temporary
licensing

members

military

spouses
provision

this
proposed
bdr
would
require
professional
licensing
boards,
including
occupational
therapy,
to
issue
a
temporary
license
to
members
of
the
military
and
spouses
if
they
meet
certain
requirements,
including
being
subject
to
a
criminal
background
check.

aware
that
a
background
check
is
not
required
for
licensure
by
the
nevada
state
board
of
occupational
therapy.
Background
checks
are
required
when
occupational
therapists
are
employed
by
hospitals,
nursing
homes,
school
districts
and
so
on,
so
requiring
a
background
check
at
licensure
is
duplicative
time
consuming
results
in
licensing
delays
and
expensive.

addition,
utilization
of
the
national
practitioner
data
bank
is
available
for
verification
of
applicants
licensee
criminal
and
disciplinary
history,

well
as
verifications
from
out-of-state
licensing
entities.

regret
to
inform

the
nevada
state
board

will

a
three-day
processing

work

and

national
occupational
therapy
compact
has
been
established

its
first
meeting
held
by
the
compact
commission
this
month.

begins
the
process
of
establishing
operating
rules
and
fees.
The
op
ot
compact

operational

to
issue
compact
privileges
for
at
least
18
to
24
months.
The
board
supports
the
con
compact
concept
and
will
evaluate
the
requirements
for
participation
when
the
rolls
and
costs
have

determined.

board.
The
state
contractors
board
regulates
licensed
contractors
in
nevada,
which
is
designed
to
protect
the
health
safety
and
welfare
of
the
public.

and
members
of
the
committee.
My
name
is
margie
green
and
I've
had
the
pleasure
of
serving
as
the
board's
executive
officer
of
the
board
for
the
past
24
years
of
my
36-year
career
with
the
nevada
state
contractors
board
again
with
me
today
is
sam
palmer.
Our
newly
hired
deputy
executive
executive
officer
sam
came
from
as
assistant
building
official
for
clark
county
for
the
past
10
years,
so
we'll
we're
welcome
to
have
him
on
board
with
us.

The
state
contractors
board
was
established
in
1941
by
the
nevada
legislature
and
is
comprised
of
seven
members,
including
six
licensed
contractors,
and
one
public
representative.
Each
member
is
appointed
by
the
governor
for
a
three-year
term.
Our
board
meets
monthly
to
provide
staff
direction
on
policy
and
governance,
approve,
license
application
hearings
and
hear
application
denial
hearings.
In
addition,
the
board
develops
a
strategic
plan
every
year
that
outlines
the
goals
and
objectives
to
be
achieved.

During
the
fiscal
year
we
have
a
number
of
subcommittees
that
meet
on
an
ongoing
basis
and
with
the
exception
of
the
recovery
residential
recovery
fund,
which
meets
every
other
month
and
is
comprised
of
three
board
members,
our
disciplinary
hearings
are
conducted
twice
monthly
by
independent
administrative
law.

Our
board
has
maintained
an
operating
reserve
policy
since
1948,
which
has
been
modified
over
the
years
based
on
recommendations
received
by
our
auditors
and
comply
with
the
most
current
financial
statement
reporting
requirements.
Our
current
operating
reserve
policy
was
revised
and
approved
by
the
board
in
on
october,
12
2010,
following
audit
recommendations
received
by
our
cpa,
firm.
The
current
reserve
policy
requires
an
annual
analysis
of
the
ratio
of
unrestricted
net
assets
and
the
board's
operating
expenses
at
fiscal
year
end
during
the
annual
audit.

The
board
authorized
monetary
refund
of
approximately
2.6
million
dollars
to
15
000,
active
and
inactive
licensees,
based
on
their
license
status.
Returning
to
the
overview
of
the
board,
we
employ
54
personnel
between
our
two
offices
in
reno
and
las
vegas
and
maintain
our
own
benefit
and
retirement
package.
The
contractor's
board
has
never
been
a
part
of
pers
since
inception.
In
1941,
however,
we
have
been
an
active
participant
in
social
security
since
1952
and
offer
both
a
401,
a
employer-funded
retirement
plan,
as
well
as
a
457
b
employee-funded
retirement
plan.

