and
I
am
the
chief
highway
engineer
for
the
streets
department
today
I'm
here,
to
provide
testimony
on
bill
number
one:
nine,
zero,
eight,
nine
nine,
which
enacted
will
amend
section
nine
dash
to
12
of
the
Philadelphia
Code,
entitled
new
stance.
If
enacted,
the
bill
would
allow
new
stands
to
provide
bill,
pain,
services
and
sell
tickets
to
museums
and
other
local
attractions.

would
increase
the
allowable
advertising

area
on
the
sidewalk
and
side
of
the
newsstand.
It
would
provide
allowances
for
additional
projections

certain
conditions

it
will

art

be

top

department

concerns
regarding
the
projection
of
the
awning
at
36
inches
and
vertical
clearance
at
6
feet.
We
feel
that
this
would
impede
the
pedestrian
walkway
further
congesting
our
sidewalks.
The
department
recommends
the
awning
being
no
greater
than
30
inches
in
a
projection
from
the
newsstand
and
have
a
vertical
clearance
of
7th
feet.

push

clearance
up
to

feet
talking
to
newsstand

thought
the
series
inches
was
still
needed

would
only

in
certain
sections
where
the
streets
department
would
have
would
have
proved
it.

fair
compromise

also
the
law
department
raised
issues

display

Amendment
issues
which

practically
don't
understand,

but
the
newsstand
people
have

so
that
will
not
be
included
in
the
bill.

representing
Beach
Street
corporation.
The
purpose
of
this
ordinance
is
to
authorize
the
striking
from
the
city
plan
and
vacating
of
a
dead-end
portion
of
Cumberland
Street,
which
extends
from
Beach
Street
to
a
terminus.
Approximately
34
feet.

the

right-of-way

owner

required

at
the
corner
and

accessible
path
across
their
property
frontage,
as
a
condition
of
passing
any
legislation

encroachment

the
public
right
away.
Furthermore,
approval
of
this
encroachment
sets
a
precedent
for
all
their
similar
encroachments,
all
of
which
generally
negatively
impact
the
city's
ability
to
properly
manage
its
right
away.

maintained

proposed
exterior
stairway
at
sixteen
forty,

two
fitzwater
Street
in
Philadelphia,
all
under
certain
terms

conditions.

The
Department
of
streets

opposed
to
this
proposed
exterior
stairway
encroachment,
as
it
was
never
demonstrated
to
us
by
the
owner
that
the
installation
of
this
exterior
stairway
was
the
only
feasible
method
to
meet
all
code
requirements
for
the
building
use
and
that
the
stairway
could
not
be
instructed
interior
the
building.
Furthermore,
approval
of
this
encroachment
sets
a
precedent
for
other
similar
encroachments,
all
of
which
negatively
impact
the
city's
ability
to
properly
manage
this
right

Charles
Prudhomme,
the
owner
of
the
property
I,
want
to
say,
I,
fully
understand
where
streets
and
planning
is
coming
from
as
kind
of
just
a
blanket
policy.
However,
this
is
a
special
circumstance.
We
are
attempting
to
save
a
church,
and
the
church
has
very
large
windows
that
are
in
fixed
locations
with
extremely
high
ceiling
heights.
Making
the
staircase
runs
very
large.
On
top
of
that,
we
have
met
made
a
deal
with
the
Preservation
Alliance.
That
would
require
us
to
not
change
the
exterior
of
the
building.

We
are
using
an
already
existing
basement
entrance
where
there
are
Bilco
doors
and
replacing
a
handicap
ramp.
That
is
more
than
double
the
size
of
this
stairwell
in
its
location,
and
we
took
it
to
the
Neighborhood
Association,
because
we
thought
that
people
may
have
concerns
and
they
open
it
up
to
the
entire
community
and
they
voted
36
to
nothing
in
favor
of
this,
which
is
why
Councilman
Johnson's
office
supported
it.
So
it
is
something
that
the
community
wants
on
top
of.
