This is uh commissioner, ed rothstein. It is thursday august 24th. I guess we have one more.

A

Week in august and going into uh september so- uh and I was able to do that from my.

A

I think first grade understanding of the calendar, but anyway before we make a teacher.

A

It started uh as always: let's stand for the pledge of allegiance and a moment of silence.

B

United states of america and to the republic for which it stands.

B

One nation, under god, indivisible with liberty and justice for all.

A

Okay, I'm going to uh take deliberately and uh start off.

A

With priority carol- and you know- has shared what's so important about priority carol, is we.

A

Share what's on our mind and what is turned into carroll county. We closed the chapter uh on tuesday.

A

With the funeral of our colleague jack lyburn, uh it was a beautiful ceremony and.

A

Besides, what resonated with me, with the amount of folks that were there, showing his impact to.

A

The business community, the county, the region and the state was his youngest son, his daughter and.

A

Youngest son um said some beautiful words, but what really resonated to me was when his son.

A

Said that jack would go out of his way to helping folks doing whatever was necessary and he said.

A

But jack never went out of his way. That was jack's way and I was like wow that was pretty powerful.

A

That was jack's way. He was a maverick, he could have been obnoxious at times. He was very dangerous.

A

On the golf cart with uh you know, bonnie, and I was always ensured to be away from that golf cart.

A

um But uh I got a ride from him on the golf court cart once and he did not crash us. Oh so he uh to.

Tell about it very, very powerful, individual and um uh got the opportunity to see a lot of um the old.

A

Older regime of economic developers from around the state that were also there that always held.

A

Jack in the highest regard, um so uh you know we'll definitely miss him. You know, but it is a chapter.

A

You know, then we get to turn the page and we're moving forward. So just wanted to share that.

A

Then, since I'm still going for just a quick second, we did have our maryland association.

A

Counties meeting or conference last week down ocean city and uh oh there's, ted okay um and we.

A

Had the opportunity to uh whether it be meeting with the leadership of.

A

Maryland with the governor and lieutenant governor, but more almost more importantly, that'd be rude.

A

But uh as important was the administration, so we met with secretary addicts, we met with.

A

Secretary robinson from commerce we met with secretary woods, mdva um go back a second, I think.

A

No, not that one, I was hand. No, not oh, my god anyway, I'm not sure what chris is doing, but um the.

A

Governor lieutenant governor came out to uh um carroll county and saw the damage from the storm.

A

And we there, it is just hold on a second there and we wrote a letter of appreciation to the governor.

A

And his team and telling him also they'll, be following up with a letter of the ask of resources.

A

So he's well aware, and so I gave the letter the gentleman in the back, the young gentleman, the back.

A

His name is dylan goldberg and he's the one that was our point of contact for the governor. That.

A

Spoke to us multiple multiple times through monday, really appreciate the sheriff as well keeping us.

A

Well informed so then I can then transcribe that to dylan- and I knew it was going to the chief.

A

And to the governor, so that's the letter, the um I don't know if the next slide will show, but um the.

A

Governor and lieutenant governor take it seriously and they literally were reading the letter.

A

um That I had just presented um and then afterwards I had the opportunity to provide.

A

A coin to dylan in his appreciation and they're all clapping. um So now it's the follow-up as.

A

Commissioner kyler says we're the shiny penny in maryland because of the way our sheriff.

A

Our uh coordination with the state's police, with westminster with dpw with bg e, especially with our.

A

9-1-1 and emergency services they received over 400 plus calls in an hour. Typically it's 10 to 20.

A

400 plus calls we, you know, I apologize say we they hold, you know with the sheriff and all of them.

A

Kept those folks in those vehicles calm and stayed in those vehicles. What was the disastrous? Could.

A

Have been catastrophic, and uh so just you know another way of saying we in carroll county know.

A

What it looks like and we performed it that awful day and we're able to share it with the governor.

A

And his team, and now we're just going to continue to follow up and I'm no longer going to be giving.

A

Kudos to the sheriff since he's in the back of the room and I'm kind of getting tired of that, so, okay.

