Description
House Cities & Counties Subcommittee - April 6, 2021 - House Hearing Room 3
A
Welcome
members
and
guests
to
the
citizen
county
subcommittee
of
local
government,
the
committee
will
come
to
order.
Mr
hutchinson
take
the
role.
A
A
C
You,
mr
chairman
and
committee,
there
is
an
amendment.
We
have
go
ahead,
sir.
A
C
Mr
chairman
and
committee
amendment
6080
makes
the
bill
this
amendment
bill
simply
adds
allowing
the
calculation
of
benefits
under
the
federal
cobra
program
for
the
reimbursement
of
health
insurance
benefits
costs
for
the
first
responders
family.
Nearly
four
years
ago,
the
legislator
voted
to
re.
We
voted
to
reimburse
local
governments
that
provided
health
insurance
benefits
to
the
families
of
first
responders,
killed
in
the
line
of
duty
after
their
death,
and
that's
for
two
years.
C
With
the
passage
of
this
amended
bill,
the
department
of
finance
and
administration
can
reimburse
local
governments
for
health,
insurance
premiums
or
expenses
for
cobra
coverage
for
the
families
who
have
lost
their
loved
one
killed
in
the
line
of
duty.
I'd
like
to
thank
the
department
of
finance
and
administration
and
the
tennessee
association
of
chiefs
of
police
for
working
together
on
this
amendment.
With
that,
mr
chairman,
I
renew
my
motion.
A
Is
there
objection
to
the
question
hearing?
No
objection,
we're
voting
on
amendment
6080,
all
in
favor
of
the
amendment
say
aye
opposed,
say.
No.
The
amendment
passes
back
on
the
bill.
You
recognize
on
1373
or
any
other
questions
on
the
bill
for
the
sponsor
hearing.
None
we're
without
objection.
We're
voting
on
house
bill
1373,
all
in
favor,
say
aye
opposed,
say
no
eyes
prevail.
A
D
Thank
you,
mr
chairman
house.
Bill
1028
allows
local
government,
that's
a
municipality
county
or
a
county
having
a
metropolitan
form
of
government
to
buy
local
ordinance
or
resolution
to
prohibit
the
use
of
tobacco
and
vaping
products
on
in
a
public
park.
Public
playground,
public
greenway
or
public
property
that
is
accessible
to
youth.
A
Okay,
chairman
kumar,
seeing
that
this
bill
opens
several
titles,
seven
to
be
exact,
will
you
allow
this
bill
to
be
referred
to
local,
the
full
local
committee?
If
amendments
are
added
that
changes,
the
initial
intent
as
passed
by
this
committee,
I'm
most
agreeable?
Okay,
are
there
questions
for
the
sponsor
on
this
bill?
E
Thank
you,
mr
chairman.
I
believe
last
night
on
the
floor.
There
was
some
references
made
at
certain
points
time
to
rick
staples.
This
has
sort
of
been
referred
to
as
rick
staples
bill
a
couple
years
gone
by,
I'm
in
agreement
that
whoever
owns
the
property
should
be
able
to
establish
the
policy
on
the
property.
E
A
A
F
F
An
unfortunate
number
of
our
homicides
are
committed
by
juveniles
that
are
involved
in
prostitution,
human
trafficking
and
that
sort
of
thing
and
we've
had
some
pretty
celebrated,
kate
or
highly
publicized
cases.
This
is
totally
permissive.
No
city
has
to
do
it,
but
what
it
does
allow
and
where
the
legislature
can
step
in
it
allows
them
to
create
a
fund
that
private
institutions,
charitable
institutions
can
contribute
to
as
well,
and
so
it
cuts
through
any
municipal
requirements
and
allows
a
city
to
set
that
up.
That's
all
it
does.
G
G
You
know,
repercussions
from
this
bill
and
just
hope
that,
as
we
move
toward
this,
that
we
can
go
much
further
in
the
future,
but
I
think
it's
a
great
opportunity
to
really
focus
in
on
juveniles
and
juvenile
justice
and
juvenile
reform
and
all
of
the
above.
So
thank
you
for
it.
Thank
you.
Thank
you.
Vice.
E
I
thank
you,
mr
chairman,
mr
sponsor,
I
appreciate
the
the
the
way
you're
bringing
this
to
to
help
municipalities.
The
question
I
raise,
though,
is
is:
is
this
something
they
could
be
doing
already.
