service
that
you
provided

entity
in
the
state

specifically

low-income

have

the
constitution

chief
deputy
attorney
general,
I'm
here
to
speak
on
hb,

and,
first
of
all,
the
attorney
general's
office
agrees
with
the
idea
that
the
states
need
to
serve
as
a
check
on
an
out
of
control,
federal
government.
We
have
some
concerns
that
this
legislation
is
not
the
best
way
to
do
it.
We
think
there
are
some
real
unintended
consequences
here
to
start
with
this
strips
the
attorney
general's
office
of
the
ability
to
litigate
in
federal
court.

So
last
week
we
sued
the
biden
administration
over
the
tax
cut
prohibition
in
the
american
recovery
plan,
act
so
tennessee
and
kentucky
sued
to
say
that's
an
unconstitutional
provision.
If
this
legislation
were
in
place,
we
could
not
have
filed
that
suit.
A
few
weeks
ago
we
joined
missouri
and
some
other
states
in
filing
a
suit
against
the
bind
administration
saying
that
the
social
costs
of
greenhouse
gases
rulemaking
was
unconstitutional.
E
E
It
would
also
undermine
our
ability
to
coordinate
in
complex
cases
so,
for
instance,
in
capital
cases,
there's
often
parallel
litigation
in
the
state
and
federal
courts.
At
the
same
time
as
the
defense
attorneys
try
many
different
tactics
to
stop
an
execution,
as,
as
it's
heading
toward
its
conclusion
right
now,
we
have
teams
of
people
working
in
both
state
and
federal
court
together
seamlessly.
E
But
if
you
split
the
authority
and
have
a
different
office
working
on
the
federal
side,
a
different
office
working
on
the
state
side,
that's
going
to
inhibit
our
ability
to
best
represent
the
interests
of
the
state
same
in
consumer
protection,
where
we
have
some
extraordinarily
complicated
litigation
going
on.
We've
got
cases
right
now,
where
we
are,
we
are
pursuing
state
litigation.

Another
problem
is
you've,
got
types
of
litigation
where
sometimes
suits
brought
in
federal
courts,
sometimes
suits
brought
in
state
court,
for
instance,
education.
Sometimes
people
sue
the
state
saying,
there's
a
problem
with
an
education
law
in
state
court.
Sometimes
they
follow
the
suit
in
federal
court.

We
saw
a
flurry
of
election
litigation
this
past
year
we
had
one
team
of
people
that
kept
track
of
everything
that
came
in
and
have
developed
substantial
expertise
in
litigating
election
suits.
We
didn't
always
get
the
results
we
wanted,
but
we
had
folks
fighting
very
hard
on
that
front.
If
you
split
the
team
you're
going
to
have
some
lawyers
working
on
one
side,
some
on
the
other
side,
they're
not
going
to
get
the.

Thank

not
going
to
get
the
opportunity
to
develop
the
same
expertise
same
with
constitutional
civil
rights,
lawsuits
against
state
law
enforcement
officials
and
other
state
officers.
Some
of
those
are
in
federal
court.
Some
are
in
state
court
again.
If
you
split
up
the
team,
we
can't
leverage
expertise
in
the
same
way.

In
addition-
and
there
are
some
constitutional
concerns
with
this
as
well-
relating
to
the
tennessee
constitution-
separation
of
powers,
it's
also
a
problem
in
criminal
cases
where
you
have
a
lot
of
continuity
between
the
state
criminal
prosecutions
and
then
the
subsequent
federal
habeas
corpus
proceedings,
on
top
of
which,
if
there's
a
state
case
that
suddenly
has
a
cert
grant
issued.
Then
it
becomes
a
federal
case
in
the
u.s
supreme
court.

So
there's
a
lot
of
overlap
between
the
work
we
do
in
state
court
and
federal
court
and
drawing
a
hard
line
between
federal
court
litigation
and
state
court
litigation
is
going
to
ultimately
hurt
the
ability
of
the
state
to
see
its
legal
interests
vindicated
in
the
best
possible
way.

attorney
general's

the
office

solicitor
general

group

appellate
lawyers

other
litigating
divisions,
including
the
medicaid
fraud
integrity
division,
which,
incidentally,
has
brought
in
about
three
million
dollars
to
the
state
over
the
last
two
years.

federal

draw

removed
from
the
attorney
general's
office.

they
had
filed
it,
but
we
wouldn't
be
in
a
position
to
file
the
suit

general's
office
was
created
under
the

this
bill
would
do
was
take
those
that
office
at
which
reports
the
attorney
general
and
put
it
in
the
legislature,
overseen

this
body.

there

many
reasons,
maybe
a
couple
he
just
described,
but
those
those
are
the
first
times
that
I've
heard
those
descriptions,
but
this
bill
has
a
hundred
thousand
dollar
fiscal
note.

