range

different
public
policy
issues,
school
safety
zones,
community
safety
zones,
senior
safety
zones,
raising
a
fines
watch
your
speed
technology
photo
radar
coming
in
and,
of
course,
the
lowering
of
speed
limits,
which
is
another
example
of
the
hundreds
of
streets
that
were
making
safer
across
the
city.
So
it's
good
to
see
that
it's
here
and
thank
you
very
much
counselors
for
supporting
it.

This
morning
with
me,
our
transportation
engineer,
the
owner
is
present
as
well
to
the
extent
that
there's
questions
of
other
deputies
or
members
that
we
can
address
I
wanted
to
just
highlight
briefly
that
the
proposal
before
you,
which
is
outlined
in
the
staff
report,
actually
is
contemplative
of
218
units,
one
two
and
three-bedroom
units.
It
is
comprising
also
approximately
4,000
square
feet
of
retail.
This
orientation
shows
you
along
the
Majerle
frontage.

It
is
the
entire
block
bound
by
Marley,
Glen,
Karen
and
Hill
Mount,
and
it
does
provide
for
a
mid-rise
building
typology,
which
has
been
the
subject
of
actually
much
public
engagement.
We
actually
hosted
two
distinct
community
meetings,
one
an
informal
open
house
that
occurred
in
January
of
this
year
and
then
it
was
followed
by
a
meeting
in
March.

The
proposal
has
been
adjusted
to
provide
additional
three-bedroom
units,
and
we
are
adhering
to
the
mid-rise
guidelines
regarding
built
form
policies,
built
form
of
provisions
contained
within
the
mid-rise
guideline,
and
there's
also
consideration
to
the
growing
up
guideline
in
the
form
of
three-bedroom
units
and
the
size
of
those
units
are
still
to
be
determined
and
and
will
be
subject
to
further
review.
I
wanted
to
also
comment
briefly,
that
this
proposal
contemplates
a
section
37
contribution
that
will
assist
in
improving
parkland
in
the
neighbourhood,
as
well
as
other
community
facilities.

There
are
a
couple
of
concerns
raised
which
I'd
like
to
speak
to
very
briefly
and
first
and
foremost,
I'm
aware
of
item
number
6
of
the
correspondence
from
a
resident
area
that
has
made
comments
about
the
right-of-way
width.
We
do
comply
with
the
proposed
dedication
of
some
lands
to
comprise
Majerle
frontage
in
27
metres.
That's
something
that's
in
the
Official
Plan.

There's
comments
raised
by
the
other
deputies
and
about
privacy
and
I
want
to
just
highlight
that
in
relation
to
privacy
elements
we
are
providing
four
rear
set
backs,
there's
a
private
lane
at
the
rear
and
that
particular
area
will
provide
extensive
landscaping
in
the
form
of
not
only
a
fence
but
additional
tree
plantings.
That
was
comments
raised
by
community
members.
That
we've
incorporated
so
in
terms
of
responding
to
other
deputies
that
may
arise
through
the
speaker's
list.
Here
we're
happy
to
respond
to
any
questions.

Composition
of
both
hard
hard
surface
treatment
and
I'm,
it's
1.8
meters,
that's
within
the
the
boulevard,
in
addition
to
a
clear
way
that
extends
onto
the
property.
So
there's
a
setback
at
the
ground
level.
What
you're
ending
up
with
is
about
7/7
meters
or
so
to
the
curb
face,
which
is
quite
a
robust
area
for
landscaping
treatments
as
well
as
the
hard
surface
for
pedestrians
and
that's
a
key
element
that
is
still
subject
to
detailed
site
planning
counselor,
but
we're
confident
that
the
design
currently
envisioned
will
will
create
a
pedestrian
realm.

lighting
on
these
will
there
be
lighting
on
the
site's
property
rather
than
the
city
lighting
there
that
exists,
but
what
about
lighting
on
the
property
owned
by
the
development?
Will
there
be
any
thought
given
to
enhanced
lighting?

people
living
there,
but
so
what
about
lighting
on
Marley

So
we
do
we're
sensitive
to
some
of
the
surrounding
conditions
along
the
as
you
move
hill
mount
into
the
neighborhood
we'll
be
sensitive
to
that,
and
probably
program
may
be
low
lighting
for
those
areas
so
that
there's
no
light
spillage
on
to
the
existing
residential,
but
for
the
street
of
Marley
itself.
We
know
that
there's
there's
a
lot
of
work
to
be
done
to
make
sure
that
it.
It
really
sets
a
high
standard
for
lighting
for
pedestrian
realm
more
committed
to
do
that.

specific
tree
count
I'm

note

it

area

composition
of
what
this
looks
like
has
gone
through
some
revision,
so
we're
envisioning
right
now.
Essentially,
a
single
row
of
dense
coniferous
trees
and
in
fact
there
is
a
rendered
image
of
that
in
the.

