A
C
Thank
you
very
much
well
good
morning,
everybody
happy
new
year.
My
name
is
councillor
james
pasternak,
I'm
the
chair
of
the
north
york
community
council
clerk
has
confirmed
that
we
have
quorum.
I'd
like
to
call
meeting
21
to
order
and
welcome.
Everybody
meeting
is
being
held
using
the
city's
webex
technology
with
members
of
council
participating
by
video
conference
city
staff
are
also
connecting
to
the
meeting
by
video
conference.
A
city
hall
remains
closed.
C
The
public
continues
to
participate
electronically
and
can
watch
the
meeting
streaming
live
on
youtube
at
youtube.com,
backslash
toronto
city
council
live
because
we're
a
meeting
remotely.
We
ask
for
your
patience
for
any
delays
and
technical
issues.
We
currently
have
two
people
registered
to
speak.
We've
been
connected
by
the
meeting
by
audio.
The
list
of
speakers
can
be
viewed
online
by
visiting
north
york
community
council's
page
at
toronto.ca,
backslash,
council
and
clicking
the
speakers
box
for
today's
meeting.
C
Before
we
begin,
I
want
to
remind
you
the
important
health
and
safety
measures
that
we
must
follow
today.
Tenants
in
the
room-
and
I
guess
clerks
myself
are
all
working
remotely
today-
is
limited
to
those
persons
who
are
required
for
the
meeting.
Audio
visual
I.t
staff
are
at
city
hall,
helping
conduct
the
meeting
members.
This
is
a
paperless
meeting.
City
clerk
has
provided
all
agenda
materials
via
cmp
the
clerk's
meeting
portal,
including
any
confidential
materials.
C
I'd
like
to
remind
staff
to
keep
their
mics
muted
with
their
videos
turned
off
unless
they
need
to
answer
questions
or
speak
to
the
committee.
This
will
make
it
easier
for
me
as
chair
and
for
those
watching
on
youtube
to
observe
members
as
they
participate
in
the
debate
and
vote
on
items
as
part
of
each
agenda.
Item
allows
members
to
raise
their
hand
or
unmute
their
mic
if
they
wish
to
question
staff
or
speak
I'll,
then
create
a
speaker's
list
and
we'll
call
on
members
when
it's
their
turn
to
speak.
C
When
voting
on
an
item
or
motion,
I
ask
that
members
ensure
that
they
turn
on
their
video,
if
applicable
and
raise
their
hand
to
indicate
their
vote.
I'm
sure
I
can
see
all
members
that
ask
you
to
keep
your
hands
raised
until
I
reviewed
all
members
votes
members
I
want
to
remind
you-
must
still
submit
your
approve.
Your
motions
by
email
and
staff
are
available
nycc
at
toronto.ca
to
help
with
motions.
C
C
We
also
acknowledge
that
toronto
is
covered
by
2013
with
the
mississauga
of
the
credit.
Are
there
any
declarations
of
interest
under
the
municipal
conflict
of
interest
act?
If
you
do
have
an
interest,
please
raise
your
hand
and
then
mute
your
mic
and
indicate
which
item
and
the
nature
of
the
interest.
C
I
don't
see
any
hands
going
up.
Okay,
we're
good!
Next,
we
need
to
confirm
the
minutes
for
our
last
meeting
on
december.
The
3rd
2020.
Can
I
have
someone
move
the
minutes
so
move
mr
chair,
counselor
carol.
Councillor
carol
moves
them
all
those
in
favor
posed
and
that
is
carried.
C
We
have
a
number
of
new
items
that
are
going
to
be
added
to
the
agenda.
Why
don't
we
just
take
them
as
a
package?
C
Some
of
them
seem
to
be
on
the
demolition
side.
So
all
I
hope
everyone's
taking
a
look
at
what
they
are
all
those
in
favor
of
adding
the
seven
new
items
to
the
agenda
posed
that
is
carried
now.
The
first
item
of
business
is
clerical
nature,
I'm
I'm
just
filling
in
his
chair
for
today's
meeting,
but
we
need
an
election
of
a
chair.
D
D
D
C
C
Yes,
I
I
would
nominate
councillor
cara.
D
D
C
Okay:
let's
go
through
the
agenda
for
non-timed
items.
There
has
been
a
request
by
councillor
cole
to
look
at
items
21-9
and
21-10,
but
we
might
be
able
to
deal
with
them
quickly
as
we
run
through
the
agenda.
So
if
they're
held
counselor
call,
we
will
move
them
to
the
top,
because
council
costs
to
leave
soon.
C
It'll
be
a
scandal:
it'll
be
travelgate;
okay
item
21.5,
preliminary
report,
zoning
bylaw
amendment
rental,
housing,
demolition,
applications,
109,
erskine,
avenue,
councilor,
robinson.
G
C
F
C
You
can
do
it
yeah
yeah,
I've
already
done
it:
okay,
okay,
fair
enough
21-6,
all
those
in
favor
opposed
that
is
carried
21-7
preliminary
report
official
plan
and
zoning
bylaw
amendment
application,
105,
shepard
avenue,
east
24
and
26
leona
drive,
counselor
fillion
I'll
move
staff
recommendations,
staff
recommendations
moved
on
21-7,
all
those
in
favor
opposed
that
is
carried
21-8.
Removal
of
taxi
cab,
standupon
streets,
north
of
sheppard
avenue
west.
That
is
my
award
I'd,
be
happy
to
move
the
staff
recommendations.
C
All
those
in
favor
posed
that
is
carried
now
accounts
are
called.
These
are
the
two
items
you
wanted
to
complete
before
departure.
So,
let's
see
what
happens
here,
21-9
payment
in
lieu
of
parking,
2586
young
street.
C
Okay
staff
recommendations
move
on
21-9
all
those
in
favor
opposed
that
is
carried
2110
traffic.
Calming
roosevelt
avenue
once
again,
council
report.