A

Priority carol, mr vigliotti. Thank you, commissioner. Rothstein I'll begin by echoing your comments.

About our friend and our colleague jack, um you know he certainly will be missed around.

D

Here, I certainly will miss him, including the rides. I got on the golf card from him.

D

So to begin everybody remembers the other weekend was the grand opening the charles carroll.

D

Community center, I thought it was an incredibly well done ceremony. It was a fantastic turnout.

D

The building, I think, is beautiful and I want to you know thank my predecessor and friend steve.

D

Lance for speaking that day and for being the driving force behind the center and the ceremony.

D

Would not have been complete without him or with any of you who attended so this past week, I had.

D

The ability or the opportunity to attend the farm museum advisory board for a kind of summer, wrap-up.

D

Meeting the board is looking ahead to everything, that's coming in the fall and the winter while.

D

Commissioner kyler was away at mako. I had the privilege of attending the community college board.

D

Of trustees in his stead, I think I did pretty well because they didn't kick me out. They they are.

D

Really really good people, and you know they really did miss having you there, but I think I sufficed.

D

um I'll, let somebody else go into detail about the the joint meeting we had with.

D

Our board of ed our delegates and our senator about the implications and the challenges that.

D

We're facing with blueprint, I was happy to be able to attend that yesterday evening and then.

D

The last thing I'll touch you on this morning. A couple months ago everybody remembers, there was.

D

A shooting that happened right beside northwest middle in taneytown and very recently I want to.

D

Thank our very recently thanks to the efforts of our state's attorney haven, shoemaker and the men.

D

And women of his office, they were able to put away the culprit. I also want to take a moment again to.

D

Thank our sheriff and law enforcement for quickly, reacting and curtailing reacting to and curtailing.

D

What could have been an even worse situation and between the efforts of the sheriff and law.

D

Enforcement and the state's attorney you know that underscores the seriousness with which we take law.

D

And order in carroll county and why this board of commissioner supports our sheriff and our state's.

D

Attorney in any way that we can and that's it for me this morning, okay, thank you, commissioner. Tyler.

Yes, um thank you um and first off I'll mention uh jack leburn and deepest.

E

Sympathy to his family and close friends, he had a lot of them. um It's it's so tragic.

E

How quickly you can find out that you have a health problem and how quickly it can.

E

Take you and and I've seen it with others, and we saw it with him and kudos to him.

E

He he planned everything that happened this week.

E

um I think down to uh probably the menu of what we got to eat after the funeral and uh it's it's.

E

Amazing, and uh and according to uh family members, I talked with his last two days or three days were.

E

Pretty ugly, but up till that point in time he was talking with everybody and doing stuff and playing.

E

And stuff and that's just awesome and and again deepest sympathy to his his family and friends.

E

um Mako was great: we got to meet a lot of the secretaries. We got to meet a lot of.

E

People walking around I need to share two emails with uh my colleagues up here.

E

um One one guy I bumped into offered us a grant or offered offered us to be able to apply for a grant.

E

um And and others were trying to sell stuff and I've done a couple.

E

Emails and got a couple emails. I need to share them with everyone.

E

Back to the um the tragedy that we had and and the the governor and the lieutenant governor and.

E

Other staff with the state- yes we're on their radar, the one thing that I think impresses them.

E

The most and I think they see it and- and I like to say at our meetings, I love carroll county.

E

In carroll county, we work together like that, when it's not an emergency, I think there's other.

E

Counties they would have been bickering about where the governor would meet and who was really.

E

In charge, none of that happens here um I do want to say, and I'm going to get in trouble for this.

E

When I go to the barracks, I always get a hug. You you've never hugged me that I can recall and he's.

A

Going to sheriff deweese, who never does physically touched, commissioner kyler just for the good of.

A

The audience so I was glad it was there, but but it's just I I just and- and I don't want to forget.

E

So many people pitched in did so much people were smart enough to stay in their cars and the phone.

E

Calls helped that, but we also had volunteers out cleaning clearing roads with their personal.

