first
item
under
new
business
is
the
ordinance
amending
section
2-5-70
of
the
town
code
for
hilton
head
island.

What
is
before
you
today
has
been
generated
by
staff,
basically
to
look
at
our
current
practices
of
our
public
meetings
and
how
we
treat
public
comment
in
looking
at
our
current
practices
in
relationship
to
the
language
that
is
currently
in
the
code.
There's
a
disconnect
between
the
two.
What
staff
is
proposing
is
an
ordinance
that
would
change
the
language
in
the
code
to
be
in
line
and
be
reflective
of
our
practices.
That
way,
we
avoid
confusion
and
potential
problems
down
the
road.

Essentially,
the
the
change
that
is
outlined
in
the
draft
ordinance
that
is
included
in
the
backup
would
remove
the
word
that
a
citizen
of
the
town
is
authorized
to
speak,
to
make
it
applicable
to
any
interested
party
being
authorized
to
speak
and
again.
We
believe
that
to
be
more
in
line
with
the
current
practices
that
are
in
place
for
our
public
comment
sessions
all
right.

So
we
have
a
existing
rules
of
decorum
provision.
We
believe
that
that
provision
is
comprehensive.
It
speaks
to
the
the
ability
to
I'm
trying
to
think
of
the
right
verbiage.
Here
it
speaks
to
the
ability
to
not
use
offensive
language
to
not
use
obscene
language
and
other
similar
tactics.
I
don't
know
that
it
specifically
references
prohibition
on
calling
out
an
individual,
but
it
does
speak
to
how
the
public
comments
and
how
the
behavior
of
the
person
is
supposed
to
be
conducted
while
they're
providing
those
public
comments.

Obviously
the
tricky
part
comes
down
to
enforcement
of
the
rules
of
decorum.
That's
where
you
know
we
always
find
our
struggles,
but
as
far
as
the
limitations
on
what
they
can
and
cannot
do,
that
is
clearly
outlined
in
the
rules
of
decorum
and
we're
not
recommending
any
changes
to
that.
At
this
time.

One
is
we
have
so
many
second
homeowners
on
the
island
and
they
are
paying
taxes.
They
may
not
live
here,
but
certainly,
if
they're
on
the
island,
they
ought
to
be
able
to
speak.
And,
secondly,
I
think
it's
better
for
us,
as
a
community
to
open
ourselves
to
comments
from
even
a
visitor
who
is
here
on
the
island
happens
to
be
an
expert
in
an
area
that
we're
going
to
be
talking
about
and
offers
an
opinion.

I
think
we're
going
in
the
right
direction
here
and
I
I
think
that
we
have
to
be
careful
as
a
community
in
our
country
as
a
matter
of
fact
that
we
don't
try
to
create
rules
for
the
10
percent
who
are
offending
us
rather
than
keeping
us
open
to
the
90
who
have
an
opinion.
That's
worth
something.

think,
that
opening
this
language
to
be
consistent
with
the
way
we
practice
makes
sense.
Consistency
is
always
good.
I
do
hope,
though,
I
think
understanding
a
bit
of
perhaps
where
tom
was
going,
that
we
return

people

be
civil
and
use
their
free
speech
and
what
they're
guaranteed
as
citizens
in
this
country

productive

joint
operating
and
ownership
agreement.
Oh
it's
not
working.

I
was
at
the
end
of
the
slideshow:
that's
why
I
apologize
there.
We
go
the
joint
ownership
and
operating
agreement
for
the
ford
shell
ring
property,
we're
going
to
go
over
the
location
and
current
conditions
of
the
property,
the
ownership
agreement,
as
well
as
financial
and
maintenance
responsibilities
and
the
next
steps
for
this
agreement.

