of
course,
mr

enables
another
option
of
the
fuel
to
be
available
to
the
consumers.
Here
in
the
state
uploaded
on
nellis,
you

find
a
map
which
details
the
states
that
currently
have
e-15
fuel
available
and
the
ones

do
not
both
the
department
of
agriculture
and
the
department
of
environmental
protection
have
been
involved
in
the
discussions
regarding
this
topic,
I
believe
that
administrator
matiavich

also
be

on

this
initiative,

offer
comments

neutral
as
we
get

that

commercialize

low-carbon
bobbles

brief,
I
know
it's
an
obsession
and
you're
looking
to
move.
We
believe
assembly
bill.
411
is
a
com,
common
sense
legislation
that
will
bring
nevada
in
alignment
with
the
vast
majority
of
the
rest
of
the
nation.

I
want

brownmay

leadership

important
matter

I'm
here
to
testify
really
to
just
one
thing,
which
is
the
market
viability
of
e15,
which
is
a
15
ethanol
blend
of
fuel
gasoline
in
nevada,
as
assemblywoman
brahmay
noted
e15
is
offered
to
consumers
in
now,
more
than
30
states
without
issue.

is
legal
for
use
in
in
now
more
than
45
states.
This
is
a
road
tested
product
that
has
many
benefits
and
has
not
had
any
safety
or
compatibility
incidents
across
the
country.

vast
majority
of
existing
fuel
dispensers
and
underground
storage
tanks
are
compatible
with
e15
and,
very
importantly,
this
bill
would
not
require
any
gas
station
to
offer
it.
It
would
merely
allow
them
to
do
so.
So
the
bottom
line
is
assembly
bill
411,
we'll
bring
nevada
into
alignment
with
most
of
the
nation
and
open
the
door
for
a
cleaner
and
cheaper
fuel
blend
made
right
here
in
america.

where
this
fuel
will
be
sold
in
nevada.
I
think
that
we
had
previously
heard
testimony
last
year
about
well.
First,
let
me
ask:
is
this
the
same
as
88
octane
fuel.

Yeah,
so
the
it's
it's
it
is,
it
is
commonly
the
same
as
88
octane
fuel.
It's
really
up
to
the
to
answer
your
question,
because
it's
an
it's
an
option
for
retailers.
It
will
be
sold
mostly
at
independent
retailers
who
elect
to
do
so
and
then
essentially
e15
right
now.
Virtually
every
gallon
of
gasoline
in
nevada
contains
10
ethanol,
and
what
this
allows
retailers
to
do
is
add
another
5
ethanol
itself
is
higher
octane
and
cleaner
than
gasoline.
So
you
can
get
a
higher
octane
fuel
for
for
less
money
from
a
retail
level.

I'm
not
an
expert
in
this
area,
but
my
understanding
is
that
there
are
some
differences
in
the
utilization
and
the
function
of
fuel
at
different
elevations
in
different
climates
and
here
in
nevada.
We
do
have
numerous
climates
that
have
different
characteristics,
and
so
what
I'm
asking
is,
would
this
I
don't.
I
don't
see
anything
in
this
bill
prohibiting
the
sale
in
any
part
of
the
state
and
I'm
concerned
that
there
may
be
parts
of
the
state
where
this
field
would
not
be
safe
to
dispense.

adopting
fuel
specifications,
the
board
of
agriculture
will
adopt
an
astm
specification
for
the
fuel
and
the
and
the
specification
for
gasoline
astm
d4814.

are
various
tables
that
are
referred
to
in
that
specification
that
address
the
things
that
you're
talking
about
temperature
elevation,
those
types
of
things,
and
while
there
are
some
amendments
to
that
specification
under
consideration
right
now,
particularly
in
response
to
changes
made
by
the
environmental
protection
agency
relative
to
e15.

compared

gasoline

use

our

sure

that
the
higher
percentage
of
ethanol
in
gasoline
helps
to
reduce
greenhouse
gas
emissions.
It
would
be
based
upon
obviously
consumption
and
consumer
choice,
so
we
couldn't
be
able
to
begin
to
forecast
what
would
the
true
impacts
be
to
greenhouse
gas
emissions
here
in
nevada,
as
it
would
simply
be
another
option
available
for
purchase
by
consumers
at
this.

