Description
House Commerce Committee- April 6, 2021
A
A
So
today
is
april
6th.
Mr
clerk,
would
you
call
the
roll.
B
A
All
righty,
thank
you.
It's
good
to
see
everyone
today
before
we
get
started
any
personal
orders.
C
Representative
zach
chairman
zachary.
Thank
you,
mr
chairman,
mr
chairman.
Today
I
have
a
special
guest
debbie
rains,
who
is
one
my
friend
one
of
my
favorite
people
and
my
neighbor
she's
here
for
pro-life
women's
day
on
the
hill
and
she's
joined
by
the
executive
director
of
choices
resource
center,
sarah
fern.
So
if
you
could,
please
make
them
welcome.
A
All
righty
super
duper
without
any
further
public
orders.
We
will
get
right
into
our
calendar
today
we're
going
to
be
adjusting
it
on
the
fly
a
little
bit
as
we
go.
We
are,
we
haven't,
we
haven't
turned
the
landing
lights
on,
but
we
have
entered
the
glide
slope
of
getting
this
thing
closed.
A
D
Is
yours
later?
Thank
you,
mr
chairman,
and
the
amendment
makes
the
bill
and
again
this
is
three
separate
kind
of
cleanups
dealing
with
the
covet
19
pandemic
for
two
different
departments
within
state
government.
A
Amendment
number
one
to
779,
please
signify
by
saying
aye
any
opposed
hearing.
None.
The
amendment
is
on
and
got
anything
else
to
share
with
us
later.
D
Well,
mr
chairman,
that
the
first
two
sections
deal
with
unemployment:
one
side
for
the
employee,
the
other
side
for
the
employer
again
to
both
prop
up
and
unemployment
trust
fund
and
on
the
other
side,
if
there's
a
weak
gap
there.
Ordinarily
there's
you
have
to
have
a
gap.
This
would
allow
for
that
to
be
waived
by
the
commissioner
again,
given
the
times
we're
in
and
then
the
third
section
deals
with
literally
just
transmitting
electronic
documents
instead
of
a
physical
document.
A
A
A
A
Got
a
motion.
Second,
let's
see,
we
also
need
to
have
an
amendment
here.
We
need
to
take
care
of
that's
amendment
3903.
A
E
Thank
you,
chairman
vaughn.
The
first
part
of
this
bill
prohibits
the
regulation
of
online
marketplace
platforms
by
local
governments
and
moves
the
the
regulation
of
those
platforms
to
the
state
level.
The
second
part
of
this
bill
says
that
these
marketplace
online
platforms
cannot
pass
along
confidential
information
of
their
buyers
and
sellers,
except
by
court
order
and
subpoena.
Let
me
give
you
a
little
more
information
about
what
we're
talking
about
when
we
say
marketplace
platforms.
E
These
are
online
applications,
software
websites
that
advertise
or
provide
information
about
available
or
offered
goods
and
services,
and
then
they
typically
provide
a
way
for
offers
for
those
goods
and
services
to
be
made
and
accepted,
and
in
some
cases
for
some
kind
of
a
payment
system
to
be
provided.
Let
me
give
you
some
examples.
In
addition
to
that
explanation:
ebay,
etsy,
airbnb,
instacart,
poshmark
shopify.
These
are
the
kinds
of
online
marketplace
platforms
that
we're
talking
about
this
bill.
The
first
part
of
the
bill
is
pro-business.
A
Thank
you
very
much.
Do
we
have
any
questions
of
the
sponsor
c1
representative
sparks
dr
obama?
Are
we
seeing
problems
with
some
municipalities
across.
E
The
state,
I
don't
know
of
any
problems
in
the
state
of
tennessee,
but
we
have
some
examples
of
other
local
governments
in
other
parts
of
the
country
that
are
implementing
their
own
regulations.
I'll,
give
you
an
example
or
two:
the
city
of
baltimore
and
the
city
of
seattle
have
essentially
regulated
minimum
wages
for
workers
in
in
that
are
hired
and
used
through
these
kinds
of
platforms
in
the
form
of
minimum
premium.