So
what
we've
been
able
to
do
with
this,
and
this
this
plan
actually
shows
the
rear
configuration
the
access
to
the
underground
garage
is
here
and
access
to
there's
an
internal
loading
and
garbage
pickup
area.
That's
accessed
also
from
this
lane
way.
So
as
that,
a
great
it
is
that
great,
that's
correct,
so
there
would
be
it
would
be
contained
within
a
roll-up
door.

type

measurements

going

addressed
for
the
residents
in
the
area
so
that
our
privacy
issues
are

are
taken
into

one
of
my
questions.

access

thought

million

condo

built
next

residents,

right
to
voice
our
opinion.
It's
great
and
dandy
that
you
want
to
do
in
construction.
You
want
to
build
these
beautiful
high-rises,
but
has
anybody
taken
into
consideration
what
the
impact
will
be
on
the
actual
community
in
our
area
everywhere?
You
turn
around,
there's
condos
being
built.
It
takes
me
a
half
an
hour
to
get
from
my
home
to
and
I
only
live
down
the
street,
which
is
five
minutes
to
get
to
York
now
some
days.
The
impact
is
ridiculous
and
now
you're
gonna
add
another.

Two
hundred
and
twenty
units
I
would
think
really
strong
and
hard
about
that.
Why
do
you
want
to
destroy
a
beautiful
neighborhood
with
this
terrible
high-rise?
That's
going
to
be
rare,
but
a
place
up
there,
which
is
going
to
stand
so
out
of
place
in
a
neighborhood.
That's
been
there.
For
years
and
years
and
years,
we've
got
two
million-dollar
homes
in
that
area.

don't
want
to
wake
up
in
the
morning
and
face
my
neighbors
who
are
outside
having
coffee
or
throwing
your
cigarette
butts
down
this
down
onto
the
floor
because
you
know
they're
just
doing
whatever
they're
doing
during
day.
That's
that's
it.
That's
a
really
big
invasion
of
privacy
in
that
neighborhood,
so
I'm
here
today
to
defend
my
neighborhood
I,
strongly
recommend
or
be
more
meetings
and
to
try
to
come
to
some
kind
of
an
agreement
with
this
project
because
we
have
a
lot
of
upset
neighbors.

want

start
off
by
saying
that
we
are
in
support
of
development.
We
recently
supported
a
nine
story:
condo
development,
six
blocks
away
from
this
site
at
Bathurst,
England,
Karen
and
I've
gone
to
the
planning
department
and
I've
said.
Please
come
to
us
with
the
proposal
from
our
early
Avenue,
that's
equivalent
to
Bathurst
and
Glen
Karen,
and
we
will
support
it.

There's
been
a
lot
of
talk
about
how
do
what
is
morally
Avenue,
and
just
this
morning
you
all
voted
on
a
motion
to
put
a
light
in
at
lenka
and
Marley
and
I'm
not
going
to
tell
you
what
the
definition
of
Marley
Avenue
is.
But
in
this
document
it
clearly
says
that
Marley
Avenue
is
a
12-meter
minor
arterial,
road
Street
with
a
40
kilometer
speed
limit.

So
I
I
wanted
further
clarification
on
what
Marley
Avenue
is
and
I
got
an
email
back
from
Stephanie
to
zoo
assistant
planning,
and
she
tells
me
that
Marley
Avenue
is
also
a
two-lane
artillery
road.
It's
not
a
major
street
and
in
the
in
the
final
report,
you
can
read
it
at
least
on
at
least
on
one
page.
Planning
Department
wants
to
refer
to
Marley
Avenue
as
a
major
Road,
and
it
clearly
is
not
so
counts
are
cold.
You've
walked
up
and
down
Marley
a
hundred
times
a
thousand
times.

You
know,
Marley
Avenue
is
not
a
Bathurst,
it's
not
a
Dufferin,
it's
not
a
Lawrence.
It's
not
even
an
Eglinton
Avenue,
so
so
for
us
to
consider
supporting
a
proposal
for
development
on
Marley
Avenue
that
we
would
consider
for
Dufferin
or
Lawrence
or
Eglinton
is
preposterous.
It's
not
the
same
Road.
So
let's
take
a
look
at
how
we
get
to
a
twenty
seven
meter
right
away.
I
also
have
another
document
here
from
official
Plant
City
Toronto
schedule
one.
It
lists
all
the
roads
in
alphabetical
order
that
have
a
planned
right-of-way
expansion.

Avenue
is
not
on
this
list.
So
I
don't
know
where
people
are
getting
the
idea
that
Marley
Avenue
is
gonna,
be
a
four-lane
road
someday.
It's
just
not
it's
not
on
the
plan.
It's
not
designated
that
way
now
to
make
things
even
more
complicated.
This
whole
proposal.
The
justification
is
that
Marley
Avenue
someday
will
be
a
four-lane
road
and,
quite
frankly,
if
it
was
a
four-lane
road
or
going
to
be
a
four-lane
road,
and
this
proposal
came
to
us,
cows
are
called.

would
go
to
you
and
say
and
say
you
make
this
more
friendly
family
kondal

it
maybe
eight
or
nine
stories,
and
we
would
support
it,
but
the
building
department
has
had
several
applications
in
the
last
few
years
where
they
could
have

steps

initiate

widening
of
Marley
Avenue
they
chose
not
to
so.
These
are
just
a
few
examples.
In
the
a
few
years,
there's
been
four
proposals
that
I've
documented
and
there's
more
where
they
could
have
taken
the
opportunity
to
say
to
these
builders.

this
is
all
about
what
we
call
Marley
Avenue.
What
is
Marley
Avenue
today,
it's
a
12-meter
Road.
What's
it
gonna
be
in
a
year
a
12-meter
Road?

it
gonna

you
start
export
rating
properties
up
and
down
Marley,
including
my
house,
you're,
never
gonna
get
to
a
27
meter
right
away.
So
let's
call
it
what
it
is.
It's
a
minor
or
chillier
Road
with
two
lanes
and
the
development
should
acknowledge
that
we
should
have
a
condo
built
on
this
corner.
But
it's
not
a
condo.