E

Chainsaw and their personal bobcat, and it's just it carroll county, is amazing, and I love it here.

E

I did get to go to a ribbon cutting for I want to get the name right, hyperspace rocket designs.

E

And t-bar, which is an interesting combination, and she has a a couple. Other businesses and.

E

It was really fun to be there, and- and uh one of the reasons that I made sure I went is.

E

They kept mentioning commissioner weaver, and I wanted to tell them that he would have been there.

E

If he could have but but he wasn't but a great event- and uh I think we forget too sometimes.

E

Our chamber does so much with these small businesses and and orchestrating those.

E

Events and uh their presence there was was very important and- and it's just what they do, it's neat.

E

um Yesterday we had a joint meeting with board of ed our delegation and us and talked about the.

E

Issues with blueprint- that was a topic we heard a lot about both in sessions and walking around.

E

At mako, it's it's a it's a problem with uh every county. The problems may be different with each.

E

County- which is why we need some opportunity to exercise local control and do what's best for.

E

Carroll county because, as you you like to say, carroll countyans know, what's best for carroll.

E

County and I'll be honest, howard countyans know what's best for howard county, but to.

E

Think that we can come up with a perfect school for the state of maryland that fits 24 different.

E

Jurisdictions is uh pie in the sky and foolish thinking charles carroll. That was a great great.

E

Event- and he did a great job speaking and.

E

Commissioner, wentz did a great job speaking and uh I'm I'm hoping that building gets used I'll.

E

Be in trouble for this comment, but we need to have more than just pickleball there. Now don't.

E

Tell her I said that, but uh but are you saying you don't like pickleball? uh No, no! I love it.

E

I got to watch commissioner vigliotti play it and uh in his suit, no less yeah in a.

E

Suit they actually have video, but your opposition was very proud that who won.

A

Well, they were 96 years old [laughter]. um Lastly, on a on us very, very serious note.

E

um This week we lost an 18 year old recent graduate from westminster, high school randy green.

E

And uh everything I hear there weren't a lot of warning signs and uh it's just.

E

um It's so hard to lose somebody who was so active and had so many friends and played football and.

E

Wrestled and and graduated from high school- and I I don't know I I think carroll county- pays.

E

Attention to mental health and pays attention to uh to all of this. I don't know what we can do more.

E

But we need to try it's just it's so depressing. I think think both of his viewings are tomorrow.

E

And uh it's just, uh um I did not know him well, he was a cousin of of our wrestlers and and saw him a.

E

Lot saw him at a graduation party a few weeks back um and and uh it's just tough, I mean we lose jack.

E

Who's on one edge of the age group spectrum, almost as old as I am, and then to see an 18.

E

Year old, within the same time span it's it's just heartbreaking and- and I need I needed to.

E

Say that today and if anybody's interested, I think there's a gofundme page to try to.

E

Help pay for his final expenses and uh and if anybody's interested in stopping to buy.

E

Fletcher tomorrow, I think it's it's a typical afternoon and evening and in tournaments private.

E

And I think on facebook they're doing a celebration of life someplace on saturday.

E

But um it's it's hard. Thank you absolutely, commissioner. Courtney. Thank you.

Well, first and foremost, I will obviously give my sincere condolences and.

F

Sympathies to the library and family, a number of us were in attendance at the service this week.

F

And you know, jack's been called everything from a maverick to a force and I think the reality is.

F

And we all know this, whether it's business owners in the community or our staff here at the county.

F

He left an indelible marco in carroll county that'll, be here for many generations to come.

F

um Very much someone that we're going to all miss and someone that definitely was heavily involved.

F

In the community, not only from the business standpoint, but everything from civic groups.

F

To just the community as a whole with who jack was definitely been a a week, for I guess I would say.

F

The loss of people, commissioner kyler mentioned the young graduate from westminster, high school.

F

We also have uh this past week we lost 99 years old, but it was elise louise bast who was the first.

F

Curator of the carroll county farm museum- uh she passed this week peacefully on saturday and then.

F

Also a gentleman I got the opportunity to meet back in june, who was uh dealing with agent orange.

