B
A
Have
a
quorum
welcome
to
the
Monday
april.
Twenty
fifth
meeting
of
the
evanston
city
council
first
item
on
the
agenda
is
mayor's
public
announcements
and
proclamations.
It
is,
as
you
might
be
able
to
tell
from
my
interrupting
a
and
pw
drinking
water
week,
and
it
is
Arbor
Day
2016
and
its
municipal
clerk
week.
I
prom
I
apologize,
Rodney
I,
don't
have
your
Proclamation
here,
but
it
is
signed
and
ready
and
I
have
one
proclamation
to
read.
I
hope,
I'm
pronouncing
this
correctly.
A
A
D
E
Okay,
Thank
You
alderman
Miller
for
your
fiduciary
responsibility
and
a
P&W.
It's
talking
about
chicken
and
waffles
I
find
it
troubling
it
once
again.
Staff
is
really
not
on
top
of
the
issues.
They're
very
embarrassing.
Now,
I'll
move
on
to
what
I
have
to
say.
It's
interesting.
The
mayor
wants
to
pass
another
statement
on
a
political
statement
tonight
wasting
everyone's
time,
unfortunately
than
the
Supreme
Court.
The
city
has
many
problems,
I
think
the
law
department
is
probably
one
of
those
problems.
E
It's
clearly
an
issue,
as
I
pointed
out,
as
we
pointed
out
in
the
round
table
in
back
in
February,
the
cities
of
law
department
has
spent
over
five
hundred
thousand
dollars
on
the
Night
Court
lawsuit,
claiming
environmental
issues
at
the
site
when
in
fact
they
told
residents,
there
were
no
issues
also
using
the
cities
of
claims.
Gas
as
a
solid
has
been
actually
stated
by
the
EPA
several
times
to
not
be
the
case.
Casting
very
serious
and
concerns
on
the
judgment
of
the
staff.
E
I
suggest
the
mayor,
rather
than
passing,
these
kind
of
political
statements
appoints
a
committee,
maybe
with
mr.
Jones,
who
is
an
attorney
in
qualified
reported.
The
round
table
to
have
a
hearing
on
this
tonight
court
suit
and
determine
why
this
is
such
a
mess.
Unfortunately,
I
remember:
the
law
department
erased
the
Harley
Clark
tapes,
which
was
rather
interesting.
Every
time
we
have
a
council
meeting,
we
have
some
problem
was
something
that
isn't
done
in
the
fiduciary
interest
for
the
taxpayers.
E
Unfortunately,
chicken
and
waffles
to
forgive
100,
two
thousand
dollar
loan
is
outrageous
to
me
and
remember
the
next
theater
when
we've
had
mess.
It's
there's
a
similar
pattern
here
of
all
these
economic
development
activities.
That
seem
to
be
a
problem,
and
certainly
we're
going
to
hear
about
the
Howard
Street
Theater,
which
is
a
similar
problem,
and
tonight
we
have
the
lease
renewal
at
Ward
8,
but
I
I
heard
it's
a
beast
in
the
past
that
Ward
8
was
going
to
refinance
the
loan
and
get
the
city
out
of
this.
E
So
what's
going
on
here,
are
we
having
another
potential
problem
down
the
road?
Possibly,
of
course
the
city
manager
did
everything
to
block
harley
clerk
and
prove
no
real
and
provided
no
cost
analysis
used
for
a
public
facility.
But
we
have
plenty
of
money
for
this
economic
development
activity
that
really
generates
no
value
to
us
cost
a
lot
of
time
and
money
of
staff.
Then
waste
a
lot
of
money
and
doesn't
do
anything.
E
My
mind's
fading
away
with
so
much
but
the
howard
street.
As
I
stated
at
the
last
meeting,
you
are
looking
for
competent
leaders
in
the
community
to
lead
a
fund-raising
effort
for
robert
crown.
Unfortunately,
I
feel
residents
are
not
going
to
want
to
get
involved
of
this.
When
I
you
look
the
mess
we
have
I'll
close
on.
This
I
almost
fell
out
of
my
seat
laughing.
When
one
council
member
suggested
she
should
get
a
big
raise,
so
she
could
donate
money
to
Robert
crown.
