a
public
hearing
if
you
would
like
to
have
a
record
of
the
agenda
for
the
public
hearing
and
for
the
other
items
in
our
regular
session
there
in
the
middle
of
the
room
on
that
table.
But
we
are
here
to
receive
public
comment
regarding
the
issuance
of
general
obligation
bonds
for
the
purpose
of
paying
for
the
costs
of
acquiring,
constructing
and
equipping
a
new
fire
station,
anybody
that
would
like
to
address
to
the
mayor's
City,
Council
or
our
staff.

Seeing

we
will
close
the
public
hearing
and
we
will
move
on
to
our
regular
scheduled
City
Council
section
session.
This
is
a
September
10th
2019

we
welcome

once

our
regular
scheduled
city
council
work

We

follow
the
agenda

with
the
Pledge

we
will
have

councilmember
Barnes
and
then
I
will
conduct
the
roll
call.

the

the

we
enjoy

thou

enjoy
these

and
freedoms
that
know
our

who

to
discuss
matters

government

city
policy,
things

be

our

mayor

a
police

those
who
volunteer

make

twenty

public
comment
period.
We
would
ask
if
anybody
would
like
to
address
the
mayor
and
the
council
to
come
forward.
Please
limit
your
comments
to
two
to
three
minutes.
We
have
one
that
has
expressed
a
desire
written
and
we'll
start
with
this
gentleman
and
we'll
have
George
Brown
come
forward
this
time.

Mayor
City,
Council
members,
I'm
George
Brown
I'm
here
to
address
briefly
American
Fork
city's
water
rights.
I
was
talking
with
the
irrigation
company
and
they're,
saying
that
they
filled
out
all
the
applications
and
documentation
for
shareholders,
but
the
American
Fork
irrigation
company
doesn't
own.
The
water,
American
Fork
city
owns
the
water
now
you're,
all
using
the
same
law.
Firm
I
think
it's
myth
hard
facing
up
in
Salt
Lake,
but
I'm
gonna
make
a
recommendation
to
you.

You
need
to
get
in
touch
with
a
attorney
named
Robert
fill
er
up
he's
down
in
Orem
when
I
see
a
head
nodding,
and
so,
if
you
really
want
to
verify
Robert
Phillips
qualifications,
Shawn
Valentine
can
do
that.
They
work
together.
Although
Bob
is
independent.
Now,
but
here's
the
problem
in
1872,
73,
American
Fork
city
received
title
to
water
and
land
from
President
Ulysses
Grant.
There
were
two
other
cities:
Provo
I
think
Layton
Utah
that
had
those
received
title
to
water
and
land
in
1896.

The
Constitution
was
enacted
for
the
state
of
Utah,
provided
that
cities
cannot
alienate
or
sell
any
of
their
water
rights.
The
American
Fork
irrigation
company
was
organized
in
1919
or
1920,
so
there's
no
way
you
could
own
the
water
because
it
wasn't
existence
at
the
time
the
Constitution
was
created.
The
problem
is:
there's
an
adjudication
process
going
on
right
now
started
out
in
1936.

Let's
go
on
now
at
the
big
time
and
they're
cutting
off
water
rights
right
and
left.
The
purpose
is
to
figure
out
who
has
legitimate,
appropriated
water
rights.
Now
one
can
argue
that
American
Fork
City
as
far
as
its
ownership
of
water
from
American
Fork
River,
doesn't
have
appropriate
water
rights.
It
has
water
rights
that
obtained
from
President
of
the
United
States.
So
that's
a
very
important
issue
that
needs
to
be
defended.
That
means
that
they
can't
take
water
away
from
the
city
without
compensation.

Of
other
water
rights
to
some
underground
water
rights,
some
other
some
streamflow
water
rights,
but
those
are
more
regular
appropriation
type
water
rights.
I
think
it's
very
important
that
American
Fork
City
stay
on
top
of
this
and
preserve
those
water
rights,
because
if
someone
were
to
take
your
water
rights
and
have
to
pay
for
them,
it
could
be
be
several
million
dollars
in
value.
So
there's
a
lot
important
things
here
and
the
City
Council
on
a
mayor.

We
do
live
in
a
desert
and
we
have
had
a
good
water
year
last
year,
but
who
knows
a
little
hovel,
a
good
water
year,
maybe
next
year,
but
who
knows
so
it's
very
important
that
these
things
be
addressed
and
take
care
of
so
get
in
touch
with
Miss
Arctic
sent
him.
This
is
my
suggestion
and
telling
the
call
Bob
fill
er
up.

I
just
leave
one
other
thing
with
you
number
of
years
ago,
people
drowned
in
the
American
Fork
irrigation
canal,
an
older
gentleman
and
a
young
boy,
and
the
lawsuit
was
initially
dismissed
that
was
filed,
but
it
was
appealed
to
the
Supreme
Court
and
Supreme
Court
said
there
was
a
hidden
trap.
Therefore
you
can
continue
the
lawsuit
and
they
were
going
full-bore
after
the
water
from
the
irrigation
company,
because
there
was
some
negligence
problems
about
why
they
drowned
Bob.

