a
matter
of
state
law
and
our
chairwoman,
councilman
bass
and

other
council
members
have
introduced
and
passed
a
resolution
urging
the
state
to
take
action
on
the
on
these
matters.
However,
our
code
does
provide
restrictions
on
the
use
of
fireworks,
but
it
does
not
specifically
say
that
they
cannot
be
used
after
9
pm,
except
for
federal
holidays.

These
injuries
and
deaths
stem
from
a
variety
of
causes
all
related
to
the
misuse,
malfunction
and
or
federal
hazardous
substance
acts.
Fhsa
regulations,
violation,
the
bannon
of
fireworks
locally,
would
have
a
positive
impact
on
lowering
these
numbers
and
protecting
citizens
that
we
are
tasked
with
protecting
in
dealing
with
fireworks,
related
death
and
injury
prevention,
the
philadelphia
fire
department,
fire
prevention,
division,
utilizes,
a
national
approach
developed
by
the
national
fire
protection
association
or
nfpa.

Many
of
not
many,
but
just
a
small
percentage
of
the
interview
reported
that
the
effect
of
the
injuries
might
be
long
term.

related
deaths
for
the
2018
cpsc
air
has
reported
five
non-occupational
firework.

those
five
deaths

The
state
has
oversight
on
fireworks,
but
the
restrictions
in
place
do
help
to,
or
at
least
give
some
t

enforcement.
The
main
one
is
consumer
fireworks
and
the
distances
from
occupy
structures
you're
not
supposed
to
utilize
any
kind
of
consumer
fireworks
within
150
feet
of
the
occupy
structure,
also
under
trees
and
power
lines,
and
the
third
thing
to
mention
is.

Permissions
are
needed
if
you're
going
to
use
them
on
any
public
or
private
property,
but
when
you
add
all
of
those
things
together
with
the
distances
and
everything
like
that,
it's
a
it's
a
lot
of
restrictions
in
place
already.

issue:
is
you
can't
really
the
enforcement?
The
enforcement
is,
is
tough,
as
he
spoke
of
earlier.

Most
of
these
most
people
are
using
them
after
hours,
and
you
know
it
sounds
like
gunfire.
Sometimes,
a
lot
of
citizens
are
frightened
by
the
fireworks.
When
it
comes
to
the
fire
code,
we
we
have
more
oversight
over
display
fireworks.
We
do
inspections,
we
conduct
inspections
at
shows
and
games,
and
we
get
to
actually
see
and
supervise
the
usage
of
the
display
fireworks
but
consumer
fireworks.

question

you
know
this
has
been
an
ongoing
issue
and
it
escalated
this
year
right
for
a
lot
of
reasons
with
with
the
city
unrest
with
covet
with
more
people
being
at
home,
and
you
know
I
I
think
it's
responsible
that
we're
we're
actually
having
this
conversation.

closely
do
you
work
with

enforcement
of
these,
because
you
know
there
are.
There
is
somewhat
separation
of
of
a
little
bit
of
responsibility
and
authority
on
you
know,
I'm
gonna
say
like
shutting
down
illegal.

illegal
operations
where
they're
selling
at
a
backyard
or
selling
on
corners,
who
is
going
to
who
is
going
to
enforce
whether
there's
a
written
or
oral
lease
on
the
corner
of
a
gas
station.
So
it's
an
ongoing
issue
and
it's
not
just
with
fireworks.
So
I
mean
you
see
it.

during
you

other
holidays.
You
know
with
the
sale
of
flyers
or
flowers
and
and
other
you
know,
shirts,
not
having
business
privilege
stuff.
So
you
know
it
feeds
into
a
different
sector
of
the
underground
economy,
and
I
know
we
don't
have
enough
lni
inspectors,
I
mean
we
need.
We
need
a
lot
more
inspectors
to
help.

question

about
enforcement,
like
how
is
the
code
currently
enforced
and
what
will
this
bill
specifically
change
in
enforcement,
because
I
understand
my
nephew
is
petrified
of
all
the
noise
over
the
summer.
My
neighbors
are
complaining
too,
but
I'm
not
really
sure
what
to
do
and
how
to
enforce
it.
And
what
exactly
will
this
bill
change
in
the
enforcement
process?.

might
need
more
teeth,
so
a
band
a
outright
band,
probably
goose-
and
this
is
in
my
opinion
it
probably
will
serve
the
enforcement
activities
a
little
better,
because
at
that
stage
there
are
no
fireworks
allowed.
You
know

I

so
it's
easier
to
to
enforce.
It
would
be
easier
to
enforce.
In
my
view,.