Glen
Karen
is
that
all
the
units
are
family
friendly.
We
live
in
a
family
community.
We
have
17
units.
There
are
three
bedrooms
at
150,
some
odd
units
that
are
single
bedroom
at
Bathurst,
England
Karen.

the
units
are
two
and
three
bedrooms,
so
we
know
that
the
people
that
living
living
there
and
the
families
that
want
to
live
in
condos
are
going
to
move
into
that
building.
What
you're
gonna
get
here
at
the
corner,
with
150
single
bedroom
units,
it's
gonna
be
Airbnb
ease,
it's
gonna
be
very
transient.
It's
not
what
the
neighborhood
is:
it's,
not
a
family
neighborhood
it.

we're

blocks
away

two
blocks

live
three

four
blocks

doesn't

I'm
gonna
build
a
10-story
at

my

is
used
more
than
the
407,
then
Vaughan,

at
Vaughn
they
built
a
Taj
Mahal

mean
if
you
walk
into
the
Glen
Karen
subway
station.
It's
a
tiny,
boutiques
subway
station.

was
designed
years
ago
to
support
that
community
and
even
access
to
it.

want

draw
people
off,
it's,
it's
tiny,
so
I
think
it's
doing
its
job.
The
other
thing
we're
doing
with
Florence
Heights
just
up
the
street
is
we're
putting
5,500
people
into
that
location.
We're
gonna,
build
condos
up
and
down
every
10
Avenue
with
the
new
subway
that
subway
we'll
be
extensively
used.

lived
on
this
neighborhood
for
the
last
41
years
and
hopefully
spent
many
more
years
in
this
neighborhood.
Mr.
chairman,
members
of
the
Community
Council
I
had
told
myself
that
I
would
not
make
a
presentation
to
you,
because
after
years
of
painful
experiences
in
trying
to
keep
the
safe,
healthy,
vibrant
neighborhoods
and
those
are
the
words
found
in
many
places
in
the
Official
Plan
I
have
come
to
the
conclusion
that
you
really
can't
fight
city
hall.

The
the
speaker
for
the
proponents
before
me
never
mentioned
massing,
never
mentioned
height.
The
planning
staff
assured
us
that
they
they
were
taking
notes
and
that
they
would
take
into
account
the
community
concerns
well
from
the
results.
They
must
have
taken
selective
notes
of
what
is
being
recommended
to
the
community
council.
Very
few
of
any
of
the
significant
concerns
are
being
reflected
in
the
final
proposal.
The
summary
chart
of
revisions
on
page
8.

If
one
looks
at
it,
carefully
speaks
volume
when
compared
to
the
list
of
community
concerns
in
pages
10
and
11,
one
of
my
former
colleagues
in
one
of
his
decision
growth.
If
it
looks
like
a
duck
swims
like
a
duck
and
quacks
like
a
duck,
then
it
is
probably
a
duck,
and
this
is
what
you
have
before
you.

In
my
view,
they
have
selectively
gerrymandered
the
front
and
rear
setbacks
of
proposals
to
meet
the
45-degree
angle
guidelines
and
thus
increased
the
building
height
I
arrived
at
their
own
interpretation
of
the
City
of
Toronto
official
plan
and
given
the
widest
possible
emphasis
on
the
provincial
guidelines,
with
no
consideration
to
good
planning
principal
Mr.
Colley
I
would
invite
the
members
of
the
Community
Council
to
drive
on
Marley
Avenue
at
any
time,
but
especially
on
rush
hour
to
get
a
true
picture
of
the
situation
and
not
from
a
consultant
report.

What
is
happening
here
is
that
developers
have
seized
on
the
planned
desire
for
Marley
Avenue
and
knowing
that
this
is
mostly
a
working-class
and
seniors
neighborhood.
Without
the
means
to
fight
them
have
been
proposing
projects
that
they
were
never
there
to
suggest
on
Bathurst
Street
or
Avenue
Road
and
they're.
Getting
away
with
it.

I
would
respectfully
urge
the
Community
Council
not
to
deal
with
this
proposal
today,
but
to
send
it
back
to
a
community
meeting
the
majority
of
those
present
that
the
mandated
meeting
have
not
seen
this
final
report
subject
to
the
outcome
of
that
meeting.
I
would
urge
the
city
planners
to
review
what
is
being
proposed
in
light
of
the
appropriate
guidelines
in
the
Official
Plan.
This
project
should
be
treated
as
an
EM
filling
project
on
a
minor
arterial
road
and
not
on
a
major
street
you're.

out
and
not
proceed
on
a
proposal
to
proposal
basis,
but
a
run
overall
vision
over
people's
friendly
Marley
Avenue.
One
may
recall
the
words
of
the
late
Jane
Jacobs
during
the
on
an
expressway
Europe
cities

for
people
here
we
are
getting
the
people
without
the
supporting
amenities
and
the
consideration
that
are
crucial
to
the
stability
and
healthy
character
of
the
surrounding
neighborhood.