Fill
er
up
was
involved
at
that
time
on
behalf
of
the
American
Fork
city
and
he
explained
to
the
plaintiffs
attorneys
that
you're
suing
the
wrong
entity
and
you
can't
sue
Merrick,
fork,
city,
etc,
etc,
and
so
you
better
settle
and
so
Mary
Fork
irrigation
company
was
able
to
settle
I,
think
some
$300,000.
Now
they
had
assets
that
they'd
acquired
over
the
years
and
it
worked
out
quite
well.

about
the

both
George
and
I
were
going

The

council
position,

think
was
gonna

we
talked

water

Brown
act

some
kind
of
adviser
or
something
regarding
water.

never
came
to
fruition,
I,
don't
know
if
George,
if
you
would
even
be
in
favor
of
something
like
that,
but
kind
of
be

don't
know
as
a
you
know,
as
a
committee
member
or
whatever
it
might
be
something
regarding
the
water.
He
has
a
wealth
of
knowledge
in
this
I.
Don't
know
that
would
be
good
to
have
him.
You
know
advised
us
Bulldog
this
whatever
it
might
be,
just
a
thought
and
again
I
don't
know
if
George
would
even
be
in
favor
of
that.
He
certainly
bring
you
to
our
attention
now.

I
would

a
work

I
know
that
I
asked
a
question:
I
think
that
heard
from
a
resident
that
they
went
to
one
of
these
open
houses.
Everyone
got
all
these
letters
and
went
to
the
open
houses
and
the
state
officials
were
wondering
where
the
city
was
that
and
one
of
the
irrigation
company
was
and
I
think
I
mentioned
that
to
you,
Brad
and
I
think
it'd
be
good
because
it
is
squirrely
on
our
shoulders.

A
vote
taken
in
the
1880s
by
all
the
communities
and
they
voted
really
wanted
to
have
the
city
manage
their
water
or
an
irrigation
company
in
American,
Fork
voted
for
the
city.
That's
why
the
city
had
all
the
water
rights
besides
the
patent
deed
from
Melissa's
us
grant,
and
so
there's
been
you
know,
give
and
take,
but
irrigation
company
doesn't
own
that
this,
the
city.

The
Fitness
Center
has
been
having
an
issue
with
a
pump
for
the
swimming
pool,
so
the
swimming
pool
has
been
closed
and
it
will
remain
closed
until
we
get
the
part
which
is
on
its
way
to
make
it
so
that
we
can
recirculate
the
water
the
appropriate
way
and
our
neighbors
have
been
helping
us
out.
Lehigh
in
Pleasant
Grove
have
been
letting
our
patrons
attend
their
pools
at
no
cost
if
they
are
members
of
our
of
our
fitness
center,
so
that
was
very
nice
of
our
neighbors
to
do
and
then
just
one
other
thing.

There
was
a
meeting
with
the
communities
that
care
as
part
of
our
community
policing
program
and
I
would
just
put
a
shout
out
to
anyone
who
wants
to
get
involved
with
the
youth
of
our
city
to
help
them
stay
on
the
right
track.
You
encouragement
and
opportunities
to
make
right
decisions.
The
communities,
the
care
program
is
a
great
Avenue
for
that,
and
we
are
looking
for
people
to
be
involved
with
that.
So
if
there's
a
community
willing
to
give
some
time
to
that,
we
would
definitely
encourage
it.

the
reporters
I
had
the
opportunity
to
go
to
the
employee
party
and
so
I
wanted
to
thank
the
staff
for
what
they
did
there
and
the
efforts
was
great
time
to
be
able
to
associate
with
a
lot
of
different
employees,

hopefully
they
felt
the
appreciation
at
the
city
house
for
the
hard
work
they
put
in
and
I
look
forward
to
seeing
those
continuing.

Items
yesterday
the
cemetery
committee
met
we've
pretty
well
finalized
the
Veterans
Day
program.
I
know
it's
still
a
little
early,
but
it's
two
months
from
tomorrow
and,
of
course,
tomorrow's
a
big
day
as
far
as
veterans
are
concerned,
and
this
whole
country
November
the
11th
at
11
o'clock
in
the
morning
at
the
Tabernacle
again
we'll
be
at
the
Tabernacle.
Hopefully,
from
now
on,
the
speaker
has
been
arranged.
He
is
a
military
leader.
I
can't
remember
his
rank
right
now,
I
think
he's
a
colonel,
we'll
have
some
good
music
and,
of
course,
we'll
honor.

