From YouTube: Planning & Zoning Board September 17, 2018
Description
Description
A
A
C
A
A
C
C
D
Is
a
quasi-judicial
proceeding
where
the
Planning
and
Zoning
Board
acts
in
a
quasi-judicial,
rather
than
a
legislative
capacity
at
a
quasi-judicial
hearing,
it
is
not
the
board's
function
to
make
law,
but
rather
to
apply
law
that
has
already
been
established
in
a
quasi
judicial
hearing.
The
board
is
required
by
law
to
make
findings
of
fact,
based
upon
the
evidence
presented
of
the
hearing
and
apply
those
findings
of
fact
to
previously
establish
criteria
containing
the
Code
of
Ordinances
in
order
to
make
a
legal
decision
regarding
the
application
before
it.
D
The
board
may
only
consider
evidence
at
this
meeting
that
the
law
considers
competent,
substantial
and
relevant
to
the
issues.
If
the
competent,
substantial
and
relevant
evidence
at
the
hearing
demonstrates
that
the
applicant
has
met
the
criteria
established
in
the
code
of
ordinance,
then
the
board
is
required
by
law
to
find
in
favor
of
the
applicant.
By
the
same
token,
if
the
competent,
substantial
and
relevant
evidence
that
the
hearing
demonstrates
that
the
applicant
has
failed
to
meet
the
criteria
established
in
the
code
of
ordinance,
the
board
is
required
by
law
to
find
against
the
applicant.
D
Are
there
any
members
of
the
board
wishing
to
disclose
any
ex
parte
communications
or
conflicts
of
interest
this
evening,
seeing
none
any
one
wishing
to
testify
this
evening
or
present
evidence?
If
you
could
please
stand
and
raise
your
right
hand
to
be
sworn,
do
you
swear
or
affirm
the
testimony
you're
about
to
give
is
the
truth,
the
whole
truth
and
nothing,
but
the
truth.
That's
why
thank.
A
You
moving
on
to
number
four
application:
number

33
site
plan
approval
to
construct
a
four
thousand
two
hundred
eighty
square
foot,
one
story
office,
building
on
approximately
0.42
acres,
located
on
a
stone
road,
approximately
150
feet,
north
of
Lake
tarpon
Avenue,
including
Lots,
20,
21
and
22
of
Lake
View
subdivision
in
the
residential
office.
Ro
district.
A
E
This
application
comes
to
you
from
tarpon
turtle,
annex
LLC,
as
mentioned
to
construct
a
four
thousand
two
hundred
and
eighty
square
foot
office.
Building
the
future
land
uses
residential
office
general.
The
zoning
district
is
residential
office.
The
applicant
was
just
to
build
an
additional
office.
Building
space
adjacent
to
its
existing
property
that
is
built
with
office,
uses
that
proper,
slow
cated
on
the
corner
of
Lake,
tarpon,
Avenue
and
Keystone
Road.
The
access
to
this
additional
office
will
be
through
that
adjacent
property
from
Lake
tarpon
Avenue.
E
The
future
land
use
was
amended
as
well
as
the
county
widen
map
was
amended
both
to
office
designations
being
residential
office.
Each
will
induce
an
office.
Countywide
designation
photos
were
processed
in
2017
and
the
site
plan
as
presented
here
is
consistent
with
the
Comprehensive
Plan
and
the
countywide
plan
requirements.
E
The
rezoning
to
residential
office
was
also
processed
in
2017,
and
the
site
plan
is
consistent
with
the
standards
of
that
district.
The
site
plan
was
reviewed
by
the
Technical
Review
Committee
on
March
22nd
2018
and
after
several
revisions
to
meet
those
standards.
That
committee
recommended
that
it
be
forwarded
to
this
board.
The
project
does
meet
concurrency
management
standards
and
the
project
facilities
impacts
are
listed
on
page
three
of
your
staff
report,
and
those
facilities
are
available
will
be
available
at
the
time
of
development
staff.
Is
there
was
public
notice
on
this?
E
Well,
actually,
this
is
a
site
plan,
so
this
meeting
was
noticed.
We
did
not
get
any
responses
or
input
from
the
public
at
the
staff
level
staff
recommends
approval
of
this
application
with
four
conditions.
First,
is
the
developer's
responsible
for
meeting
the
minimum
criteria
of
the
land
development
code
and
for
acquiring
all
other
jurisdictional
permits
or
approvals
number
two,
any
lighting
to
be
installed
on-site
is
to
be
shielded
and
directed
internal
to
the
site.
Number
three
construction
plans
shall
be
consistent
with
the
approved
site
plan.
E
The
payment
of
all
requisite
fees
attended
to
the
project
shall
be
paid
in
accordance
with
the
land
development
code
and
number.
Four
at
this
site
plan
shall
expire
at
one
year
from
the
effective
date
unless
an
application
has
been
filed
for
a
building
permit
with
construction
plans
signed
and
sealed
by
registered
engineer
licensed
in
the
state
of
Florida
and
half-lit
can
and
agent
are
present.
Are
there
any
questions.
A
E
C
E
C
F
My
name
is
Jason
Kenny,
Kenny
engineering,
I'm,
the
engineer
record
and
I
am
the
person
that
is
responsible
for
the
typographical
error
that
referenced
Hillsboro
County
on
that
plan.
Usually
what
we
do
we
got
started
with
a
go,
buy
set
of
plans
that
was
previously
used
in
Hillsboro
County
they're,
just
one
of
the
things
that
just
got
overlooked
gotcha
so.
C
G
And
I
just
want
to
thank
everybody.
Nedra
and
Torn's
hunt,
1955,
North,
Highland
Avenue
tarpon
springs.
Thank
you.
I
just
want
to
thank
everybody.
Everybody's
been
so
courteous
to
us
for
the
development
of
this
site.
It's
been
a
very
peculiar
site
with
the
stuff
that
we
inherited
onto
it,
know
that
and
I
hope
all
of
you
driven
by
it
in
the
last
60
days,
I
mean
it's
all
landscaped
and
we're
not
quite
done
with
it.
G
G
It's
going
to
be
a
very,
very
pretty
place
and
allowing
us
to
build
another
4200
80
square
feet
there
and
everybody
keeps
their
fingers
crossed
we're
meeting
with
a
very
very
nice
firm
tomorrow
afternoon
to
finalize
the
documents
that
they're
going
to
go
into
that
building,
so
you're
going
to
have
another
very
nice
quiet
tenant
that
as
professional
as
anybody
you
want
in
that
building.
Thank
you.
Thank
you.
Anyone.
A
A
A
E
Well,
part
of
it
is,
as
we
talked
last
time,
is
that
we
are
going
to
be
looking
at
the
entire
code,
assuming
the
budget
passes
tomorrow
this
coming
year,
so
that'll
be
one
of
the
first
things
I
think
we'll
talk
about.
We
just
have
not
done
a
whole
lot
of
work
on
on
the
code.
Changes
because
part
of
it
is
to
make
sure
everything's
consistent.
We
change
one
thing
and
what
those
impacts
are
to
applicants
public
and
everything
for
each
I
think
you
guys
and
we've
had
another
board.