forward,
they
will
be
required
to
also
give
a
road
widening

plan

irrelevant
whether
it's
a
two-lane
road

a
four-lane
road
like
Bathurst,
if
it's

metres,
is

metres.

case
that
the
gentleman
earlier
mentioned
about
Bathurst
the
project
that
we
proved
that
bathrooms
that's
correct.
It's
a
four-lane
road,
but
with
very
small
sidewalks
and
Boulevard
widths,
and
that
was
also
a

meter
right
away
as
its
plan
along
Marley,
the
building
at
Bathurst
and
Glen
care,
and
although
9
storeys
is
32
and
a
half
metres,
excluding
mechanical
penthouse,
this
building
is
approximately
the
same
size
as
in
fact
lower
its

metres,
excluding
mechanical
penthouse,
but
it's

storeys.
So
the
bathroom
has
higher
floor
to
ceiling
heights.

terms
of
contextually,
the
height
that's
proposed
here
is
quite
appropriate

you
go
further
down
Bathurst

are
buildings
over

correct

contextually
is
what
the
surrounding
context
is

intersection

nine

story

planned
policy
context
that
we're

look

planning
context
here

mixed-use
site,
it's
not
an
Avenue
nowhere
in
the
Official
Plan,
it
says
you
must
have

mid-rise
building,
so
any
developer
could
have
come
here
and
proposed
a
taller
building.
What
we
were
successful
in
doing
is
convincing
the
applicant
to
stay
with
a
mid-rise
building.

That
is
really
well
sculpted,
as
you
can
see
from
the
rendering
at
the
rear.
It
generally
complies
with
a
forty
five-degree
on
your
plane
and
there's
multiple
multiple
terracing
at
the
back,
and
when
you
look
at
the
higher
floors
like
the
ninth
floor
and
the
10th
floor
there
in
fact,
over
20
meters
from
the
rear
lot
line
in
terms
of
setback.
So
at
the
lower
level
at
the
ground
floor
you
have
the
9
metre
setback,
the
driveway,
a
buffer
or
landscape
strip.

But
when
you,
when
you
go
higher
as
you
go
higher
up,
it's
it's
quite
a
distance
in
terms
of
the
higher
floors
distance
to
the
to
the
rear
property
line
and,
as
I
said,
that
the
10th
floor
is
about
26
meters
away

that
is
to
address
the
Overlook
and
privacy
issue
with
one
of
the
residents
addressed
earlier.

townhouse
development
up
further

single-family
homes
rebuilt

it

really
a
bit
of
a
hodgepodge
of
what's
happening
in
a
comprehensive
way,

so
I

see.

this
being
the
first
significant
development
on
this
section
of
Marley?
For
many
years
the
residents
have
a
right
to
be
anxious
and
concerned,
and
and
Marley
you
know
historically,
has
been
since
the
days
of
Esther
shiner
has
always

bypass
as
a
result
of
the
building
of
the
Allen
and
etc
etc.
So
it's
always
been
a
contentious
trafficked
area
and
there
are
continual
traffic
challenges,
as
there
are
on
all
the
streets
in
my
ward,
whether
it's
Bathurst,
whether
it's
Yonge
Street,
whether
it's
Avenue
Road
and
don't
even
talk
about
Dufferin.

So
Marley
is
part
of
this.
You
know
intensive
traffic
area
in
the
city
and
it
is
always
challenging
making
our
streets
safe.
The
the
other,
important
thing
to
mention
I,
think
in
all
of
this
discussion
about
this
proposal
is
that
Marley
needs
a
facelift.
We
have
had
some
serious
problems
in
the
community.
Over
the
last
number
of
years.

We've
had
police
action,
municipal
licensing
standards,
we've
had
gunfights
up
and
down
the
street,
and
the
community
is
also
asked
for
a
renewal
of
Marley
Avenue
that
the
status
quo
is
not
what
they
want.
They
don't
want
to
see
these
hodgepodge
buildings.
They
don't
want
to
see
the
strip
malls,
so
miry
is
changing.

want
to
see
good
quality
housing
and
they
also
tell
me
they
don't
want
social
housing,
they
don't
want
tea
CHC,
and
so
you
know
this
is
basically
at
market
condos,
and
so
it's
going
to
bring
working
people
into
the
area
and

entirely
on
top
of
everything
else.
The
area
sits
right
down
the
street
from
a
subway
station
that
nobody
uses.
Basically
it's
almost
up
there
at
bazarian,
because
in
that
area
of
Glen
Karen
and
Marley,
it's
all
single-family
homes.

here's
a
major
subway
investment
and
you've
got
single-family
homes
surrounding
it.
No
wonder
there
are
it's
a
very
little
usage
on
Glen,
Karen,
Station
and,
in
fact,
there's
another
entrance
down
on
the
view
mount
that

also
pretty
used
because
it's
surrounded
by
single-family
homes.
So
this
is
part
of
a
change
on
Marley.
That
I
think
has
the
potential
to
be
the
beginning
of
a
revitalization.
We
are
also
getting
the
developer
to
contribute
back
into
the
community.