C
C
C
It'll
get
better
21-11
car
share
vehicle
parking
areas,
two
awards
involved,
counselors,
robinson
and
phillian.
E
C
Okay,
stop
it
yeah.
Okay,
all
those
2111
car
share.
Vehicle
parking
is
being
moved.
All
those
in
favor
proposed
that
is
carried
2112
youtube,
prohibition,
fresh
meadow
drive,
counselor
carol,.
A
Sorry
about
that,
yes,
yeah
I'll
move
staff.
Recommendation
staff
recommend
approval.
C
C
C
Okay
staff
recommendations
moved
on
21-14
all
those
in
favor
opposed
that
is
carried
2115
naming
of
an
existing
public
lane
in
a
block
bounded
by
don
lee
drive,
lair,
drive,
eglinton
avenue,
east
and
sutherland
drive
council
robinson.
C
That
is
carried
2116
is
a
timed
item
with
a
deputent
and
21
17
has
a
debutants
timed
as
well.
A
C
You
read
my
mind:
I
was
just
going
to
go
to
the
new
items
which,
which
are
obviously
not
timed,
and
I
don't
know
if
anyone
wants
the
demi-
that
deputy
be
a
deputy
on
that
there's.
A
lot
of
demolition
here.
A
A
Yes,
so
mr
chair
items
19
through
23.
the
reason
they're
in
separate
reports
well,
while
they're
being
walked
on
as
new
items.
It's
because
this
is
all
one
site.
It's
all
part
of
one
development,
but
they
they're
still
in
separate
lots.
That's
that
a
semblance
of
the
lot
hasn't
happened,
but
they
need
to
be.
The
demolition
needs
to
to
go
on,
because
this
site
badly
needs
to
be
cleaned
up.
A
So
staff
rushed
the
report,
but
when
they
had
to
do
all
of
the
separate
reports
they
didn't
get
them
done
in
time
for
the
deadline.
That's
that's.
The
only
reason
that's
being
walked
on
these
are
staff's
actual
demolition
reports
and
so
through
19-23
all
speak
to
the
same
development
site
and
I'm
happy
to
move
each
of
those
items
with
the
number
three.
The
cleanup
conditions
being.
A
D
B
A
No,
these
are
our
single
family
dwellings
that
have
been
vacant
for
some
time.
It's
part
of
the
reason
we're
asking
them
to
demolish
now,
even
though
they
they're
not
picking
up
the
building
permit
right
this
very
day,
we're
asking
to
do
the
demolition
and
and
conditions
of
number
three,
because
there's
a
there's,
an
infestation
problem,
because
the
homes
have
been
vacant
for
so
long.
B
Yeah,
oh
okay,
so
no
tenant
issues
at
all
leave
because
often
single
homes
that
have
been
owned
by
someone
for
a
while
will
have
tenants
and
cumulatively
they
could
have
more
than
four
out
of
six
units.
B
Know
legal
staff
used
to
be
very
concerned
with
any
demolitions
that
might
kind
of
usurp
the,
but
as
long
as
you've
checked
that
out,
that's
fine.
Thank
you.
A
C
C
So
we
can
vote
on
21
there
we
go
2118
through
2123.
D
C
I
kind
of
had
a
feeling
you
jump
in
okay,
all
right,
so
we're
gonna
have
to
go
through
each
one.
21-18,
it's
been
moved
all
those
in
favor.
C
Opposed
that
is
carried
21-19.
C
2120,
all
those
in
favor
host
that
is
carried
2121,
all
those
in
favor
post
that
is
carried
2122,
all
those
in
favor
posed
that
is
carried
2123.
C
All
those
in
favor
opposed
that
is
carried
and
we
have
another
2124
is
another
walk-on
motion.
Clancy
drive
parking
prohibition,
counselor
carol.
A
Yes,
thank
you,
mr
chair,
just
very
quickly.
This
is
this,
is
I
know
another
one
that's
been
walked
on
as
a
new
item.
A
Ordinarily,
what
you
would
do
is
is
bring
a
emotion
asking
staff
to
conduct
a
poll,
but
this
is
a
pretty
dire
situation,
particularly
if,
if
there's
an
accumulation
of
snow
and
so
staff
recommended
that,
if
we
didn't
mind
letter,
dropping
and
doing
the
poll
ourselves
and
giving
the
results
to
them-
and
the
situation
here
is,
is
so
dangerous
that
in
fact
the
for
the
for
my
first
time
ever,
I
don't
know
about
the
rest
of
you.
C
Okay,
so
2124
clancy
drive
parking
prohibition.
The
staff
recommendations
are
being
moved
all
those
in
favor
opposed
that
is
carried.
C
E
Okay,
well
I'll,
just
I'd
like
to
say
a
few
words
on
this
application,
because
a
lot
of
hard
work
has
gone
into
it
and,
as
you
can
see
by
looking
at
it,
it's
incredibly
well
researched
and
detailed
report.
So
I
would
like
to
start
mr
chair
by
thanking
our
planning
staff
for
this
excellent
report.
I
have
to
say
for
the
better
part
of
this.
E
Last
year,
jason
brander
has
had
a
very
difficult
task,
as
our
planner
reviewing
every
single
application
in
the
young
edmonton
neighborhood
and,
as
you
all
know,
they
are
pouring
in
the
applications.
I
have
two
planning
meetings:
public
planning
meetings
just
this
week
alone.
E
It's
quite
unsettling,
and
this
is
no
easy
task
that
jason
has
been
faced
with
and
he's
done
an
excellent
job.
I
also
want
to
thank
jason's
manager,
al
rozowski,
all
of
you
know
him
and
and
his
attention
on
this
file.
E
It's
also
important
to
highlight
the
fact
that
local
residents
have
been
very
engaged
on
this
and,
quite
frankly,
we've
had
newly
formed
residence
group
as
a
result
of
this
very
aggressive
proposal
that
is
mid-block
and
will
really
change
the
face
of
of
this
area
if
approved.
