Description
House Cities & Counties Subcommittee - March 8, 2022 - House Hearing Room 3
A
B
You,
mr
chairman,
I
have
a
special
guest
with
me
today
and
she's
going
to
be
with
me
all
day,
she's
from
down
rutherford
county
and
miss
marty
green.
If
you'd,
please
stand
up
she's.
My
shadow
today
make
her
feel
welcome.
A
Any
other
announcements-
personal
orders
at
this
time:
okay,
seeing
none
we'll
go
ahead
and
start
with
our
calendar
for
today,
first
bill
is
house
bill,
653
and
chairman
hazelwood
is
not
with
us.
So
without
objection,
we'll
roll
house
bill
653
to
the
hill
hearing,
no
objection.
A
C
C
What
this
does
is,
it
just
adds
another
tool
to
the
toolkit
for
them
to
recruit.
It
gives
them
the
ability
to
offer
grants
to
police
push.
Let
me
rephrase
it
offer
grants
to
perspective
police
fire
teachers
and
nurses,
nurses,
and
they
can
make
grants
up
to
the
amount
of
their
property
tax
bills.
But
let
me
be
clear:
this
does
not
mandate
that
they
use
their
grant
for
their
property
taxes,
but
in
order
to
if
they're
going
to
receive
grants,
these
are
the
only
guidelines
that
I
put
in.
C
If
they're
going
to
receive
these
grants,
then
they
have
to
live
in
the
municipality
where
the
grant
is
being
offered
and
those
grants
can
be
used
for
whatever
they
want
and
it
allows
the
municipalities
to
come
up
with
their
own
program.
We
also
put
checks
and
balances
in
this
program
has
to
be
ran
by
our
comptroller
to
ensure
that
it
complies
with
our
constitution.
C
Comptroller
spoke
to
them,
they
said,
okay
and
the
last
thing
on
that.
C
You
know
they
are
to
come
up
with
their
own
program
and
it
has
to
have
a
clawback
provision
in
it
also-
and
this
is
for
them
to
if
they
want
to-
let's
say,
for
instance,
they
want
to
recruit
a
police
officer.
They
recruit
the
police
officer
if
he
wants
to
get
the
program
they
contract
with
that
officer
for,
however,
many
years
he's
in
their
program
and
they're
able
to
offer
these
grants
to
them,
and
with
that.
D
Thank
you,
mr
chairman.
Welcome
to
committee
first
time.
Is
this
your
first
bill
in
here?
It
is
my
first
bill
in
here.
Okay,
we're
gonna,
give
you
a
hard
time
on
that
front
today,
at
all
my
question
is:
can
you
go
drill
down
into
a
little
bit
deeper
about
the
incentive?
How
do
they
incentivize
rice
program.
C
Yes,
sir,
so
so
all
we
did
was
put
the
just
basic
framework
in
place.
They
are
to
come
up
with
their
own
program.
Our
basic
framework
says
they.
They
can
create
a
program
that
allows
those
four
professions
to
be
able
to
receive
a
grant
from
that
municipality
and
up
to
or
in
the
amount
of
their
property
tax
bills,
if
they're
buying
property
in
a
municipality.
C
Now
it
does
now.
Also
in
that
framework
it
says
these,
and
these
grants
are
not
to
be
used.
Necessarily
they
don't
have
to
be
used
to
pay
those
property
taxes.
It
also
has
to
have
a
clawback
in
it
right
if
this
person
gets
fired
or
or
quits
or
whatever
they
have
to
pay
their
money
back
and
the
last
piece
in
it.
I
think
I
said
it
earlier,
but
I
didn't
forgot:
oh
the
the
municipality
that
the
grant
comes
from
it.
D
C
Up
to
departure!
Thank
you.
Sorry,
chairman.
It's
up
to
the
city,
whatever
they
put
in
their
program,
but
not
for
property
tax.
