The Committee on Finance of the Council of the City of Philadelphia held a Public Hearing on Wednesday, December 6, 2017, at 3:00 PM, in Room 400, City Hall, to hear testimony on the following items:
171052 An Ordinance authorizing and approving the execution and delivery of a Service Agreement between the City of Philadelphia and the Philadelphia Authority for Industrial Development relating to the financing of energy conservation and efficiency measures at the Philadelphia Museum of Art Main Building, the Perelman Building and the Rodin Building; approving the issuance by such Authority of bonds, notes or other evidences of indebtedness in one or more series to finance or refinance such project and authorizing and approving the obligation of the City to pay in full when due the Service Fee and other amounts payable under the Service Agreement; authorizing certain City officers to take certain actions required to issue such bonds, notes or other evidences of indebtedness; covenanting that the City will make necessary appropriations in each of the City's fiscal years to provide for, and will make timely payments of, the Service Fee and other amounts due under the Service Agreement; and authorizing City officials to take other necessary or appropriate actions to effectuate the purposes of this ordinance; all under certain terms and conditions.

Bills

these
two
bills
proposed
to
authorize
the
procurement
Commissioner
on
behalf
of
the
city,
enter
into
a
guaranteed
energy
savings
contract
with
the
Philadelphia
Energy
Authority,
and
authorized
the
financing
of
this
project
through
the
issuance
of
bonds.

together
would
enable
the
city
dead,
reduce
long
term
energy
use
and
cost
at
the
three
Philadelphia
Museum
of
Art
buildings,
the
Perelman
building
or
dead
museum
and
the
main
building,
which
is
this
gen
funds,
single
largest
energy
user.
The
Office
of
Sustainability
is
responsible
for
coordinating
and
implementation
of
green
works,
Philadelphia
the
city's
sustainability
vision
through
green
marks.
The
city
has
made
developed
in
municipal
energy
master
plan,
which
is
focused
on
lowering
the
useful
energy
carbon
emissions
and
reducing
our
energy
use
and
cleaning
our
energy
supply.

energy
office
as
part
of
the
office
of
sustainability
focuses
on
completing
projects
and
programs
that
reduce
utility
costs,
while
demonstrating
the
city
government's
ability
to
lead
by
example.
We
strongly
believe
that
we
cannot
ask
residents
and
businesses
to
take
steps
that
we
are
not
willing
to
do
ourselves
so
that
then,
today,
together
with
our
partners
at
the
Philadelphia
Energy
Authority
and
the
Philadelphia
Museum
of
Art,
we
testify
in
support
of
a
project
that
demonstrates
that
commitment
to
carbon
reduction
by
implementing
energy
efficiency
in
buildings
that
are
among
the
city's
largest
energy
users.

The
city
is
the
Pennsylvania
guaranteed
energy
savings
act
to
reduce
energy
and
utility
costs
at
the
city's
quad
flexibilities
City
Hall
municipal
services,
building
the
one
Parkway
building
in
the
criminal
justice
center
through
two
years
and
the
performance
phase,
I'm
pleased
that
the
project
has
generated
revenue
or
or
avoided
cost
of
more
than
six
million
dollars.
We're
looking
to
replicate
the
success
of
the
quad
Plex
project,
while
also
building
on
several
related
admission
initiatives.

the
Philadelphia
energy
Authority's
executive
director,
Emily
Shapira
she's,
going
to
summarize
how
this
fits
into
the
Philadelphia
energy
campaign.
I
talked
a
little
bit
about
the
jobs
and
creation
job
creation
associated
with
this
work
and
I'm
also
joined
today
by
Gail
Hardy,
the
president
of
the
Philadelphia
Museum
of
Art
I'm,
going
to
let
her
talk
a
little
bit
about
how
this
fits
in
with
the
infrastructure
work
happening
at
the
museum.
At
this
time,
this
project
began
development
in
early
2017
with
the
issuance
of
a
competitive
RFQ.

Ultimately,
we
selected
Johnson
Controls
as
a
qualified
ESCO,
just
to
determine
a
feasibility
of
energy
conservation
measures
in
the
building's
building
on
their
audit.
Johnson
Controls
completed
a
subsequent
review
of
the
buildings
in
developed
a
proposal,
proposal
of
measures
for
the
city,
Energy,
Authority
and
Philadelphia's
ium
of
our
trivia.