We
currently
license
over
17
000
construction
companies
in
the
state
of
nevada,
including
both
residential
and
commercial
contractors.
Licensees
consist
of
sole
proprietors
partnerships,
corporations
and
llcs
of
this
of
the
current
17416
act
of
licensees,
approximately
35
percent
or
4976
are
from
out
of
state.

Applicants
are
required
to
take
and
pass
any
required
trade
exams,
as
well
as
the
construction
management
survey
exam
which
tests
the
applicant's
understanding
of
applicable
state
laws
and
knowledge
of
operating
a
business.
The
license
classifications
range
from
specialty
licenses,
such
as
plumbers
or
electricians
to
general
contractors.

Projects
can
rema
can
range
from
small
home
repairs
to
building
projects
such
as
the
raiders
stadium.
To
give
you
an
idea
of
the
volume
of
work
performed
by
our
licensing
department
during
the
past
fiscal
year,
approximately
three
hundred
and
thirty
five
new
license
and
license
change.
Applications
were
received
and
just
over
seven
thousand
four
hundred
and
fifty
eight
license
renewals
were
processed.

Making
licensure
more
accessible
to
those
who
have
an
interest
in
starting
a
construction
business
in
nevada
is
something
the
board
remains
committed
to.
Since
2017,
our
board
has
continued
to
identify
potential
barriers
to
licensure
and
labor
market
entry,
while
also
seeking
the
opportunities
to
expand,
license
portability
and
reciprocal
agreements.

We've
worked
with
our
exam
provider
to
allow
applicants
to
take
nevada-based
exams
at
any
of
their
approved
facilities
across
the
nation.
The
board
recently
initiated
rulemaking
to
create
a
license
category
for
residential
remodeling
work,
which
is
intended
to
provide
a
pathway
to
licensure
for
smaller
companies
that
may
not
have
the
general
building
or
commercial
construction
experience.

And.
Lastly,
we've
raised
our
awareness
of
our
small
business
assistance
and
veterans
assistance
programs.
These
programs
provide
individualized
assistance
to
veteran
applicants
and
offer
monthly
seminars
to
business
applicants
that
provide
information
concerning
requirements
and
other
helpful
tips.

These
offenses
normally
consist
of
violations
of
laws
such
as
failure
to
obtain
a
building,
permit,
hiring
or
doing
business
with
an
unlicensed
contractor
or
failure
to
maintain
industrial
insurance.
Our
criminal
division
investigates
all
unlicensed
contractor
complaints
and
may
forward
validated
cases
to
local
district
attorney's
offices
for
criminal
prosecution.

The
fraud
unit
also
assists
licensed
contractors
who
have
been
victimized
by
embezzlement
through
criminal
activity
such
as
theft,
diversion
of
funds,
forgery
and
misrepresentation,
because
many
of
these
cases
are
often
rejected
by
the
courts
as
a
civil
matter.
The
ability
for
the
contractor's
board
to
investigate
the
allegations
and
prepare
criminal
charges
with
enhanced
penalties
for
crimes
against
seniors
has
been
successful.
When
presenting
the
case
to
the
district
attorneys
or
attorney
generals
for
prosecution.

The
efforts
of
our
fraud
unit
have
resulted
in
the
prosecution
and
conviction
on
multiple
criminal
fraud.
Cases
have
resulted
in
both
restitution
to
the
victims
and
prison
time
for
the
offenders
during
fiscal
year,
2020
21
or
21
22.
Our
enforcement
division
received
over
2152
complaints,
processed
3398
fingerprint
cards
and
performed
230
background
investigations.

The
money
that
we
receive
from
disciplinary
fines
is
deposited
into
the
construction
education
fund
and
is
distributed
by
the
commission
on
construction
education
in
the
form
of
grants.
These
grants
include
community
educational
and
industry,
affiliated
organizations
that
want
to
implement
and
promote
construction
education
programs
in
the
state
of
nevada.

Additionally,
the
residential
recovery
fund
subcommittee
considered
85
claims
during
2122
and
awarded
over
767
thousand
dollars
to
harm
homeowners.
Many
have
put
their
life
savings
on
the
line
they
were
senior
citizens
taking
advantage
of
or
homeowners
who
had
their
projects
abandoned.
The
balance
of
the
recovery
fund
of
june
30th
2022
is
approximately
5.5
million
dollars.

