It
is
the
intention
of
this
board
to
promote,
protect
and
improve
the
health,
safety
and
welfare
of
the
citizens
of
tarpon
springs
by
providing
an
equitable,
effective
and
inexpensive
method
of
enforcing
various
codes
within
the
city
of
tarpon
springs.
Any
aggrieved
party
may
appeal
a
final
administrative
order
of
this
board
to
the
circuit
court.
Such
appeal
shall
be
filed
within
30
days
of
the
execution
of
the
order
to
be
appealed.
A
Florida
statute
286.0105
requires
any
party
appealing
a
decision
of
this
board
to
have
a
record
of
the
proceedings
to
support
such
an
appeal.
The
procedure
of
this
board
is
as
follows.
First,
the
city
presents
its
witnesses
and
exhibits,
after
which
the
alleged
violator
is
able
to
ask
the
city's
witnesses
any
specific
questions
regarding
their
testimony.
A
Secondly,
the
alleged
violator
is
allowed
to
make
a
presentation
and
present
his
or
her
witnesses
and
exhibits.
Then
the
city
can
question
the
alleged
violators
witnesses
after
both
rounds
of
testimony
both
on
the
part
of
the
city
and
on
the
part
of
the
alleged
violator.
Each
party
is
asked
to
give
a
closing
statement
first
by
the
city
and
then
by
the
alleged
violator
after
those
three
steps
are
taken.
This
board
will
close
the
public
hearing
portion
of
the
case
to
discuss
it
and
take
appropriate
action.

the
owner.
We
had
a
phone
call
and
actually
we
had
an
email
that
was
forwarded
to
us
today
by
the
arborist,
shannon
brewer
who's
here.
Should
we
need
her
to
testify?
On
june
22nd
of
2021,
I
conducted
the
initial
inspection.
The
I
put
that
the
property
was
overgrown.

I
have
since
changed
my
mind
with
overgrowth
there.
It's
really
not
grass
and
weeds,
they
are
actually
plants,
so
I'm
actually
not
going
to
ask
to
have
8-52
as
a
violation
but
I'll
get
to
that.
At
the
very
end,
however,
there
is
not
required
vertical
clearance
over
the
road,
and
one
tree
may
be
dead.
Checking
with
the
arborist
property
is
8
400
square
feet.
On
the
same
day,
I
did
get
a
response
from
the
city
arborist,
shannon
brewer,
who
confirmed
that
the
tree
was
dead.

On
august
26
of
2021,
the
sign
was
posted
and
the
affidavit
of
posting
was
signed
on
september,
8th
of
2021.
The
final
inspection
was
conducted,
the
vegetation
excuse
me,
the
dead
tree
had
still
not
been
removed
and
the
required
vertical
clearance
over
the
street
is
still
obstructed.
So
I'll
go
ahead
and
bring
up
the
pictures.

another

this

where
the
vertical
clearance,
which
is
supposed
to
be
13,
feet,
6
inches,
so
that
emergency
vehicles
can
get
through.
It's
well
below
that
again
another
picture
of
the
tree,
another
dead-

this

actually

picture
from
the
arborist
that
she
took,
showing
that
the
tree
is
dead.

basically,
what
I'm
asking
the
code
board
members
is
to
find
the
property
in
violation
of
city
code,
133.02
applicability
and
maintenance,
and
in
violation
of
city
code
7-12,
which
is
the
national
fire
code
that
adopts
the,
which
is
the
code
that
requires
a
13
foot,
six
inch
vertical
clearance,
and
I
had
received
an
email
with
some
more
information
from
mr
delac
earlier,
but
because
he's
here
I'll
just
let
him
testify
to
that.
And
that

my

Can

out
that
I
couldn't
build

the
city
had
no
water
available
to
it,

septic
to
it.

fact,
there
was
no
street
in
front
of
it.
The
street
dead
ended
at

lot
and
the

street
is
now
was
a
huge
pile
about
20
feet,
high
of
rubbish
that
various
contractors
had
dumped
on
it
and
that
continued
to
be
a
problem
for
the
next
30
years.

cut
them
up
and
he
got
rid
of
them
through
his
trash
collection,
and
this
is
the
next
step.
If
I'd
have
been
smart,
I
would
have
had
the
whole
tree
cut
down
in

first

save

than
I'm
gonna
spend
on
it
now,
but
I
I've
gotten
a
estimate
from
stevens
in
dunedin
just
fortunately,
just
briefly,
I
will
tell

haven't
been
dithering

wasting

property
should

and

growing.

the

decades,

did
have
contact
with
the
owner
through
phone
calls
on
august
16th
of
2021,
an
initial
con
inspection
was
conducted,
the
property
was
overgrown
and
growing
into
the
street.
On
august
18th
of
2021,
the
repeat,
violation
notice
of
hearing
was
mailed.
The
green
card
was
returned,
stamped
cove
at
19,
which
is
in
today's
circumstances,
is
often
the
case
on
august
26
2021,
the
sign
was
posted
and
the
affidavit
of
posting
was
signed
on
august
31st.

actually
had
to
go
out
because
there
were
other
properties
along
the
street
that
were
also
overgrown,
and
when
I
went
out
to
do
a
another
inspection
for
those
I
did
notice,
fortunately,
for
them
that
their
property
had
been
cut.
Also
so,
as
of
august
31st
31st,
the
overgrowth
had
been
cut
and
the
property
was
in
compliance,
so
the
property
was
in
violation
from
the
date
of
the
initial
inspection
on
august
16th
of
2021
until
complied
on
august
31st
of
2021,
which
totaled
15
days
and
I'll
go
ahead
and
show
you.

thing

they
never
did
call
to
say
it
was
in
compliance
and
all
the
properties
along
that
strip
had
been
cut.

as
I
said,
because
it
was
in
compliance,

though
they
hadn't
contacted
us,

compliance.