The
resulting
measures
are
a
mix
of
high
payback
energy
conservation
measures
and
long
term
infrastructure
needs
for
the
Philadelphia
Philadelphia
Museum
of
Art
that
produces
project
with
strong
environmental
benefits
and
improvements
to
PMA
operations.
Following
the
city's
direction,
Johnson
Controls
developed
a
set
of
proposed
energy
conservation
measures
that
BET's
best
fit
this
criteria.

Through
this
project,
Johnson
Controls
has
committed
to
working
with
the
city's
Office
of
Economic
Opportunity
and
a
contract
with
certified
firms
to
offer
mentorship
and
capacity
building
to
the
Philadelphia
minority,
women
and
disadvantaged
businesses
and
specific
areas
of
energy
efficiency.
As
a
project
move
towards
towards
implementation.
Johnson
Controls
has
partnered
with
another
of
subcontractors
as
committed
to
a
participation
rate
of
forty
over
forty
percent
for
the
project
and
I
should
note
too,
that
included.

Today,
we
submitted
over
on
the
desk
the
participation
form,
which
was
signed
off
by
the
Office
of
Economic
Opportunity,
as
well
as
the
signed
Economic
Opportunity
plan
for
the
project
by
implementing
should
city
council
approve
the
project.
The
city,
PA
and
art
museum
will
complete
a
technical
roof
and
for
a
technical
review
and
prepare
for
project
implementation.

expect
project
implementation
to
take
approximately
18
months
by
implementing
these
energy
conservation
measures
will
make
much-needed
basic
improvements
to
these
three
important
buildings,
yielding
guaranteed
energy,
carbon
and
cost
savings
to
the
general
fund,
all
while
improving
operations
at
the
Philadelphia
Museum
of
Art.
This
project
continues
to
demonstrates
the
city's
commitment
to
energy
efficiency,
the
municipal
energy
master
plan,
the
Philadelphia
energy
campaign
and
the
art
museums,
core
project
initiatives.

energy
performance
project
on
the
art
of
the
Philadelphia
Museum
of
Art.
Our
mission
at
the
Philadelphia
Energy
Authority
is
to
drive
energy
affordability
and
sustainability
for
our
city
and,
as
you
may
know,
in
February
of
2016,
with
the
leadership
of
council
president
Clark,
we
launched
the
Philadelphia
energy
campaign.
F
To
that
end,
the
campaign
is
a
10
year:
1
billion
dollar
investment
in
energy
efficiency
and
clean
energy
projects
and
city
buildings,
schools,
low
and
moderate
income,
housing
and
small
businesses.
Citywide
it'll
create
10,000
jobs
and
help
build
our
city's
clean
energy
economy.
The
two
bills
before
you
today
are
a
major
step
forward
in
the
energy
campaign
representing
the
city's
second
energy
performance
contract
after
an
extremely
successful
project
at
the
quad
Plex.
This
initiative
at
the
Art
Museum
is
critical
to
reducing
utility
costs,
helping
meet
our
city's
environmental
commitments,
creating
jobs
and
economic
development.
F
So
I'll
touch
very
briefly
on
just
five
key
points.
First,
this
project
represents
a
reduction
of
as
much
as
25
percent
of
energy
and
water
use
in
the
city's
highest
consuming
buildings
that
are
part
of
the
general
fund.
So
for
us,
that's
a
big
deal.
It's
a
great
place
to
start
suck
and
it'll
create
jobs.

direct
jobs
will
be
created
in
the
construction
phase
of
this
project
and
more
than
one
hundred
and
fifty
three
additional
indirect
and
induced
jobs
throughout
the
life
of
the
project.

For
a
total
of
two
hundred
and
twenty
seven
net,
jobs
will
be
created
in
my
written
testimony,
I
provided
some
additional
technical
detail
on
our
job,
estimating
and
tracking
model
which
we
had
developed
specifically
for
Philadelphia,
using
local
recent
labor
market
data
by
the
economist
at
the
American
Council
for
an
energy-efficient
economy
late
last
year.
Our
spreadsheet,
with
economic
data,
can
also
be
made
available.
If
anybody
wants
it,
this
project
will
exceed
our
initial
diversity
requirements
as
well.

