close

loopholes

stopping
pbms
from
reducing
a
dispensing
fee
to
offset
reimbursing
an
actual
cost
for
a
drug
or
device
or
a
pbm
from
charging
a
pharmacy,
an
additional
amount
to
process
a
claim.
It
requires
a
pbm
to
have
a
reasonable
appeal
procedure
for
any
pharmacy
to
challenge
a
reimbursement
amount
if
it
is
less
than
what
the
pharmacy
paid
to
acquire
the
drug
or
device
allows.

act
does
not
levy
the
tax.
It
simply
authorizes
the
council
of
these
two
metropolitan
governments
to
enact
attacks
by
ordinance
of
the
metropolitan
council.

to

the
twra
and
we're
dealing
with
the
wildlife
management
endowment
fund
that
people
that
buy
a
lifetime
sportsman's
license,
and
this
money
has
accumulated
in
with

twra
they've

71
million
dollars
in
this
fund
right
now,
they're
able
to
basically
draw
a
small
amount
of
interest
of
113
000
a
year
by
creating
this
endowment
fund
through
the,
through
the
help
of
the
attorney
general
and
the
our
treasurer
they're
able
to
start
this
irreparable
trust,
and
they
now
can
put
this
money
in
with
the
treasury
in
the
consolidated
retirement
type
plan,
and
we
feel
like
we're
going
to
be
able
to
increase
that
hundred
and
thirteen
thousand
to
four
to
five
million
dollars
per
year,
which
will
help
them
not
have
to
increase
hunting
and
fishing
license
in
the
future
in
the
near
future.

tests

nice
wages
that

being
paid
by
trucking
companies
for
these
drivers,
so
anything
that
we
can
do
to
help
them
get
on
the
road,
and
we
all
know
that
we
have
supply
chain
issues
across
the
country
and
across
the
state.

I've
been
getting
calls

local
businesses

memphis

could
actually
provide
the
service,
but
because
of
how

law

position

able

it
and
they
have
a
waiting
list,
like
you
said,
of
people
just
trying
to
get
their
licensure,
and
I
think
this
is
going

go

long
way

help
with
just
the

experiencing

we

truckers

road,

to

we

I
really
appreciate
that,

our
company
alone,
we've
got
over
a
hundred
trucks
sitting
idle
with
no
drivers
and
we're
doing
all
kind
of
advertising
paying
bonuses
and
nothing
seems
to
work.
But
I
do
want

commend
the
governor's
office
and
really
the
department
of
safety
and
commissioner
long
and
elizabeth
stroker
we've
met
all
during
the
last
year,
trying
to
come
up
with
some
things
that
will
make
it
easier.

like

this
bill,
I'm
a
little
concerned
and
dr
dropping
that
age
to
18
on
the
semi
truck
drivers,
especially
air
brakes
and
those
are
pretty
complicated
machines
to
operate.
I
just
know
personally
how
I
drove
when
I
was
an
18
year
old
versus
a
21
year
old
and
I'm
a
little
concerned
with
the
data.
Even
the
car
rental
agencies,
insurance
agencies.
We
have.
We
have
substantial
data
to
substantiate
that
18
year
olds,
19
year
olds,
20
year
olds
drive
differently,
there's
different
driving
patterns.

just
I
just
hope,
as
a
state
will
really
monitor
that,
and
if
this
becomes
a
problem,
if
there's
lots
of
wrecks
fatalities
associated
with
those
younger
drivers,
I
hope
in
the
future.
We
would
definitely
revisit
this
if
we
see
that
trend
carry
over
from
every
other
driving
aspect
into
our
commercial
licensing.

studies

about
allowing

this
is
out
of
high

until
they're
21.

with

us
changing

they

drive
out
of
warehouses,
maybe
across
town
and
right
back
and
learn

drive

they

get
out
on
the

young

experienced

interstate

very

disappointed
in
the
sentencing
code.

literally
reset
our
sentencing
code
top
to
bottom,
every
single
crime
at
100
percent,
but
at
the
average
that
folks
are
actually
serving
now,
and
so
we
looked
back
and
worked
with
fiscal
review
and
legal
and
everybody
did
a
fantastic
job
of
really
looking
at.
How
long
are
people
actually
serving,
and
so
I
I
mean
right
now.