Unfortunately,
there
are
probably
no
people
from
the
health
department
and
l,
and
I
are
working
at
two
o'clock
in
the
morning
and
to
answer
council
member
brooks's
question:
there's
graduated
fines
that
are
in
place.
So,
in
addition
to
the
enforcements
that
that
exist,
there
are
fines.
The
first
fine
is
between
100
and
300
dollars
for
the
first
offense,
the
second
offense.
This
is
all
within
a
one
year
period.
However,
if
a
person
does
this
five
times
in
one
day,
those
are
five
separate
offenses,
so
the
first
offense
is
between
100
and
300.
Fine.

second
offense
is
between
two
hundred
and
four
hundred
dollar.
Fine.
The
third
offense
is
between
three
hundred
and
five
hundred
dollar
fine
and
every
offense
after
that
is
five
hundred
to
seven
700,
which
are
pretty
significant
fines
and
the
person
would
have
that
like
within
a
12-month
period.

the
police
and
it
was
very
well
handled,
but
yeah
people
want
to
to
have
enforcement,
and
I
think
this
is
something
that
will
will
help,
probably
not
the
common
situation
where
you
have
a
hundred
people
gathered
together,
but
you

more
like
what
was
typical,
two
or
three
or
five
people.

clear
that
enforcement
does
not
equate
to
arrest,
because
I'm
thinking
about
council
members
a
scenario
that
he
just
pictured

suppose
someone
in

crowd
have
built
up
these
fines
up
to
400.
In
any
way,

it
lead
up
to
young
people
getting
arrested
for
fireworks.

pyrotechnics

colorful
loud
that
type
of
thing,

our
fire
officials
said,
you
know,
one
of
the
big
concerns
is
injury
to
themselves
and
to
others,
and
I
think
about
that
little
boy
who
did
what
a
lot
of
little
boys
would
do.
I
would
have
done
hang
on
to
the
firework
as
long
as
you
can
to
show
your
friends
that
you've
got
the
guts
to
do
it
and,
and
unfortunately
you
know
he
lost
his
hand
and
just
people
just
don't
understand
like
these.

to
just
hear
clearly
that
it's
not
going
to
result
in
young
people
being
arrested
for
fireworks
and
I
understand
the
danger
behind
children
holding
fireworks.
I
understand
that,
but

concern
is

danger
behind
large
sums
of
young
black
men
in
the
hood
getting
arrested
for
fireworks,
even
though
my
neighborhood
is
also
blowing
up
with
fireworks
all
night.
The
results
should
not
be
at
rest
for
young
people
having
a
good
time.

concern.

provide
testimony
on
bill
number

We
have
many
people
in
the
neighborhood
who
suffer
from
ptsd
associated
with
the
sounds
of
gunshots
and
other
loud
noises.
We
have
terrified
children
and
working
people
who
can't
sleep
at
night
due
to
the
noise
one
resident
wrote
to
me
saying
quote
these
fireworks
are
really
out
of
hand.
It's
every
single
night.
We
have
elderly
people,
children,
pets,
people
who
work,
and
it's
terrorizing
us
and
causing
trauma
and
anxiety.

confusion
factor
when
one
hears

noises,

one
was
dean

call
them
into
the
police
if
it's
a
gunshot,
but
you
can't
really
tell
many
cases,

means
you
know.
Sometimes
they
may
not
get
called
in
or
they
may
get
called
in
as
a
gunshot
when
they're
exactly
really
just
fireworks,
which
are
you
know,
much
less
dangerous,
which
wastes
the
police
time.
So
it
will
be
best
to
you
know,
outlaw
these
things
as
much
as
possible.

fire
department
and
our
police
department.

appreciate

taking

no
place

to

know
I

dogs

time
I
walk
outside.
They
pull
me
back
in
because
they
were
terrified.

car

drive

I

find
people
that
were
actually
shooting
off
these
fireworks
so
that
I
could
report
them
and
tell

police
or
the
fire
department
where

find
them,

that's

found

problem.
They
were
in
close
proximity
to
where
I
was
living
it.
It
was
really
awful.
I
mean
I
understand
federal
holidays
and
I
understand
when
people
get
frustrated
and
the
gentleman
that
mentions
sparklers
there's
nothing
wrong
with
sparklers.

a

comment

answer
to
that
question.

it
is.
Enforcement
is
always
challenging.
I
think
the
first
problem
that
we
encountered
was
we
never
had
this
type
of
activity
with
fireworks,
not
not
to
my
knowledge,
not
not
anything
like
this
three
four
five
weeks
in
a
row
night
after
night,
two
o'clock
in
the
morning
three
o'clock
in
the
morning
and
really
loud,
but
but
one
of
the
problems
is
there
was
nothing
prohibiting
well
yeah.

had
to
get
written
permission
if
you
were
in
a
public
space
but
for
example,
you
know,
does
that
include
the
park
or
does
that
include
a
sidewalk,
or
does
it
include
a
a
vacant
lot
wherever
it
is
so
so
it
was
difficult
because
while
there
are
restrictions,
for
example,
the
purchase
of
fireworks,
is
you
have
to
be
over
18.,
but
after
you
purchased
it,
the
possession
of
it
is
not.
You
could
be
12.