This
is
the
location
of
the
ford
shell
ring
property.
It
is
on
squire,
poke
road
near
the
roundabout
with
gumtree
road.
It
is
currently
heavily
vegetated.
There
is
an
earthen
trail,
that's
been
there
for
quite
some
time.
It
is
overgrown
and
there
have
been
some
trees
down
from
matthew
that
block
portions
of
the
trail
at
this
point,
but
the
intent
is
to
open
that
back
up,
but
the
current
conditions
are.
There
is
currently
an
earthen
trail
and
a
probably
10
to
14
foot
wide
access
to
get
into
the
property.

earthen
trail

The
operating
agreement,
the
town
and
county,
purchased
the
property
jointly
in
2003,
and
at
that
time
we
had
an
intergovernmental
agreement
with
regard
to
the
property.
This
agreement
will
supersede
that
agreement,
and
this
agreement
was
gone,
has
gone
to
the
county
council
in
april
of
2021
with
their
approval.
At
that
point,
we
started
working
on
the
details
of
the
agreement
going
through
our
legal
process
developing
the
site
plan.
We
wanted
to
make
sure
that
we
had
everything
in
order
before
we
brought
the
operating
agreement
to
you.

So
that's
where
we
are
today,
and
there
is
an
option
in
that
agreement
for
the
county
and
the
town
to
enter
into
an
agreement
with
the
hilton
head
chapter,
the
archaeological
society
for
them
to
do
tours
some
site
inspections,
minor,
cleanups
and
maintenance
of
the
property.
Should
we
want
to
go
down
that
road
for
the
responsibilities
the
county
is
responsible
for
the
major
part,
the
capital
improvements
and
any
major
improvements?

So
this
part
they
will
pay
for
all
of
the
capital
improvements
to
the
park
right
now
there
will
be
fencing
the
trail
and
parking
area.
So
if
our
drainage
culvert
fails,
if
there's
major
maintenance
to
the
parking
area,
if
a
tree
falls
on
the
fences
that
will
all
fall
to
the
county
to
take
care
of
those
responsibilities,
the
town
will
be
the
day-to-day
responsibility,
the
opening
and
closing
of
the
park,
the
mowing
and
blowing
of
the
the
trail,
as
well
as
the
parking
area,
which
should
be
a
minimal
cost
to
the
town.

is
the
site
plan
that
we
have
drawn
up
at
this
point.
That
is
the
current
location
of
the
trail.
That
is
there.
We
are
widening
it
to
make
it
a
little
more
accessible
and
then
we're
adding
the
parking
area
to
the
area,
and
we
put
it
to
try
to
put
it
in
an
area
where
we're.
I
think
we're
only
removing
like
one
tree
to
put
this
in,
so
we
tried
to
do
it
as
minimal
disturbance
as
possible,
since
it
is
a
historically
significant
property.

The
trail
that
goes
off-site
towards
the
right,
it
will
be
a
part
of
the
access
agreement
that
we
have
for
the
bar
and
well
property.
So
that's
why
you
see
that
trail
off
to
the
other
side.
The
other
access
is
actually
something
we've
had
in
place
since
we
bought
the
property
it.
There
is
a
current
access
to
fuller
points
that
allows
us
a
secondary
access
to
the
property,
and
that
will
not
be
necessarily
a
public
access.

To
my
knowledge,
it's
already
in
place
and
has
been
for
for
quite
some
time
since
we
purchased
the
property,
but
I
know
we're
putting
a
gate
there,
because
right
now,
there's
a
couple
of
bollards
and
fuller
point
has
been
dumping:
their
landscape
debris
on
the
property.
So
we're
trying
to
prevent
that.

If
we
get
an
approval
from
town
council,
there'll
be
an
execution
of
the
agreement
with
beaufort
county
town
staff
will
continue
to
work
with
the
county
on
the
permitting
construction
of
the
park.
And
then,
if
we
choose
to
move
forward
with
other
elements,
it
will
be
have
to
programmed
into
the
town's
cip
program
for
us
to
take
on
the
cost.
For
that
and
so
I'll
be
happy
to
take
any
questions
on
the
joint
operating
agreement.

information
to
people
walking
around
that
pathway
in
a
way
that
it's
not
just
a
sign
that
they
forget
in
15
seconds
after
they've?
Read
it
but
has
an
impact
and
they
go
home
and
talk
about
good
grief.