We
put
in
the
RFP
a
requirement
of
a
minimum
of
35
%,
MW
DBE
participation,
and
we
will
reach
more
than
40
in
the
in
the
final
construct.
So
we're
very
excited
about
that.
Fourth,
this
project
sets
a
critical
precedent
for
other
city
departments
and
buildings.
It
demonstrates
really
a
collaborative,
sophisticated
approach
that
achieves
energy
outcomes,
while
also
respecting
unique
functions
and
requirements
and
sensitivities
of
one
of
our
city's
most
complex
buildings.

That's
been
really
important
as
we've
as
we've
approached
other
departments
and
other
projects
to
see
that
something
as
complex
as
the
as
the
art
museum
can
do.
This
we're
also
currently
working
with
the
school
district
on
their
first
Energy
Performance
pilot,
just
as
a
side
note,
which
is
and
they're
really
watching
the
art
museum
very
carefully
to
see
how
that
goes.
So
we
know
for
the
school
district.
This
mechanism
will
unlock
hundreds
of
millions
of
dollars
in
new
capital
funding
for
the
district.

So
it's
important
to
address
those
building,
repairs
and
system
upgrades,
and
this
really
sets
that
precedent
for
them.
The
final
thing
here
is:
is
that
we
feel
really
excited
about?
Is
that
we've
been
an
active
member
of
this
project?
Development
team
and
the
Energy
Authority
will
hold
the
contract
with
Johnson
Controls
in
partnership
with
the
city
and
paid
which
will
allow
the
city
to
take
full
advantage
of
the
expertise,
resources
and
the
contract
of
the
Energy.
Authority
I'd
like
to
note
that
PA
will
not
be
the
bond
issuer
on
this
project.

As
you
can
tell
from
the
first
ordinance
by
counsel
advised
some
clarifications
were
required
in
Pease
Articles
of
Incorporation
before
we
could
go
forward
with
issuing
debt,
so
we're
in
the
process
of
understanding
those
needed
revisions
and
getting
that
resolved.
We
are
in
agreement
that
this
project
should
move
forward
via
paid
and
we're
very
appreciative
of
the
treasurer's
office
and
the
finance
office
with
their
assistance
in
making
sure
we're
prepared
for
the
next
opportunity.

continue
to
be
involved
in
tracking
this
projects,
progress
on
construction,
energy
reduction,
job
creation
and
diversity
participation,
and
we
will
support
the
energy
office
throughout
the
measurement
and
verification
process.

the
next
few
years,

least
we'd
like

express

deep
thanks

the
team
at
the
Philadelphia
Museum
of
Art
and
at
Johnson
Controls

figuring
out
how
to
integrate
this
energy
project
seamlessly

core
renovation

project
is

partnership
and

the

the

Authority
and
our
competitively
selected
vendor

Controls
Inc.
The
museum
is
the
cultural
heart
of
the
city
of
Philadelphia,
a
source
of
civic
pride
and
educational
resource
and
an
economic
engine
in
fiscal
2017.

We
welcomed
nearly
one
eight
hundred
thousand
visitors
through
our
doors,
including
sixty-seven
thousand
schoolchildren
as
the
largest
museum
in
the
city.
We
are
committed
to
ensuring
that
our
collections
and
our
programming
are
accessible
to
all
audiences.
Adult
admission
is
20
dollars,
which
has
been
consistent
since
2012.

We
offer
reduced
admission
for
seniors
and
students
and
children
under
12
and
students
at
local
art.
Schools
are
always
free,
while
the
general
admission
pricing
is
comparable
or
even
modest,
compared
to
other
institutions
in
the
region
and
around
the
country.
We
understand
that
for
many
residents
even
this
is
cost
prohibitive,
and
thus
we
offer
multiple
opportunities
for
people
to
visit
the
museum
and
take
part
in
educational
programming
at
low
or
no
cost.

