assembly,
district

the
east
side
of
las
vegas,
from
paradise
to
henderson,
and
I'm
here
to
present
assembly
bill
338,
which
I
hope
will
be
a
fairly
simple
bill.
As
chair
flora
says
there
is
a
history,
but
but
the
road
was
paid
very
helpfully
two
years
ago,
when
we
as
a
legislature,
passed
assembly
bill
34.

It
would
increase
return,
we
would
earn
more
money,
which
is
very
important
especially
now,
and
it
would
mitigate
risk
as,
as
we
know
from
portfolio
investment
theory
that
you
you
can
both
increase
your
returns
and
reduce
your
risk
by
diversifying
your
portfolio,
some
things
are
going
to
go
up
and
other
things
are
going
to
go
down.
So
you
just
want
to
make
sure
you
have
a
well-balanced
portfolio.
That's
what
assembly
bill
34
did
and
this
bill
is
essentially
a
tweak
of
one
part.

There
were
a
number
of
different
investments
that
were
added,
and
this
is
for
four.
The
treasurer
manages
four
kinds
of
investments.
One
is
the
state's
general
portfolio
and
if
you
turn
to
page
three
I'll
illustrate
what
this
bill
does
through
the
general
portfolio,
it
does
the
same
thing
for
all
four
funds:
pools
of
funds.
So
there's
a
the
general
portfolio,
there's
the
higher
education,
prepaid
tuition,
trust
fund,
there's
a
state
permanent
school
fund
and
the
local
government
pooled
investment
funds.

So
there
are
four
pools:
they
have
the
same
flexibility
and
if
you
go
to
page
three
lines,
six
through
around
twenty
three
or
so
what
you'll
see
is
the
guidelines
for
investing
in
securities
issued
by
foreign,
financial
institutions,
corporations
or
governments,
and
there
are
a
number
of
safeguards
that
are
very
important
there,
because
we
want
to
make
sure
when
we're
investing,
we
do
so
safely
and
what
this
bill
does
is
just
makes
a
couple
tweaks.
The
first
is
you'll
see
on
line
14,
to
eliminate
the
requirement
that
the
securities
be
publicly
traded.

They
still
have
to
be
registered
with
the
securities
and
exchange
commission,
but
what
we've
seen
in
recent
years
is
a
greater
move
from
publicly
traded,
bonds
and
other,
and
this
is
both
by
corporations
and
governments
to
what
I
call
private
placement
and
and
why
why
corporations
and
countries
like
to
do
private
placement
bonds?
Is
it's
a
more
streamlined
process?
You
don't
have
to
jump
through
as
many
hoops
regulatory
hoops
that
you
do
if
you're
issuing
them
for
publicly
traded
and
that's
because
the
people
who
buy
these
private
placement
bonds
are
very
sophisticated.

Large
investors,
their
state
treasures,
their
pension
funds,
their
private
hedge
funds
and
so
on,
and
so
we
don't
need
to
have
as
much
regulatory
oversight
and
so
for
the
company
or
the
country.
That's
issuing
these
with
the
streamline
process.
They
can
issue
their
debt
more
quickly
and
it
saves
them
money
and
in
in
return
you
get
a
higher
interest
rate.
It
can
be
half
a
percentage
point.
It
can
be
a
percentage
point
which,
when
you're
investing
millions
of
tens
of
millions,
hundreds
of
millions
of
dollars
can
add
up
very
quickly.

There
is
no
reduction
in
safety,
just
as
they
they
back
their
private
placement
bonds.
In
the
same
way,
they
back
their
publicly
traded
bonds.
It's
this.
They
get
the
same
credit
rating
that
doesn't
change
at
all.
Although
you'll
see
we
do
make
another
change,
as
they
say,
the
main
thing
is
what
you
the
only
trait:
what
is
the
trade-off?
You
get
a
higher
interest
rate,
it's
just
as
safe.
You
lose
liquidity,
they're
private
placement,
they're
not
publicly
traded.