really
used
on
Miley
and,

you
heard,
the
developers
say,
the
agents
say:
they've
also
purchased
a
property
on
I,
guess,
Miley
to
open
up
wonderly
Park
to
the
people
who
live
in

area,

right
now,
there's
just
a
narrow
walkway,
so
there's
potential
to
bring
in
better
quality
housing.
It's
getting
rid
of
some
of
the
hodgepodge
construction
and
putting
some
widening
of
the
sidewalk
widening
of
the
road,
because

of
that
land
is
going
to
be
dedicated
to
the
city.

much
as
it

difficult

appreciate
that,
perhaps
it
would
have

wonderful

have
six
storeys

existing
neighborhood

terms

development
site
is
located
mid
block,
unlike
all
of
their
townhouse
developments

vicinity

subject

gain
access
from
a
side
street
as
opposed

Bayview
Avenue
itself.

an
example,
the
townhouses
that
are
planned
at
two
will
get
Road
just
north
of
the
subject.

a
moment
to
focus
more
particularly
on
the
two
detached
dwellings
that
are
proposed

located
behind

seven
townhouses

Bayview

In
our
submission,
there
is
no
planning
rationale
whatsoever
that
justifies
these
detached
dwellings
other
than
the
accommodation
of
a
very
ambitious
building
program
that
is
out
of
keeping
with
the
size
and
location
of
the
subject
site.

Firstly,
these
two
detached
Dolan's
cannot
be
considered
neighborhood
houses,
some
of
the
baby
townhouse
design,
Cod
lands.
This
is
primarily
because
neighborhood
houses
are
required
to
meet
the
existing
zoning
bylaw
requirements
of
the
adjacent
neighborhood,
which
includes
respecting
the
prevailing
law
areas,
lot
coverages
and
setbacks,
which
these
detached
dwellings
do
not
further.
The
two
proposed
detached
dwellings
will
not
have
frontage
visibility
or
presence
on
a
public
street
which
serves
as
another
example
of
why
the
proposal
fails
to
meet
the
intent
of
the
baby
house
guidelines
as
well
as
good
planning.
More
generally.

In
addition
to
these
more
generalized
concerns,
there
are
also
a
number
of
more
specific
adverse
impacts
that
the
proposed
development
would
have
on
the
immediately
adjacent
neighbors,
such
as
my
clients.
Firstly,
the
application
would
have
the
effect
of
constructing
seven
townhouses
adjacent
to
my
clients,
front
yard
and
two
detached
alanis
adjacent
to
their
rear
yard.

Additionally,
the
rear
yard
landscaping
proposed
between
the
townhouses
and
the
existing
neighborhood
houses
is
inadequate,
particularly
because
the
two
detached
dwellings
are
proposed
to
be
shoehorned
in
between
the
townhouses
and
the
rear
yards
of
these
existing
neighborhoods
to
the
east.
A
proposed
front
yard
setback
to
the
townhouses
are
also
inconsistent
with
the
landscape
character
of
other
properties
that
front
to
Bayview
Avenue.
The
application
proposes
that
the
seven
townhouses
be
setback
between
six
and
seven
meters
from
Bayview
Avenue,
where,
as
the
governing
zoning
bylaws
require
a
minimum
setback
of
12
meters.

I
would
also
note
that
almost
without
exception,
existing
development
along
babyyou
Avenue
complies
with
the
1212
meter
minimum.
The
concern
with
the
way
the
seven
townhouses
interact
with
Bayview
Avenue
is
further
exasperated
by
the
fact
that
the
applicant
has
proposed
garbage
pickup
for
all
nine
dwellings
at
the
front
of
the
subject
site
and
along
Bayview
Avenue.
In
addition
to
the
obvious
aesthetic
concerns
with
having
collected
garbage
pickup
on
Bayview
Avenue,
this
approach
will
also
seriously
undermine
efforts
to
achieve
an
attractive
public
realm.

Overall,
this
is
a
neighborhood
that
is
characterized
by
substantial
detached
homes
on
large
locks,
with
generous
setbacks
and
landscaping.
The
proposed
townhouse
development
does
not
respect
or
reinforce
the
existing
character
of
the
neighborhood,
including
the
prevailing
building
types,
the
patterns
of
rear
and
side
yard
setbacks
and
the
incorporation
of
landscaped
open
space.
It
is
on
this
basis,
the
proposed
development
fails
to
conform
to
the
city's
official
plan
and
does
not
meet

intent
of
the
Bayview
townhouse
guidelines.

to

concerns
with
the
proposed
heritage
listing.
This
is
a
process
that
we
take
very
seriously
and
it's
one
that
we
believe
needs
to
be
done
right
with
proper
consultation,
especially
with
the
stakeholders
who
are
most
affected,
the
the
owners
of
the
very
properties
that
are
being
proposed
to
be
listed,
and
today
we
really
have
not
seen
much
meaningful
consultation.
As
you
may
know,
this
matter
was
initially
scheduled
for
the
November
12th
meeting
of
the
tpb,
and
there
was
a
notice
of
pending
staff
report.

With
this
deferral,
we
were
unfortunately
unable
to
schedule
a
meeting
with
staff
and
our
clients
team
and
our
clients
team
having
been
able
to
review
the
staff
report
in
their.
In
our
view,
the
staff
have
not
provided
a
compelling
rationale
for
why
the
properties
should
be
included
on
the
registrar,
we're
also
very
concerned
about
the
approach
that's
being
proposed.