So
I
want
to
thank
the
newly
formed
totten
residence
group.
They've
done
a
great
job
and
very
engaged
worked
very
hard.
Sarah,
the
south
eglinton
repairs
and
residents
association
and,
all,
quite
frankly,
all
the
neighbors
who
have
been
involved
in
this
application
in
the
in
the
area.
E
In
the
immediate
area
we've
received,
countless
emails,
we've
had
countless
conference
calls
and
virtual
meetings.
So
thank
you
very
much.
It's
always
disappointing
when
applications
are
appealed
to
lpat
in
advance
of
the
city
coming
up
with
their
decision.
I
find
that
very
you
know
this
circumventing
the
planning
process
in
toronto
is
very
frustrating
and
it
just
happens
constantly
now.
E
Certainly,
in
my
word,
when
this
application
was
originally
submitted,
I
would
like
my
colleagues
to
know
it
was
actually
a
mid-rise
building,
a
story,
but
after
the
minister
of
municipal
affairs,
unilaterally
overhauled
the
city
council
approved
young
eglinton
secondary
plan
you'll.
Remember
it
well
midtown
in
focus
the
heights
just
went
gangbusters,
so
they
actually
basically
got
rid
of
all
our
height
limits
and
put
on
their
own
and
made
them
extraordinarily
high.
E
This
application
was
resubmitted
after
being
nine
stories
to
27
stories,
and
if
you
haven't
seen
a
picture,
you
know
a
visual,
a
visual
always
helps.
So
here
we
go.
Here's
a
good
here's,
this
beautiful
neighborhood-
and
I
don't
know
if
you
can
see
this
but
boom
up,
screwing,
this
so
or
that's,
what's
being
proposed.
E
I
think
planners
have
done
an
excellent
job
and
I
just
I
just
really
concerned
still
to
this
day
about
the
province's
role
and
again
circumventing
and
basically
years
of
consultation
and
work
went
into
this
midtown
in
focus
years
of
it
by
so
many
people,
including
planners
the
local,
counselors
and
and
residents,
and
it
was
all
turned
on
its
head.
E
So
I'm
just
really
happy.
I
can't
tell
you
how
happy
I
am
with
how
detailed
this
report
is
and
nuanced.
E
I
think
that
it's
one
of
the
best
reports
I've
seen
that
has
come
out
of
planning
and
I
think
we,
I
hope
that
you
will
join
me
in
in
supporting
this.
This
report
today
and
I
hope
the
residents
continue
to
stay
engaged.
The
tdsb
has
expressed
their
strong
opposition
to
this
application
because
of
school
capacity
issues
in
the
area,
and
we
just
want
to
build
a
great
city-
and
this
is
not.
This
is
not
good
planning.
E
This
is
clearly
not
good
planning
for
multiple
reasons,
including
the
fact
that
it's
that
it's
it's
not
a
mid-rise
and
where
it
should
be
at
mid-rise,
and
it's
not
it's
mid-block,
it's
mid-block.
So
I
could
go
on
about
this
application
for
hours,
because
so
much
time's
been
invested,
but
I'll
wrap
it
up
there.
Thank
everyone
involved
and,
and
really
just
want
to
again
thank
the
planners
for
such
a
great
report.
C
Thank
you,
councillor
robinson
councillor,
carol.
A
Yes,
mr
chair,
probably
my
question
is
it
can
be
a
question
of
the
mover
and
it
would
speed
things
up.
Council
robinson,
I'm
facing
a
similar
challenge
because
of
provincial
action
up
along
the
shepherd
avenue
secondary
plan,
although
they
didn't
go
to
the
extra
mile
of
rewriting
the
plan
and
making
it
a
law,
their
intensification
around
the
shepherd
subway
stations
are
causing
me
the
same
problem
where
it's
a
shallow
site
and
a
single
family
dwelling
right
behind
it.
A
A
And
if
there,
if,
if
by
some
miracle,
we
didn't
have
to
fight
it
because
they
they
came
to
their
senses
and
you
had
a
minutes
of
settlement
that
would
come
to
council
anyway,
and
I
could
read
that
yeah,
that's
correct,
okay,
that's
the
plan!
Okay!
Then
then,
then
I
won't.
I
want
to
unpack
this
neighborhood
problem
right
here
and
now,
but
I
I'd
love
for
you
to
keep
me
posted
because.
G
A
And
I'll
stay
I'll
stay
in
touch
with
planners,
because
it's
it's
causing
us
the
bill.
108
is
causing
us
the
same
problem
along
shepard
after
after
years
of
trying
to
to
control
that
it's
now
open
season
on
the
shallow
sites
that
have
single
family
dwellings
right
behind
them.
Thank
you
for
your
fight.
E
Yeah
so,
mr
chair,
I
would
like
to
to
move
staff
recommendations.
C
Okay,
thank
you.
Council
robinson
recommendations
moved
on
21-3
all
those
in
favor
opposed
that
is
carried
21-4.
Also
timed
item
for
9
45..
I
don't
see
any
deputies
on
this
item
request
for
directional
report
official
plan
and
zoning
bylaw
amendment
applications,
40
42,
44,
46
and
48
hendon
avenue,
calcium.
C
C
It
is
application
to
remove
a
private
tree
at
147,
fenn
avenue,
and
we
do
have
a
deputy
on
this.
I
item
is
sandy
roma's
on
the
line.
H
Yes,
thank
you.
I've
come
to
council
to
appeal
an
application
submitted
to
forestry
in
march
2020
to
remove
a
private
tree
from
my
property
after
the
application
was
denied.
I
was
in
touch
with
councillor
robinson's
office
and
various
staff
from
forestry.
In
july
2020
I
received
an
email
from
forestry
stating
the
following.
H
H
I
live
with
my
spouse
and
my
elementary
school
age
child
at
147,
fen
avenue
the
honey
locust
tree
is
located
in
the
rear
of
my
yard.