Pay.
E
Airbnb
and
new
york
city
have
been
involved
in
a
lawsuit
over
the
city's
requirement
that
airbnb
pass
out
confidential
information
about
their
buyers
and
sellers.
So
there
are
some
examples
of
this
kind
of
thing
around
the
the
country
there's
some
examples
of
cities
in
california
doing
getting
in
a
dispute
over
whether
these
workers
should
be
classified
as
non-employees
or
not,
and
so
this
is
just
a
way
of
promoting
commerce
in
the
state
of
tennessee.
In
light
of
the
different
instances
that
have
occurred
across
the
country
where
local
governments
have
imposed
regulations.
A
We've
got
a
question
on
the
bill.
Excuse
me,
chairman
powers,
this
question
on
the
amendment.
I
was
getting
ahead
of
ourselves
there,
all
those
in
favor
of
the
amendment,
please
signify
by
saying
aye
any
opposed,
no
amendments
on
the
bill.
Any
further
discussion,
seeing
none
we'll
call
the
question
all
those
in
favor
of
house
bill
1336,
please
signify
by
saying
aye
any
opposed
we're
off
to
calvin
rules.
Thank.
E
F
Thank
you,
chairman
and
members,
and
in
I'm
ready
to
go
into
whatever
excruciating
detail
on
this
legislation
that
you'd
like
chairman
and
members.
I
I
do
understand
that
that
there
may
have
been
some
red
flags
by
our
legal
staff
and
is
there
a
potential
that
we
could
get
the
legal
staff
to
explain
those
to
me
as
as
some
folks
interested
in
this
legislation
or
are
watching
at
the
moment.
Mr
chairman,
please.
A
Absolutely
and
we'll
go
out
a
session
to
hear
from
legal.
G
F
Representative
hawk
and
thank
you,
mr
chairman
and
members,
and
if
I
could
I'll
I'll,
do
my
email
as
well
but
give
discretion
or
give
the
give
the
permission
for
for
ms
shanks
to
communicate
with
the
proponents
of
the
legislation
to
to
have
the
broad
discussion
about
how
we
correct
that
that
that
small
detail
and
then
I'll
come
back
and
give
you
all.
The
excruciating
excruciating
details
that
you,
like,
sir.
A
Thank
you,
sir.
Whenever
we
go
to
talking
about
microneedling
and
all
that
kind
of
stuff,
it
could
get
a
little
prickly.
Yeah,
oh
well,
well
stated:
oh
and
there
we
have
it
and
we're
back
in
session
now
alrighty
with
then
without
objection.
It
seems
to
be
something
that
could
be
handled.
Rather
simply
it's
a
grammatical
situation
so
without
exception
we're
gonna
roll
house
bill
915
one
week.
A
F
Thank
you,
mr
chairman
members
of
the
committee
this
bill.
Just
does
one
thing:
it's
a
one
sentence
bill.
We
have
good
anti-fishing
legislation
in
tennessee.
This
is
phishing,
which
is
the
act
whereby
people
use
people
use
your
electronic
communications
to
get
at.
You
get
your
personal
information
to
defraud.
You
doesn't
explicitly
talk
about
texts
when
the
when
the
act
was
made.
Emails
were
the
way
this
was
done.
F
A
H
Thank
you,
chairman
and
committee
about
five
years
ago
I
ran
a
joint
resolution
that
said
that
we
would
establish
a
gold
depository
in
the
state
of
tennessee
upon
point
and
and
so
for
five
years
been
dealing
with
this
and
working
with
this
and
finally,
we
have
investors.
The
plan
is
for
private
investors
to
build
it
fund,
it
staff
it
tennessee,
will
run
it
and
get
a
revenue
stream
off
of
it.