C
B
You,
mr
chairman,
my
friend
from
the
west
coast
to
tennessee.
How
are
you
today,
I'm.
A
Okay
on
the
bill,
sir,
I'm
sorry
is
the.
B
Purpose
this
bill
to
undo
what
we
passed
here,
while
back
that
you
don't
have
to
live
in
memphis
to
work
to
be
a
city,
a
fireman
or
a
policeman.
C
Representative
parks,
absolutely
not,
it
does
not
undo
that
law.
Absolutely
not
it's
just
another
tool
that
cities
can
use
if
they
want
to
bring
people
to
live
in
their
city.
That's
all
it
does
not
undo
their
law
at
all
representative
calvi.
B
C
C
B
C
B
Crawford
thank
you
and
then
finally,
the
the
part
about
the
teachers
will.
This
include
the
teacher
staffs
substitute
teachers.
People
like
that
representative.
D
Thank
you,
mr
chairman,
going
back
to
chairman
crawford's
question.
Medical
professionals
was
the
intent
for
first
responders,
like
ambulance
representative.
C
C
A
E
C
Parkerson
and
and
thank
you
for
the
representative
miller
and
and
it's
not
just
for
shelby
county,
though
it's
statewide,
because
and
and
and
maybe
you
know-
and
I
don't
want
to
speak
for
legal,
but
maybe
they
left
the
the
definition
in
regards
to
nurses
a
little
bit
more
abroad,
because
you
know
there
may
be
a
different
need
for
somebody
for
medical
professionals
like
a
doctor
in
rural
areas,
and
so
I'm
okay
with
the
with
it
being
broad,
because
every
every
shortage
of
those
pers
that
personnel
that
type
of
personnel
rather
is
not
germane
specifically
to
shelby
county.
A
B
A
B
B
This
legislation
will
allow
the
governing
bodies
of
these
cities
to
set
the
compensation
paid
to
their
elected
officials
and
bring
them
in
line
with
the
other
343
cities
whose
compensation
is
established
locally.
This
legislation
is
permissive
and
includes
safeguards
that
mandate.
This
action
be
done
by
two-thirds
vote
of
the
local
governing
body
and
only
effective
following
the
next
local
election.
A
A
B
A
A
B
A
A
B
A
And
the
next
bill
on
the
calendar
is
house
bill
2787
by
chairman
ramsey
and
there's
been
a
request
to
take
that
bill
off
notice.
Is
there
objection
to
taking
the
bill
off
notice?
Hearing
no
objection
house
bill
2787
involves
notice.
The
next
bill
on
the
agenda
is
2349
by
chairman
holtzclaw.
Do
we
have
a
motion?
B
You
chairman
and
committee
members,
basically
hb
2349,
is
a
is
a
cleanup
from
a
drafting
area
from
last
session
and
you.
B
A
B
Thank
you
and
this
this
clarifies
that
a
craft
brewer
may
choose
self
to
dispute
in
their
home
county
and
another
county
not
already
assigned
to
a
wholesaler,
and
it
allows
them
to
distribute
up
to
1800
barrels
of
beer
annually
and
I
believe,
we're
changing.
A
A
A
E
Thank
you,
mr
chairman
and
committee.
This
bill
would
just
prohibit
a
local
government
from
providing
money
to
an
abortion
clinic,
so
pretty
straightforward.
D
I
want
to
thank
the
representative
for
bringing
this
legislation
it's
near
and
dear
to
many
pro-life
legislators
in
this
body
and
represents
our
beliefs
as
a
republican
as
a
conservative,
and
I
think
this
a
very
good
piece
of
legislation
and
and
shines
the
light
in
the
area
I
did
not
know
was
taking
place.
So
I
applaud
you
for
bringing
this
legislation
and
fully
support
this
legislation.
E
Thank
you,
leader,
gantt
and
again,
I
know
some
support
abortion.