Possession
is
not
a
violation,
and
then
you
know
you
have
to
be
like
150
feet
away
from
a
occupied
structure,
but
but
150
feet
away.
You
could
still
hear
it
pretty
loud
and
and
these
these
appear
to
be
some
type
of
like
aggregated
firework,
because
the
the
the
explosion
is
is
louder
than
any
type
of
cherry
bomb
or
whatever
I
I've
ever
heard.
The
the
thing
is
that
simply
letting
people
know,
I
think,
a
lot
of
people.

But
if
they're,
if
they're
just
setting
off
fireworks
and
they
don't,
they
don't
understand
that
that
it's
it's
prohibited.
You
know
it
gives
the
health
department,
l
and
I,
and
in
this
case
the
police,
if
it's
two
o'clock
in
the
morning
or
or
the
fire
department
ability
to
say,
hey,
listen,
it's
prohibited,
so
it
is
illegal
and
it
comes
with
a
fine
and
hopefully
people
will.

just
pulled
over
and
started
shooting
them
off
and
there
are
right
across
the
street
from
residential
homes.
So
how
do
you
I
mean
woody?
You
have
to
like
chase
after
them
and
say:
oh,
there
is
a
guy
here
and
then
call
the
police
and
then
hope
they
get
there
before
the
guy
takes
off,
because
he
knows
he's
someone
has
seen
him.

Yeah,
I
I
think
this
is
a
first
step
in
a
a
trying
to
address
that
question
through
the
cooperation
of
our
agencies
around
the
fact
that
now
it's
very
clear
and
and
people
are
alerted
and-
and
we
will
kind
of
deal
with
it
from
here.
But
this
is
what
we
can
do,
and
enforcement
is
a
matter
of
the
administration
as
a
legislative
body,
we're
passing
a
law
and
certainly
we're
going
to
work
with
the
administration
about
enforcement.

that
then,
becomes
the
state
matter,
because
there
is
an
effort
by
council
members.
As
I
said
at
the
very
beginning,
council
member
bass
introduced
a
resolution
co-sponsored
by
other
council
members,
and
I
think,
passed
unanimously
by
by
council.
Just
urging
the
state-
and
I
know
state
legislators
are
looking
at
you
know,
banning
fireworks
altogether
from
the
city
of
philadelphia,
the
sale
of
it
all
right.

lifelong
resident
of
philadelphia.
I
was
absolutely
blown
away,
no
pun,
intended
by
the
higher
than
usual
number
of
explosions
that
were
in
the
night
sky.
This
year,
I've
lived
in
philadelphia
for
28
years,
varying
parts
of
the
city
and
and
as
we
all
know,
this
year
was
ungodly.

If
I
were
at
a
later
point
in
my
life
and
had
a
small
child
in
the
house,
I
don't
know
if
we
would
have
made
it
through
the
summer
in
in
my
neighborhood
it
was.
It
was
that
bad
individuals
would
come
over
to
the
ceo
and
recreation
center
behind
my
house
and
light
up
fireworks
from
the
athletic
field,
hockey
rink
and
even
the
playground
you
know
around
or
after
midnight
every
night.

You
know
when,
when
I
would
call
9-1-1
and
ask
for
someone
to
come
out
and
take
a
look,
they
said
you
know
they
were
busy
which
I
get
it.
But
at
what
point
do
quality
of
life
issues
qualify
as
important
when
the
police
would
come
by
would
be
hours
after
the
offenders
had
already
left.
The
damage
is
already
done
to
the
neighborhood
and
to
the
residents.

When
confronting
the
individuals
would
be
threats
of
violence
or
less
commonly,
they
would
actually
have
a
conversation
and
say:
well,
I'm
not
breaking
any
rules,
let
alone
the
fact
they
would
be
trespassing
in
a
park
after
dark
under
trees,
near
houses,
lighting
off
fireworks,
with
the
passage
of
this
bill.
That
statement
would
be
false
because
they
would
be
breaking
rules
and
it
would
provide
an
avenue
for
the
city
to
stop
these
events
from
happening
and
provide
peace
and
comfort.

To
me,
my
family,
my
neighbors,
and
this
is
philadelphia.
There
are
so
many
great
reasons
to
live
in
the
city,
but
quality
of
life
issues
like
this
severely
outweigh
all
the
positives.
I
could
possibly
list
I
like
a
good
fireworks
show,
but
not
the
expense
of
myself
or
anyone
else's
health
or
sanity.

it
is
the
beginning
to
change
behavior
when
they're,
when
we
are
restricted
from
a
whole,
from
a
entire
prohibition
of
of
fireworks
in
the
city
of
philadelphia
because
of
the
state
law
preemption
right.

commend
council,
for
you
know
trying
to
change
behavior
with
some
of
the
local
provisions
that
we
were
able
to
do
that
were
not
preempted.