I
live
with
disability
and
have
mobility
issues.
The
purpose
of
the
request
is
because
the
tree
is
hazardous
and
impedes
accessibility
from
the
pathway
to
access
and
enjoy
my
backyard
from
the
side
of
the
house
due
to
an
aggressive
root
system.
H
The
tree
has
multiple
roots
above
grade
and
has
lifted
the
pavers,
rendering
the
patio
inaccessible
or
challenging
to
pass
over
with
per
for
persons
with
assisted
devices,
wheelchairs,
walkers,
canes
and
such
and
for
those
who
suffer
from
stability
and
mobility
issues.
There's
risk
of
injury
and
toppling
over
and
a
tripping
hazard.
The
tree
and
root
system
has
altered
the
grading
of
the
area
so
that
water
no
longer
runs
away
from
my
home,
but
rather
towards
the
home,
causing
a
pooling
effect.
H
This
is
likely
causing
a
compromising
situation
on
the
foundation
of
my
home,
as
we've
experienced
some
dampness
in
the
basement
area
in
recent
months,
it
is
likely
to
get
worse
over
time
and
cause
further
damage,
if
not
removed
the
also.
The
proximity
of
the
tree
to
our
home,
slight
lean
and
canopy
are
also
likely
to
cause
serious
damage
to
our
home,
should
it
be
compromised
by
natural
causes.
H
The
tree
is
currently
two
to
two
and
a
half
meters
away
from
my
from
the
back
of
my
house,
the
damage
there
has
been
damage
to
our
property
from
two
trees
of
similar
condition
and
vintage
in
recent
years.
The
roots
are
approximately
20
centimeters
above
grade
in
certain
areas
and
in
parts
of
the
walkway
and
significantly
more
at
the
base.
It
appears
to
lean
towards
the
house.
The
canopy
of
the
tree
is
beyond
the
roof
line
and
much
is
directly
over
my
home.
H
H
H
If
this
is
if
this
had
been
anyone
other
than
the
resident,
I
hate
to
think
what
the
liability
would
have
been:
insurance
wise,
removing
the
tree,
creating
an
accessible
and
stable
pathway
and
patio
mitigates
risk
and
liability
to
people
and
property.
As
a
homeowner,
I
feel
I'm
doing
the
responsible
thing
by
my
appeal.
H
Forestry
suggested
that
the
walkway
can
be
repaired.
I
don't
believe
this
is
a
viable
solution
in
order
for
the
patio
and
walkway
to
be
repaired
without
injuring
and
removing
the
tree
roots
would
mean,
I
would
have
to
raise
the
grade
of
the
area
of
the
path
conservatively
that
could
be
close
to
30
centimeters
of
soil
above
the
current
grade,
basically
to
smother
the
roots
with
the
tree
intact,
and
the
amount
of
elevation
required
to
level
the
path
and
make
it
safe
and
accessible.
H
As
such,
I
have
briefly
explained
how
the
recommendation
to
prune
or
treat
or
cut
or
rem
leave
the
tree
or
fix
the
walkway
by
rebuilding
the
sub
layer
and
relaying
stones
would
not
solve
the
accessibility,
issues,
drainage
or
liability
of
to
persons
or
property.
I
suspect
it
would
be
highly
unlikely
that
I
could
satisfy
building
code
requirements
for
accessibility
requirements
with
this
recommendation
too.
As
such,
this
would
not
resolve
any
issues
that
the
tree
and
root
system
impose
based
on
my
application
as
a
homeowner
taxpayer.
C
H
H
And
taxpayer
one
would
hope
to
feel
safe
enough
to
be
able
to
access
and
your
property
with
the
needs
and
requirements
that
you
have
this
current
health
crisis
has
made.
It
has
obviously
impacted
us
all,
and
we
know
that
isolation
and
risk
is
magnified
for
the
elderly
and
disabled
and
children.
I
think
that
the
quality
of
life
and
safety
of
people
in
our
community
is
valued
and
recognized,
whether
it
be
in
public
or
private
property.
F
H
So
I'm
just
asking,
I
don't
believe
that
this
would
be,
as
mentioned
in
my
comments.
The
reason
why
I'm
really
here
is
because
the
the
forestry
bylaw
does
not
address
my
my
issues
or
conflicts,
so
I'm
hoping
that
you
might.
G
H
Able
to
to
bring.
C
C
A
Yes,
well,
it
was
just
a
quick
question
of
staff.
I
note
that
in
the
report
you
said
that
the
arborist
report
that
accompanied
the
application
did
not
give
a
condition
for
the
tree.
Do
we
not
do
we?
Is
that
not
explicit
in
in
our
instructions
for
for
applying
for
a
tree
removal
that
the
arborist
report
should
tell
us
what
the
condition
of
the
tree.
G
Is
I
hope
everyone
can
hear
me
through
you,
mr
chair,
it's
a
standard
component
of
an
arborist
report,
but
there's
no
fixed
format
for
arborist
reports
and
it's
not
uncommon
for
them
to
be
written
in
sort
of
a
free
form,
and
in
this
case
we
were,
you
know
in
reviewing
the
arborist
report.
It
doesn't
specifically
state.
You
know
this
tree
is
in
xyz
condition.
A
G
C
E
Okay,
so
I
just
want
to
expand
on
counselor
carol's
question
staff
had
relayed
to
our
office,
not
me
directly,
but
to
my
office
that
indeed
it
was
a
completely
healthy
tree
and
maintainable
is.
Is
that
actually
can
we
get
clarification
on
that?
Because
I'm
I'm
now
confused.
G
Through
you,
mr,
yes,
that's
correct
the
the
context
of
the
application.
In
this
case
it
was
submitted
as
a
non-construction
request,
and
so
much
of
the
information
that
the
deputy
spoke
to
is
not
information
that
we
can
consider
for
us.
It's
simply
a
request
related
to
the
removal
of
the
tree.