Instead,
the
process
that's
being
proposed
by
staff,
achieves
a
similar
intent
as
an
HDD
without
the
procedural
safeguards
in
place,
and
we
think
this
is
something
that's
worth
further
conversation
and
discussion.
We're
also
very
concerned
that
this
process
is
a
bit
of
a
misguided
effort
to
do
heritage
planning
in
isolation.

clients
properties
are
not
included
in
the
recently
adopted
Don
Mills
secondary
plan
they're,
actually
outside
the
scope
of
that
secondary
plan
boundary
and
yet
they've
been
caught
up
in
this
batch
listing
process,
and
so
it's
concerning
that.

intersection

will
also
be
spurred
costing
the
deferral
today,
as
suggested
by
the
deputy
mayor
and
supported
by
mr.
Chang.

By
way
of
background,
our
client
has
approximately
2,000
employees
about
900
of
whom
work
at
the
Foresters
building
at
seven
eight
nine
Domino's
Road
as
owners
of
the
building
foresters,
is
also
landlord
to
approximately
35
tenants
in
the
building
forces
is
not
a
real
estate
company
or
a
developer,
but
nevertheless
has
been
thrust
into
a
number
of
different
planning.
Initiatives
very
recently
include
the
Domino's
Crossing
secondary
plan.

The
area
surround
the
forestry
site
was
largely
developed
in
the
early
1950s
and
continued
into
the
70s,
and
by
virtue
of
that,
the
site
design
the
site
design
the
built
forms.
The
densities
are
very
representative
of
that
era,
which
are
suburban
in
nature.
However,
the
Don
Mills
cross
from
secondary
plan
represents
a
much
more
contemporary
vision
for
this
area,
realizing
that
it's
undergoing
a
transition
to
a
more
urban
context,
particularly
because
of
the
establishment
of
higher
order,
transit
and
the
ongoing
evolution
of
the
area
into
a
higher
density.

Mixed-Use
community
to
date
for
stirs
has
actually
participated
in
work
collaboratively
with
staff
as
part
of
the
dominoes
crossing
the
Don
Mills
Crossing
secondary
plan
process.
However,
although
the
secondary
plan
expressly
recognizes
that
there
is
significant
redevelopment
potential
on
our
clients
site,
the
potential
listing
on
the
city's
register
describe
certain
suburban
components
of
our
clients
site
that
are
inconsistent
with
the
vision,
vision
of
the
secondary
plan.

Following
our
request
for
a
meeting,
we
were
actually
fortunate
enough
to
engage
with
some
preliminary
discussions
with
heritage
staff,
particularly
regarding
the
ways
that
these
recommendations
are
inconsistent
with
the
policies
that
are
alive
in
the
Dominos
secondary
plan.
We
also
discussed
the
challenges
of
operating
a
large
older
building
in
this
area
and
the
ways
that
heritage
listing
could
interfere
with
the
ability
to
undertake
maintenance
and
revitalization
efforts
in
order
to
ensure
a
healthy
office
campus.

These
discussions
were
particularly
timing
as
the
appeals
of
Domino
secondary
planners,
scheduled
for
a
case
management
conference
before
the
Local
Plan
Appeal
Tribunal
on
Wednesday
of
next
week.
We
will
be
in
attendance
on
behalf
of
foresters
at
that
procedural
event,
seeking
status
to
an
appeal.
That
is
related
to
the
Heritage
characteristics
of
the
foresters
site
and
believe
that
continued
flexibility
at
this
time
may
be
needed
in
order
to
resolve
those
appeals
based
on
the
progress
that's
been
made
to
date,
so
we
hope
it.

So
in
these
circumstances,
as
I
suggested,
we
ask
that
this
item
be
deferred,
at
least
with
respect
to
the
foresters
property
at
seven
eight,
nine
dominoes
road
in
order
to
allow
for
continued
discussions
between
our
clients
and
city
staff.
Alternatively,
if
you're
inclined
to
make
a
decision
today,
we
submit
there
accomodation
to
include
the
Foresters
property
on
the
city's
Heritage
Register
and
not
be
some
more
to
not
be
supported
by
Community,
Council
and,
of
course,
subject
to
any
questions
you
have.
Those
are
my

Toronto's
heritage
is,
as
you
know,
vitally
important
to
Toronto's
economy,
culture
and
spirit.
Toronto's
heritage
needs
to
be
understood
across
the
whole
City
of
Toronto.
Fundamentally,
that's
why
this
item
is
extremely
important
for
both
North
York
and
the
city
as
a
whole
and
represents
a
great
step
forward
for
heritage
protection
in
Darnell's
and
North
York
and
having
heritage
as
part
of
a
planning
study.
That's
what
that's
that's.

What
should
happen
that
you
you
on
the
front
end
you
look
at
heritage
and
so
that's
able
to
influence
the
evolution
of
the
projects
that
are
being
proposed
later
the
plan
and
then
for
leader
projects
can
be
influenced
by
by
what
you
find
out
about
the
history
of
the
area,
the
heritage
of
the
in
the
built
form
and
the
landscapes
of
the
area.
That's
ideal
and
that's
what's
happening
in
this
case.
So
a
modernist
architecture
is
North
York
in
North
York.

