decision

legislatively

reclassification,

biennium,
the
chief
financial
officer,

assumed
the
majority

further
testified
that
the
chief
financial
officer
who
oversees
five
functional
units
is
currently
unable
to
perform
all

the

for

attorney
general's
workers,
compensation,
fraud,
budget
budget,
1033,
and
this
budget
has
two
fraud
units,
the
first
being
the
workers
compensation
fraud
unit.
This
unit
is
responsible
for
the
investigation,
prosecution
or
fraud
committed
by
employees,
employers
or
medical
providers
against
insurance
companies
or
self-insured
employers
for
workers
compensation.

insurance
fraud
unit
is
funded
through
a
transfer
of
insurer
assessments
collected
by
the
insurance
division
of
the
department
of
business
and
industry.
The
revenue
collected
from
civil
penalty,
recoveries
for
the
workers,
compensation
fraud
unit
and
the
insurance
fraud
unit
also
are
included
in
this
budget
and
are
used
to
support
the
investigation
activities
of
the
fraud
units.

this
time
to
support
the

collected

division
of
insurance,
who
is
able

retain

percentage

then

able

sustain
the

for

and
2.2
million
dollars
in
fiscal

the
savings

would
be
generated
if
the
position
transfer
in
major
issue,
one

approved
in
follow-up
communication
with
fiscal

The
agency
indicated
it
intends
to
redistribute
the
reserve
balance

budget
back
to
partner
organizations
to
partially
offset
funding
reductions
which
were
required
to
balance
the
base
budget.

these
concerns,
the
agency
testified
it
had
initially
requested
general
fund
or
other
settlement
funds

be
transferred

budget
to
offset
the
loss
of
national
mortgage
settlement
funds
and
the
pending
reductions
of
funding.

partner
organizations,
however,
based
on
concerns
from
staff
at
the
controller's
office,
the
governor's
finance
office
and
the
legislative
council
bureau's
fiscal
analysis,
division
which
noted
the
restriction
restricted
nature
of
this
budget
as
a
special
revenue
fund
created
for
a
specific
purpose.

agency
proceeded
to
proportionately
reduce
funding
to
subject
for
some
grants
to
partner
organizations
to
balance
the
budget
in
follow-up
communications.
After
the
budget
hearing
with
the
governor's
finance
office,
the
controller's
office
reiterated
that
this
special
revenue
fund
was
established
for
the
express
purpose
of
receiving
the
proceeds
of
the
consent
judgment.
Order
related
to
the
national
mortgage
settlement
and,
as
such,
the
controller's
office
does
not
believe
it
would
be
appropriate
to
transfer
other
settlement
funds
into
this
fund
unless
the
settlements
are
for
this
expressed
same
purpose.

noted
previously,
the
agency
did
have
to
reduce
1.12
million
dollars
from
the
base
budget
in
fiscal
year
2022
and
2.2
million
dollars
in
fiscal
year
2023
to
balance
the
budget,
and
while
the
agency
intends
to
use
the
remaining
reserve
balance
to
offset
these
reduced
funding
levels
to
partner
organizations,
the
balance
in
the
reserve
is
only
sufficient
to
partially
restore
the
reductions
in
fiscal
year
2022,
as
recommended.
The
governor's
budget
funding
for
subgrants
to
part
organizations
would
be
completely
eliminated
in
fiscal
year.

Therefore,
given
the
guidelines
from
the
comptroller's
office
with
respect
to
the
restricted
nature
of
this
budget,
the
money
committees
could
consider
transferring
the
sub-grant
programs
from
this
budget
to
the
state's
state
settlements
budget
in
fiscal
year
2023
in
order
to
utilize
unobligated
settlement
funds
of
up
to
approximately
1.8
million
dollars
in
that
budget
to
provide
subgrants
to
continue
providing
sub
grants
to
partner
organizations
in
fiscal
year.
2023
the
unobligated
settlement
funds
in
the
state
settlements
budget
are
from
the
volkswagen
settlement,
which
are
eligible
for
use
for
consumer
protections
and
deceptive
trade
practices.

committees
asked

agency

any
alternative
funding
sources
apart
from
general
fund
that
had
been
explored
to
continue
supporting
these
consumer
protection
efforts
and
the
agency
indicated

had
formulated