So
if
you
want
to
jump
in
and
out
of
your
bonds,
you
know
you
have
to
wait
a
couple
years
or
one
year
or
whatever
the
maturity
is.
I
assume
our
state
treasurer
does
not
speculate,
make
speculative
investments
in
bonds
and
does
hold
them
to
maturity
and
what
a
lot
of
investors
of
these
private
placement
bonds
do.
Is
they
stagger
them?
So
you
could
invest
20
million
today
for
two
years
and
in
two
years
all
20
million
would
roll
over
or
you
could
do
five
million
every
six
months.

So,
every
six
months
you
would
have
money
rolling
over
and
there
for
your
you
get
greater
you
get.
You
would
have
minimized
the
liquidity
trade-off,
but
still
get
the
same
interest
rate.
So
it's
it
allows
our
treasure,
as
I
say,
just
to
increase
the
flexibility
that
we
gave
the
treasurer
two
years
ago
and
and
get
an
additional
return,
which
is
very
important
now
but
again
by
diversifying
you're.
Reducing
your
risk,
not
increasing
your
risk.

The
other
change,
if
you'll
see
on
line
19-
and
this
was
suggested
by
the
treasurer's
office-
to
change
the
double
a
requirement
to
single
a
and
the
reason
why
they
suggested
that
the
difference
between
double
a
and
single
a
is
is
quite
minor
and
in
fact,
if
you
look
at
other
states,
what
you'll
see
is
single
a
is
pretty
common
and
even
states
will
go
a
little
lower,
because
this
investment
so-called
investment
grade
bonds,
you
can
go
even
a
little
below
a
to
triple
b.
So
states
like
utah
louisiana
oklahoma
have
a
minimum
single.

like
this
bill
proposes
states
like
colorado,
arizona.
Georgia
will
go
even
to
triple
b,
so
we're
still
being
very
safe
by
st
by
requiring
single
a
and
we
get
a
nice
increase
in
return.
So
that's
paid
and
as
I
say,
we
do
the
same
thing
that
you
see
on
page
three
on
page
six
and
ten
and
thirteen,
I
think
for
the
other
three
investment
funds.

various
investment
portfolios,
which
total
over
30
billion
dollars.

investment
statutes
provide
the
broadest
framework
for
the
types
of
assets
states
can
invest
in,
however,
statute
nrf
355.045
requires
the
state
board
finance
to
approve
the
investment
policies
of
the
fund,
which
are
more
detailed
and
can
be
more
restrictive
than
statute.
Therefore,
the
amendments
proposed
in
338
would
potentially
be
outlined
in
more
detail
as
an
amendment
to
the
investment
policy
down
the
road
and
being
voted
on
by
the
state
board
of
finance
pursuant
to
nrs
355.045.

so
what
this
program
is
is
the
ability
for
people
to
opt
in
and
purchase
the
price
of
their
nc
higher
education
at
today's
setting
at
today,
today's
prices
or
when
your
children
or
your
grandchildren,
your
words
or
your
guardians
go
off
to
school,
and
so
it's
a
great
program.
It's
been
doing.
I
Well,
I'm
not
going
to
do
a
bunch
of
legislative
history

you,
I'm
just
going
to
let
you
know
that
we
have
a
great
program
that
that
has
been
working
well,
but
there's
a
couple
of
things
that
I
think
believe
we
need
to
change
in
order
to
make
it
work
better.
So,
first
of
all
I'll,
let
you
know
that.
I
This
right
here
are
the
the
minutes
and
the
actuaries
from
the
nevada
prepaid
tuition
program,
and
so
I'm
not
going
to
walk
you
through
the
entire
actuarial.
I
will
just
tell
you
that
the
most
recent
actuarial
evaluation
of
the
report,
as
of
june
30th
2020,
lets
us
know
that
the
fund
is
healthy.
The
fund
is
solvent
and
the
fund
is
doing
well.
In
fact,
the
fund
right
now
is
that
funded
at
165
per
10,
and
the
the
different
projections
also
show
that
it's
going
to
continue
to
grow.
I
It's
going
to
continue
to
be
more
solvent,
even
looking
at
projections
based
on
what
different
tuition
increases
scenarios
in
most
of
those
scenarios,
those
funds,
this
one
will
hit
a
thousand
percent
solvency.
So
we've
got
something:
that's
working
really
well
with
the
the
bill.

