Thank you, mr chairman. Yes, this is a a nine and a half acre parcel of land. It's on in north, montgomery on sixth street. In parallel street I've got some maps here. uh It's uh it presently is zoned m3, which is what the zoning is necessary for this use, and we are just the the planning board of adjustment is saying that we have to come before you all to get blessed uh for this use. Basically, this is a rendering of what the facility will look like.

This is a smyrna ready mix. They operate in 14 states, they have over 4 000 employees and the they've got a net value of about 500 million dollars, so they're coming to montgomery as a new industry would come to montgomery to because they see the market. Here is good, so I would humbly ask you all to pass this and let us go about bringing more industry into montgomery I'll answer. Any questions that's necessary.

uh Mickey I've got one suggestion to be sure that when this development plan comes back before the board that um that you're, showing two curb cuts on um six straight right- that a lot of times we see these and that access is typically all gravel.

We're going to require some amount of payment, an apron out front okay to to keep gravel out of 63. right. Okay. Now I don't, I can't tell you the length it needs to be, but a distance that just keeps gravel out of 6th street. That's that's what we always require.

Well, thank you uh that that was a basic rendering and we know that we've got to put a site plan together to submit uh to to get the uh a permit, and all of that will be done and we'll have a local uh engineering firm handling that for us. So yeah.

50 years ago, gotcha we are on the southwest corner of west south boulevard and I-65, and then the vacant tracks around it correct all, except for the ones abiding the ramp directly. There yeah everybody.

Okay, so the unique issue with this property, as you can see, on this handout everything hatched is wetlands. We didn't know that until very recently, so all of those trees that you see in there are the wetlands which above the highway. So if we place a 45 foot tall sign that is allowed by code, it will not be seen it will be buried in the trees. We would have to take out a massive amount of trees which, being in wetlands, that always creates an issue.

So what we've done, on the other hand out, is we flew a drone to see how high we would have to get to get above the trees to not have to disturb all those trees to tear them down for visibility purposes?

There's a 80 foot and 90 foot. That would be the bottom of the sign. The sign itself is 30 foot tall.

I don't believe that was in the handout packet, but we're allowed 1200 square foot total and our sign is actually only 684 square foot. So it's much smaller than what's allowed we're just trying to get it over the trees.

What this is is a renovation to the building that we've done and it's a collision center gerber collision center, and the request is just it was changed to an m3 uh zoning and we're just going with the recommended amount of parking that uh is in that zone.

Board members uh I'll remind you that a b3 zoning, I'm sorry district requires six and a quarter parking spaces per thousand square feet. So that's why the uh request is to retail get this variance because that's a that's an inordinate amount of parking required in a b3 zone in a business only.

Tell us what you think the complaint is, because I understand this came before us as a complaint.

All right, hello, everybody, I'm lewis bell jr! You know, since I was a small child, you're.

Going to speak a little louder and more distinctly.

Okay, my name is louis bell. Jr and you know, since I was a small child, I loved exotic animals and, to this day that's one of my passions and so the complaint I believe, originally came because I had originally. I had four chickens. Somehow somebody ended up giving me some more and so I end up with more chickens, and I think the complaint was derived from the fact that the chickens well, I had like four shirley and tinkerbell that would like group up and jump the fence um so pretty much.

I think that's where the complaint came in, because the chickens would jump the fence and go into the neighbor's yard. However, to compromise for that issue, I just said: okay. Well, you know I really like my exotic animals, and so I got rid of all of the chickens. I have no chickens. However, I still have five turkeys.

Okay well, however, I do have five turkeys left and three emu, so I'm requesting to keep those because those are like you know. I've raised them from babies, they've been there. The emu they're like with like 150 pounds, a piece and they pretty much it's just like a giant bird. It doesn't make any noises it doesn't. It doesn't jump the fence, it's just like having a dog the equivalent of having a dog in the backyard and the turkeys don't go underwear because they were raised with the emus.

So I got rid of the chickens to compromise for whatever the issue may have been, because I know the chickens would get out and get into other people's yard, and then you know and there's also people across the street who have chickens. But you know those are not mines. I have I don't own chickens.

Why do you think you had this complaint? Did it have something to do with noise? Did it have something to do with odor? uh Did it have something to do with any of these animals getting out and roaming the neighborhood or what you know.

Yes, I believe that it was came from the chickens getting out because before then, I've been there three years with the same animals and I would never get in the complaint, and so recently I noticed up to now with the chickens around the time that the chickens started getting out. That's when it seemed like the complaint came.

Well, I'm gonna see if there's anybody here that has that may have filed that complaint if they've come forward or anyone else that may have before or against uh this item. Okay, any questions board members.

I do um so, how long has it been since you've gotten rid of the chickens.

I just got rid of them, probably like when, like around the time, I came to pick up the paperwork which was about roughly, I want to say three weeks ago. Maybe four.

Weeks ago- and you basically keep the animals as a support system- are that they serve any other type of purpose.

Well, it's it's just it's my passion and it's a hobby that I love and it's like they're, just pretty much like you know, I don't have any kids. So it's like it's just the equivalent of how people have kids and you know, they're pets, yes, they're, my pets and I mean the emu, even though they look like giant dinosaurs, they are the cuddliest things in the world like when I go home. They run up to me, and I also have you know my mr lawrence and my actual landlord here who's.

You know he sees them also all the time and you know like when we get work done on the house. The people be scared of them. I'm like look they're, they're, harmless, it's just a big bird. So, okay.

I'm actually in the process of preparing to buy a home, and so I've been looking in several rural areas, particularly in the one where my mom lives and that's in sale brook, and I also looked at certain areas in prevalent, and so my goal is to stay in a certain budget range, because I know what I can afford and so I'm trying to make sure I buy a home in a rural area also looking to buy a mobile home and placing that on some property.

But so basically I'm just looking for because, as of now, I can finally say: okay, I'm well enough to you, know, buy a home and so I'm preparing to buy a home. So you know that's just you know, that's just the rental property that I'm at currently, okay,.

Unless there was a complaint I mean, I don't think it's an artist against them.

It's just the fact that these people next door have complained, and they did tell me that they were mad about the chickens getting over into their backyard and these same people that doing this complaining are out there drinking every afternoon and shooting guns in the neighborhood and the rest of neighbors are scared to death of those people, not these animals. Man, I've been out there and he is. I wish I had every tenant as good a tenant as this man is he's, he's a wonderful tenant.

I think it was speculation, mr stanley. I think it was speculation years ago it just didn't speculate out how.

About that I don't know, you know anyway tell us what you want to do.

uh The request here is uh for a variance on the on the height of the fence and the privacy vents um just a little background. A fence of some sort has been in that exact location since the homeowner moved in 20 years ago and for an unknown amount of time. Prior to that, so probably 40 years, that fence has been there.

A couple of things have changed over the years. At one point, beth manor drive ended at interstate court. That was subsequently opened up, creating a through traffic situation.

H

The second factor is that across the street, where the old chevron station was, which was a sort of a limited busy, business has been replaced now, a lot of construction noise going on and that promises to be a lot more busy. As far as a business is concerned, so noise concern and privacy concerns.

They've torn that one down and got.

A new one going up right exactly so. It just seemed once that fence became dilapidated and needed, replacing it just seemed prudent to put up a fence high enough to meet those new needs which was through traffic and in the in an expanded business. So.

Put it up not aware you had to come back and get it.

In exactly the same spot that it's always been got you.