Schools
are
invited
and
they
will
all
receive
a
special
invitation
to
come,
join
us
and
they
usually
do
and
they
do
the
5th
graders,
because
they're
studying
that
in
their
history
sections
and
looking
ahead
tomorrow,
Parks
and
Recreation
Committee
meeting
at
6
o'clock
they're
having
kind
of
an
annual
social,
but
they
will
also
be
doing
some
business
as
we
continue
to
talk
about
the
future
of
some
trails
and
some
parks
and
some
planning
and
and
some
suggestions
that
they
will
be
bringing
forward
to
the
city
and
city
councils.
So
that's
my
report,

I
A
couple
of
things
to
report
today:
first,
as
far
as
the
chamber
of
commerce,
they
are
having
multiple
ribbon
cuttings
they're,
bringing
new
members
into
the
chamber,
so
many
that
I
attract
me
and
the
mayor
mayor
have
been
trying
to
go
to
as
many
as
we
can
either
one
or
both
of
us
and
kudos
to
them
for
working
so
hard.
The
other
thing
I
wanted
to
report
on
today
was
that
I
was
able
to
go
on
the
tour
of
tssb
and
as
a
newer
councilmember.
I
That
was
really
enlightening
to
me
and
I
I
was
about
to
say,
I
enjoyed
it,
but
it
was
definitely
an
experience
that
I
learned
from
and
if
any
of
you
have
a
chance
to
do
that,
if
we
haven't
already
I
would
really
recommend
it
just
because
it
brought
to
light
so
many
things
that
maybe
I
hadn't
thought
all
the
way
through
and
I
was
able
to
meet
some
people
that
were
involved
in
that
organization
as
well.
The
other
thing
I
wanted.
I
The
last
thing
I
wanted
to
report
on
was
that
I
was
able
to
attend
a
walkable
community
event
in
Salt
Lake
City.
A
couple
of
weeks
ago
and
I
was
happy
to
see
we
had
been
doing
that
and
as
well
as
one
of
our
planning
commissioners-
and
it
was
really
nice
for
us
to
be
able
to
facilitate
a
conversation
where
we're
all
talking
on
the
same
level
and
I
really
do
support
having
our
planning
commissioners
get
education
in
way
that
they,
we
can
have
that
so
I
thought
that
was
really
good
bear
with
me.
I
I
want
to
just
report
on
a
couple
of
things
that
I
learned
there.
He,
the
main
speaker,
spoke
of
four
things
that
make
a
community
walkable
and
it
was
one
a
reason
to
walk,
meaning
a
useful
reason
to
it
has
to
be
safe.
Three
has
to
be
comfortable
and
for
interesting
and
for
a
safe
walk.
He
we
control
it
by
limiting
the
size
of
the
block,
the
number
of
lanes
on
the
street
and
the
width
of
the
street
itself
and
to
make
something
comfortable.
I
He
talked
about
having
buildings
closer
to
the
street
itself
or
at
least
closer
to
the
pathway.
Let's
see
and
as
far
as
interesting,
he
said,
signs
of
life
are
what
makes
things
interesting.
People
don't
want
just
the
sight
of
a
building.
They
want
to
be
able
to
have
a
doorway.
They
don't
want
to
have
just
a
long
fence.
They
want
to
have
some
sort
of
place
that
they
think
maybe
people
are
gonna,
come
out
and
be
part
of
that
landscape.

Just
think
there
are
great
events
to
bring
people
together
in
a
very
social
setting.
They're,
not
really
there
to
work
they're
there
to
get
to
know
each
other
or
the
spouses
of
an
individual
and
I
just
found
that
there's
great
unity
in
the
Planning,
Commission
and
people
know
each
other
well
and
I,
really
pretty
state
staffs
efforts
and
bringing
people
together
and
it's
coming
to
come
to
an
end
here.
The
temperatures
are
gonna
start
dipping.
So
anyway,
that's
the
mayor's
reporting.

Interesting
to
see
this
and
remember
2010
when,
when
Robin
and
I
were
elected,
the
first
time
we
saw
that
whole
area
and
how
things
have
changed
since
that
plan
that
was
so
baked
how
that
has
come
down.
And
now
some
of
these
sup
more
southern
Parcher
are
coming.
It's
kind
of
exciting
to
see
the
progressive
changes
and
I
think
it's
pretty
awesome.

my
only
comment
is
just
again:
we
appreciate
the
Planning
Commission
and
have
a
great
amount
of
confidence
that
that
Commission
and
those
people
really
studied
these
issues
and
look
at
them
in
fine
detail,
so
that
some
of
the
things
that
don't
make
sense
to
people
like
me,
I,
don't
have
to
worry
about,
because
they've
got
some
engineers
and
some
other
people
are
really
do
their
duty
in
and
just
give
thanks
to
them
for
doing
that.
I

their
minutes.
I
really
appreciate
those
to
look
and
see
what
they've
done.