For
example,
we
offer
free
visits
for
all
philadelphia,
public
and
charter
school
students,
$2
admission
for
any
adult
with
the
PA
access
card,
I'll
pay.
What
you
wish
admission
policy
every
Wednesday
evening
and
first
Sunday
of
the
month,
also
free
our
programs,
such
as
the
words
that
play
vocabulary,
initiative
that
uses
creative
play
to
help
parents
strengthen
their
child's
vocabulary
and
a
multi-year
partnership
with
our
neighbors
at
the
Mantua
Civic
Association,
which
has
resulted
in
activities
such
as
bulbs,
not
bullets
and
the
new
Spring
Garden
Street
mural.
As
a
result
of
this
activity.
G
Each
year
the
museum
generates
more
than
two
hundred
and
fifty
million
dollars
of
economic
impact
on
the
city
and
reach
economies,
as
well
as
near
nearly
19
million
in
tax
revenue.
An
investment
in
the
museum
yields
an
excellent
return,
one
which
helps
the
city
to
address
its
financial
challenges.
The
museum
is
also
a
driving
force
for
why
people
want
to
live
work
and
play
in
Philadelphia
as
a
city
owned
institution.
The
city
provides
critical
capital
and
operating
support
to
secure
and
maintain
our
buildings
and
directly
pays
the
museum's
utilities.

Of
course,
this
level
of
usage
is
necessary,
as
international
museum
standards
require
our
buildings
to
be
climate-controlled
at
all
times
to
protect
the
priceless
works
of
art
housed
in
the
collection
and
the
sheer
magnitude
of
the
building.
The
main
building,
which
includes
over
600,000
square
feet
of
dedicated
gallery
space
gallery
education
and
office
spaces
is
also
contributes
to
this
consumption,
but,
despite
the
necessary
the
necessity
of
our
energy
consumption.
G
As
long
as
a
long-standing
partner
of
the
city,
we
understand
and
embrace
the
need
to
reduce
this
level
of
energy
usage
to
help
save
costs,
and
to
that
end
we
have
worked
with
the
city
over
several
administrations
to
reduce
our
energy
consumption
through
smaller
targeted
investments
in
new
systems
and
a
commitment
from
our
staff
at
all
levels
to
assist
in
the
efforts.
As
a
result
of
this
work,
we
have
experienced
success
in
reducing
our
energy
and
have
even
were
even
lauded
in
the
2014
municipal
energy
benchmarking
report
for
our
efforts.

But
despite
these
gains,
it
has
become
clear
that
a
much
larger
investment
is
needed
if
we
want
to
significantly
reduce
our
consumption,
which
is
what
this
project
seeks
to
do.
A
significant
investment
in
energy,
efficient
lighting,
electrical
infrastructure,
heating
and
cooling
system
upgrades
and
water
and
stormwater
improvements
that
the
three
buildings
will
allow
us
to
address
some
of
the
signals,
most
significant
sources
of
energy
usage
at
one
time
in
order
to
maximize
reduction
of
energy
consumption.

The
museum
is
well
poised
to
lead
a
successful
project
at
this
time,
as
we
undergo
construction
of
the
core
project,
the
first
major
interior
renovation
of
the
historic
main
building
since
it
opened
in
1928.
As
many
of
you
are
aware,
the
core
project
will
upgrade
and
replace
many
of
the
museum's
aging
building
systems,
some
of
which
are
original
to
the
building
or
well
past
their
useful
life.
It
will
also
renovate
and
improve
public
and
education
spaces
and
enhance
accessibility
and
circulation
within
our
landmark
building.

While
the
scope
of
this
energy
conservation
project
is
completely
outside
of
the
scope
of
work
for
the
core
project.
Proceeding
with
the
energy
conservation
during
the
core
project,
construction
will
increase
efficacy
by
allowing
Johnson
Controls
and
their
subcontractors
to
access
the
areas
of
the
main
building
that
our
temporal
air
temporarily
exposed
during
construction,
as
well
as
benefi
benefits
of
coordinating
with
museums,
general
contractor,
LF
Driscoll,
who
is
on-site
and
knows
the
buildings
inside
and
out?
Well,
we
are
under
major
construction.

We
and
the
office
of
sustainability
feel
confident
in
our
ability
to
help
steward
this
project,
which
is
a
city
priority
in
an
efficient
and
timely
manner,
and
to
achieve
the
best
results
that
we
can.
We
look
forward

implement
this

infrastructure
costs

million,

aesthetics
were
about
another
seven
or
eight
million
is
like
20
million
dollars
to
convert
from
Veolia
to
PGW,
but
the
annual
savings
were
two
million
dollars
a
year,
which
is
a
ten
percent
return.
So
Michael

know
that
I
know
that
some
of
the
cards
right
now
but
I
guess.