Some
don't
support
abortion,
but
we're
talking
about
taxpayers
dollars
here
and
taking
money
in
this
case
from
people
that
do
not
support
abortion
with
the
force
of
law,
taking
those
tax
dollars
and
spending
their
tax
dollars
on
something
that
they
disagree
with.
So
I
appreciate
your
support.
E
E
B
Thank
you
so
much,
mr
chairman,
I'm
having
trouble
formulating
some
conversation
around
this
and
I'm
also
losing
my
voice,
but,
as
dr
briggs
said,
I
do
not
have
coven.
B
E
Yes,
I
think
this
legislation,
as
I
understand
it,
could
impact
in
that
situation.
You
know,
in
other
terms,
you
could
look
at
it
as
laundering
money,
where
the
situation
that
occurred
resulted
in
me
bringing
this
bill.
It
was
a
direct
contribution,
as
you
mentioned,
but
if
you
do
give
another
entity
that
gives
to
the
abortion
clinic,
I
think
this
could
apply
as
well.
E
Otherwise
you
could
just
have
people
setting
up
a
501c3.
We
love
babies
and
local
governments
could
give
money
to
that
entity.
We
love
babies
and
then
that
entity
could
turn
around
and
give
it
to
an
abortion
clinic.
So
I
think
these
entities
need
to
make
a
decision.
Do
they
want
taxpayer
money
or
do
they
want
to
give
money
to
an
abortion
clinic?
A
D
Thank
you,
mr
chairman,
members
of
the
committee,
I'm
doug
garrett,
with
the
office
of
legal
services
and
to
representative
leatherwood's
point.
The
bill
addresses
direct
appropriations
to
elective
abortion
providers,
as
stated
in
the
bill,
there's
nothing
to
prohibit
a
local
governmental
entity
from
as
a
condition
to
an
earmark
of
funds,
to
say
essentially
that
if
it
gives
to
united
way,
then
it's
to
be
used
for
a
specific
purpose
and
which
exclusive
of
which
could
be
the
an
elective
abortion
provider.
D
So
it
would,
it
would
behoove
the
city
or
the
county,
whatever
local
governmental
entity
is,
is
earmarking
or
appropriating
monies
to
specify
the
purpose
for
which
it's
to
go.
D
Thank
you,
mr
chairman.
So
let
me
get
this
straight.
So
if
we
have
a
county
entity
or
city
municipality
or
county
entity
that
gives
to
a
non-profit
and
that
non-profit
in
return
gives
to
an
abortion
provider,
then
that
does
not
negate
or
this
legislation
would
not
apply
in
that
situation.
Is
that
what
I'm
hearing
mr
garrett.
D
As
I
read
the
I'm
sorry
doug
air
with
the
office
legal
services,
as
I
read
the
legislation,
it's
a
direct
earmark
of
funds,
however,
to
to
get
at
that
point
or
to
prevent
that
from
occurring
that
pass
through
through
say
a
united
way
or
something
else,
then
that
local
governmental
entity
it
would.
It
would
be
to
their
benefit,
to
specify
that
that
these
funds
are
to
go
for
this
purpose
or
that
purpose,
but
not
specifically
to
an
elective
abortion
provider.
D
A
D
D
D
A
A
A
Next
item
is
house
bill
838
by
representative
sparks,
and
he
has
taken
that
off
notice.
So
without
objection
house
bill
838
is
off
notice.
Hearing
no
objection,
838
is
off
notice.
The
next
item
is
house
bill.
2039
by
chairman
carr
he's
asked
that
that
be
roll
one
week
is
their
objection
to
the
role
hearing.
No
objection
house
bill.
2039
is
rolled
one
week
and
that
brings
us
to
the
heel
of
the
calendar,
which
is
house
bill.
2519
by
representative
sexton.
A
A
B
Thank
you,
mr
chairman,
for
those
that
are
interested.
The
house.
Local
full
committee
will
be
meeting
at
12
o'clock
in
house
hearing
room
1
today.
