resolve
this
difference

took

with

light
committee

house
and
open
conference
and
resolve
the
difference
between
the
bodies
on
house
bill.

bill

passed

worked
on

are

creating

new
appellate
court
to
handle,
handle
these
issues
we're
going
to
use
existing
resources,
thus
saving
taxpayers
millions
of
dollars.

doing
is

a

basically
chairman,
curcio's
bill
that
we
this
this
body's
already
passed
along
with
representative
garrett's
bill,
basically
going
to
be
marrying
the
two
bills
and
adding
a
couple
tweaks
to
the
two.
So
with
that
said,
I'm
going
to
let
representative
garrett
start
us
off
with
kind
of
what
he'll
his
bill
did
and
reinterred
that
to
the
body,
and
then
chairman
curcio
can
do
the
same.

probably
a
month
ago,
the
bill
that
we
passed
that
established

a
constitution

the
constitution
was
challenged
from
a
state
statute
that
we
passed
here.
It
created
that
venue
that
venue
still
remains
where
you
can
file
that,
where
you
reside
just
as
the
other
bill
that
we
passed
and
where
the
plaintiff
lives
also.

includes
state
statutes,
executive
orders
and
administrative
rural
regulation
just
as
the
bill
established
venue
that
we
passed
in
this
house
a
few
weeks
ago.
So
with
that,
I'm
going
to
yield
further
my

chairman
curcio

bill

we've
passed
three
times
on
on
on
this
floor.

the
three
judge
panel,

much

this
as
language
that
you've
already
voted
in
the
affirmative
on

so
what
we're
doing
again.
As
chairman
farmer
alluded,
we
are
not
creating
three
brand
new
judgeships.
Instead,
if
this
three-judge
panel
is
triggered
under
the
under
the
parameters
of
this
bill,
then
it
will
trigger
the
impanelment
of
three
existing
trial
court
judges,
one
of
which
being
from
the
jurisdiction
where
the
the
case
was
filed.

Those
folks
will
come
together,
they'll
make
their
determination,
they'll
dispose
of
the
case
and
they'll
go
back
from
once.
They
came
so
that
I
think
again
to
chairman
farmer's
point:
does
this
in
a
fiscally
conservative
way
in
a
limited
government
way
in
a
way
that
does
not
cost
taxpayers
millions
of
dollars?
And
it's
my
understanding,
there's
not
a
fiscal
note
associated
with
doing
it.

bill
that
you
voted
on

the
affirmative,

brought
now
again
three
times
and
in
representative
garrett's
bill

brought

you've

brought

the
qualifications

which

a
civil
action
in
which
the
complaint
meets
each

following
criteria
must
be
heard

determined

three-judge

panel
preserved

chapter
and
that's
in
under
2018-101
section
a
one,
two,
three
okay.
So
if
anything
triggers
this
action,
this
panel
will
be
selected
and
then
they
will
hear
the
case
from
the
very
beginning.

How
are
objections
going

ruled
upon
during
the
hearing
if
an
objection
is
made
to
evidentiary
matter
or
pre-trial

there
going
to
be
two
judges
and
they're
going
to
whisper
to
each
other
and
decide
how
they
going
to
decide
on
the
fly,
because
this
as
a
trial
matter,
is
just
simply
unprecedented?

The
actual
the
actual
legislation
addresses
that
2018
101
in
section
b6,
as
in
any
court
across
the
county,
they
can
have
its
local
rules
supreme
court
will
determine
what
their
rules
will
be
for
this
three
judge
panels.
In
other
words,
if
they're
going
to
have
a
motion
in
front
of
this
three-judge
panel
for
a
scheduling
order,
which
is
a
pretty
simple
procedural
motion,
one,
the
judges,
according
to
the
presiding
judge,
can
make
that
decision.

When
a
decision
becomes
dispositive,
which
means
it's
a
motion
to
dismiss
or
summary
judgment
they
can
get
rid
of
the
case
before
it
appears
at
trial.
Then
that's
when
the
three
judge
panel
will
have
to
make
that
decision
based
upon
the
majority
of
the
decision,
but
any
procedural
matters
that
are
not
substantive
in
nature
can
be
decided
according
to
the
rules
that
this
court
will
create
for
themselves.

judge

in
this
circumstance

presiding
judge

to
what
the
precedent
is

cited,
and

exactly
that
rule

going
to
be

was
brought

are
they
going
to
decide
among
themselves
that
one
of
the
three
is
going
to
decide
all
the
evidentiary
matters?