first
change
that
we
have
in
section
one
is
the
requirement
that
the
college
savings
board
who
oversees
this
fund
would
create
a
policy
that
would
look
at
the
over
solvency
of
the
pro
of
the
program
and
be
able
to
think
about
how
to
spend
down
some
of
that
money
for
the
rate
for
the
policyholders
in
the
program
and
so
section,
one
will
allow
them
to
set
up
regulations
to
consider
a
changes
to
the
contract
in
that
way,
potentially
rebates
to
the
the
policyholders
who
are
paying
in
on
this.

that
cost
of
a
student
credit
hour,
but
it's
not
covering
it,
doesn't
cover
the
cost
of
fees
and
so
right
now,
if
you
show
up
with
your
prepaid
nevada
college
program,

you've

custom
cost

college

covered,
but
actually
you've
got
student
credit
hours
covered,
and
then
you
have
all
of
these
other
fees
that
that
you've
got
to
make
sure
that
you
have
available
for
your
student
to
actually
enroll
and
attend
their
nc
education
and
right
now
those
fees
aren't
allowed
to
be
a
paid
from
a
person's
pre-paid
tuition
fund.

So
what
section
three
does
is
reference
the
definition
of
a
qualified
higher
education
expense,
so
any
of
those
fees
that
make
fit
the
definition
of
that
qualified
higher
education,
expense
can
be
used
and
that's
what
it
does.

testify,

support
of
assembly
bill
362.,
to
provide
some
background
on
the
program
since
1998,
the
nevada
prepaid
tuition
program
has
helped
families
take
control
of
rising
tuition
costs
by
purchasing
in-state
tuition
at
today's
rate
for
use
in
the
future.
The
program
has
a
number
of
different
plan
options,
ranging
from
prepaying
for
a
four-year
degree
or
a
two-year
degree
at
one
of
our
community
colleges
or
a
combination
of
the
two
contract
pricing
is
also
flexible.

For
instance,
families
can
choose
to
pay
in
one
lump
sum
or
through
a
series
of
extended
monthly
payments
until
the
child
graduates
from
high
school
contract
benefits
can
be
used
at
nc
institutions
to
cover
the
cost
of
tuition
or
at
hundreds
of
higher
education
institutions
throughout
the
world
to
help
offset
costs.
Last
year,
the
treasurer's
office
established
524
new
prepaid
tuition
contracts,
which
brought
the
program's
total
enrollment
to
22
239
children.
The
program
is
currently
in
its
open
enrollment
period
and
is
accepting
new
contract
applications
that
suggest
people
go
to
navigate.gov,
that's
nv
nvigate.gov.

As
chair
of
the
nevada
college
savings
board
of
trustees,
which
serves
as
the
fiduciary
of
the
program,
we
appreciate
the
majority
leader
taking
on
this
peaceful
educate
of
legislation.
We
believe
ab362
gives
the
prepaid
tuition
program,
greater
flexibility
and
the
chance
to
expand
opportunities
to
further
assist
nevada
families
who
purchase
their
prepaid
tuition
plan.

offices
work
closely
with
legal

bill

make
sure

meets
the
strict
standards
by
which
the
program

chapters
that
regulate
the
clerk's
office.

primarily
clarifies

simplifies
language
on
the
legislative
intent

more
easily

interpreted

the
clerk's
office

county
clerks

working
with
with
the
stakeholders
and
helping
us
address
that
concern.
If
you

that
they
understand

nature
of
where
the
issue
is
coming
from
and
how
we're
going
to
address
that.

