A
Without
any
compensation,
our
procedure
for
conducting
business
I'll
call
the
name
of
the
petitioner.
If
you
would
please
come
to
the
mics
speak
clearly
into
the
mic,
present
your
item
and
be
prepared
to
answer
any
questions
that
any
board
member
might
have
or
anyone
in
the
audience
might
have.
Once
we
receive
public
testimony
on
a
particular
item,
the
members
of
the
board
will
deliberate.
A
We
will
render
our
decision
I
remind
the
members
members
with
a
part
that,
if
you
have
a
personal
or
a
financial
interest
in
any
particular
item,
you
require
to
recuse
yourself
from
voting.
Any
testimony
that
is
submitted
by
the
petitioner
on
behalf
of
the
petitioner
during
the
presentation
of
the
agenda
item
will
be
binding
as
to
any
decision.
The
board
legs
relative
to
the
motion.
I'll
remind
board
members.
If
they
motion
to
deny
it
is
a
night
owner.
Only
any
particular
item
is
made.
A
reason
must
be
given
this
time.
A
A
A
A
B
Bought
a
lot
on
Woodley
Terrace,
there
was
an
existing
structure
there
that
was
demolished
in
2009
and
I.
Believe
I'm
told
me
that
when
that
structure
was
demolished,
they
zoned
it
are
125
which
gives
you
10
foot
side
yards
I,
want
to
say
it's
50
foot
front
and
40
foot
back
the
new
house
that
I'm
willing
to
put
on
there.
A
B
B
A
But
the
objective
of
this
is
to
keep
water
off
of
the
adjacent
property
owner,
okay,
okay,
and
so,
if
that
ever
could
becomes
a
problem,
you
know
you
don't
have
to
deal
with
it:
okay,
okay,
so
I,
don't
know
what
you
do
about
further
sloping
it
swales
or
whatever,
but
you
just
got
to
keep
that
water
off.
Okay,
okay,
you
know
front
14,
foot
setback
any
question
for
members.

Lillian
Butler
I'm
at
three-one,
three-one
Woodley
terrorists
across
the
street
from
this
property,
and
my
question
is:
with
that
side
yard
variance.
Then
what
is
the
distance
between
the
two
houses
each
side
and
is
that
going
to
be
a
safety
issue
regarding
any
kind
of
emergency
fire?
You
know
ambulance
anything
that,
for
some
reason
needs
to
go
between
those
two
houses.
Mr.
B
A
Ma'am
does
that
answer
your
question.
It's
approximately
14
feet
with
the
front
wider
at
the
rear,
but
the
zoning
only
allows
I
mean.
The
zoning
only
requires
a
a
10-foot
setback
anyway,
so
that
business
was
never
intended
to
accommodate
an
emergency
vehicle
of
any
sort,
but
you
still
have
plenty
of
room
there
for
people
to
walk
through
pedestrian
walk
through.

A
motion
of
Miss
Brown
to
approve
you
have
a
second
second
mr.
Holmes,
any
further
discussion.
All
in
favor
raise
your
hand.
It's
unanimous
okay
item
number
three
is
presented
by
nexor
LLC,
representing
elemental
properties,
LLC
requesting
a
special
exception
for
above-ground
storage
tanks
to
be
located
at
12:21,
Newell
Parkway
in
an
m1
zoning
district.
Thank.
C
You
good
evening,
I'm,
Milton,
Lovell
and
I
am
the
CFO
and
general
counsel
at
nixar
LLC
in
Memphis
Tennessee.
We
have
a
real
estate
entity
called
elemental
properties
and
that's
actually
the
entity.
That's
purchased
this
property,
but
the
facility
will
be
operated
as
a
district
distribution
hub
and
retail
store
by
nexor
LLC
and
we
are
seeking
a
we're
in
an
m1
light
industrial
zone
and
we're
seeking
a
special
exception
for
two
above-ground
storage
tanks
to
store
atmospheric
gases.
A
C
Okay,
we
have
previously
been
before
this
board
for
a
property
on
Selma
highway,
which
we
received
the
approval
for
this
the
same
exception.
It
is
same
in
one
except
we
were
not
able
to
close
on
that
property
because
of
some
heirs
that
owned
that
building
prior
to
a
foreclosure
and
so
that
building
still
sets
vacant
here.
But
we
have
found
this
undeveloped
property
that
we
are
building
a
new,
a
new
facility
on
it's.