F

Issues mr george keaney, who was fortunate enough to receive 50 years after the fact his uh his air.

F

Medal mr keaney passed a few days ago. I'm going to be briefly leaving this morning to stop out.

F

And see the family at his uh uh visitation, and I will be back shortly there after that.

F

um And I think it's just unfortunately it's it's that tricky part of life, there's no really good.

F

Clean way, to put it, obviously, all of these individuals have have affected all of us in.

F

Carroll county in a variety of ways, and we're very fortunate that we have amazing people in carroll.

F

County, it's just unfortunate that we don't get to keep them as long as we would like to.

F

um On a different note, I will mention that on monday I attended the uh the cafe at tech court.

F

Ribbon cutting the tech court cafe is owned by collision course. Some of you may know them from.

F

A variety of events on main street in westminster, uh tony and ashley gerald the dynamic duo that our.

F

Collision course are an incredible team. They've have over 30 years of restaurant experience.

F

Collectively and they will be opening a location on main street in westminster in the near future,.

F

As well so they will have the location at tech court which just opened. That is a takeout venue.

F

Only otherwise, and that is located in the fr conversions building, it's primarily utilized.

F

For fr conversion staff, but it is a takeout restaurant for the public on tuesday morning I was.

F

Able to attend the ribbon cutting for the carroll county health department's wheels, the mobile unit.

F

They've now set up for health on wheels. I think think this is going to be a significant asset.

F

To the community, as there are people throughout our county, even though we we consider ourselves.

F

Rural, we don't realize. Sometimes I think how rural we are in places. This will give access.

F

To a variety of health care usage without having to come into the uh the carroll county, hospital or.

F

Other locations for certain things, I think, that'll be a huge benefit to the community. I look forward.

F

To seeing how how that works moving forward, it was great we had garrett hoover from the hospital was.

F

There as well as well as a number of other parties to wearing that, and I just think it's going to be.

F

Incredible benefit, and uh that is all I have this week great. Thank you. Thank you, commissioner. Karen.

uh Thank you good morning, carroll county. So um as far as jack lyburn again, I I didn't know him.

G

As long as as many others, but I did feel like I got to know him and in the short period of time.

G

That I didn't know him. He was extremely helpful for me down in my district to quickly understand.

G

And learn what was really going on in terms of economic development and some of the businesses.

G

And some of the other things that were happening down there or could happen so for that I'll I'll.

G

Be eternally grateful and uh speaking of grateful, I was very grateful for the the opportunity we had.

G

As a group to spend a little bit of time with his daughter and his staff, which I think he felt was.

G

Part of his family prior to his passing. So for that I am extremely grateful because I again I I.

G

Didn't know jack as long as many others, but I felt like I did get to know him and he will be missed.

G

And also appreciate commissioner kyler mentioned in that young man, when I saw that you know I.

G

That's that's my children's age group and it was jarring. My thoughts are with the family, it is.

G

Extremely tragic mental health is hard. It's really hard one of the easiest things we we can come up.

G

With is is for the ability to people to make a phone call. I know we've talked about 988 a lot.

G

I'm here, as a commission and all five of us strongly support its efforts. So 988 is an.

G

Option for people, let's get that number out in the community and in our schools in our families.

G

Let's get it everywhere, so people know that help could could be as easy as a phone call.

G

So I appreciate you mentioning that um I did want to mention.

G

In terms of of situations that our life and death- and I appreciate the staff bringing this up, this.

G

Morning and I've got the honor of mentioning that we do actually have two uh we're all keeping tabs.

G

On this horrific incident, this tragedy in hawaii in maui and what I discovered this morning and.

G

I appreciate the staff sharing this with us is that carroll county actually has two volunteer.

G

Members currently deployed to maui hawaii as part of fema's urban search and rescue system.

G

Usar is the acronym both are members of maryland task force, one based out of montgomery county.

G

So that that is, that is just amazing. I mean we've got two people from carroll county maryland. All.

G

The way over in hawaii dealing with that situation, which is just horrific and it.

G

Seems like it just goes from from bad to worse, so I wanted to bring that up and then lastly,.