The
greatest
heritage
legacy
is
arguably
that
of
modernist
architecture
from
the
1960s
to
the
1980s
period
for
heyday
of
its
rapid
growth
and
development.
The
period
in
which
North
York
was
built
corresponds
with
the
period
in
which
tronto
grew
from
a
mid-sized
city
into
Canada's
largest
metropolis.
Not
only
are
modernist
buildings
in
North,
York,
unique
and
experimental.
They
are
artifacts
from
that
period
of
remarkable
growth
and
therefore
should
receive
in
the
same
respect
and
treatment
as
1920
Scott's
skyscrapers
in
New
York
City.

Modern
architecture
is
Don
Mills,
not
just
north
or
but
Don
Mills,
particularly
Don
Mills
Don
Mills
is
known
for
the
development
of
a
corporately
built
new
town
and
on
Toronto's
fringe
at
the
time.
It
also
represents
a
milestone
in
the
history
of
Canadian
commerce,
with
the
rapid
post-war
growth
of
industry
and
corporate
offices.
Canadian
and
international
corporations
moved
their
Canadian
headquarters
to
Don.
Mills
include
IBM
bata
shoes,
Imperial,
Oil,
Wrigley's,
North
York
community
involvement.

Ten
years
ago,
the
North
York
Community
Preservation
panel
recognized,
which
is
a
city
appointed
committee,
recognized
the
importance
of
modernist
architecture
in
North.
York
and
arranged
for
two
forms
in
successive
years:
2009
2010,
in
partnership
with
the
RA
architects
and
the
City
of
Toronto,
the
2009
event
was
coincident
with
the
release
of
a
spring
of
a
reprint
by
PRA,
architects
of
the
city
of
North,
Yorks,
North,
1997,
North,
Yorks,
modernist
architecture
report.
If
you'd
like
I,
can
give
you
copies
of
these
reports.

interested
a
year
later,
the
inventory
was
updated
and
additional
properties
were
were
identified
through
PRA,
the
1997
inventory
identified
over
200
modernist
projects
as
having
heritage,
value
and
worthy
of
protection.
However,
only
40
were
included
in
the
City
of
Toronto
inventory
of
heritage
properties
or
listed
at
that
time
further
to
the
2009
2000
it
informs.

support
the
staff
recommendation
that
the
identified
properties
be
included
in
the
City
of
Toronto
Heritage
Register.
So
the
question
raised
by
my
friends
earlier
was
of
deferring
this
item.

why
we

think

properties
have
been
on
less
for
the
last
30
years,
they've
been
studied
in
depth
in
the
last
two
years
through
the
CHR,
a
which
was
part
of
a
planning
study
which,

owners,
they
were
part
of
that
study.

had
two
lawyers

properties
out

they're
even

property

subject
to
a
demolition
permit
and
there's
no
replacement
requirement
for
commercial
buildings.
So
a
demolition
permit
could
be
issue
in
the
normal
course
of
Toronto
buildings
work

10

20
days,
depending

the
circumstances.
If
a
property
is
on
the
Heritage
Register,
what
puts
in
place
is
an
opportunity
for
City
Council
to
consider
whether
or
not
it
should
be
designated.

designation

happen

any

We've
certainly
had
properties
that
have
been
designated
even
when
things
are
in
the
middle
of
a
tribunal,

the
tribunals

upheld

that
actually
can
be
relevant
even
after
an
application,
because
it's
a
separate
legislation.
That
obviously,
is
not
ideal.

hope
is
that,
through
initial
listings,
we
are
at
the
beginning

a
conversation

understand

evolution

the
site
and
we
recognize
that
some
of

attributes
seem
expansive,

alarmed

idea
that
heritage
conservation

a
very
intentional
part
of
the
planning
process

is
not
the
city's
intention

heritage
to
limit
growth.

aware

building

to

described

buildings

listed
because
of
its
cut
the
cladding
on

it
clad
within
the
last
twenty
years,
which
is
inconsistent
with,

it
being
the
hair,
the
cladding
being
of
a
heritage,

question

they
really
done
their
homework?

think
that
we
need
time
to
the

applicants

spare

owners
here
do
need
some
time
and
I
would
say
that
they
deserve

we
arrived,

began
to
produce
fruit,

hazelnut

fruit,
our
clusters
of
thick
softly
spiny
and
bristly
husks
that
are
2
to
3
inches
in
size
as
quickly
as
the
fruits
of
the
tree
arrived
so
did
squirrels,
ants
bees
and
wasps
to
relish
in
the
nuts
and
south.
We
have
since
been
inundated
for
the
last
ten
years
with
this
fruit
through
the
months
of
July,
August
and
part
of
September.

Almost
every
year,
as
noted
by
our
arborist
report,
the
fruit
is
a
slip
and
fall
hazard
to
pedestrians
on
the
sidewalk
vehicles
parked
underneath
it
into
anyone
attempting
to
navigate
around
them
to
our
home,
ravaging
squirrels
spit
out.
The
shells
and
drop
the
fruit
to
the
ground
below
the
sidewalk
is
littered
as
well
as
stained.
We
are
attacked
by
bees
and
wasps
attracted
to
the
fruits
and
nuts
and
SAP,
and
we
would
really
like
this
to
stop.