suspicion

attorneys
that
would
be
working
for
the
attorney
general
as
the
solicitor
general's
office
would
now
be
moving
over
here.

opioid
lawsuits,
our
local
district
attorney
generals
decided

they
wanted
to
bring
lawsuits
as
it
relates
to
opioid
manufacturers,

then
the
attorney
general
at
first
didn't
want

to
do
it.
If
we
had
the
opportunity
to
do
that,
then
we
could
direct
them
to
do
it
and
we
wouldn't
wait
upon
the
attorney
general's
office
to
do

allows
us

disability
fraud.

happening
right
before
many
people's
eyes
across
our
state,

so
this
bill
sets
up
a
separate,
independent
department
that
is
fully
funded
by
the
feds.

operating

40
other
states
with
this
same
kind
of
program
and
they
want
tennessee
to
be
involved,
because
it's
about
what
you

I
should
be
very
concerned
about
is
saving
the
people's
pocketbook
and
disability

genesis

disability

to
help
those
who
are
truly
dis,
abled
and
cannot
work,
and
so
bad
actors
are
out
there.

disabled

they're
doing
things
that
prove
they

program

fraud

group
is

to
be
totally
funded
by
the

organizations,

a
continued.
We
have
continued

do
great
things
through
volunteer
service.
As
nonprofit
organizations.
We

create
fundraising
opportunities

generate
revenue

support

mission,
often
donating
personal
funds.

recognize
a
few

veterans
organizations
that
are
here
that
are
in
support

this
legislation.
The
american
legion,

has
over
37
000
members,
members
and
auxiliary

current
state
commander,
is
unable

attend,

he
assured

he
has
already

His
membership
has
voted
in
favor
of
this
legislation.

of
the
veterans
of
foreign
wars,
richard

representing
over

000
veterans

auxiliary

support

this
legislation,

the
past
national
commander,

veteran
members
in
support
of
this
legislation,

also

recognize
the
vietnam
veterans,
which
is
our
largest
veterans,
membership

our
veterans
of
foreign
wars,

the
current
president

is

the

and
I
want
to
thank
all
the
other
veterans

supporting
this
legislation.

things
I

mention
that,
actually
we
do
in
the
community.

think
you

Our
legislation
is
key.
Suicide
prevention
is
vital
if
we're
not
out
there
serving
our
veterans,
making
that
contact

that
interaction
and
supporting
them
there's
no
there's
very
little
support.
This
gives
them
an
opportunity.
Veterans
are
the
best
people
for
veterans
to
come
to
for
assistance.

also
have
volunteer
work
out
in
the
veterans
hospital,
there's
thousands
of
hours
where
volunteers
go
out.
They
provide
food
food
clothing,
we
donate
there.
We
go
down
and
help
with
their
projects,
their
programs,
honor
guard
funeral
services
and
patriotic
days,
scholarship
programs,
the
amvest,
the
vfw
american
legion
military
order,
the
purple
heart
marine
corps;
dav,
that's
just
to
name
a
few
projects,
we're
out
cleaning
up
the
community,
we're
doing
things
to
help
others,
but
also
our
community
service,
we're
out
doing
home,
repairs,
handicap
ramps,
etc.

donations,
clothing,
helping
families
in
need
also
sponsoring
families
during
christmas,
when
they
don't
have
the
the
funds
to
to
take
care
of
their
families
and
their
children,
donations
we're
out
donating
to
hospitals,
funerals,

vehicle
repairs,
emergency
disaster.

tornadoes

veterans
stepped

the

set

facts,

about
how

vets

va
treatment
are
problem.
Gamblers,
ptsd
veterans
are
up
to
60
times
more
likely
to
have
a
gambling
problem
than
the
general
population

vets
and
psychiatric
unit
patients
meet
criteria
for
problem
gambling,
4
out
of
10
veterans,
seeking
help
for
gambling
report
and
a
suicide
attempt.

second
thing
they
listed
was
the
presence
of
bingo
gambling
in
which
service
members
average
a
hundred
thousand
dollars
wages
per
month,

that's
just

north
carolina

will
be
an
increase
in
harmful
consequences,
illegal
activities,

embezzlement
theft,
family
problems,
spousal,
child
abuse,
divorce,
suicide,
new
law
enforcement
needs,

this
runs
totally
against
our
republican
family
values.

have

it's
very
worthwhile-

just
want
to
make

mission
driven
to

in

can't
think
of
a
better
way
to
try
to
have
persons
in
a
community
that
concerned
about
other
persons
that
make
sure
they're.

problem
gamblers

organization

volunteers,

proceeds

to
be
used
for
charitable
purposes.

restrictive

bill

provision