G
G
G
E
And
there
was
the
deputy
my
resident,
and
I
am
grateful.
She's
come
today
and
explained
her
position,
but
we're
trying
to
as
a
council
we're
trying
to
figure
out
how
to
navigate
this.
It
seems
like
a
difficult
one,
but
there
was
talk
about
uneven,
patios
and
and
threats
to
the
foundation.
E
Is
that
something
that
that,
like?
What's
your
position
on
that?
What
what's
your
perspective
on
this.
G
The
the
are
if
this
were
a
construction
related
application,
the
construction
being
relaying
the
patio
and
the
connection
there
being
or
the
the
tentative
position
or
scenario
being
that
the
removal
of
the
tree
is
necessary
to
accomplish
the
construction
that
is
proposed
at
this
time.
If
I
had
to
sort
of
project
where
we
would
stand
in
that,
we
don't
have
enough
information
on
the
table
from
the
applicant
in
terms
of
concrete
documentation
that
the
removal
of
the
tree
would
be
necessary
to
affect
the
repairs.
G
Our
perspective,
my
experience,
is
that
there
is
a
good
possibility
that
the
tree
could
be
retained
and
and
that
it
hasn't
been
sufficiently
explored
for
us
to.
G
E
Okay,
well,
you
can
see
this
is
really
difficult
for
for
council
to
decide
what
to
do
because
we're
hearing
about
accessibility
issues.
So
that's
that's
a
concern.
Is
there?
Is
there
have
you
investigated
to
the
point
that
or
is
covered
a
problem
in
all
of
this?
Have
you
investigated
this
to
determine
whether
there's
accessibility
issues,
because
I
I
certainly
have
not
been
to
the
property.
G
I
personally
haven't
been
to
the
property
if
the
information
that
has
been
conveyed
by
the
deputy
is
correct,
and
I
have
no
reason
to
to
to
think
it
isn't
the
there
would
be
an
access
or
accessibility
issue
for
persons
with
mobility
concerns
or
wheelchairs
on
the
existing
walkway.
It
is
uneven
enough
that
there
would
be
an
accessibility
concern
as
as
noted
in
her
comments
and
in
our
staff
report.
G
E
And
so
is
there
a
way
to
fix
to
resolve
the
accessibility
issues?
You
know
with
related
to
this
specifically
to
the
patio
without
removing
the
tree.
Is
there
a
way
to
accomplish
have
a
win-win
here
and
accomplish
both
again,
I
it's
for
me
it's
challenging
because
usually
I
would
go
to
the
site
and
go
see
it,
and
I
haven't
been
able
to
do
that
for
obvious
reasons.
E
G
I
can
I
can't.
We
would
hope
that
that
would
be
possible.
It
would
require
a
collaborative
review
or
investigation,
including
people
who
are
qualified
to
relay
the
patio,
including
tree
experts
like
a
private
arborist
and
possibly
including
someone
who
can
speak
to
the
the
zoning
issues
around.
You
know
if
the
regrading
is
necessary,
if
it's
necessary
to
raise
the
level
of
the
soil
between
the
tree
and
house.
G
C
Six
minutes,
I
I
just
have
a
very
quick
question:
there's
a
there's.
A
line
on
here
on
page
two
tree
roots
are
not
physically
capable
of
exerting
enough
force
to
lift
or
crack
properly
constructed
and
maintain
infrastructure
such
as
dwelling
foundations
and
walkways,
and-
and
I
must
admit,
I've
been
to
mostly
neighborhoods
in
the
united
states.
I
used
to
go
down
to
new
york
a
lot
when
my
daughter
was
there
queens
and
brooklyn,
and
here
their
sidewalks
are
so
buckled
and
it's
usually
adjacent
to
large
trees.
C
Is
it
when
you
say
properly
constructed?
Would
you
conclude
that
those
sidewalks
are
poorly
constructed
or
that
their
roots
are
overly
aggressive.
G
I
would
I
I
have
taken
issue
internally
with
the
specific
nature
of
that
of
that
language.
I
I
will.
I
will
say
that
I
don't
agree
with
it.
I
think
you,
you
correctly
ascertained
that
in
situations
where
we're
dealing
with
something
like
an
interlocked
patio,
it
is
possible,
under
normal
circumstances,
for
tree
roots
to
heave
and
buckle
those
structures.
I
would
modify
that
statement
if
I
had
the
choice.
G
Please
bear
in
mind
that
the
staff
report
was
co-authored
by
a
number
of
parties,
but
I
would
modify
that
statement
to
say
things
like
foundations
and
will
build
concrete.
Driveways
are
robust
enough
that,
if
they're
properly
built
tree
roots
won't
create
problems
for
them,
but
I
wouldn't
include
interlock
walkways
in
that
statement.
E
Well,
that's
a
great
question.
I
don't
know
I
feel
like
there.
There
needs
to
be
a
bit
more
investigation
that
take
place
here.
I
don't
know
how
my
colleagues
feel
about
this.
It
seems
like
I
mean
I
feel
very
you
know
I
feel
very
sad
for
the
for
the
owner
for
sandy
and
the
family
that
lives
at
147
fenn,
and
this
is
she's
identified-
that
this
is
a
very
challenging
situation
for
her
family
for
herself
and
her
family.
So
I
would
like
to
be
helpful.
E
At
the
same
time,
council
is
very
committed
to
maintaining
trees.
I
mean,
if
you
look
at
the
voting
record
of
city
council
on
trees
in
the
last
few
years,
the
tree
seems
to
win,
so
I
don't
know
what
to
do
with
it.
If
any
of
my
brilliant
colleagues
have
ideas,
but
one
idea
might
be
to
defer
it
to
provide
ample
time
for
further
investigation,
so
staff
could
come
back
with
maybe
more
comprehensive
and
solid
answers,
but
I'll
throw
to
counselor
carol.
I
see
she's
got
her
hand
up.