Hail

deputy
secretary
of
state
for
southern
nevada
and
I
supervised
the
document
preparation
services
program
for
the
secretary
of
state's
office,
so
the
issue
that
will
be
clarified,
which
I
have
been
working
on
and
also
had
our
deputy,
that
oversees
the
notary
program.
Reviewing
this
as
well
will
be
a
clarification,
and
I
will
read
the
language
that
I
have
submitted
to
address
the
issue.
I
So
we
have
a
number,
in
fact,
possibly
a
majority
of
our
document-
preparation,
registrants,
who
are
also
nevada,
notaries,
and
we've
already
made
clear
last
session
that
they
can
advertise
that
they
are
a
notary
as
well
as
a
document
preparation
service.
Now
what
this
will
do
is
clarify.
They
can
charge
the
notary
fees
that
a
notary
would
charge.
I
They
may
also
charge
the
fee
that
a
document
preparation
service
would
charge
to
prepare
or
transcribe
scribe
a
document,
so
it
would
just
allow
them
to
do
that
without
creating
any
potential
conflict.
One
of
the
prohibits
prohibited
acts
of
the
notary
is
that
they
cannot
notarize
their
own
signature.
I
They
cannot
notarize
a
document
in
which
they
are
named.
They
cannot
notarize
a
document
that
benefits
them,
maybe
an
inheritance
or
a
property
in
any
way.
That
would
be
a
conflict
of
the
notaries
duties.
I
So
it
has
been
an
issue
that
had
come
up
in
this
aspect
in
this
program,
and
this
clarifies
that
they
would
be
allowed
to
charge
their
document
preparation
fee
and
to
charge
their
notary
fee
if,
in
fact,
they
are
notarizing
a
document
they
prepared,
and
this
would
take
care
of
an
issue
for
them,
and
I
would
just
say
that
the
small
business
community
that
is
bringing
this
forward-
they
are
reputable
operators.
They
are
the
reason
it's
an
issue.

the

for
the
county
or
city
to
reduce
the
fees
it
charges
for
barricade

encroachment
permits
and
building
permits
when
the
balance
in

amount,

to
accelerate
the
construction
of
fire
stations
in
a
fast-growing
area
and
put
folks
back
to
work
in
a
time
where
some
larger
prevailing
wage
projects
are
coming
to
a
close.

think
that
this
really
helps
us
hit
the
sweet
spot
and
dial
in
how
that
process
works
by
ensuring
that
the
project
is
designed
bid
and
once
you
know
what
the
actual
dollar
is,
dollar
figure
is,
and
what

additional
need
is
that
only
those
funds
are
transferred
over
to
facilitate
the
construction
of
the
fire
station.
So

funds

currently
proposed
only
applies

counties

only

local

an
enterprise
fund.
That's
been
established.
An
enterprise
fund
reserve
balance,
that's
in
excess
of
the
current
statutory
requirements
and
only
in
counties
larger
than
seven
hundred
thousand.

So
this
my
understanding
and
speaking
with
all
local
government
stakeholders
is
that
this
would
only
apply
to
clark
county
and
only
applies
in
the
unique
set
of
circumstances
where
we
had
several
very
large
projects.
That
built
a
very
healthy
fund
reserve
hit
a
scenario
where
we
had
a
lack
of
funds
because
coming
out
of
the
great
recession,
the
funds
had
never
been
made
to
recover
to
keep
up
with
the
need
for
fire
service
in
the
southwest
portion
of
clark
county
and
so
we've
now
indexed
those
fees
going
forward.

We've
also
again
have
a
very
healthy
fund
reserve.
So
I
think
it's
a
very
unique
set
of
circumstances
and
would
certainly
hate
for
anybody
to
extrapolate
this
policy
in
this
very
unique
set
of
dynamics
and
circumstances,
to
somehow
mean
that
this
is
a
piggy
bank
for
for
other
types
of
projects.
This
is
directly
tied
to
construction,
need
and
and
will
serve
and
and
benefit
the
folks
that
paid
in
to
this
fund
in
the
first
place,
and
those
are
all
really
critical
elements
and
protections
that
we
think
are
important.

every
attempt

schedule

hearings

dialogue

for

spirit

bipartisan

we

members
from
both
sides

agencies

amount

accomplished

committee