F
Thank
You
Madeline
decree,
hello,
everyone,
I
Russian,
run
in
the
district
65
in
here.
I
forgot
my
speech,
but
anyway
I'm
just
going
to
summarize
a
little
bit.
What
I
wanted
to
say,
I
wanted
to
bring
up
the
issue
to
the
council
about
the
shooting
that
went
on
on
asbury,
I'm
kind
of
concerned
about
that
shooting
by
the
police,
because
at
first
I
thought
it
was
in
the
neighborhood
that
the
person,
a
young
man
who
did
the
shooting
I'm
kind
of
concerned
about
the
taser
gun
that
was
used.
F
That
could
not
sort
of
stop
this
young
man.
Did
we
not
have
some
training
on
that
the
Taser
and
also
the
shooting
and
I,
don't
know
if
the
investigation
is
finished
or
not
with
this
incident,
but
it
bothers
me
because
the
policeman
did
the
shooting
and
it
was
a
BB
gun
grant
you
someone
said
the
BB
gun
looked
like
a
real
gun.
I
can
get
that
understand
that
my
concern
is
when
the
policeman
did
the
shooting
did
the
young
man
had
the
gun.
F
F
Believe
me
I'm,
not
saying
that
note
should
not
be
any
safety
there
for
the
police
officers,
but
the
training
or
when
to
use
that
gun
and
when
not
to
use
it,
and
if
we're
going
to
have
a
shoe,
whether
it's
young
people
or
the
policeman
we
had
better
take
another
look
and
I
would
like
to
sail
a
bit
more
about
the
chicken
and
waffle.
My
one
of
my
favorite
restaurants,
that
was
here
in
this
town,
we
lost
it.
F
I'm
sorry
now
I
have
to
try
to
go
to
Chicago,
but
in
Robert
crown
I
wanted
to
say
something
about
that
too,
because
there's
I
understand
it,
there's
a
library
that
people
are
trying
to
get
it.
Robert
crown
we
have
been
trying
to
get
a
library
here
in
the
fifth
Ward
for
a
long
long
long
time
and
I
was
wondering
what
happened
to
that
idea.
Thank
you.
Thank
you.

I
J
Madam
mayor
members
of
council
and
city
clerk
green
with
respect
to
the
action
requested
of
myself
at
the
committee
I
obtained
a
copy
of
the
cook
county
clerks
tax
Redemption
certificate,
which
indicates
that
the
taxes
at
the
subject
property
at
24-24
dumpster
the
deficiency.
There
is
noted
in
the
amount
of.
J
J
Systema
twas
stamped
received
by
the
Cook
County
Clerk,
approved
by
the
Cook
County
Clerk
I,
should
say
it
was
transmitted
to
the
law
department
pursuant
to
our
request
and
demand
made
of
the
seller's
attorney
after
some
delay.
The
seller's
attorney
finally
did
comply
with
their
quest
and
provide
us
with
this
information.
The
total
tax
is
indicated
on
this
Redemption
track.
J
The
item
on
page
288
of
the
City
Council
packet
line
number
1
305,
which
speaks
to
redemption
of
taxes
owed
to
cook
county
for
the
years
2012
2013
2014
and
the
first
installment
of
2015.
The
number
there
is
1945
62
and
thirty
cents,
which
correlates
with
the
number
provided
on
the
documentation
from
the
Cook
County
Clerk.
H
G
Wasn't
the
APWU
committee
meeting
but
I
tried
to
listen
to
I,
think
all
of
it
is
agreeing
to
release
the
lien
for
this
payment
amount,
but
not
releasing
the
deficiency.
An
option
I
mean
o
in
the
ordinary
universe.
It
is
an
option.
Is
there
any
reason
why
we
cannot
structure
it
that
way
in
this
situation?
I
can.
J
Represent
to
the
council
that
we
have
repeatedly
pursued
that
up
and
with
the
seller's
attorney
and
his
response
to
us
always
was
speaking
to
the
issues
of
economic
development
and
the
need
to
redevelop
the
property
which,
of
course,
our
policy
issues
outside
the
purview
of
the
law
department
with
respective
structuring
the
deal.
We
did
our
level
best
to
to
frame
it
in
such
a
way.
