refused

hard

last

bill

allow

There
was
an
oversight.

years
ago,
when
cookville
regional
medical
center
was
formed,
creating
a
private
act
hospital.
At
that
time,
all
the
hospital
employees
were
actually
employees
of
the
city
of
cookeville
because
of
that
inadvertent
lack
of
transfer.

this
bill
would
allow
all
the
assets
and
liabilities
from
the
city
of
cookeville
and
their
pension
system
to
to
be
housed
in
their
appropriate
location,
is
with
those
employees
at
cooper,
regional,
medical
center.
This
bill
has

the
secretaries
or
the
constitutional
officer,
treasurer
and
tcrs
staff.

local
school
board.
Attorney
there
was
a
con.
There
was
a
concern.
I
think
it'd
probably
be
better

letter

In
my
office,
a
juvenile
at
a
school
in
our
system
was
involved
in
a
situation
with
another
student
that
was
captured
on
video.
Also,
the
sro
made
an
official
report
to
the
sheriff's
department.

However,
the
guardian
of
one
of
those
students
filed
an
open,
open
records,
act,
request
with
the
putnam
county
school
board
of
of
education
and
with
the
putnam
county
sheriff's
department,
seeking
copies
of
the
video
and
a
copy
of
the
sheriff's
department's
report.
Since
this
involved
juveniles,
the
attorney
didn't
feel
it
was
appropriate
to
release
the
information
of
the
school
board
had.
Regarding
the
other
student,
not
the
student
in
question,
but
the
other
student
ferpa
has
some
limitations,
but
did
not
specifically
preclude
this.

the
purpose
of
this
bill
is
to
require
that
the
only
people
allowed
to
have
these
in
an
open
request.
Open
records
request
would
be
the
juvenile's
parents,
in
this
case
in
either
case
either
parent.

legislation

laws

this

concerned
that
this
bill
duplicates
and
perhaps
conflicts
with
what
is
already
in
the
code,
the
closed
records
of
a
minor
student
that
were
created
by
a
school
resource
or
other
law
enforcement
officer
and
that
are
maintained
by
a
law
enforcement
agency.

But
in
title
371,
title
37,
1,
154,
juvenile
records
of
law
enforcement
are
already
closed
and
confidential
and
in
that
part
of
the
code
in
the
juvenile
part
of
the
code,
it
also
makes
some
exceptions
for
when
those
are
not
confidential.
And
probably
the
biggest
exception
is
when
the
juvenile
is
transferred
to
adult
court.
But
it
has
some
other
things
about
an
exception
for
the
officers
of
public
institutions
or
agencies
to
whom
the
child
is
committed
like
a
school
or
other
state
agency.

So
I
think
that
the
language
in
this
particular
exemption
puts
it
in
conflict
with
that.
I
don't
think
that
that
record
was
released
in
putnam
county
to
the
other
parent
in
this
situation.

I'm
concerned
it
would
close
records
that
would
be
exempt
under
the
other
part
of
the
juvenile
code,
if
that
makes
sense
that
the
when
something
is
transferred
to
adult
court,
I
do
want
to
make
clear
that
there's
already
an
exemption
in
the
public
records
law
for
victims
for
juvenile
victim
victims
that
was
passed
a
couple
of
years
ago,
so
any
photo
or
video
depiction
of
a
juvenile
victim
is
already
confidential.
Under
the
law,
ferpa
does
have
some
protections,
so
we're
not
so
much
concerned
with
closing,
of
course
also.