H
That's
the
plan,
so
it
finally
got
investors
together,
and
we've
met
several
times
with
the
treasurer
department
of
revenue,
people
comptroller
and
the
chairman
of
finance
on
both
the
senate
and
the
house
side,
and
at
this
point
in
posture
now,
it's
the
treasurer's
request
that
we
asked
tasser
to
do
a
feasibility
study
now
for
the
establishment
of
gold
depository
and
that's
what
this
bill
says.
A
A
All
right,
I
saw
a
representative
hound
town's
hand,
go
up
as
well.
I
H
Use
your
imagination.
I
really
can't
even
guess,
texas
built
their
first
depository
in
2018,
okay,
it's
full
already,
so
they
are
building
a
second
one
and
I
know
some
of
the
rates
that
they
charge
for
storage
in
the
depository.
But
I
do
not
know
the
revenue
stream.
I'm
sorry.
H
A
Chairman
powers,
thank
you,
mr
chairman,
and
this
the
sponsor
this
bill
actually
came
through
banking
subcommittee,
and
you
also
mentioned
that
it
included
other
precious
metals
along
with
it.
But
I
really
think
this
bill
is
golden
and
I'll
be
supporting
it.
I
Funds
are
still
coming
now
on
the
bill.
Just
say
you
make
a
deposit
x
number
of
hundred
thousand,
maybe
a
million
dollars
worth
to
go.
You
obviously
can
go
and
retrieve
part
or
all
of
your
gold
whenever
you
want
to
without
any
you
know,
string,
maraud,
strings
attached
or
anything
of
that
nature.
Does
that
spell
out
in
the
bill
as
well.
H
Well,
this
bill
only
deals
with
asking
for
a
taxer
study:
okay,
but
but
yes,
somebody
who
deposits
whatever
amount
has
it
has
an
option
to
take
it
out
most
folks
who
store
stole
for
that
purpose,
though,
until
unless
they
sell
all
their
assets,
but
most
don't.
Okay,
thank.
J
Thank
you,
mr
chairman,
when
you
said
the
state
will
not
own
the
depository
repository,
but
the
state
will
run
it,
do
you
mean
administer
rules
and
for
the
operation
or
you
don't
mean
that
the
treasurer's
office
will
literally
run
the.
H
A
C
Mr
chairman,
what
kind
of
deterrent,
if
this
went
all
the
way
through
what
kind
of
deterrent
would
the
would
the
the
the
current
bullion
tax
be,
and
if
this
went
all
the
way
through?
Do
you
see
that
that
would
be
an
issue
that
we
would
need
to
address
at
some
point
to
help
this
be.
H
Thank
you
for
bringing
that
up.
Yes,
sir
right
now
at
this
point
in
tennessee
we're
one
of
the
few
states
left
in
the
whole
southern
sector
of
the
united
states,
that
has
a
sales
tax
on
gold
and
rare
coins
and
paper
money,
and
so
yes
for
this
to
be
successful.
There
is
another
bill
in
the
hopper
coming
through
that
representative
gantt
has
thanks
for
bringing
that
up.
That
does
away
with
sales
tax
on
gold
bullion
the
state
of
tennessee.
C
Thank
you,
mr
chairman
sharon
halsey,
thank
you
for
the
bill
and
I
do
support
the
legislation,
but
just
as
a
reminder
when
study
bills,
taser
or
otherwise
come
to
calendar
and
rules.
We
hold
those
bills
until
our
last
calendar
because
again
not
all
study
bills,
leave
calendar
and
rules,
and
especially
if
it's
a
tasker
study,
because
we
only
limit
those
to
three
that
go
out
per
year
to
not
overwhelm
tasser.
So
just
as
a
reminder
as
you
put
that
on
notice,
but
I
do
support
the
legislation.
Thank
you
for
bringing
it.
Thank
you.
A
Thank
you,
chairman
zachary.
Actually,
this
bill
is
double
referred.
He's
gonna
go,
spend
some
time
with
her
friends
and
finance
ways
and
means
following
here,
so
seeing
no
more
comments,
we're
gonna
call
the
question.