E
A
Well
well,
mr
chair,
if
the
local
counselor
wants
to
to
defer
it
I'll
vote
for
that,
but
I
would
be
prepared
today
to
move
the
staff
recommendation
for
refusal
and-
and
I
know
that
comes
as
very
bad
news
to
to
the
resident.
But
I'll
tell
you
why
what
I
pulled
out
of
the
report
when
I
read
it
is
we
have
a
honey,
locust
tree
that
where
it
is
and
and
how
it
would
have
to
be
removed
and
how
it
has
to
be
paid
for
and
replaced
at
a
significant
cost
is
a
costly
endeavor.
A
But
what
the
report
recommends
are
ways
to
to
take
that
same
money
and
spend
it
ameliorating
the
situation
redoing
the
path,
so
that
so
that
it
is
level
building,
solo
and
re-compacting
it.
So
the
roots
are
covered
and
you've
got
a
better
base
on
which
to
build
a
proper
path.
Both
of
these
courses
of
action
are
going
to
cost
some
money,
but
they
both
of
them,
would
result
in
a
change.
A
The
reason
I'm
in
in
favor
of
asking
that
the
resident,
if
they
wanted
to
solve
their
path
issues
they
do
it
by
by
simply
doing
the
soil,
buildup
and
redoing.
That
path
is
because
I
think
they're
going
to
have
to.
If,
if
the
mobility
is
the
issue,
they
would
remove
the
tree
and
still
have
to
do
that,
they're
still
going
to
have
to
rebuild
and
and
replace
that
path
and
there's
a
way
to
do
it.
A
That
saves
the
tree
and
so
that,
I
think,
would
be
in
keeping
not
only
with
the
policy
but
with
council
of
the
whole,
because
this
appeal
would
have
to
go
to
to
the
whole
of
council.
It
would
be
in
keeping
with
their
usual
pattern
of
of
determining
these
things
from
the
report,
so
we
can
defer
if
the
counselor
wants
to
move
that,
but
I
would
put
the
staff
recommendations
on
the
table
as
a
motion
today
as
well.
C
C
I'm
I'm
a
little
concerned
about
the
response
to
my
question
that
that
there
was
internal
debate
on
whether
to
put
that
telltale
sentence
on
on
page
two,
which
really
leans
the
report
for
a
denial.
C
So
but,
but
if,
but
if
it's
the
will
of
counsel,
I
would
support.
I
would.
I
would
support
a
a
removal,
a
motion
to
remove
or.
C
E
Well,
I
I
think
we
should
proceed
with
counselor
carol's
motion
and
then.
E
Said
she's
putting
it
on
the
table
and
we
all
know
what
will
happen
at
city
council
anyway,
no
matter
what
the
circumstances
are.
City
council
will
overturn
community
council's
decision.
We
all
know
that,
like,
let's
be
honest,
this
elephant
in
the
room
is
no
matter
what
this
body
decides.
It
will
go
to
city
council
for
final
approval,
just
to
explain
to
the
residents
and
city
council,
no
matter
what
the
issue
seems
to
overturn
community
council
decision
or
or
further
endorses.
E
So
I
think
we
should
proceed
with
counselor
carol's
motion,
and
if
that
whatever
happens
there,
then
I
would
place
the
other
deferral
motion.
Does
that
make
sense?
Mr
chair
or
that's.
E
C
C
Madam
clerk,
that's
my
that's
my
understanding
too.
A
motion
to
prefer
comes
first.
C
C
We
would
vote
on
councillor
robinson's
motion
first
and
then
on
councillor
carroll's
move
to
support
the
staff
recommendations.
C
Okay,
councilor
robinson
has
moved
deferral
to
the
next
scheduled
community
council
meeting.
All
those
in
favor.
C
2117
now,
madam
clerk,
we
have
already
opened
reopened
this
item
and
that's
how
it
got
here
we
reopened
and
then
deferred.
So
we
don't
have
to
reopen
this
item
again.
It
is,
it
is
on
the
floor
for
debate.
Is
that
correct.
D
B
Thank
you,
counselors
for
reopening
this
issue
good
morning.
I
just
wanted
to
present
the
perspective
of
the
homeowner
enter
in
this
matter.
B
The
reason
we
constructed
that
fence
in
in
that
manner
was
because
of
an
incident
occurred
approximately
three
years
ago,
when
the
construction
actually
commenced.
A
motor
vehicle
at
high
speed
collided
with
the
the
power
line,
the
hydro
pole
in
front
of
our
property
and
broke
and
swing
onto
our
fence
and
took
the
whole
fence
down
so
that
hydro,
pole
in
front
of
our
properties
is,
has
been
replaced.
B
It
was
the
impact,
was
hard
enough
and
to
to
break
the
hydro
pole,
and
at
that
point
we
we
just
we
had
to
replace
the
fence.
B
We
approach
a
local
contractor
who
had
done
many
projects
in
the
neighborhood
building
very
similar
fences
for
the
project,
the
the
property
line
where
the
fence
is
was
like
that
when
we
purchased
the
property
22
years
ago,
it's
right
in
line
with
the
northern
neighbor
and
southern
neighbors.
B
So
it's
only
after
defense
was
constructed
that
we
were.
We
were
made
aware
that
there
was
encroachment
on
the
city
property
and
I
could
only
speculate
why
the
the
fence
was
built
along
that
line
and
part
of
the
reason
is:
there
are
three
pre-mature
trees
in
the
front
of
the
property.
You
know
within
our
our
yard
and
more
on
our
neighbor's
property
and
that
would
have
impeded
the
building
of
the
fence
along
the
property
line.
As
a
result,
the
fence
was
pushed
more
onto
the
city
city,
property.
B
We
have
made
an
application
for
encroachment.
The
fees
have
been
paid,
all
the
locates
have
been
cleared,
and
so
the
there
is
there
were
some
issues
when
I
reviewed
the
the
youtube
video
from
the
last
meeting
that
were
brought
up,
and
I
just
wish
to
clarify
some
of
them.