Since
the
first
claim
was
paid
in
2001.
The
recovery
fund
has
awarded
over
14
million
dollars
to
harmed
homeowners
across
our
state,
and
I
can
tell
you
firsthand.
There
is
no
greater
feeling
than
helping
a
homeowner
who
has
been
harmed
by
an
unscrupulous
contractor,
much
of
while
much
of
our
work,
centers
on
our
the
accountability
of
our
licensing
licensees
and
regulating
their
abilities
to
follow
the
laws
of
our
state.
Our
greatest
our
greater
purpose
and
outcome
is
measured
by
the
people
we
protect
each
and
every
day.

That
brings
industry
professionals
and
the
contractors
board
together
to
hire
like
the
importance
of
hiring
licensed
contractors
for
homeowners
of
all
ages,
looking
to
engage
in
home
repair
or
remodel
projects
and
an
informational
program
that
has
been
provided
to
community
community
managers.
Realtors
and
governmental
agencies
responsible
for
hiring
contractors.

We've
recently
formed
a
statewide
interagency
task
force
to
combat
illegal
and
unlicensed
activities.
Members
of
the
task
force
include
the
state
contractors
board,
the
attorney
general's
fraud
unit,
the
labor
commissioner
department
of
business
and
industry,
dir,
osha,
local
law
enforcement
and
the
district
attorney's
offices.

We
also
meet
with
various
industry
associations
to
share
the
objectives
and
activities
of
the
board,
seek
their
input
and
proactively
address
the
concerns
of
relevance
to
the
board
during
the
fiscal
year.
We
welcome
the
opportunity
to
work
with

industry
in
reaching
out
to
high
school
students
to
share
with
them
the
value
value
of
a
career
in
construction.

The
forums
provide
an
interactive
discussion
with
students
highlighted
the
benefits
of
a
career
in
construction,
allowed
each
panelist
to
share
their
own
personal
story
of
how
they
entered
the
construction
field
to
demonstrate
how
their
certain
path
they
took.
Every
professional
that
we
meet
with
has
taken
a
different
path
to
achieve
success.

Additionally,
the
board
participated
in
events
like
construction
career
day
and
the
consumer
protection
awareness
week.
These
forums
provide
an
opportunity
to
share
a
more
in-depth
information
with
state
and
local
representatives
and
industry
professionals
about
licensed
verification,
the
board's
investigative
services
and
related
re
resources.

also
had
the
pleasure
of
responding
to
four
audit
requests
during
the
past
four
years.
Two
from
the
legislative
sunset
committee
and
two
for

the
executive
branch
audit
committee.
Both
platforms
gave
our
board
the
opportunity
to
share
its
story
and
demonstrate
the
transparency
we
hold
ourselves
accountable
to
regarding
operations
of
our
board,
we're
proud
of
the
efforts
we
make
and
continue
to
make
to
protect
the
public
and
promote
the
integrity
of
the
industry.

think,
there's
a
disconnect
in
a
way

kids
today
are
into
the
career
pathway

pipeline

they

nowhere
to
go
use
it.

them

anything

We
go
to
different
high
schools,
trade
schools,
some
at
a
college
level,
community
college
level.
We
also
reach
out
to
minority
women's
groups.

found
that
there's
a
desire
for
some
underprivileged
females
to
get
into
construction
a
career.
They
hadn't
thought
of
before
each
of
our
panelists
that
we
have
on
these,
and
these
forums
represents
a
different
walk
of
life.
Sometimes
we
will
have
a
representative
from
a
union
that
is
interested
in
apprentice
programs.

You
know
they
had
different
booths
set
up
where
everyone
could
get
information
on
apprenticeship
programs.
We
are
continuing
to
do
more
and,
of
course,
I
hate
to
use
the
coveted
word
as
an
excuse.
It's
not
we're
now,
just
getting
our
programs
ramped
back
up
again,
and
that
is
part
of
our
fall
program
to
reach
out
even
more.
Yes,
there's
a
lot
of
opportunity
for
students.