have
seen
this
kind
of
a
reaction,
so
I
think
there
is
truly
an
opportunity
whenever
we
have
an
archaeological
site
or
a
botanical
site
or
whatever,
to
convey
to
the
public
why
that
is
so
different
from
other
places.

supposed
to
be

last
year's
budget,

we
got
held
up
in
permitting
and
the
pandemic,

we're

to
it

bed
this
spring.

the
permitting
taken
place.

the
same
property.
There
is
a
dirt
driveway
there
right
now,
and
that
is
because
the
triangle
piece
in
the
back
is
owned
by
the
barnwell
family
and
the
only
access
to
that
property
is
across
the
ford.

existed
when
we
bought
the
property,
and
we
acknowledged
that
when
the
property
was
bought,
so
the
dirt
trail,
that
is
there
off
of
square
pope
road
goes
back
to
the
barnwell
property.

Currently,
the
intent
is
for
the
town
and
the
county
to
execute
a
termination
of
the
existing
easements
for
two
reasons,
one
because
it
contains
a
septic
and
drain
field
on
the
count
on
the
town
and
county's
property
that
we
would
like
to
eliminate
in
lieu
of
a
utility
easement
and
then
also
the
access
itself
is
going
to
be
modified,
that
it
will
be
wider
to
accommodate
two-way
traffic.
And
it's
going
to
be
slightly
shifted
away
from
the
marsh
to
give
us
more
of
a
buffer
area.

So
we
will
be
proposing
to
terminate
the
existing
septic
and
drain
field
and
abandon
the
existing
easement
in
lieu
of
creating
a
new
access.
Easement
and
the
town
parcel.
The
pro
the
park
will
have
a
swing
gate
similar
that
we
have
to
all
of
our
other
properties.

But
once
you
get
to
the
end
of
the
parking
area,
we'll
have
a
chained
access
that
will
be
open
for
the
public
to
walk
around
and
then
the
town
and
the
county,
as
well
as
the
barnwell
family,
will
have
access
to
a
combination
lock
specific
to
that
where
they
could
drop
the
chain
to
be
able
to
get
back
to
their
property.
Should
they
need
to.

And
we
have
made
it
clear
to
the
barn
wells
that
we
are
not
the
town
and
county
not
responsible
for
any
of
the
public
that
happen
to
wander
over
to
their
property,
that
they
have
the
option
to
put
up
a
fence.
Should
they
want

put
up
no
trespassing
signs
things
of
that
nature,
but
that
the
town
and
county
would
not
be
responsible
for
that?

So
you
can
see
that
the
the
little
rectangular
area
in
the
back
is
the
septic
area
that
was
put
in
adjacent
to
the
property,
and
you
can
see
that
currently
up
at
the
front
there,
the
access
easement
is
closer
to
the
marsh,
so
we've
shifted
it
a
little
bit
to
the
left
and
we'll
put
in
a
new
drainage,
culvert
and
widen
it
to
24
feet
for
two-way
traffic
there.

the
next
steps
on
this
this
has
to
go
through
county
approval
and
town
approval.
So
at
this
point
it's
scheduled
for
the
march
7th
natural
resources
committee
before
the
county
and
then
going
to
county
council
on
march
14th
and
again
we
have
a
recommendation
before
you
all
today
and
if
it's
approved
it
would
go
to
town
council
as
early
as
march
15th,
and
if
both
those
are
approved,
we
will
be
executing
and
recording
both
documents,
the
termination
of
easements
and
the
access
and
utility
easements
with
the
county
and
susan
carter.

The
density
of
that
of
those
properties
was
taken
and
transferred
across
the
street
to
the
squire
pope
the
the
side
on
square
pope
at
gumtree,
and
subsequently
those
two
parcels
will
rezone
to
conservation.
So
they
have
no
ability
to
have
a
land
use
on
their
development,
but
they
do.
We
do
still
have
to
have
access
to
the
property
should
they
want
to
get
back
there
for
fishing
or
anything
like
that.