First
of
all,
regarding
a
visibility,
the
it
is
a
half
wall,
so
there
is
clear
visibility
within
over
when
exiting
the
prop
when
exiting
our
yard.
B
The
the
main
impediment
visibility
is
actually
from
our
south
neighbor,
which
has
a
solid,
a
wooden
fence.
So
we've
always
that's
always
this
traffic
approaching
from
that
that
direction.
That
is
more
of
concern
to
us
when
we're
exiting,
since
our
driveway
is
about
a
meter
away
from
our
southern
neighbor.
B
B
We've
been
there
for
22
years.
Our
neighbor
has
a
solid
wooden
fence
at
the
same
line
and
there
hasn't
been
any
issues
there
this
this
construction.
It
may
not
be
obvious
from
the
pitchers,
but
the
half
wall
is
actually
floating.
It's
not
constructed
solidly
onto
the
ground,
it's
resting
on
the
pillars,
so
there
is
complete.
There
is
a
space
at
the
bottom
there
that
allows
that
would,
for
example,
allow
snow
to
be
also.
B
It
gives
clear
access
unobstructed
access
to
all
utilities.
You
can
dig
under
that
under
those
those
walls,
so
I
think
you
know
a
lot
of
those.
I
just
wanted
to
present
some
of
these
factors
from
the
honors.
You
know
homeowners
point
of
view.
B
We
we
approached
this
contractor
with
the
with
the
belief
that
he
was
knowledgeable
with
the
city
bylaws
and,
and
would
you
know,
construct
it
as
as
as
appropriate,
and
we
were
assured
many
times
that
this
was
in
fact
the
case.
So
now
we're
left
in
the
in
the
large
in
the
you
know,
holding
this
this
short
end
of
the
stick,
and
I
just
wish
you
to
reconsider
the
application.
C
E
Okay,
just
to
thank
you
very
much,
mr
chair,
just
to
be
clear.
This
incident
that
happened
in
2017.
I
I
want
to
call
it
an
accident,
but
a
car
like
a
car,
basically
came
flying
onto
your
property
and
my
understanding
is
your
children
often
are
out
there.
You
have
young
children
out
playing.
That
was
my
understanding
from
your
partner.
A
very
scary
experience
this
car
flying
and
that's
why
you
built
this
fence.
Is
that
correct.
B
That
that's
correct,
yes,
it
is,
you
know,
because
it's
on
the
main
street
there
is,
there
is
always
speeding
vehicles.
There
are
many
times
a
trap
for
cops,
because
people
are
speeding
to
get
on
the
highway
yeah.
E
We're
most
of
us
are
very
familiar
with
bayview
avenue
and
the
pro
problems
with
speeding
on
bayview
avenue
and
volume.
Two,
so
that's
good
to
understand,
and
the
contractor
gave
you
the
impression
that
defense
was
completely
within
the
bylaw
correct.
B
We
have
been,
we
have
been,
we
have
been.
That's
that's
correct,
yes,
because
I'm
not!
This
is
actually
the
first
time
I've
ever
had
any
issues
with
city
or
any
legal
matters.
You
know
so
I
I
I
really
trusted
that
he
would
be.
You
know,
since
that's
what
he
did.
I
we
honestly
taught
steve.
E
Yeah,
okay
and
and
the
other
outstanding
issue,
along
with
the
sight
lines,
is
the
encroachment
piece
I
just
want
to.
I
just
want
to
confirm
you
did
say
it,
but
I
want
to
confirm
that
you
have
you
have
applied
for
that
encroachment
agreement,
correct.
B
Yeah,
yes,
we
have
applied
for
it,
the
fees
have
been
being
paid
and
that
application
has
been
has
yeah.
We
have
forwarded
a
copy
of
the
receipt,
also
yeah.
C
Thank
you,
council
robinson,
any
other
questions
for
the
deputies.
C
I
just
have
a
couple
so
the
plan
here
is
an
encroachment
agreement
and
I
think
some
slight
modifications
to
the
height
which
will
have
it
conform
is
that
is
that
a
pathway
to.
I
Good
morning,
mr
chair,
as
eleanor
angeliano
for
municipal
licensing
and
standards,
I'm
going
to
defer
to
my
colleague
ronald
baird
from
transportation
services
who
was
asked
to
also
be
present
today,
as
the
encroachment
agreement
would
go
through
transportation
services.
So
perhaps
he
could
speak
to
that
portion
of
it.
Please,
and
thank
you.
B
C
So
it
looks
like
with
an
encroachment
agreement
and
and
modifications
this
fence
would
conform.
Yes,.
A
Yeah
I
I
now
need
clarification,
because
what
we
have
before
us
doesn't
give
us
the
ability
to
ensure
that
these
modifications
would
happen
if
we
don't
have
very
specific,
a
very
specific
recommendation
with
very
specific
modifications
in
it.
Neither
neither
recommendation
that
that
that
exists
in
the
reports
helps
us
to
guarantee
that
those
sight
lines
would
be
would
be
addressed
et
cetera,
et
cetera.
My
am,
I
am
I
right
in
that.
B
That
that's,
I
would
say
that
would
probably
be
correct.
Yes,
so.
A
E
Yeah,
I
do
have
a
very
specific
motion.
That's
been
written
by
staff
that
addresses
counselor
carol's
concerns,
but
I
see
I
do
see
elena.
I
think,
with
her
hand
up.
I
think
she'd
like
to
speak
on
this.
E
I
Just
wanted
to
further
add
through
you,
mr
chair,
just
in
response
to
will
the
fence
then
comply,
so
we
just
something
for
the
counselors
to
keep
in
mind
that
the
the
fence
exemption
application.
That's
before
you
is
with
respect
to
the
fence,
that's
on
the
private
property
which
does
not
comply.