Imagine
if
you
were
in
your
own
business,
you
owned
real
estate,
but
you
used
another
utility
company
and
you
didn't
use
your
own
because
when
we
add
two
million
dollars
of
value
to
PGW
on
a
5%
cap
rate,
we
raise
the
value
of
PGW
40
million.
So
my
god
I
guess
I
just
want
to
put
that
out
there,
because
I
really
feel
we
should
be
looking
at
that.

regards

PGW,
as
you

you
know
we
we
are
interested
in
that
project
and
converting,
but
the
answer
is
basically
not
right
now

the

current
infrastructure
there

do
think
we
need
to
refresh
some
of
those
numbers
from
PGW
and
continue
to
look
at
that
opportunity
at
the
Art
Museum
and
and
we're
committed
to
continuing
to
kind
of
track
that
as
a
project
for
the
future

project,

really
prioritize
Economic
Opportunity
plan
and
pushed
our
our
selection
process
towards
vendors
that
were
had
experience
in
these
spaces
and
had
experienced
both
contracting
with
with
folks,
but
also
on
the
workforce
aspect.
So
that's
been
a
priority
as
we
went
through
and
kind
of
selected,
Johnson,
Controls
and
then
than
in
developing
these
ECMs.

critical
of
is
the
way
our
city
see

when
I
see
participation,

see
the
subcontractor
and

thought,
and
it
was
unclear
to
me
that
when
it
said
subcontractor,
it
wasn't
clear
to
me
that
they
were
a
minority
or
female
or
a
disabled
contract
it
just
as
a
contractor
and
I
thought
that
five
percent
might
indicate
under
WBE
that
they
were
five
percent
women
on
on
the
job.

the

studies,

what
level
of
participation

believe
that
they're
qualified,
for
example,
minority
workers
in
the
city
and
the
six
percent

this

subcontractor.

for

future
projects
through
this

line

questioning
is
precisely

First,
tell
me:

you
would

state,
in
the
testimony
that
Johnson
Controls
has
partnered
with
a
number
of
in
WDS

subcontractors
who
have
committed
to
a
participation
rate
of
42
percent
share
with
us?
How
that
a
commitment
was
arrived
at
with
that
number
come
from
sure.

when
we
initially
put
out
the
project,
we've
got
a
number
of
two
energy
conservation
measures,
so
we're
going
out
and
with
Johnson
Controls
they're
pricing
for
a
chiller
installation
and
for
lighting
installation.
They
go
to
a
kind
of
a
broad
stake
of
vendors
and
and
I'm
happy.
That
in
this
project,
is
a
lot
of
folks
that
they've
worked
with
in
the
past,
but
hoping
is,
is
helpful
and
then
from
there
sort
of
you've
got
firm
quotes
for
that
work
and,
and
that
is
then
passed
on
basically
to
the
city
for
the
for
the
project.

And
I
think
one
of
the
things
that's
tricky
is
you
know
we
are
selecting,
then
the
energy
conservation
measures
that
we
want
to
go
forward
with.
So
there
are
some
measures
that
we
didn't
select
because
they
didn't
have
good
payback,
so
they
weren't
kind
of
a
good
return
on
investment
and
the
contractors
that
were
associated
with
that
work.
Then
you
know
don't
necessarily
move
forward
to
the
final
project,
so
it
sort
of
shakes
out
a
little
bit.

the

the
bulk

that
that
needs
to
be
reflected
for
the

more
about
the
Oversight
Committee.

has
that
been
in

will
that

in

serve

answers

those
questions

thought

Energy
Authority
as
very
willing
and
interested
participants
in
that
you

as
soon
as
we
get
the
project
kind

contract
signed
and
the
ink
dry
we'll

project
meetings
and
until
then,
we've
been
pushing
Johnson,
Controls
collectively
as
a
group
to
to
make
sure
that
they're.

meeting
the
best
and
good-faith
efforts
both
on
participation
but
also
on
workforce,
and
you
know
it's
our
intention
to
continue
to
do
that.

diligent
on
