quasi-judicial
proceeding

heritage
preservation
board
acts

a
quasi-judicial,
rather

a
legislative
capacity
at
a
quasi-judicial
hearing,
it
is
not
the
board's
function
to
make
law,

a

board
is
required
by

this

an
estimated
construction
day

1885,

the
applicant

proposing

replacement

four
windows
that
are
set
in
in
two
pairs
on

side
of
the
structure.

back
to
the
front,
you
will
note
that
the
master
site
file
form
notes
two
over
two
wood
windows,
and
you
can
see
that
that's
what
they
have
on
the
front,
but
on
the
side-
and
I
did
do
a
site
visit,
I
was
able
to
view
the
front
and
the
east
side,
but
I
didn't
view
any
other
parts
of
the
building,
but
on
the
side,
these
are
single.

windows.

applicant
has
submitted
several
pictures
showing
the
condition
of
the
windows.
The
applicant
has
stated
that
the
windows
have
been
repaired
in
the
past,
apparently
a
couple
of
times,
so
these
pictures
show
that
there
is
damage
to
the
actual
frames
and
also
to
the
trim
in
the
casing.

applicant
is
not
proposing
to
disturb
the
surrounding
elements,
the
for
the
frame
and
casing
and
the
trim
and
and
sash,
so
those
would
be
repaired
and
maintained
as
wood.

looked

those
additions
without
looking
at
them.
I
would
assume
that
they
are
do
have
historic
significance
in
their
own
right
as
an
addition
from
the
20s.
So
that
would
be
something
I
would
encourage
the
board
to
talk

applicant
about
as
far
as
the
placement
of
vinyl
windows
on
the
original
structure,
whether
there
are
any
other
type
of
windows
on
the
original
structure.

wood.

overall,
the
windows
are
not
visible
from
the
public,
from
the
public
right-of-way
and
even
from
the
front
of
the
property.
When
you
walk
up
to
the
house
and
they
are
in
pretty
poor
condition,
they're
pretty
old,
they're
somewhere
around
135
years
old.
We
can
assume.
So
those
are
also
factors
to
consider.

was
noticed,
and
there
were
no
responses
received
based
on
the
notices
and
staff
is
recommending
approval,
with
the
assumption
that
the
board
would
make
findings
that
this
potential
mixing
of
window
types
is
acceptable
and
the
conditions
would
address
obtaining
permits
and
to
maintain
all
the
wood
surrounding
elements
of
the
windows.

pat
beautifully
summarized
everything,
but
just
to
give
you
our
viewpoint,
we've
always
taken.

The
approach
that
we
try
to
restore
things
as
well
as
we
can
to
the
way
they
used
to
be
for
an
example.
We
came
before
the
board
years
ago
when
we
first
bought
the
house
and
we
were
remodeling
our
kitchen
and
there
was
aluminum
windows
there
and
we
were
putting
in
a
a
new
door
that
we
put
in
that
we
was
also
aluminum
and
we
put
in
french
doors.
I
Now,
since
we've
had
the
house,
we've
had
to
repair
these
two
sets
of
windows.
So
it's
four
windows
and
we
had
to
do
it
shortly
after
purchasing
the
house
and
then
about
10
11
years
later,
they
needed
repair
again
they're
on
the
east
side
of
the
house,
they're
not
visible
from
the
road
and
they
take
a
brunt
of
the
sun
during
the
beginning
of
the
day.

They
will
look
the
same
as
the
current
windows
and
the
trim
around
the
windows
will
remain
the
same.
If
there
is
any
damage
there,
they
will
replace
the
wood,
but
it
will
look
exactly
the
same.

All
those
windows
are
aluminum,
so
you
can
see
those
from
the
road
and
also
it
wraps
around
to
the
east
side,
aluminum
windows,
but
then
there's
also
aluminum
windows
up
on
the
second
floor
above,
where
we're
currently
looking
to
replace
these
windows
that
are
beyond
repair,
but
we
believe
that
what
the
builder
is
recommending
to
replace
would
be
more
appropriate
than
adding
aluminum
windows.
In
there
we
didn't
put
aluminum
windows
and,
like
I
said
in
the
past,
we've
replaced
aluminum
windows
with
what
we
had
that
was
working
and
functioning.

So
that
is
our
thing.
We
we
try
to
do
our
best
to
restore
things
to
make
things
look
the
same
and
that's
what
we're
trying
to
do
here.

windows
are

safe

in

in
place.

doing
an
aluminum
or
a
vinyl,
clad
wood
window.

come
in
impact
as
well,
just
because
then
you're

a
third
flavor
of
window
to
your
house,
to
where

vinyl

sash.

look
slightly
different,

questionably
and
aesthetically.