J
I
can
tell
you
that
the
seller's
attorney
was
adamant,
that
if
it
was
the
city's
position,
that
it
would
keep
waiting
and
not
provide
a
release
sufficient
that
that
could
be
tendered
to
the
title
company
and
the
title
agent
that
the
deal
would
continually
fall
by
the
wayside
in
the
city,
in
his
view,
would
run
the
risk
of
possibly
getting
no
money
back,
because
the
simply
put
the
seller
is
never
going
to
pay.
The
taxes
never
wanted
to
pay
the
taxes,
and
this
is
the
issue
this
is.
J
G
H
J
Two
points
I
will
represent
to
this
council
that
dealing
with
this
seller's
attorney
has
been
challenging,
to
say
the
least,
and
the
fact
that
he,
as
an
officer
of
the
court,
has
taken
positions
representative
of
his
clients
wishes,
which
are
completely
adverse
to
good
faith
and
fair
dealing
to
two
other
obligations.
At
it
alone,
I
can
say
that,
given
the
history
of
those
interactions,
that
I
have
every
confidence
in
every
expectation
that
the
seller's
attorney
will
not
be
cooperative
all
the
way
up
to
closing
at
closing
post-closing.
I
I
Now
I
understand,
you
know,
there's
issues
of
whether
the
judgment
proof,
if
there's
I
mean
we
haven't,
looked
until
they
me,
if
there's
any
other
assets
of
the
corporation
correct
right,
we
don't
know
anything
else
about
this
corporation
that
owns
this
building
right
any
assets
or
anything
else.
We.
J
We
have
no
indication
that
they
own
any
assets
and
the
fact
that
they
were
involuntarily
dissolved
by
the
Illinois
Secretary
of
State
I'm
drying,
an
informed
guess
that
there
is
nothing
to
pursue
their
with
respect
to
the
status
of
the
other
corporate
entity
that
owns
the
two
other
locations.
We
not
been
given
direction
to
seek
pierce
that
veil,
so.
I
I
There
any
do
you
know,
there's
any
related
principles
between
the
two
corporator
are
related
principles:
okay,
see
I,
you
know,
I,
don't
I'm,
just
going
to
say,
I
think
we
have
to
do
more
due
diligence
into
this
before
agreeing
to
waive
the
loan.
I
think
there's
potential
enforcement
or
collection
actions
that
we
could
take
if
we
had
way
if
we
gave
you
more
time
to
do
some
research
into
the
different
corporations
that
are,
you
know
that
exists
under
different
DBAs,
so
I
I
think
it's
premature
to
to
prove
this.
I
C
So
the
option,
then,
in
terms
of
the
buyer
and
I,
have
to
say
again
my
focus
is
trying
to
get
the
building
back
on
the
tax
rolls
and
doing
business
and
producing
something
for
us
so
that
we
don't
have
a
complete
loss.
If
we
follow
the
course
I
think
that
ottoman
Wilson
is
suggesting
can
that
building
still
be
sold
to
the
new
buyer
in
a
timely
manner
so
that
that
piece
could
be
taken
care
of,
and
then
we
could
still
deal
with
the
seller
later.
C
It
I
just
want
to
make
sure
I'm
understanding
that
correctly,
because
I
hear
two
different
things,
I
think
ottoman,
Wilson,
I'm,
saying
one
thing
and
I
hear
all
of
Manila,
saying
I,
think
other
I
think
I'm
correcting
here,
I'm
hearing
two
different
things:
ok,
I
just
need
to
know:
can
we
proceed
get
the
building
so
on,
and
so
the
new
buyers
could
open
it
and
get
it
going
for
us
and
at
the
same
time
pursue
other
measures
once
that's
taken
care
of.
We.
J
Can
take
that
approach
at
closing,
I
don't
know
if
all
parties
at
the
table
will
be
satisfied
with
that
it
may
close
with
the
condition
that
that
alderman
Wilson
expressed
be
set
in
which
we
could
express
at
closing
as
I
sit
here
tonight.
I
just
don't
know
if
the
closing
would
actually
go
through
with
that
thought
that
set
of
parameters
in
place.
Ok,.