E
A
F
Yeah
my
understanding
is,
it
depends
on
the
municipality,
it
would
depend
on
a
municipal
charter
and
actually
no
in
many
cases.
It
would
not
be
possible
for
them
to
do
it
where
they're,
combining
public
funds
from
501c
three
organizations,
as
well
as
public
funds
by
chairman
wright.
So
so
it
would
actually
create
a
new
pardon
me.
Go
ahead.
E
I
see
we're
telling
the
municipalities
to
go.
Do
something
that
probably
they
could
be
doing
already,
that
that
private
private
partnership
with
a
with
a
community
cannot
exist
now
under
code
representative.
F
Stewart,
no,
no,
it's
not
necessarily
true.
What
I'm
saying
is:
there's
not
a
code
provision
that
allows
a
fund
like
this
and
depending
on
your
municipal
charter
or
your
municipality,
I
can't
speak
to
every
municipality,
but
in
nashville
for
example,
this
could
create
a
new
legislatively
sanctioned
function.
I
don't
think
we
could
do
this
under
our
current
charter.
Vice.
E
H
Thank
you,
mr
chairman,
sponsor
I
didn't
understand
everything
you
said
about
the
funding.
It's
going
to
be
public
funding
and
and
private
funding,
and
what
else
did
you
say
representative
just.
F
F
H
Calfi,
well,
I
know
you're
addressing
a
real,
serious
problem
here
and
I
I
didn't
I'm
sorry
I
didn't
understand
you
sound
a
little
muffled
kind
of
like
I
do
when
I'm
making
a
prank
phone
call
but
yeah.
I
can't
take
off.
A
A
D
A
A
I
You,
chairman
and
committee,
there
is
an
amendment
that
I
have
that
rewrites
this
bill,
that
is
untimely.
A
It's
untimely
and
is:
is
there
objection
to
hearing
an
untimely
bill
so
objection
we
have
objections,
so
we
will
not
take
up
or
consider
the
untimely
amendment
so
you're
recognized
on
house
bill
1450,
sir.
Yes,.
I
So
what's
happened
is
as
they
working
with
the
municipal
league
had
come
up
with
what
this
bill
says
is
a
user
fee
that
goes
to
the
utility
districts.
I
We
have
seen
now
that
from
what
we
feel
there
is
a
better
solution
in
which
the
amendment
that
I
had
that
was
untimely
would
address,
and
so
you
know
moving
forward
with
what
we
have
right
now.
I
don't
think
it'd
be
in
the
best
interest
of
the
state
to
do
so
at
this
time.
With
this
current
language
that
I
have.
A
A
J
This
bill,
simply
attempts
to
clarify
local
governments
can
enter
into
contracts
with
licensed
health
care
providers
that
are
qualified
in
the
psychiatric
or
psychological
field
for
mental
health
evaluations
in
order
to
make
hiring
decision
for
jailors
and
when
the
local
government
relies
in
good
faith
on
the
licensed
health
care
professional
opinion
for
the
hiring
decision,
it
will
not
create
a
cause
of
action
against
the
local
government
with
that.
Mr
chairman,
we're
open
for
questions,
and
we
also
have
mr
will
denami
from
hamilton
county
also.
A
K
K
A
A
A
A
That
would
increase
its
collateral
by
25
percent,
shall
deposit
additional
collateral
to
secure
such
increase
within
10
calendar
days
of
the
deposit.
Additionally,
this
subsection
is
repealed.
On
january
1st,
2023
not
only
will
be
a
large
sum
of
money
transferred
this
may
there
will
be
another
transfer
taking
place
next
may
this
bill
will
automatically
repeal
itself
on
january
1st
2023
any
that's.
That's
the
explanation
of
the
bill,
mr
any.
K
K
A
A
A
H
A
Are
there,
the
chair
would
like
to
again
express
its
thanks
for
not
only
the
hard
work
that
all
the
members
put
into
this
committee
this
year,
but
also
the
staff
we
have
a
new
ra
in
research,
analysts
and,
and
they
they've
done
a
really
good
job
starting
mid-stream,
and
we
wish
them
the
very
best
in
their
career.
I
can't
say
enough
for
our
legal
analyst,
who
has
been
ready
and
proactive
on
all
the
bills
that
we've
heard
this
year,
leader
gantt,
you
should
be
recognized.