G

You know, commissioner kyler mentioned how great I think, we've all mentioned, how great we get along.

G

Here in this county, we have our differences of opinions sometimes, but we get along and.

G

That was on display last night at the meeting between the carroll county board of education.

G

Our carol delegation and the commissioners yeah, I thought it was a pretty extraordinary.

G

Mailing meeting for a couple of different reasons, but more so mostly because again.

G

You I pro, I would imagine it's fairly rare, to get all those people in the same room who agree.

G

On a path forward, what needs to be done and that discussion centered all around maryland blueprint.

G

I've been talking about maryland blueprint for about six months now and it's gaining the.

G

Concerns growing over it, it is official about maryland blueprint. It is a very ill-advised.

G

Ill-Funded ill-conceived funding and resource mandate that happens to be an education program.

G

And that's my thoughts on it and counties. Municipalities all over the state are slowly.

G

Becoming to the realization that it's not going to help them at all, we know it's not going to.

G

Help the state of education here in carroll county and I think a lot of people around the state are.

G

Trying to are finally realizing that better late than never so we're going to do our part working.

G

With our delegation, as they go back to annapolis, we're going to work with fellow municipalities.

G

On some common ground in terms of blueprint, because there is common ground amongst many.

G

Different diverse counties and that's important so you'll hear much more from us going forward, but.

G

That meeting last night I felt was, was pretty extraordinary, really just if anything in the.

G

Sense that we're all coming together and having a real, constructive conversation educating each.

G

Other and then looking at paths forward to how we're going to do what's right for the carroll.

G

County public school system and our children, because that's what it's really all about.

Thank you, I I appreciate it and I don't think there's any jurisdiction in maryland. That brings.

A

Together the border county commissioners, board of education and the legislators in one minute at.

A

Least I have not seen or heard in my tenure that that's ever happened, so that is a testament to.

A

You know us all working together and just to one more quick. Second, I was not in attendance of that.

A

I was at another event dealing with something of education, resiliency program center on fort meade.

A

And its focus is on mental health, a large part of it. It's focused on a lot of things, but very large.

A

Focus on mental health I'll be leaving at 10 to go back to the installation to talk about mental.

A

Health in the family, in the military community, which you know affects all of us, because eight.

A

Percent of that workforce is here in carroll county. You know and we're not just talking.

A

Those men and women in you know uh uniform whether it be red, blue or green, but it's also the family.

A

Members and it's their neighbors, it's everybody! Everyone is affected when something happens so.

A

um So I do appreciate the highlight of that and the importance and I'm those that know me: I'm not.

A

Very silent when it comes to trying to silence the stigma of you know: challenges with mental health.

A

um Okay, let's move forward and uh miss carol. Let's talk about uh a chain, can I say one thing really.

Quickly, I apologize sorry because I don't use. I there's a new addition to our public hearing.

Room an absolutely gorgeous uh desk now for presentation area that matches the other areas.

um You may or may not know this, but our facility staff built all this furniture, including this.

C

New edition- and um I think I think it really makes it look very nice and lisa- gets to be.

C

There they are yeah. Well, hopefully they signed it. The bottom or somewhere so and um lisa gets to be.

The first one to use it, the inaugural lizzy, you have the honor, so don't don't don't mess it up.

So we're going to talk about a change order. Steel pavilion at piney run park. Yes good morning, commissioners, good morning.

Yes, yes, sorry.

I

The carroll county department of recreation and parks entered a contract with game time.

I

um Care of cunningham recreation to construct a steel pavilion at piney run park. The.

I

Board concurred in december of 2022 to award this contract in the amount of 124 975.24 cents.

I

Since that time, a change order has been issued in the amount of sixteen thousand.

I

Four hundred thirty dollars, which exceeds the 10 percent of the original contract that.

I

um Has has now requires the board to approval, approve these additional funds. This project.

I

Is funded through the lppi dnr and I will let lisa take over to tell you about the pavilion.

Yes, so this is a totally 100 funded by the local parks and playground infrastructure grant from.