I
guess
my
question
is,
and
perhaps
anyone
can
weigh
in
on
this.
Could
we
potentially
see
a
situation
where
this
becomes
a
consumer
protection
concern
where
people
really
aren't
educated
is
to
the
differences
of
what
gasoline
they're
opting
into
and
perhaps
it
could
wear
down
their
vehicles?
Is
that
something
that
could
happen
down
the
road
if
we
approve
this.

So,
yes,
that
that
could
exist
if
the
pumps
weren't
appropriately
labeled,
which
is
one
of
the
reasons
for
the
delay
in
the
dates
for
implementation
on
this
piece
of
legislation
in
particular,
so
that
both
the
department
of
environmental
protection
and
the
department
of
agriculture
have
the
opportunity
to
appropriately
identify
the
regulations
necessary
to
ensure
appropriate
consumer
awareness.
So
there
would
be
labeling
involved
and
the
pumps
would
be
appropriately
marketed
again.
It
would
not
be
required
for
purchase
for
availability
for
purchase
at
any
particular
retail
outlet.

there's
nothing
just
to
confirm:
there's
nothing
in
this
bill
that
would
require
them
to
determine
how
to
prevent,
for
instance,
the
negative
effects
of
that
correct.
It's
we're
assuming
that
if
we
pass
this
bill,

regulations

come
after

address
the
consumer
concerns
that
were
that
were
that
could
potentially
result.

there
is
no
flexibility
within
that,
so
this
just
simply
enables
a
higher
octane
gasoline
be
available
for
purchase
within
nevada
through
the
department's
regulatory
process.

to

us
through
that
process,
but
both
the
departments
of
environmental
protection
and
agriculture
have
been
involved
in
the
discussions
relative
to
the
rollout
of
this
fuel.

granted
permission
by
the
federal
government
in
order
to
do
that,
they
have
to
show
they
have
what's
called
a
mis-fueling
mitigation
plan,
which
means
they
have
to
show
that
they
have
a
plan
to
make
sure

is

very
good
question
doesn't
happen,
and
there
is
guidance
for
that
and
there's
also
a
large
yellow
decal
that
goes
on
the
pump,
and
so
really
the
endeavor
here
is
to
make
sure
that
nevada
does
what

other
states

done

sure,
and
the
retailer
has
the
obligation
to
do
what
the
federal
government
requires,
which
is
to
prevent
consumer
problems
with
this.

everything

laundry

proposes
changes

the
statutes
governing

fund

up
discharges

also
known
as
the
petroleum
fund.
In
short,
ab40,
proposes
to
do
the
following
three
things.
First,
it
changes
the
definition
of
small
business
for
purposes
of
fund
administration
in
response
to
an
executive
branch
audit.

right
now
the
fund
provides
up
to
one
million
per
tank
with
lower
limits
for
small
heating
oil
tanks,
and
these
are
basically
tanks.
You
find
in
gas
stations
and
most
of
the
time
to
reimburse
operators
for
costs
associated
with
investigation
and
cleanup
a
petroleum
substance
releases
to
soil
and
groundwater.

would
allow
ndep
and
the
board
to
engage
in
a
stakeholder
process
with
a
proposed
petroleum
fund
policy
resolution
that
could
be
adapted
adopted
into
nevada
administrative
code
through
both
the
board
review
claims
and

legislative
commission.

board
review
claims
include
members
representing
the
public,
regulated
industry
and
government
agencies.

Ndp
will
perform
additional
research
and
comparisons
on
options
for
changing
the
definition
of
small
business,
including
thresholds
based
on
gross
income,
net
income,
fuel
sales
and
or
fuel
throughput
ndp
will
also
explore
options
for
indexing
or
updating
the
definition
on
a
periodic
basis,
which
would
be
facilitated
by
moving
the
definition
from
statute
to
regulation,
the
assembly
committees
on
natural
resources
and
ways
and
means
approved
two
amendments,
one
minor
from
ndep
and
then
one
submitted

the
nevada,
petroleum,
marketers
and
convenience
store
association.
Those
are
both
deflected
in

amendment
that
came
at
the
request
of
the
patrol
marketers
will
allow
for
additional
funds
beyond

million,

needed
at
certain
cleanup
sites,
ndp
accepted
the
amendment

condition
that
safeguards
be
included

effective
and
efficient
use
of
funds
with
appropriate
oversight.
Those
changes
are
reflected
in

subsections,

seven

minor
changes

longer
the
operator.
So
we're
really
proposing
this
revision
to
clarify
that
the
funds
available
for
those
who
are
operating,

facility

own
it

discovered
later

from
fuel
suppliers
and

at
the