All
in
favor
of
oh
I've
already
gone
to
the
next
sheet
house
bill.
353,
please
signify
by
saying
aye
aye
any
opposed
no
enjoy
finance
chairman
halsey
house
bill
943
by
representative
manus
is
next
on.
We
have
a
motion
and
a
second.
We
see
no
amendments.
So
the
floor
is
yours,
representative,
menace.
K
Thank
you,
mr
chair.
Thank
you
committee
house,
bill
number.
943
is
a
cleanup
and
clarification,
and
it
clarifies
that
an
employee
retaliation
claim
for
complaints
about
discrimination
or
harassment
may
only
be
brought
under
the
tennessee
human
rights
act.
Today.
Employees
have
the
ability
to
bring
action
under
two
portions
of
the
tennessee
state
law,
the
tennessee
human
rights
act
and
the
tennessee
public
protection
act,
thus
increasing
the
cost
for
employers
in
defending.
K
Not
only
does
this
amendment
benefit
employers,
but
it
also
benefits
aggrieved
employees
by
providing
clarity
for
the
proper
cause
of
action,
keeps
them
from
misunderstanding
which
act
to
file
the
claim
under
and
that
could
lead
to
their
claims
being
dismissed
for
an
otherwise
procedural
misunderstanding.
So
I'll
take
any
questions
from
the
committee.
Thank.
A
I
K
Representative
madison:
it's
a
clarification
because
literally
they
they
are
supposed
to
file
under
the
tennessee
human
rights
act.
If
they
filed
under
the
tennessee
public
protection
act,
they
would
be.
That
would
be
a
procedural
misunderstanding
or
that
would
be
a
wrong
procedure,
so
it's
more
guidance
that
they
should
file
under
the
tennessee
human
rights
act.
I
I
K
B
Thank
you,
mr
chairman
committee
ryan,
king
with
the
tennessee
chamber
and
representative.
We,
we
don't
have
any
formal
data,
but
we
do
know
of
instances
where
these
cases
have
been
brought
under
both
statutes,
and
it's
just
had
to
be
clarified
by
the
courts.
I
I'm
a
new
man
brand
new
spanking
brand
new.
All
right
can't
help
it
when
you're
born
that
way
like
this
is
the
deal.
Obviously,
we
want
to
streamline.
We
want
people
to
file
accurately,
but
still
the
data.
If
we,
if
we're
going
to
step
on
the
toes
of
citizens-
and
I
know
the
the
chairman
he's
jubilant
about
you-
know
citizens
and
business
being
able
to
work
together.
I
So
is
that
I,
but
I
don't
want
to
do
anything
that
we
have
not
thoroughly
vetted
and
make
some
kind
of
mistake
where
citizens
not
being
able
to
you
know,
get
what
they
need,
and
that
doesn't
mean
that
it's
going
to
end
up
in
their
favor
but
to
be
heard
properly.
So
I
would
think
that
we've
had
some
data
to
say
that
x,
number
of
folk
filed
and
they
followed
the
wrong
area
and
they
got
disqualified
or
something
of
that
nature.
Just
something
to
hang
your
hat
on.
B
No-
and
I
I
agree
with
that,
sir
and
I
I
would
say-
and
I
don't
want
to
speak
on
behalf
of
this
committee
or
the
general
assembly,
I
would
say
sponsor
that
the
intent
of
the
general
assembly
was
for
claims
to
be
filed
under
the
human
rights
act
or
originally
so
that
was
your
all's
original
intent.
Looking
at
the
legislative
record
chairman.
A
Stand
by,
though,
I
want
to
clarify
my
understanding
and
it's
not
necessarily
my
I'm
jubilant
about
the
the
business
and
the
people
working
together.
It's
the
tremendous
acumen
that
our
freshman
member
has
shown
by
bringing
this
forward,
but
isn't
it
safe
to
say
that
this
legislation
does
not
diminish
any
citizens
or
employees
right
to
bring
action?