J

The state this uh intent for this project was to have another company come in and take care of the.

J

Flat concrete flat work, the silt, fencing topsoil, sodding and soil stabilization.

J

However, the game time um company is willing to do that, so we don't have to.

J

Bring in another outside contractor and add this into the current scope of the project.

Motion to approve the spending of an additional sixteen thousand four hundred thirty dollars to.

D

Game time, care of cunningham recreation for the completion of the steel pavilion construction at.

D

Piney run park. Second, I have a motion. I got a second any discussion seen here in an all.

When you come on up and talk about driving simulator and the dell semi rugged computers.

Real quick note, commissioner guernitz chief tom ledwell's wife, is one of the responders to maui.

K

Oh okay, she's a in one of the urban search and rescue units and is a retired, montgomery.

K

County firefighter fire rescue down there, so with all the pressure he's got his wife's in.

K

Maui, for probably a month, so not a fun trip to hawaii. No, that's the way you want to go no, but.

K

They're good people, and- and so uh it's amazing just to let you know that somebody we know.

I

Okay, the office of procurement in cooperation with the carroll county, sheriff's office, request.

I

Your approval to purchase a parole, sim, 7 law enforcement, driving simulator with the needed.

I

Accessories and a four-year extended warranty to l3 harris in the amount of 126 thousand four.

I

Hundred dollars, this cost is offered at a 20 percent discount off list price. If the order.

I

Is placed before september 22nd, the maryland department of public safety and correctional.

I

Services has sent l3 harris a notice of intent to award and is awaiting for final approval from.

I

The maryland board of public works, which is scheduled for september, the 20th 2023.

I

The shares has been awarded a grant which will fund this purchase. This amount is within the.

I

Budget and no additional fund should be required and I'll. Let sheriff always tell you about the.

I

Patrol sim, so this is not the simulator that you used back in high school to learn to drive.

um My first police car was an 87 caprice. I think rich was a a horse, so so uh this this system, if.

K

You look in inside of our police cars now um it could resemble the cockpit of an f-16 and so.

K

um We didn't have that when we were growing up in the police department, so computers, uh cameras.

K

All the technology- that's in these things, these simulators are- are priceless to us to give us a.

K

180 degree view, but you can imagine the virtual reality systems today the ability to put a new.

K

Recruit even in service in a system like this and show them all the the features or the the.

K

Obstacles that they're gonna they're gonna see as they navigate down the road just routine patrol.

K

High-Speed chases, or even um just going to an emergency response call and and what comes at them.

K

It's not uncommon and we've seen so many crazy things that you're riding down the road I stopped.

K

A woman for speeding on 140 at center two days ago and uh she stopped just cold turkey in lane. One.

K

um And we're all panicking there's a bunch of cars behind me and and these recruits need to see that.

K

They need to see the people, don't just calmly pull to the shoulder and they don't just calmly get out.

K

Of the way, there's all sorts of things that happen in front of them, and so this simulator will will.

K

Get to the academy, as we start in a couple of weeks, we're hoping to get it, get it set up and.

K

And situated in our virtual reality room, we do have a milo system for firearms and use of force.

K

It'll, go in that same room, so it'll work out just absolutely wonderfully for for the new academy.

K

Coming in and as well as in services, we start that in january, um all all grant funded. We applied for.

K

It some time ago and of course, maureen's group made sure that everything was legit before we. We.

K

Applied for everything, so um we have to have that, but any questions on it can we try this.

K

You can yeah yeah, it was dale earnhardt senior that used to ride with.

K

um North carolina highway troopers regularly at a friend that was a north carolina highway trooper.

K

The additional cost, in addition to preserving the roadways, the complete width of the road.

Instead of just the lane width, the county database shows lane width the actual width of.

The road and I had some measurements done, for example, freedom avenue database shows 22 foot.

The actual average is 27.8 feet when you go side to side versus white line, to white line and.

To preserve the road, you should do the entire width instead of just white to white, because.

Then, if the edges are preserved as well and they don't fall off and break which end will.

