side
extension
would
not
harm
the
character
of
the
conservation
area.
Nor
is
it
considered
that
the
proposal
will
harm
neighboring
residential
amenities
by
way
of
noise.
Furthermore,
it
is
not
considered
that
the
proposal
will
increase
parking
demands.

panel
which
originally
granted
permission
for
this
development
into
a
restaurant
and
my
view,
and
the
majority
of
the
panel
was
that
it
enhanced
the
area.
I
am
absolutely
certain
that
when
we
gave
permission
for
it,
it
was
not
for
things
like
parasols
and
awnings.

it
was
just
I
mean
it's
as
much
for
the
applicant
as
officers.
It
was
just
around
the
practicalities
of
the
nine
o'clock
limit.

certainly
support
there
being
a
limit,
but
I
just
wonder
if,

o'clock

bit
too
early
and
inflexible,
think
of
a
nice
summer's
evening
when
actually
that
might
be
detrimental
to
business.
So
it's
really
a
question
for
applicant
and
if
there's
a
justification
for
officers,
why
we've
gone
for
nine
o'clock.

objection
as

orientated
so

nothing

deal

people
around

needed
to

brought

application

instance,

because

directions

were
the
case,
that
panel
were
to
say
that
they

happy
or
with
a
later
opening
hours
and
for
the
outdoor
areas,
then,
certainly
in
terms
of
a
variation
to
the
other
consent
that
we've
gotten
that
we
haven't
got
in
front
of
us
today.

in
the
high
summer
sunset
is

to
personal
commitments
as
you'll
be

The
procedure
for
this
is
for

request

put

with