I
always
tell
the
students
drive
around
the
valley
and
look
at
some
of
these
big
projects,
and
those
are
contractors
that
are
building
those
it's
a
great
opportunity
for
you,
so
we're
going
to
continue
to
outreach
more
and
again
we're
trying
to
partner
as
much
as
we
can,
whether
it's
with
legislators,
government
officials,
trade,
schools,
community
colleges,
wherever
we're
we're
open
for
any
outreach
that
anyone
wants
to
provide.

folks

posing

contractor

not
so

went
on
youtube
and
I
see
that
there's
one
video

talks
about
beware

scammers,
but
it's
like
four
years
old,
I'm
not
trying
to
give
you
any
more
work,

you
know
if
you
all,
could
just
go
back
and
take
a
look
at
that.
Maybe
there's
some
other
things
that
you've
learned
from
especially
the

cases.

at

where
they
trust

and

concern
is:
whenever
money
starts
flowing,
you're
always
gonna
have
folks
who
are
trying
to
figure
out
how
they
can
get
their
hands
on
it.

disciplinary
hearings.

long
like,

someone

they
get
in
pretty
quickly?

they
like
since
there's
two
every
month

is
there
like
a

day,
usually
period.

we
have
to
come.

first

all,
we
have

comply

the
due
process,
notices
of
the
hearing,
etc
and
usually
those
two
days
and
sometimes
they're
more
than
that,

alj

set

calendar

he'll
have
anywhere
from
five

ten
cases.
That
day
the
of
course
the
respondent
is,
has
the
opportunity
to
provide
counsel
or
come
in
appear
with
counsel.

alj
will
hear
the
matter
and
a
decision
is
usually
rendered
that
day.
From
that
point,
he
issues
a
final
decision
in
order,
and
then
that
goes
into
effect
and
then
the
respondent
has
appeal
rights,
but
for
the
most
part

there

bit
of
a
lag
in
our
disciplinary
hearings,

we're
getting
caught
up
now,
we've
been
having
more
hearings
so
that
we
can
get
rid
of
that
backlog,
but
each
case

depends
on

extent

what
the
charges
are

the
witnesses
involved
sometimes
they're.

board's
required

reserve
and

do

much
money

licensing

going

cut
back
on

agencies,

get
to

back
to
the
legislature
and
ask
for
more
money.

to
operate
within
our
means,

built
a
substantial
reserve
and
then,

the
end
of

think
it

about
a
five-year
period.

we

employees
that
they

desire
as

goes

hold
that
employer
and
that
license
holder
responsible.
For
that.
I
know
there
are
things
that
happen
with
embezzlement,
that's
for
a
different
avenue
for
recourse,
but
they
there's
no
limit
to
who
they
hire
as
their
employees.

fraudulent
claim
against
that
contractor's

one

the
things
we
heard
is
that
there
across
the
board
was
that
there
was

shortage
of
nurses
in
our
state,
and
we
heard
this
as
a
recommendation.

lot
of
recommendations
that

was
one

really
piqued

interest
and
I
looked
into
further.
How
do
we
get
more
people
into
nursing
programs
in
our
state,
and
one

our
presenters
talked
about

lack
of
nursing
schools

were
part
of
the
millennium
scholarship?
So
what
we
did
is
we
looked
into
a
list
of
other
schools
that
could
be
part
of
of
the
millennium
scholarship
and
we
found
some
other
nursing
schools
in
our
state.

gives
the
eligibility
requirements
for
schools
to
participate
in
the
in
the
millennium
scholarship.
They
have
to
be
nevada,
foreign
schools,
nevada-based
schools,
both
the
mojave
and
nightingale
college
are
schools
that
were
established

state,
but
just
have
clinical
programs
here,
so
they
would
not
be
eligible
to
participate
in
the
in
the
millennium
scholarship.

of
the
things
I
would
like
to
note
is
that
if
for
a
student
who's
eligible
for
the
millennium
scholarship

maybe
is
interested
in
nursing,
this
they're
already
eligible
for
the
millennium
scholarship,
this
just
opens
up

possibility
of
them
actually
getting
into
a
program
that
they're
interested
in,
because
it
gives
them
more
options
to
where
they
can
use
that
millennium
scholarship.
Nursing
is
a
very
competitive
program.

deans

some

nursing
schools

seats
fill
up
very
quickly,

somebody
who
might
have
thought
about
doing
an
in-state
nursing
program

able
to
because
they
don't
have

seats

these

and
now,
if
we
can
keep
them
in
state
with
a
scholarship,
there's
a
good
possibility
that
they
might
stay
here
and
actually
practice
in
their
field.

to

answer

regarding
the
bank
on
program

really
helps
communities

underbanked

banked.