It
just
so
happens
that,
in
this
incident,
part
of
the
fence
is
also
encroaching
on
city
property,
which
is
the
big
factor
here,
because
it
is
indeed
causing
a
sight
line
obstruction.
I
So,
just
to
answer
the
question:
if
the
encroachment
agreement
is
satisfied
that
they
make
the
modifications
and
transportation
services
grants,
the
encroachment
agreement
does
not
make
the
rest
of
the
fence
in
compliance.
However,
council
can
move
to
pass
the
fence
exemption,
which
would
allow
then
the
fence,
that's
on
the
private
property
which
municipal
licensing
and
standards
regulates
under
our
offense
by-law,
and
that
is
before
council
today
to
be
permitted
to
remain.
As
is,
I
just
wanted
to
clarify
that
point.
Thank.
C
You
thank
you
very
much.
Thank
you
very
much
appreciate
that
council
robinson.
E
So
I
have
quite
an
extensive
motion
because
I
know
this
council
is
concerned
about
sight
lines,
as
am
I
and
I
share
their
concerns,
but
I
have
quite
a
detailed
motion
that
has
been
actually
not
written
by
me
but
written
by
staff.
E
E
It
there
it
is
okay,
here
we
go
so
these
are
the.
These
are
the
things
that
us
staff
have
altered
a
b
and
f,
and
you
see
the
alterations
and
the
modifications
in
front
of
you.
If
I
can
zero
in
on
f,
the
fence
shall
be
installed
in
such
a
manner
that
site
restrictions
for
drivers
and
pedestrians
are
eliminated.
E
I
think
that's
again,
written
by
staff
and
and
and
comprehensive.
I
just
I
just
do
want
to
say,
there's
a
bit
of
a
side
story
to
this,
and
that's
why
I
asked
it
to
be
reopened.
E
This
is
actually
the
very
first
time
we've
heard
from
the
property
owner
previously
councils
didn't
hear
from
anybody
because
they
showed
up
at
the
site
versus
coming
on
to
the
council
meeting.
They
thought
the
meeting
was
at
the
site.
The
second
meeting
it
was
the
contractor
who
I
understand,
did
not
do
maybe
the
best
job
articulating
the
position
to
counsel
you
know.
There's
been.
This
is
a
family.
A
young
family
living
here
there's
been
very
serious.
E
Safety
concerns
on
bayview
avenue,
including
this
incident
that
happened
to
their
own
family
in
2017,
where
a
vehicle
completely
lost
control
and
ended
up
on
their
front
lawn,
and
so
they
went
we're
going
to
build
a
fence,
we're
going
to
build
a
fence
to
make
sure
our
children
are
safe.
E
So
I
think
the
applicant,
the
deputy,
did
a
good
job
in
saying
they're
working
hard
to
address
the
concerns,
including
the
encroachment
and
now
the
sight
lines,
and
there
are
very
mature
trees
behind
this
fence
that
we
are
trying
to
preserve
beautiful
old
trees.
And
so
this
motion,
as
I
said,
has
been
written
by
staff
and
would
have
to
be
abided
by
in
order
to
make
this
all
come
to
an
end.
A
resolution.
C
Anyone
else
to
speak
yeah,
a
deputy
mayor,
minnewan
yeah.
Thank
you.
F
F
If
we
didn't
have
these
restrictions,
people
could
be
building
fences
close
to
the
sidewalk
and
blocking
the
lines
everywhere
and
if
they
relied
on
the
fact
that
you
know
children
were
involved,
we
would
have
to
provide
examples
for
every
property
where
children.
C
F
So,
just
to
finish
the
idea
that
there
are
children-
if
that
wasn't
a
reason
why
we
would
allow
for
every
exemption,
there
would
be
fences
everywhere
and
they
wouldn't
comply
with
the
bylaw
from
a
policy
point
of
view.
I
don't
agree
with
that,
and
you
know
the
the
the
sight
lines
that
were
mentioned
by
staff
you.
You
are
actually
trading
off
one
safety
issue
and
and
creating
another.
F
So
I
think
we
spent
a
lot
of
time.
Considering
this,
I
think
it's
time
to
take
a
decision
and
my
decision,
you
know
you
look
at
bayview
avenue.
We
shouldn't
be
having
fences
along
bayview
avenue,
there's
some
nice
houses
along
there,
and
if
we,
if
we
were
to
have
a
line
of
fences
down
that
entire
street,
you
know,
I
think
the
you
know
that
street
would
suffer.
F
F
C
Okay,
thank
you,
deputy
mayor,
any
other
speakers
on
the
item.
C
I
think
I've
made
my
position
clear.
I
think
it's,
I
think
it's
a
reasonable,
a
reasonable
pathway
to
to
a
compromise.
I
do
agree
that
a
world
of
fences
doesn't
always
lead
to
good
neighbors,
but
but
in
this
case
I'm
a
little
sympathetic
to
the
family.
The
compromise
is
in
order.
C
C
C
Okay,
councillor
robinson's
motion:
we
put
it
on
the
screen.
C
Oh,
I
see.
Okay,
so
was
I'm
sorry
that
didn't
carry
now
deputy
mayor
minnewong
has
moved
the
refusal
option
on
the
staff
report.
There
we
go
all
those
all
those
in
favor.
F
Sorry,
I
I
just
look.
The
recommendations
are
basically
I
didn't
I'm
not
really
yeah.
I
am
moving
recommendation
number
one.
Thank
you,
mr
chair.
It's.
C
Refusal
right-
yes,
all
those
in
favor
and
I
don't
see
counselor
carol,
so
not
a
recorded
vote,
but
I
see
counselor
philly,
counselor,
deputy
member
wong
and
counselor
carol.
That's
three
opposed
councillor,
robinson
and
counselor,
pastor
jack
that
carries.
C
Okay,
the
bills.
C
C
Okay,
councilor
fillion.
Do
you
want
to
do
the.
C
C
Councilor
fillion
council.
C
There
we
go
counselor
carol.