End up working inside of your white lines, so that was one road. It was an increase of 3 500.

Square yards, a second road that we went out and re-measured and re-looked at was pinch valley.

And the database shows 18 feet. There are certain sections that it's up to 28 feet if it's on a turn.

And and variances, so that's what made up for such a large variance this year.

Why wasn't the homework done prior as far as the width of these roads? If we knew we were going.

To be focus on these roads last year we were staffing, we don't have the staff to go out and.

Measure every road one of the inspectors that helps with this was out on medical leave. Last.

Year from september to december, that left us with one inspector to maintain all nuisance complaints.

All utility complaints, staffing, yeah, okay- I mean that that that's a fair answer. It's just we we.

Approved this in may and we have a changeover about 30 percent. You know increase now I mean.

An individual to meet these needs and by project so you're outsourcing it to a firm to say, hey here,.

Is the task we do not have the resource in-house because of the short staff it may cost? Fifty.

Has reviewed for the legal sufficiency for that contract just a little background to understand.

What this is bonds are funded or a funding source of capital projects that you have approved in the.

Community investment plan cip book in order to achieve the best value for the taxpayers, money.

The county works with each rating agency to obtain a credit rating, so.

We work with the three rating agencies, who are moody's, fitch and standard and poor's.

What does that mean for the county, a credit rating measures, the credit worthiness of the.

County and or the ability to pay back bonds by the county investors base their borrowing.

Rate our borrowing rate on these credit ratings, so a county, that's aaa like us, would and should.

Get a lower interest rate than a county that would be of equal size that was rated triple b.

So currently we are a county with triple triple a rating um from all three of those rating agencies.

uh Restaurants in the ag district, so as a very quick background there on may 4th.

um You asked us to investigate and look into this issue and really there were two primary.

Issues that we were looking at one is food preparation at farm alcohol producers and.

X

Then also restaurants functioning at golf establishments on july 18th. The planning.

X

Commission gave both amendments that we presented to them as recommendations, a.

X

Favorable recommendation back to you all. We presented that information to you on july.

X

27Th and you agreed to on to direct us to go to public hearing, which is why we're here today.

X

So um again, the purpose of the farm alcohol producer amendment is to make the county code.

X

Consistent with the state liquor requirements- and our recommendation is a very simple change to add.

X

In text that essentially states that the county code will follow the state law and uh yes, while.

You're there, technically, if we want to be more strict, we certainly can, but we've made a decision.

E

That we we'd prefer not to, and that's why we're doing this exactly yes, and it also state saves.

X

um Time and effort, if the state were to change their the law and make things less strict than the.

X

County would remain in consistent with that moving forward. So yes, but you're, absolutely correct.

X

Regarding the restaurants at golf courses, our understanding is that the industry, the golfing.

X

Industry is pretty common for restaurants to co-exist at golf facilities, whether it's a.

X

Golf course or a driving range, and so we wanted to make that allowance for, um for those types of that.

X

Kind of business practice when we met with you on the 27th it was. The concern was brought up that.

X

um We wanted to, we did not want chain, restaurants and those in those um all right, fast, food type.

X

Restaurants to to be considered for this, because we're not interested in a golf course then.

X

um Reaching a deal with a fast food, restaurant and and opening up on their property, and so.

X

um We revisited um well, this is the same as you saw before the use table and we added in a cup two.

X

um Caveats to the code that we think will protect that. The first is item d on the list there, which.

X

Is that the food service, as part of a golf course, and our golf driving range may not include a.

X

Drive-Through service, we recognize that fast food restaurants, most often have drive-through service.

X

And so if we prohibit a drive-through service, I think that'll keep that type of of use from from.

X

Developing the other recommendation we have is that the food services allowed within this.

X

Section must operate under the existing name of the golf course and our driving range. So if, if it.

X

Was a fast food chain type restaurant? They would want to take advantage of the marketing power of.

X

Their their brand name right. So if we require that the restaurant or the food service at that golf.

X

Course function under the name of the golf course that would lend itself up. We think more to what is.

X

Desirable, which is allowing for the food service, but not promoting restaurants, especially chain.