If
you
get
a
10-year
sentence
at
30
percent
you're
not
going
to
serve
10
years
you're
not
going
to
serve
five
years,
you're
unlikely
to
serve
three
years,
I
mean
you
may
be
up
for
parole
in
as
little
as
17
months.
Maybe
you
get
out,
maybe
you
don't,
but
it
just
isn't
a
system
that
works.
So
we
went
through
all
of
that
in
criminal
justice.
This
amendment
actually
complies
with
the
discussion
that
happened
there.

They
passed
it
with

understanding
that
we
were
making
sure
we
weren't
reducing
anything
significantly
from
a
policy
standpoint,
but
just
reflecting
the
actual
sentences
that
are
being
served
now.
Mr

I
will
say
in
doing
that.
The
fiscal
note
in
this
bill
is
still
approximately
10.8
million
dollars
a
year.

will
say
that
that
is
minuscule
in
comparison
to
the
cost
of
lives
and
the
pain
that
both
defendants,
defendants,
families
and
especially
victims
and
victim
families
have
to
go
through
and
going
back
and
forth
to
the
parole
board
over

over

over
again
pro
board
folks
do
a
great
job,
but
it's
just
not
something
they
should
ever
have
to
do
so.
With
this
amendment,
I
understand
this
will
go
behind
the
budget,
but
there
are
several
truth
and
sentencing
bills.
This
year
I
support
every
single
one
of
them.

closer
we
can
get
to
truth
and
sentencing,

everybody
knows
everybody

when
somebody
goes
in

long

to
serve

simply
works
better
as
a
system,

and
the
amendment

too

one-year
supervised
release
right
at

very

mentioned

as
something

consider

mechanism

frankly,
punish

behavior.

history,
members

armed
forces

served
before
1975
if
they
gained
employment

the
state

members

the
credit.

essentially,

end

your
first
year
of
state
service,
you
were
actually
at
the

five
years
toward
retirement.

this

it

folks
that
have
served
in
the
armed
forces
after
1975

zeroes
in

are

day
for
every
day
that
they

in
the
armed
forces
at
a
cost
of

trafficking

sex
trade
in
the

amendment
added
kidnapping
aggravated

napping
and
especially
aggravated
kidnapping
to
the
list
of
offenses
that
are
eligible
for
criminal
asset
forfeiture
and
that's
criminal
on
conviction.
We're
not
talking
about
civil.
This
is
criminal
asset
forfeiture,
and
this
is
just
targeting
kind
of
the
worst
of
the
worst.

child
is
kidnapped
and
put
in
an
suv
or
taken
to
a
house,
that's
already
an
offense,
that's
worthy
of
someone's
life
being
taken.

legislation

to
be

in

the

brief
comment
and
we
will
keep
it
very
brief
on
the
amendment
I
just
wanted
to
share
with
you
all
a
brief
concern.
We
had
current
law.
As
was
stated,
the
cost
reflected
on
the
fiscal
note
is
based
on
the
highest
operating
cost
of
the
next
10
fiscal
years.

captures
the
highest
operating
cost
of
the
next
three
fiscal
years.
We
have
a
concern
that
amendment
could
result
in
reduced
projected
costs
for
periods
of
increasing
or
increa
decreasing
incarceration
when
a
sentence
is
more
than
three
years
changing
from
three
years
to
ten
years
may
reflect
no
cost
in
the
fiscal
note
or
substantially
less
cost,
due
to
the
fiscal
impact
of
the
sentence
year
or
the
impact
of
the
sentence
years,
starting
after
the
period
allowed
in
this
bill,
which
is
three
years.

we
just
want
to
share
with.

funding

know
as
a
result
of
increased

of
incarceration.

additional
funding,

population
grows

beds

filled
longer

future
growth
needs
for
the
new
construction
of
beds

likely
penalties
on
crimes
today,
as
we
know,

time

impact

our
prisons,
so
we
just
wanted
to.
In
summary,
the
amendment
may
cause
the
department
to
be
underfunded
for
the
variable
cost
of
admissions
when
legislation
is
passed
that
increases
incarceration
periods
to
more
than
three
years.

departments

that

capital

that
process

shorten
the
duration

and
understand

costs

short
term,

we

forward
and
plan
with

idea

we

setting
aside
capital
to

build

prisons

incarceration
goes
up
or
if
incarceration
goes
down,
then
we
could
understand

expense