We
could
no
longer
park
our
vehicles
in
our
own
driveway
around
the
road
during
the
summer
months,
while
we
pay
for
city
driveway,
widening
parking
permits,
we
cannot
use
her
driveway
25
percent
of
the
year
and
are
forced
to
shuffle
our
cars
to
neighboring
streets
each
day
to
prevent
property
damage
to
our
vehicles.
Notwithstanding
these
preventative
measures,
their
cars
has
sustained
significant
damage.
Each
year
urban
forestry
made
reference
to
an
application
in
2010
to
remove
the
subject
tree
and
that
was
approved
in
principle
following
the
involvement
of
the
local
councillor.
O
2010
was
significant
because
that
was
a
year
that
I
had
a
heart
attack.
It
wasn't
due
to
the
tree,
however,
my
family
was
young
and
my
wife
was
working
and
I
was
the
only
one,
who's
cleaning
up
the
Turkish
hazelnuts
three
times
daily
and
I
was
now
unable
to
do
so.
We
deemed
enough
was
enough
then,
and
we
believe
that
the
tree
should
be
removed.
The
report
also
noted
that
two
requirements
to
proceed
with
removal
were
never
met
and
the
matter
was
closed.

We
disagree
with
this
and
consider
the
matter
still
open
with
respect
to
a
requirement
number
one.
We
were
told
to
have
five
replacement
trees
planted
for
the
tree
to
be
removed.
This
has
been
accomplished
since
2010
on
st.
Germain
Avenue
house
number
211,
a
9
to
12,
199
and
193
are
just
a
few
and
our
immediate
neighbor
that
have
new
trees
requirement
number
to
payment
for
the
appraised
value
of
the
tree.

The
apple
tree
policy
states,
city
of
Toronto,
urban
forestry,
may
remove
healthy
apple
or
crabapple
trees,
where
such
trees
are
located
on
City,
boulevards
and
result
in
fruit,
falling
onto
city,
sidewalks,
private
walkways
and
driveways
nearby.
Creating
a
potential
safety
hazard
approval
is
subject
to
the
requirement
that
the
adjacent
property
owner
submit
payment
in
the
amount
of
$350.
The
keywords
are
fruit,

2010,
we
were
asked
for
3000

for
a
permit
to
remove
this
fruit
barren
tree
and
now
we're
hearing
asked
for
5048
for

highways
due
to

of

difficult

forestry

review
the
tree

in

wife
and
I
agree
that
the
city
owned
Turkish
hazelnut
tree
in
front
of
our
home.
It's

Germain
Avenue,
is
a
lovely
tree.
However,
we
argue
that
this
tree
had
never
been
planted
on
the
boulevard
in
her
neighborhood.
It's
a
nuisance
in
a
hazard
to
ourselves,
our
neighbors
and
community.

It's
become
too
difficult
for
us
to
maintain
and
manage
our
life
around,
and
we
please
ask
that
you
reject
the
recommendation
of
urban
forestry
and
please
allow
this
tree
to
be
removed.
We
ask
that
the
three
hundred
fifty
one
dollars
and
61
cents
that
we
paid
the
city
for
our
application
to
remove
the
tree,
be
the
cost
of
the
permit
to
do
so,
and
so
the
city
please
arrange
to
remove
this
tree
as
soon
as
possible.

summer
was
horrendous.

was

worst

damaged
that
the
paint
was
actually
removed.

longer
have
that
vehicle
any
longer
and
one
of
these
nuts
called
well.
There
are
Turkish,
hazelnuts,
I,
don't
know
what
they're
called
hazelnuts.
The
tree
is
a
Turkish
hazelnut
and
they
produce
a
nut.

knowledge
from
from
that
time
of
the
year,
I
suspect
that
the
bees
and
wasps
are
being
drawn
to
the
secretions
from
Athens.
So
my
suspicion
is
that
the
tree
has
Athens,
which
is
not
unusual.
Many
trees
are
host
to
Athens
at
non
threshold
levels
and
the
aphids
secrete
honeydew,
just
like
they
would
in
houseplants,
and
the
bees
and
wasps
are
likely
being
drawn
to
that
they're
also
drawn
to
that
on
the
ground,
as
well
as
on
the
leaves
and
cars,
and
anything
like
that.

wouldn't
know
in
advance
when,
at
the
time
of
fruit
formation,
we
wouldn't
know
if
it's
going
to
be
a
heavy
year
or
a
light
year,
but
in
terms
of
standard,
our
bora
cultural
practice,

pruning

would
be
required
to
effectively
remove
the
fruit
before
it
forms
would
not
be
desirable
for
the
for
the
tree
in
terms
of
the
the
city's
maintenance
of
its
asset.

normal
maintenance
pruning.
There
is
a
mechanism
to
allow
the
adjacent
owner
to
undertake
that
pruning
at
their
own
expense,
but

would
also
caution

acceptable
would
be
limited
and
would
be
commensurate
with
the
mitigation
of
the
of
the
fruit
problem.

decline

pruning

tree

accepted
horticultural
pruning
practices
to
ensure

tree

done
a
reputable

is

meters
on

kilometer

place
to

moving
the
staff
recommendations
with
an
amendment
that
City
Council
direct
that
the
acting
director
traffic
management
endeavour.

install

signal
as

on

lack
of
a
safe
pedestrian
crossing
for
the
770
meter
stretch
of
Sheppard

the
type
of
location
that
we
keep
reading
in
the

has
hit
and
killed,
and
it's
kind
of

miracle