X

Restaurants and fast food, so those are our two recommended changes from the discussion.

The last time we had with you, but at this point we would open it up for public comment and so on.

Well, before the public comment, um this is being proposed as allowed uses not conditional uses.

Correct, actually, what we're proposing is that a restaurant if they want to function at a golf.

Course that it first of all needs to be co-located at the rest, at the golf course, and also that.

It would be conditional, so they would have to go before the bca for approval for that unconditional.

Use and my next question was going to be what's the difference, but you essentially asked that.

If it's an allowed use, they don't have to do that correct if it's conditional they do, and there can.

Be some more restrictions? Yes, given at that point in time. Absolutely that's the difference. Yes, and.

It also opens it up for additional public comment, so it's a public meeting, so the public can express.

Their opinions that, during the bza process as well, okay and and uh technically we'll we will need.

Critique the language in the two proposals today, it's to it's sort of a reminder. We had brought a.

Proposal to the prior board of commissioners back in november to allow a a restricted uh restaurant.

Use uh incident to the farm, alcohol production, of course, we're interested in cold saturday farm.

But we felt that we could draft it in a way that it would make sense to to appear in the zoning.

Codes, I have the language here that maybe you can you can give it to uh I'll follow along with me,.

What we are proposing is that, in the section under farm alcohol producer accessory uses.

Which would be uses that are allowed incident to the farm alcohol production? That list currently.

Includes 19a tasting rooms b accessory food sales to accompany the beverage tasting, see.

Retail sales facility for sale of novelty and gift items related to beverage the sales of beverages.

Produced on site, e-guided tours f, promotional activity, so they're already in the code, we would.

Propose the addition of g, which is highlighted in red, a reservations only dine-in restaurant with a.

Seating area not to exceed combined square footage of the farm, alcohol production, storage and retail.

Areas which incorporates existing agricultural or historical structures on the grounds and then.

Of course, subject to integrated site plan, approval with the main farm, alcohol producer facilities and.

The bulk requirements, which would include setbacks that were otherwise applicable to the farm, alcohol.

Producer use, which are already in the code. uh So what I'd like to do um what we would like to.

See is for you to incorporate this in the current initiative to uh to amend the text to include this.

I know we're a little bit out of the process, but we just didn't realize until this was presented.

To the planning commission that it was back up for discussion, but we're very close in nature,.

To what you're, considering now you're, considering restaurants in a rural area and there's still a.

Keen interest by the cold saturday farm operation to pursue this in the future. This is not something.

Want to commercialize the farm and keep it in the family. We don't want to subdivide another.

Farm, it's a beautiful, beautiful piece of land and we certainly invite you all to come out and.

See what we have planned the situation we're in is that we have a beautiful home that was built.

In 1765, french colonial manor stone manor house that we're trying to figure out what to do with.

In the future, so it's a very unique special situation and we're getting the farm alcohol.

Production designation, uh but to me the house really has the opportunity to be use something.

Similar to the milton inn or the antriman, something really fine, something very special.

Something that would really be a destination for people to come out to carroll county.

um Again, something uh reservation only probably three or four nights a week.

um Set menu sort of something. But if the house deserves to really tell its story and uh kind of.

Move into like a new generation, my father's lived there for 40 something years he's 80.

um We're passing the farm over to my brother and I so we're just trying to find out what we can do to.

Make the place special open it up to the public and really create something that carroll county.

Can be proud of so I know we find ourselves in kind of a little bit of a a gray area here.

I think this is an issue that I feel we're all coming to terms with we're getting a lot smarter.

It doesn't restrict businesses and that's what we want. That's what we're here for right.

Restaurant with reservations and so on, but maintain that stick to that prescribed list.

Of what the liquor state liquor license says, there would not need to be a change to the county code.

To allow that, because what we're proposing is, is that we maintain consistency with the state law.

My concern is that this would be less restrictive than what the state law says and would want to.

Talk with the county attorney's office as to whether that's something that's allowable so.

What we're really talking about here with this is not necessarily whether or not they can or can't.
