Description
The Committee on Streets and Services of the Council of the City of Philadelphia held a Public Hearing on Tuesday, March 22, 2016, to hear testimony on the following items:
160097 An Ordinance amending Section 9-213 of The Philadelphia Code, entitled "Farmers' Markets," by adding a permissible location, all under certain terms and conditions.
160112 An Ordinance authorizing Dr. Jack Carroll for Magee Rehabilitation Hospital to construct, own, and maintain a liquid oxygen tank and the construction of an associated masonry enclosure at 1513 Race Street, Philadelphia, PA 19102, all under certain terms and conditions.
160131 An Ordinance authorizing the installation of all-way stop signs at the intersection of 22nd Street and Porter Street.
160145 An Ordinance authorizing the revision of lines and grades on a portion of City Plan No. 44 by placing on the City Plan Thirty-Seventh Street from Market Street to Filbert Street and from Filbert Street to Warren Street, Cuthbert Street from Thirty-Seventh Street to Thirty-Eighth Street, north of Filbert Street, and Warren Street from Thirty-Seventh Street to Thirty-Eighth Street, all under certain terms and conditions, including the dedication to the City of the said beds of Thirty-Seventh Street, Cuthbert Street, and Warren Street.
160146 An Ordinance authorizing the paving of Thirty-Seventh Street from Market Street to Filbert Street and from Filbert Street to Warren Street, Cuthbert Street from Thirty-Seventh Street to Thirty-Eighth Street, and Warren Street from Thirty-Seventh Street to Thirty-Eighth Street, under certain terms and conditions.
160147 An Ordinance establishing parking regulations in the vicinity of: Pine street and 45th street; Melville street and Locust street.
160148 An Ordinance authorizing Rachel Miller of Best Partners LP, ("Owner") to install, own and maintain an open-air sidewalk café at 4301 Baltimore Avenue, Philadelphia, PA 19104 ("Property"), under certain terms and conditions.

an
ordinance
requested
by

associates

on
behalf
of
Wexford
development
LLC.

purpose
of
this
action
is
to
permit
that
the
redevelopment
of
the
14
acres
of
former
university
city,
high
school
and
and
Charles
are
drew
elementary
school
sites
which
were
acquired
by
drexel
university
from
Philadelphia
School
District,
wexford
Science
and
Technology
University
City,
University,
City,
Science,
Center
and
Drexel
University
are
proposing
a
large-scale
mixed-use
development,
including
commercial
office,
laboratory,
residential
and
academic
uses,
with
a
total
of
2.7
million
square
feet.

zoning
remapping
bill
for

this
proposal,

recommended
for
approval
on

10th
2014

Planning

This
bill
would
permit
McGee
rehabilitation
hospital
to
construct
and
maintain
a

oxygen
tank
and

Spring

This
encroachment
will
occupy
11
feet
on
a
sidewalk,
leaving
approximately
six
feet
for
pedestrians.
The
city
holds
the
right-of-way,
our
sidewalks
and
streets
and
trust
for
the
benefit
of
all
Philadelphians.

Our
rights
of
way
are
small,
democratic
spaces
open
to
everyone.
A
right-of-way
are
also
people.
Our
rights
of
way
are
how
people
travel
between
work,
home
and
friends
there.
How
commerce
moves
they're
aware
people
go
to
be
heard
on
the
public
matters
that
are
most
important
to
them.
They
are
the
physical
connections
between
neighborhoods
that
create
the
geography
we
recognize
as
Philadelphia
and
is
home.
For
that
reason,
council,
the
Planning
Commission
industries,
Department
guard
the
city's
rights-of-way
jealously.
I
We
do
not
likely
surrender
them
to
incur
unless
the
encroachment
is
consistent
with
the
purpose
and
the
design
of
the
right-of-way
and
will
not
interfere
with
it.
There
is
no
question
at
this
proposed
encroachment
which
will
occupy
well
over
half
the
width
of
the
sidewalk,
fundamentally
changes
the
spring
street
right-of-way
at
that
location,
and
it
is
a
far
more
substantial
character.
Unusual
encroachments
routinely
reviewed
by
streets
and
approved
by
council.
Under
any
other
circumstances,
the
streets
department
would
be
constrained
to
oppose
an
encroachment
of
this
type.
I
Nevertheless,
we
recognize
that
truly
unique
circumstances
exist
in
this
case
and
in
need
outweighs
the
otherwise
overriding
interest
in
protecting
the
integrity
of
the
right-of-way
McGee
rehabilitation,
hospital,
a
non-profit
medical
institution,
renowned
for
the
physical
function
it
preserves
and
restores
in
its
patients,
has,
along
with
standing
presence
on
Spring
Street
in
order
to
provide
its
life,
restoring
rehabilitation
services
to
as
many
as
possible.
It
has
no
choice
but
to
expand
its
oxygen
tank
capacity.
Moreover,
it
appears
that
no
other
location
for
the
new
tanks
exists
on
the
premises
at
any
price.
I
In
other
words,
McGee
provides
a
unique
and
essential
service
to
the
city.
It
has
no
choice
but
to
expect
to
expand
its
oxygen
tank
capacity
and
there
is
no
other
safer,
feasible
location.
To
do

amendment
represents
what

was
just
stated
in
circumstances
as
compelling
as

as
narrow.

the

department
will
present
no
opposition
to
the
encroachment.

These
properties
were
purchased
from

city
of
Philadelphia
approximate

years
ago.
The
properties
were
purchased
as
part
of
a
redevelopment
agreement
from
the
RDA
and
PhD

at
the
time.
The
encroachment
was
written
into
the
plans,
although
it
was
never
legalized.

hope
is