A
I'd
like
to
answer
that
question
a
little
bit
to
jail,
idol
called
me,
Oh,
three
or
four
weeks
ago,
concerned
from
the
bank's
point
of
view
that
we
not
drag
our
feet
so
that
which
was
his
quote
I
would
deny
we
are
dragging
our
feet,
but
so
that
the
sale
could
go
through.
So
he
was
clearly
concerned
about
the
timing,
alderman
rainy,
then
alderman,
Wilson.
H
So
I'm
prepared,
because
I
I
believe
that
this
could
this
could
close
out
the
possibility
of
selling
this
property
I
think
we
should
go
ahead
bite
the
bullet
go
ahead.
Consider
this
our
contribution
to
a
new
business
coming
in
and
if
there's
any
way
without
bringing
up
the
issue
of
not
disposing
of
what's
owed
to
us
by
the
seller,
and
if
we
could
pursue
him
in
any
way,
I
mean
we
should
I,
don't
think
we
can
I
think
it's
a
waste
of
our
time,
so
I'm
going
to
encourage
us
to
support
this.
H
G
G
But
if
the
sale
doesn't
go
through,
if
the,
if
and
these
things
they
are
time-sensitive,
we
don't
know
exactly
how
much
more
time,
if
any
time
the
tax
buyer
is
going
to
extend
the
redemption
period.
So
if
they
decide,
you
know
what
done
waiting
I'm
just
going
to
go
file
my
petition.
Now
we
have
an
entirely
different
problem.
Now
we
run
the
risk
of
not
getting
anything
so
I,
certainly
don't
want
to
double
down.
G
G
I
Turn
e4
our
world
so
we're
secondary
as
a
creditor
in
this
room,
its
first
bank
at
russ's
first
correct
is
that
just
cite
an
aside
in
regard
sur
other
loans.
Under
this
program?
Are
we
usually
I
mean
I,
assume
the
rel
structured
differently?
Are
we
mostly
secondary
in
those
those
moments?
I
know
it's
hard
for
you
to
come
out
the
top
your
head,
that
you
know
every
single
of
these
contracts
we
have,
but
on
your
recollection,
is
that
our
practice
that
we're
secondary.
J
Let
me
let
me
think,
for
a
minute,
I
think,
with
respect
to
the
novel
circumstances
of
this
particular
transaction.
The
way
it
was
structured,
we
were
secondary,
I,
don't
believe
that
that
protocol
obtains
in
other
situations-
and
we
can
certainly
follow
up
with
you-
to
confirm
that.
But
but
this
is
this-
is
an
outlier.
C
K
D
I
I
So
I
still,
don't
you
know,
I
I,
don't
think
we're
going
to
be
able
to
get
anything
at
closing
as
a
result
of
this
I
rather
actually
pursue
take
more
time
and
pursue
other
actions
against
the
holders
of
the
loan,
potentially
by
examining
their
corporate
structure
and
seeing
if
there's
a
possible
lawsuit
in
that
regard,
so
I'll
lose
but
I,
don't
think
we'll
get
anything
at
closing.
So
I'm
gonna
vote
no
well.
I
You're
not
going
to
get
anything,
no
I
said
I,
don't
think
we
will
I
mean
I,
don't
know
we
don't
know,
I
mean
here's
the
thing.
So,
if
we're
looking
at
settlement
charges
total
settlement
charges
on
this-
and
you
know
without
going
in
the
math
two
hundred
thousand-
is
going
to
back
taxes.
140,000
is
going
to
I'm
sorry
hundred
ninety
thousands
going
to
the
first,
the
first
bank
and
trust
in
a
sense.
You
know
I
just
don't
know
if
there's
much
way
over
at
closing
I'd
rather
pursue
other
action
enforcement
actions
against
their
see.
H
A
D
A
L
Really
briefly,
in
honor
of
Arbor
Day,
which
is
the
last
Friday
in
April,
everyone
is
invited
to
the
ecology
center
on
Sunday
afternoon
may,
first
from
one
to
four
for
a
big
workshop
and
celebration
of
May
Day,
where
everybody
can
learn
how
to
make
their
gardens
be
able
to
be
certified
by
the
National
Wildlife
Federation
and
advance
our
initiative
to
become
certified
a
community.
That's
certified
by
the
Wildlife
Federation
Thank.