What
it
does
is
it's
just
eliminating
a
false
trail
that
they
could
go
down
prior
to
getting
to
where
they
needed
to
go.
B
I
Let's
jeremy,
I
think
you
actually
put
that
and
that's
what
that's
what
we
at
least
I
seek
to
make
sure
that
that
is
the
case
and
and
that's
what
we
want.
You
know
both
parties
to
be
able
to
do
what's
necessary
to
find
some
kind
of
redress
and
in
the
vendor
we
find
there's
some
problem.
I
guess
I'll
see
you
back,
you
know
again
we'll
figure
out
how
to
mend
it.
I'm
fingers
crossed
that
there
will
not
be,
and
the
fact
of
it
is
now.
I
I
guess
what
we
have
to
do
is
at
some
point
make
sure
the
word
is
out
to
the
general
population.
So
they'll
know
exactly
what
road
to
try
down
if
there
are
complaints,
but
thank
you
for
your
explanation.
Thanks
for
the
legislation
as
well
appreciate
it,
mr
chairman,.
A
All
righty
thank
you
and
thank
you,
mr
king,
for
being
so
willing
to
spend
your
time
with
us
this
morning,
we're
back
in
session
any
further
questions
of
repres
of
the
bill,
sponsor
any
questions,
seeing
none
all
those
in
favor
of
house
bill
943,
please
signify
by
saying
aye
any
opposed
nose
eyes.
Have
it
we're
off
to
calendar
and
rules.
Thank
you,
mr
chair.
Thank
you
committee.
Our
very
own
representative
alexander,
is
going
to
be
bringing
us
house
bill
732
at
this
point
properly,
motioned
and
seconded.
Then
we've
also
got
an
amendment.
G
Say
so,
this
basically
allows
someone
who
is
involved
in
domestic
violence,
assault
rape,
any
of
those
things
stalking.
If
someone
is
being
stalked,
they
can
get
out
of
their
lease
earlier
than
their
lease
is
states
with
the
tenant
if
they
provide
a
written
notice
to
the
landlord
and
they
provide
proof
of
the
assault
or
an
order
of
protection.
G
A
I
Up
for
it,
that's
a
good
bill.
I
like
the
bill,
but
I
have
a
question
for
you:
what,
if
you
are
a
person,
a
male
or
female,
but
now
you
know
today
it
can
work
both
ways:
mental
abuse,
too.
Sometimes
you
have
the
situation,
men
and
quiet
and
don't
say
anything
about
it,
but
it
happens
according
to
the
record.
But
what,
if
you
have
a
situation
where
a
person
has
a
child
and
that
child
has
been
in
that
complex
wherever
they
live,
that
neighborhood,
where
they
live,
is
actually
being
attacked
in
that
home?
J
Thank
you,
mr
chairman,
thank
you
representative
for
bringing
this
bill.
This
is
something
that
we've
been
trying
to
get
accomplished
for
years
and
getting
people
to
understand
the
dangers
that
families
are
in
when
people
are
being
stalked
and-
and
this
has
given
them
an
opportunity
to
get
somewhere
safe,
put
their
family
in
a
safe
environment,
particularly
dealing
with
children,
as
the
representative
just
mentioned.
So
I
really
appreciate
you
bringing
this
bill
and
I
look
forward
to
working
and
signing
on
to
it.
A
One
please
signify
by
saying
aye
any
opposed,
no
we're
back
to
the
bill.
Anything
to
add
representative
alexander
we've
got
a
question
on
the
bill.
That's
been
called
the
objections,
seeing
none
all
those
in
favor
of
house
bill
732,
please
signify
by
saying
aye
any
oppose
no
or
if
you,
if
you're,
if
you
know,
if
you
have
an
op,
if
you're
opposed
to
it,
please
see
the
clerk
but
we're
off
to
calendar
and
rules.
A
Yes,
sir.
Thank
you
chairman.

rise.
